February 4, 2003 has been fixed as the date for commencement of trial, reports added. The court framed charges against LeT terrorists and Pakistani national Ashfaq, his wife Rahmana Yusuf Farooqi, Babar Mohsin Bhagwala, Devender Singh, Shahnshah Alam, Rajiv Kumar Malhotra, Moolchand Sharma, Matlub Alam, Farooq Ahmed Qasid and Nazir Ahmed Qasid for attacking the Red Fort. On December 22, 2000, a Lashkar-e-Toiba (LeT) suicide squad attacked the Red Fort in New Delhi, killing two Army personnel and a civilian.

Media reports said a Delhi court on January 8 postponed to January 17 the hearing on the bail application of Iftikhar Geelani, pending completion of proceedings in the lower court. The court said, since the government has rejected the opinion of the Military Intelligence on the sensitivity of documents seized from Iftikar, the hearing was adjourned to await the outcome of the lower court. The lower court has summoned Director-General Military Intelligence (DGMI) Lt. Gen O. S. Lochab and Joint Commissioner of Police Neeraj Kumar. On December 23, 2002, Lochab appeared before the Chief Metropolitan Magistrate and said documents recovered from Iftikar did not contain any classified information. Iftikar Geelani, a journalist and son-in-law of All Parties Hurriyat Conference (APHC) leader S A S Geelaniu, was arrested on June 9, 2002 under the Official Secrets Act for allegedly possessing documents compromising national security.

Top National Socialist Council of Nagaland Isack-Muivah (NSCN-IM) leaders Th.Muivah and Isack Swu met with Prime Minister Atal Behari Vajpeyee at his official residence on January 9, in New Delhi. The outfit’s spokesman reportedly said, prior to the high profile meeting, that the outfit has not given up its demand for self-determination and that its decision to hold unconditional talks was in an "accommodative spirit". He said it did not mean the NSCN-IM has agreed for talks within the framework of the Indian Constitution. However, Muivah Swu reiterated their sincerity in ‘solving the problem realistically’. After a 40 minute meeting the Prime Minister, Swu said the talks were held in a cordial atmosphere and India and Nagas have ‘come closer to understanding’. He further added that the Prime Minister has been trying to solve the problem according to Naga history. Expressing optimism over the maturity level of the political leadership, Muivah said the Prime Minister was ‘quite understanding and added that the Union government knows and very well understands the reality of the Nagas. However, Swu, replying to a question said ‘there is no greater or smaller Nagaland’. The NSCN (I-M) leaders are scheduled to meet with Deputy Prime Minister L K Advani today, January 10.

According to media reports, the Union government would like to start negotiations with the proscribed A’chik National Volunteers’ Council (ANVC) terrorist outfit of Meghalaya, after the ongoing Naga peace talks in Delhi. Quoting official sources, though a date is yet to be fixed, talks could most likely take place in early February. Reportedly, the government and the ANVC agreed to meet in New Delhi and to work out a settlement. Unnamed sources in Garo Hills claimed the outfit has already held two meetings with the Union government’s representatives where it has agreed to meet Union government leaders without any preconditions. However, the only condition reportedly set by the ANVC was security cover to its leaders— chairman Dilash Marak and general secretary Jerome Momin, in hiding in Bangladesh.

Muivah and Isack Swu met with Deputy Prime Minister L K Advani and reiterate that their goal of a single administrative unit comprising all Naga-dominated areas remained intact. According to media reports, after a 50-minute long meeting, general secretary Th. Muivah said Nagaland was the place of their natural habitation and they (the Nagas) were asking nothing more or nothing less. Both the leaders reportedly said the outfit neither would participate nor interfere in the forthcoming Legislative Assembly elections in Nagaland.

According to media reports, a Delhi Court, on January 13, released Syed Iftikar Geelani, seven months after he was arrested for alleged violation of the Official Secrets Act. He was released as the government withdrew charges against him. Iftikar Geelani’s counsel said a case for compensation and probe into the ‘‘conspiracy’’ to level allegations against him would be filed soon. Iftikar Geelani said he was victimised by certain people in the Intelligence Bureau (IB) and some bureaucrats, but did not mane them. Media reports said the Supreme Court, on January 13, admitted a batch of petitions challenging the Prevention of Terrorism Act (POTA). Among the petitions filed was one by Marumalarchi Dravida Munnettra Kazhagam (MDMK) leader Vaiko, detained under POTA in Tamil Nadu since July 11, 2002, for allegedly making statements in support of the proscribed Liberation of Tamil Tigers Elam (LTTE). While admitting the petitions and fixing the matter for final disposal in March, the Bench said it was an important issue and needed to be heard in detail. Besides Vaiko, the People's Union for Civil Liberties (PUCL) and All India Human Rights and Justice Front (AIHRJF) have challenged POTA on the grounds that its provisions were draconian and violated fundamental rights guaranteed in the Constitution.

Both the convicts, in their appeal to the Delhi High Court, on January 14, sought discharge in the case claiming that there was no evidence against them, reports said. According to media reports, the Delhi High Court (HC), on January 30, admitted an appeal from the Jaish-e-Mohammed (JeM) terrorist, Mohammed Afzal, who was sentenced to death in the December 2001-Parliament attack case. The reports also said that the HC has allowed Afzal to argue his defence against the award. In its order the HC also directed the Tihar jail authorities to produce Afzal before it on February 3, when the reference for confirming the death sentences imposed on three convicts would be heard. The appeal of other convicts in the case–– another JeM terrorist Shaukat Hussain Guru, his wife Navjot Sandhu alias Afsan Guru and S A R Geelani have already been admitted by the Court on January 15, 16 and 22 respectively. While the first and the last were awarded death sentence Navjot Sandhu was awarded five-year rigorous imprisonment.
