In a landmark ruling, the Supreme Court of the Maldives on February 01, has ordered an immediate release of Maldives’ former President Mohamed Nasheed and former Vice-President Ahmed Adeeb, reports Maldives Independent. After the court hearing, hundreds of people gathered onto the streets of the capital city Male with cheering, waving flags and saying, “The Government is over Allah Akbar”. Referring to the current President Abdullah Yameen, Mohamed Nasheed told Rajje TV that he believe that wisest decision for Abdullah Yameen could take, is to resign from the post of President. I will go to Male but not tonight, added Mohamed Nasheed. The prisoners are free to go until fair trials could be conducted without any undue influences, read a statement released by the Supreme Court of the Maldives.

India’s Ministry of External Affairs (MEA) has issued a travel advisory for Indian citizens to avoid travel to the capital city of Male and other islands of the Maldives, until further notice, reports Avas Online on February 5. The advisory also suggests the Indian expatriates in Maldives to take precautionary measures to ensure their safety and avoid attending public gatherings. The Indian Government expressed its grave concern over the intensity of the political upheaval and the failing political situation in the Maldives, read the statement issued by the MEA.

Amending and restricting the access to the Constitutional Rights, the Maldives’ President’s Office has amended the decision of a state of emergency, reports Rajje on February 6. The rights on arrests or detentions which is applicable under the Article 48 of the Maldives’ Constitution would be suppressed during the emergency in the State, said an unnamed Spokesperson of the President’s Office. The Maldivian Government did announced the state of emergency on the night of February 5, which is only applied through the declaration in the Government Gazette and Parliamentary approval, and neither of which had been followed. Despite suppression of the Supreme Court’s authority to be the final source of interpreting the Constitution, the Court is still charged with determining the validity of the declaration of state of emergency.

The Maldives President Abdulla Yameen Abdul Gayoom had sent a letter to the Maldives’ Supreme Court 9SC) expressing a serious concern about the rights of the State’s employees that would have been violated with its decision of February 1, 2018 to release the Political prisoners including the former Maldivian President Mohamed Nasheed, reports Maldives Times on February 6. In the letter the President has urged the Supreme Court judges not to overstep the rights of the other institutions and employees of the State, said the Minister of Legal Affairs at the President’s Office Uza. The Indian Navy (IN) warships are on the patrol over the western seaboard and some of the Indian Defence Personnel are in Maldives due to Defence cooperation between two nations, said an unnamed official. In the times of crisis, India has always willing to provide support to the Maldives.

In a post on his twitter account, former Maldivian President Mohamed Nasheed defended his decision to urge India for Military-supported envoy to restore the political stability in the Maldives because ‘handling the crisis internally’ could lead to chaos, reports Raajje. Mohamed Nasheed—an opposition leader, humbly ‘requested’ Indian and the United States (US) Governments that political figures are released and Government finances are in crisis. India must send envoy supported by its Military, to release Judges and Political detainees and US must halt all financial transactions to current Maldivian regime leaders, read a tweet post by Mohamed Nasheed on his twitter account.

From its list of ‘friendly nations’, the Maldives has excluded India and rejected envoys tasked with briefing and updates on the ongoing crisis in the country, reports Maldives Times on February 9. The President Abdulla Yameen Abdul Gayoom’s office had announced that their envoys would travel to China, Pakistan and Saudi Arabia but not India. The announcement was made after few hours of update in which Chinese Foreign Ministry warned Indian Government against Military intervention in the matter of the Maldives and appealed to the International Community to participate in ‘constructive role’ of respecting the Maldives’ sovereignty. Former Maldivian President Mohamed Nasheed had seek India’s Military support to resolve the political crisis in the country. Though, India has not responded to the request so far but issued an official statement of expressing grave concern over the Maldivian Government’s reluctance to abide by the decision of the Supreme Court of Maldives.

India has noted China’s reaction in which the latter has said about the Maldivian Government’s ability to protect the security of Chinese personnel and institutions based in the Maldives, read a statement issued by India’s Ministry of External Affairs (MEA). Aalif Rauf—an alleged kidnapper of a Maldivian journalist and one of three people charged with terrorism had been awarded an expensive flat worth MVR 2 million (USD 128, 205) under the Maldivian Government’s Housing Scheme, reports Maldives Independent on February 11. A list of applicants approved by Maldives’ Housing Minister Dr. Mohamed Muizzu, was leaked on February 5, enlisted Rauf under the allotment of a flat in Male Grand flat in Old Arabiyya compound in the city. “What must happen now is an independent inquiry that people can trust in. And if there were any wrongs had been done, it must be reversed, and action must be taken against those who did it. The problem is that there is no independent institution in Maldives that people can trust,” said former Housing Minister Mohamed Aslam.

We would submit an appeal to start the Parliament sessions and meet the Deputy Secretary General in this matter. Often the Military forces us out of the Majlis but today they had locked and chained the gates. When we went in they carried us and threw us out over the gate. I went in three times and was thrown out three times, said Opposition MP Ahmed Mahloof. The way in which the SoE was approved by the Majlis (Parliament of Maldives) was a contravention of the Constitution of Maldives and it is a matter of concern, read the statement. The MEA’s interpretation is incorrect as the Maldivian President Abdulla Yameen declared the SoE and the Majlis extended it. The Foreign Affairs Council (FAC) of the EU on February 26 adopted a series of conclusions on the Maldives situation, in light of the recent deterioration of the situation in the island nation. As expected, the FAC adopted a seven point conclusion which included a call to Maldivian Government to immediately end the SoE and restoration of all Constitution Rights. They [Maldives] did not provide any reasons but I think it is due to the current situation there, said Indian Navy Chief Admiral Sunil Lanba. ‘Milan’— which was first held in 1995, will be held from 6th-13th March 2018 and 16 nations had confirmed to be participating in this Military exercise. A total of 23 countries have been invited to the multilateral exercise. Milan is specifically aimed at exercises for littoral nations held by the Indian Navy’s Andaman and Nicobar Command, which manages India’s engagement with regional Navies.

The establishment of the Observatory in Makunudhoo island—a Western-most in the North (near to India) would allow the China to monitor a key Indian Ocean shipping route via which many merchants and other ships passes, said an unnamed political member in the Maldives. An official agreement titled as the ‘Protocol on Establishment of Joint Ocean Observation Station’ between China and the Maldives was finalised in 2017 when the two countries also had signed a Free Trade Agreement (FTA), said an unnamed Indian official. However, the Chinese Government through the Global Times newspaper has denied the claims of China’s marine cooperation with the Maldives carried no Military intentions and the ‘Indian media were stretching the reports that stems out of jealousy of Chinese cooperation with other South Asian countries.
