Mrs. Samantha said despite not being a signatory to the 1951 Convention Relating to the Status of Refugees, Sri Lanka has been accommodating refugees and asylum seekers in the country and the country is burdened with the influx of refugees.

The Chairman of the Presidential Commission to Investigate into Complaints Regarding Missing Persons (PCICMP) Maxwell Paranagama on October 2 said that the commission is expected to get statements from military personnel on disappeared persons in the coming days, reports Colombo Page. Since the Establishment of the Commission on August 15, 2013, the Commission up to date has received in excess of 19,471 complaints inclusive of approximately 5000 complaints from relatives of missing security forces personnel.

The trial against Sri Lankan-born Galleon hedge fund founder Raj Rajaratnam for allegedly funding Sri Lanka's Tamil Tiger terrorist group Liberation Tigers of Tamil Eelam (LTTE) is expected to begin as early as 2015, reports Colombo Page on October 4. In a seven-count complaint filed in the United States (US) District Court for the District of New Jersey by the law firm Motley Rice LLC, family members of those killed and survivors of bombings committed by the LTTE alleged that Rajaratnam and the family foundation headed by his father provided millions of dollars in funds used for terrorist attacks. However, the case has since been kept on hold because of several factors. Raj Rajaratnam is currently serving an 11-year prison term after convicted by the Federal Court in New York in October 2011 for insider-trading.

The Government has allocated SLR 300 million for 2014 alone to pay compensation to civilians of the North who were impacted by the war, reports Colombo Page on October 6. The compensation is being granted to civilians who had lost their limbs and hands and also house and property due to the war. Out of the total amount allocated, SLR 110 million has already been paid and another SLR 130 million will be paid to 1,500 affected families in the North on October 12 by the President Mahinda Rajapaksa at a function to be held at Iranamadu in Kilinochchi District. The Government has also taken measures to repair 100 places of worship that had been damaged by the war. The programme is carried out by the District Secretaries and Divisional Secretaries under the supervision of Minister Chandrasiri Gajadeera.

He said “More than a decade since the last Committee review of Sri Lanka’s record in 2003, it’s disturbing to see how many rights issues raised then still persist in the country and how the Government has ignored promises to address them. The United Nations (UN) Human Rights Committee on October 7 opened its 112th session at Palais Wilson, Geneva during which it will review the reports of Sri Lanka's human right record, reports Colombo Page. The Committee of 18 international independent experts will review Sri Lanka's human right record on October 7 and October 8. The last such assessment of Sri Lanka was conducted in 2003. During the session, the Committee will also hear, in closed meetings, from UN organizations, specialized agencies, non-governmental organizations and national human rights institutions on the situation in Sri Lanka.

The Sri Lankan Government has taken measures to establish a special Bureau for Reconciliation to facilitate the implementation of Recommendations of the Lessons Learnt and Reconciliation Commission (LLRC), reports Colombo Page on October 10. A Committee headed by the Secretary to the President Lalith Weeratunga is engaged in monitoring the implementation of 144 recommendations of the LLRC contained in the National Plan of Action. Out of the 144 LLRC recommendations, 45 are deemed to be completed, 89 are ongoing and 10 are in the early stage of implementation. The Special Bureau for Reconciliation will function under the Secretary to the President to carry out tasks entrusted to it for the purpose of facilitating the Committee's work in monitoring the implementation of the LLRC recommendations. The proposal put forward by the President to establish the Special Bureau for Reconciliation, was approved by the Cabinet.

The Chairman of the PCICMP Maxwell Paranagama and PCICMP Secretary H.W. Gunadasa met the Chairman of HRCSL, Retired Supreme Court Justice Priyantha Perera at the HRC office in Colombo on October 9. Chairmen of the HRCSL and PCICMP agreed to share the information they have in their possession from relatives of missing persons and work together in an effort to find a solution to the complaints regarding missing persons.

The ICRC in January this year has presented proposal to the Government to conduct a Family Needs Assessment for the families of missing persons and Sri Lankan authorities have accepted it. Police Media Spokesman Senior Superintendent of Police (SSP) Ajith Rohana said that Ten ex- Liberation Tigers of Tamil Eelam (LTTE) cadres who underwent rehabilitation in Boossa and a one month basic training course in heavy vehicle operation including back hoe loaders and excavators successfully completed the course at the Vocational Training Centre in Galle, Southern Province on October 13, reports Daily News. The Government spent LKR 52,000 for each participant for the residential heavy vehicle operation training course. Arrangements will be made to find employment for them here or abroad. President of the UK based outfit, GTF, Rev. Dr. S.J. Emmanuel in a letter addressed to Secretary of State for Foreign and Commonwealth Affairs, Philip Hammond, MP alleged that UNSCR 1373 was being used by Sri Lanka to intimidate Tamil speaking people living both in and outside the country. The targeted persons included UK citizens as well as those residing in UK. Alleging that Sri Lanka was a rogue state, the GTF leader warned that other Governments, too, could abuse the UNSCR 1373 unless remedial action was taken. The European Court of Justice (ECJ) on procedural grounds on October 16 annulled the European Council measures maintaining the Liberation Tigers of Tamil Eelam (LTTE) on the European list of terrorist organizations but allowed measures to keep their assets frozen, reports Colombo Page. The effects of the annulled measures will be maintained temporarily in order to ensure the effectiveness of any possible future freezing of funds, the Court ruled. The European Court said a decision by the European Council to place the LTTE on a list of terrorist organizations had been based on "factual imputations derived from the press and the internet" and not on acts examined and confirmed in decisions of competent authorities as required by law. The Court stressed that those annulments, on fundamental procedural grounds, do not imply any substantive assessment of the question of the classification of the LTTE as a terrorist group. The European Union (EU) proscribed the LTTE as a terrorist organization in May 2006, and has remained on its list of terrorist entities ever since. Apart from the EU, the LTTE is proscribed as a terrorist organization in the United States (US), India, Canada, the United Kingdom (UK) and Sri Lanka. Meanwhile, The Government of Sri Lanka expressed concern over the decision of the ECJ to annul the EU regulations proscribing the LTTE. The Ministry of External Affairs said that the ECJ judgment requires in-depth study by all the defendant parties. The Ministry statement said the island was confident that the European Commission and the EU member states would take the “best possible decision” on the future course of action to be taken in this regard.

Meanwhile, the General Court of the EU said on October 21 that the decision to lift sanctions on the LTTE was a legal ruling of a court and not a political decision taken by the EU Governments, reports Colombo Page. The Court in a statement said that the legal ruling is clearly based on procedural grounds and it does not imply any assessment by the Court of the substantive issues of designating the LTTE or of freezing LTTE funds. It also said that the EU institutions are studying the Ruling carefully in detail and they will reflect on the options open to them and, in due course, decide on appropriate remedial action to take.
