The lack of progress on tackling terrorism is evident from the fact that in 2014, the conviction rate in the three Anti-Terrorism Court's (ATCs) of the twin cities of Rawalpindi and Islamabad remained low, reports Dawn. In the two ATCs of Rawalpindi, 205 cases were heard but there were convictions in less than ten. However, even this was a success compared to the Islamabad ATC which did not convict a single accused. There is no one reason to explain why terrorists are rarely convicted by the courts. Be it the flawed investigation, the lack of evidence or the fear of the terrorists, all these reasons lead to those accused of terrorism being freed by the courts. Since 2007, over 2,000 alleged terrorists, who have been accused of having been involved in high profile terrorism cases, have been freed by the ATCs of the country. And if the Security Agencies are to be believed, a large number of them have rejoined terrorist outfits. The ATC Rawalpindi acquitted Lashkar-e-Jhangvi (LeJ) chief Malik Ishaq from three cases of terrorism for want of evidence. Ishaq was facing three charges under separate FIRs registered under sections 9 and 11 of the ATA (which deal with whipping up sectarian hatred) and section 16 of the Maintenance of Public Order (MPO).

Meanwhile, at least six convicts whose black warrants have been issued after the rejection of their mercy petitions by the President will be executed any time, reported Dawn. The six prisoners on death row in terrorism cases are militants belonging to Lashkar-e-Jhangvi (LeJ), Ataullah alias Qasim and Mohammad Azam alias Shareef; Bahram Khan, Shafqat Hussain, Jalal Morejo and Abdul Razzaq Chauhan who had been convicted of assault and murder, according to Inspector General (IG) for prisons Nusrat Mangan. In all, the IG prisons said, there were 457 inmates on death row across Sindh.

Meanwhile, sources in the Regional Directorate of Prisoners on December 18 revealed that there were six District and three Central jails located in Punjab, while the central jails were located in Multan, Rahimyar Khan and Bahawalpur Districts, reported The News. “At least 94 executions, including 86 murder and eight terrorism cases, are pending in the region. Their execution is pending due to the decision on mercy appeals filed with President Mamnoon Hussain. The convicts involved in terrorism cases belong to the Lashkar-e-Jhangvi (LeJ), Sipah-e-Sahaba Pakistan (SSP) and Sipah-e-Muhammad,” they said. The sources revealed that over a dozen terrorists involved in the terrorism cases would be executed in Multan Central Jail after the completion of the process. “The lifting of ban on death penalty requires at least one-month process to implement the execution. The prisoners on death row having the Presidential stay after rejection of their mercy appeals will be hanged early,” they added. Also, it was reported that the Punjab Government is likely to get at least 80 top terrorists executed in coming days after it sought details about all condemned prisoners who had been awarded death penalty by various courts in the past, reports Dawn. At present, there are over 530 condemned prisoners in all Punjab jails that include around 80 terrorists of banned militant organizations/groups who were awarded death sentence under murder and terrorism charges by Anti-Terrorism Courts, it is learnt. “These terrorists (about 80) fall under extremely high-profile category in the list of 530 culprits awarded death penalty. Their execution was halted after all of them filed mercy petitions before the president, who under the law is empowered to cancel such punishment,” an official said on the condition of anonymity. He said that since the Government looked to be serious to execute at least the top terrorists in the phase-1, the Home Department had sought urgent details from the quarters concerned in this regard in view of the Government’s decision.

An Anti-Terrorism Court (ATC) on December 19 issued black warrants for two Lashkar-e-Jhangvi (LeJ) militants, identified as Attaullah alias Qasim and Mohammad Azam alias Sharif, who had been given death sentence by an ATC in July 2004 for killing Dr Ali Raza Peerani on sectarian grounds in June 2001 in the Soldier Bazaar area of Jamshed Town in Karachi, provincial capital of Sindh, reports Dawn. The court directed the jail authorities at the Sukkur central prison to carry out the hanging of Attaullah and Azam on December 23, 2014, at 6:30 in the morning till death. The jail authorities in Karachi requested another ATC-III to issue fresh black warrants for two condemned prisoners, Behram Khan and Shafqat Hussain, in separate cases. The court had issued black warrants for both the convicts but their hanging was deferred by the Presidency. Behram was sentenced to death for murder, while Sub-Inspector (SI) Pir Bux was awarded life imprisonment for abetting the killing in 2003. Behram along with SI Pir Bux killed lawyer Ashraf inside the courtroom of the courtroom of Justice Zawar Hussain Jaffery in the Sindh High Court in a case of mistaken identity, while Shafqat was found guilty of kidnapping-for-ransom case in which he killed a boy named Umair (7) in New Karachi Town area in 2004.

It was reported on December 21 that there are 382 prisoners in five Divisions of Sindh who were awarded capital punishment for their involvement in different heinous crimes, reports The News. As many as 115 prisoners are in Karachi Central Jail, 178 in Hyderabad prison, 73 in Sukkur prison, and 19 in Larkana Central Prison. The appeals of mercy of six prisoners have already been rejected. After rejections of their appeals for mercy, Muhammad Azam, Attaullah and other two local prisoners Jalal and Abdul Razaq would be hanged. Seven prisoners in Sukkur jail belong to Lashkar-e-Jhangvi (LeJ), Sipah-e-Sahaba Pakistan (SSP). In view of threats, the authorities have beefed up security of prisons with the deployment of additional contingents of Police and Rangers.

A three-member review board of the Lahore High Court (LHC) dismissed the Provincial Government’s application on December 22 seeking an extension of Lashkar-e-Jhangvi (LeJ) leader Malik Ishaq’s detention, reports The Express Tribune. Ishaq has been detained for the past six months. The Home Department detained him on July 4, 2014 under the Maintenance of Public Order (MPO) law for inciting violence through hate speech. After 90 days the Provincial Government produced Ishaq before the LHC’s review board and asked for an extension of 90 days. As the extension is about to expire, the Government once again produced him before the review board requesting an extension. The request was denied as the Government failed to provide reasonable justification for the extension of detention.

A Special Court on December 24 remanded Lashkar-e-Jhangvi (LeJ) leader Malik Ishaq in judicial custody for two weeks in a murder and terrorism case lodged with Airport Police Station in Rahim Yar Khan District on the complaint of one Husain Abbas on October 14, 2014 over the sectarian killing of his son Allah Ditta, reports Dawn. Ishaq was produced before Special Magistrate Ghulam Mujtaba Baloch in a murder and terrorism case. The case was lodged under Pakistan Protection Act 2014. The court had rejected physical remand, observing that physical remand of a suspect who was booked on charges of abetment, could not be granted. The court has granted 14-day judicial remand of the suspect and fixed January 7, 2015 the next date of hearing.

Five Lashkar-e-Jhangvi (LeJ) militants were arrested from Ittehad Town in Baldia Town in a raid conducted by Crime Investigation Department's (CID) Anti-Terrorism Cell on December 29, reported Dawn. The CID also recovered weapons, including five hand grenades from their possession. Sources revealed that the arrested militants had received jihad training in Waziristan area of Federally Administered Tribal Areas (FATA).
