Leader of the House Lakshman Kiriella in reply to a question raised by Member of Parliament (MP) Wimal Weerawansa on devolution of power in Parliament on February 9 said that the Government intends to hold a public referendumon new Constitution with the consent of all political parties, reports Colombo Page. He further said that no clauses have been defined yet in the proposed new Constitution and discussions are being held to formulate a legal framework. He said the Government will not go for federalism regarding the devolution of power. He noted that some political parties have not presented their suggestions on the new Constitution and assured that all suggestions put forward by the relevant stakeholders will be presented to the Parliament. He said "My consistent policy is that judicial activities must be done in a fair & transparent manner." The President pointed out that he is, under no circumstances, ready to use the remaining executive powers remain with him in an arbitrary manner, as a person who worked very openly as well as a President who gave his executive powers to the Parliament and other independent institutions through the 19th Amendment to the Constitution. "People in this country expected the end of the war to bring peace, the winner would bring the peace, but it didn't happen. A Sri Lankan identity couldn't be created. Separately, Tamil National Alliance (TNA) in Parliament on February 23 extended its fullest support to the Government in the process of formulating a new constitution while expressing party's dissatisfaction in the Government's lack of progress in resolving the Tamil people's issues, reports Colombo Page. Leader of the Opposition R. Sampanthan, moving an adjournment debate motion in Parliament said "While we on our part will extend the maximum cooperation to the satisfactory conclusion of these processes and to the non - recurrence of violence, it is absolutely essential that these processes be taken forward in a genuine and purposeful manner to ensure permanent peace with justice and equality to all citizens. Foreign Minister Mangala Samaraweera speaking at a press briefing in Colombo on March 16 said he Government could not bring in foreign judicial officers under the existing constitution, reports Daily Mirror. Samaraweera neither confirmed nor denied the inclusion of foreign judicial officers in the judicial process of the country. However, he pointed out that the inclusion of such officers were in fact just a recommendation made by the international community when drafting the resolution. “As a sovereign nation we are entitled to look at all options. We cannot bring in foreign judicial officers under the existing constitution, but we are exploring all our options,” the Minister said.

The Opposition Leader called for the full and expeditious implementation of the Geneva Resolution. “This is not a resolution against Sri Lanka, but a resolution pertaining to certain acts committed by the two parties of the conflict violating humanitarian and human rights laws. The culture of impunity should not continue. Former President Mahinda Rajapaksa himself had gone to Geneva in the 1990s to seek its intervention when there were grave human rights violations in the South. What happened in 1988-89 and 2008-09 are crimes against humanity. This should not be confused with legitimate actions taken by the State against armed combatants carrying on an armed struggle against the State. Can the killing of Lasantha Wickrematunga,the disappearance of Prageeth Ekneligoda, five students in Trincomalee, 17 workers in Muttur be swept under the carpet because those who committed them are members of so called ‘war heroes’? Prime Minister Ranil Wickremesinghe, presenting the Bill to the House, said it was being presented in line with an agreement the Government had with the opposition to present it in Parliament prior to the establishment of the OMP. “This institution is paramount in order to put an end to the issue pertaining to the disappearance of persons as soon as possible,” he said. In response to a question raised by Joint Opposition Parliamentary Group Leader Dinesh Gunawardene as to whether the members of the OMP had already been appointed, the PM said they would be appointed only after the Amendment is passed. The National Action Plan for the Protection and Promotion of Human Rights 2017-2021 documents goal-oriented activities in Human Rights arena, aimed to strengthen the national processes and mechanisms for the protection and promotion of human rights through substantial constitutional, legislative, policy and administrative frameworks. The President made these remarks while addressing the Annual Conference for Judicial Officers started at Galadari Hotel in Colombo. Speaking at the occasion, the President said he believes that background required for judges to make their decisions independently and issue verdicts without any political influence has been set up. He has also explained that there are enough intellectuals with good knowledge in the field to carry out legal tasks without consulting foreign judges. As a result of that, the problem has been removed, he said.
