The central government should decide within eight weeks on the extradition and repatriation of a woman from Kerala who is detained in Afghanistan with her child on charges of joining the Islamic State (IS) terror outfit, the Supreme Court ruled on January 3, reports Hindustan Times. The court was hearing a petition filed by VJ Sebastian Francis, a resident of Ernakulam District in Kerala, who requested repatriation of his daughter Sonia, alias Ayisha, and granddaughter. The two are at Pul-e-Charkhi prison in Kabul since 2019, before the Taliban takeover in Afghanistan.

Dhaka Special Tribunal on January 4 rejected bail of former Joint Secretary General of Hefazat-e Islam (HeI) Mamunul Huq who is a charge sheeted accused in subversive case, reports Daily Observer. Judge Fatima Imrose Khonika of Special Tribunal of Dhaka passed the order responding to a plea. At the same time, she set March 13 for recording the depositions of the witnesses in the case. On January 14, 2015, Bangladesh Nationalist Party (BNP) and Jamat-e-Islami (JeI) leaders and workers vandalised vehicles and set those on fire at Madhya Pirerbagh of Sheorapa under Mirpur Model Police Station in Dhaka city. Later, ASI Khondker Rajib Ahmed of Mirpur Model Police Station filed the case under the Special Powers Act. Mamunul Huq was a charge sheeted accused in the case. On December 4, he was produced before the tribunal for showing him arrested. After the hearing the tribunal granted the petition. Afterward, Mamunul Huque's lawyer Syed Zainul Abedin Mesbah submitted a prayer to the tribunal seeking his client's bail. After the hearing, the tribunal rejected the bail prayer.

Pabna District Special Court on January 4 sentenced to life imprisonment four cadres of outlawed Purbo Banglar Communist Party (PBCP) for killing a man in Santhia upazila (sub-District) of Pabna District in 2006, reports The Daily Star. The convicts are Wasim Munshi (39), Mohammd Mostafa (42), Mirazul Islam (43) and Shahadat Hossain (30). Of them, Shahdat and Wasim were present before the court while the other two accused were tried in absentia. District Special Judge Mohammad Ahsan Tarek also fined the convicts Tk 25,000 each. According to the case statement, Rafikul Islam of village Gobindapur village went to visit his in-laws' house at Sagarkandi village on October, 19, 2006. The same day, PBCP cadres abducted Rafikul from the house and later killed him.

An Anti-Terrorism Court (ATC) in Lahore on January 7 acquitted 17 workers of Tehreek-e-Labbaik Pakistan (TLP), reports Samaa TV. A case against them was registered at Shahdarah Police Station of Lahore for disrupting the Government’s work and giving death threats. Police in its report had declared them not guilty. The court decided to acquit the accused in light of the Police report. In October, thousands of TLP workers were arrested and FIRs, under sections of inciting violence and terrorism, were registered at multiple Police stations in Lahore after they clashed with the Punjab Police during their march on Islamabad.

Colombo District Court on January 7 rejected a request made by former President Maithripala Sirisena that he be released from several civil lawsuits filed by the victims of Easter Sunday attacks, reports Daily Mirror. The relatives of those who have died during the suicide bomb blasts took place in Colombo and individuals who injured had filed 128 lawsuits before Colombo District Court claiming compensations from former President Maithreepala Sirisena and several others. President's Counsel Faizer Mustapha appearing for the former President made a request to release his client from these cases. He further contended that there is no legal basis to proceed with these lawsuits. President's Counsel Shamil Perera appearing for the aggrieved party raised objections for the request and said the application to release the defendant from the cases is contrary to the provisions of Civil Procedure Code. The victims alleged that the defendants including former President Sirisena have failed to perform their official duties entrusted to prevent the terrorist attacks that took place on April 21, 2019 which caused irreparable damages to them.

On January 9, two accused, Abdulla Ali Manik and Mohamed Thasleem, pled not guilty when prosecution read out charges against at a hearing held in Criminal Court, reports Sun.mv. Both are booked for supporting a terrorist organization under Article 16-1 (b) of the Counter-Terrorism Act with reference to Article 16-1 (a) (1). Abdulla Ali Manik has claimed that the terror organization, Islamic State (IS) disbanded two years ago and that he does not support the organization. Both were arrested after the May 6 Improvised Explosive Device (IED) attack on Speaker Mohamed Nasheed.

Dhaka Special Tribunal on January 10 sentenced 10 leaders and activists of Bangladesh Nationalist Party (BNP) to jail for five years in a case filed over cocktail explosion during a hartal in Dhaka city's Bhashantek Police Station area in 2013, reports Observer. The jailed persons are: Sumon Chandra, Jasim, Aminul, Sohel, Kawsar, Jewel, Abdur Rahman, Shaheed, Mohsin and Liton. They were also fined BDT 5,000 each. In default, they will have to suffer three months more in jail. According to the prosecution, the accused exploded cocktails at Bhashantek intersection on November 26, 2013, during hartal-blockade called by BNP-led 18-party alliance. Later, Bhashantek Police Station sub-inspector Zahidul Islam lodged a case under the Explosive Substances Act.

An Anti-Terrorist Court (ATC) of Lahore on January 12 announced nine times death sentence to four accused in the Johar Town Blast case while a female accused has been sentenced to five years imprisonment, reports Geo News. ATC court judge Arshah Hussian Bhutta put forward his verdict of the case in which at least three people were killed, while 21 others sustained injuries on June 23, 2021. Citing security reason, the proceedings of the trial was completed in Kot Lakhpat Jail of Lahore. The accused included Eid Gul, Sajjad Shah, Peter Paul, Ziaullah, and Ayesha. During the case proceedings, almost 56 statements from the witnesses were recorded. However, all the accused refused to accept the allegations levelled against them.

Usthadh Rasheed Hajjul Akbar (61) was arrested in August 2019, following the Easter Sunday bombings in April 2019 which killed over 270 people. A two-judge bench headed Justice Mohammad Iqbal Kalhoro said that the task force must have officers not below the rank of Deputy Superintendent of Police (DSP) in every district of the metropolis for recovery of the missing persons. The bench directed an additional advocate general to meet with the chief secretary (CS) and the inspector general of police for setting up the task force. It directed the Police to use modern technology to trace out missing persons and to approach the National Database and Registration Authority for blocking the computerised national identity cards of such persons.

On January 19, the Criminal Court found two persons, Ismail Haisham and Ahmed Zihan Ismail, guilty of murdering blogger Yamin Rasheed, reports Avas.mv. Yamin was murdered in the stairwell of his home on the night of April 23, 2017. Charges of assaulting a person with a sharp object with intent to kill were raised against six suspects: Ismail Haisham Rasheed, Hussain Ziyad, Ismail Rasheed, Hassan Shifaz, Mohamed Dhifran, and Ahmed Zihan Ismail. The Criminal Court questioned the charges against Ziyad, Ismail, Shifaz, and Dhifran as the State had not submitted any evidence against them and acquitted them. Court sentenced Haisham and Zihan were sentenced to 25 years in jail, and the period they have already spent in detention, four years and eight months and eleven days, was reduced from the sentence. Therefore, they will serve 20 years, three months, and 19 days.

The duo was arrested in connection to the assassination attempt on current Speaker of Parliament Mohamed Nasheed on May 6,2021. During the hearing, the state submitted evidence against the suspects, including secret witnesses, anonymous testimonies as well as other evidence including police intel reports, those who compiled the report, mobile forensic reports and those who compiled it as well as a resolution by the President’s Office, submitted to prove terrorist links to the Islamic State and Al Qaeda. The Appellate Division of the Supreme Court (SC) on February 2 declared penalty of two convicts in wartime crimes invalid due to their death, reports Bangladesh Post. The apex court abated appeals of two war crimes case convicts from Keshabpur in Jessore District against their conviction and sentences by the International Crimes Tribunal-1 (ICT-1), as the two have already died of natural causes in jail custody. The two convicts are Maulana Sakhawat Hossain who was awarded a death sentence for committing crimes against humanity in 1971, and Billal Hossain Biswas, who was awarded life term imprisonment in the case. On August 10, 2016, the ICT-1 awarded death sentence to Sakhawat Hossain and life imprisonment till natural death to Billal Hossain Biswas. However, Billal died in 2018 and Sakhawat died on December 11, 2021, in jail, before the hearing of their appeals.

Sanjeev Kumar Sah, the mayor of Bhangaha Municipality in Mahottari District, had approached the SC demanding that the poll date decision be scrapped. Sah argued that holding elections across the country for 753 local units breaches the constitutional provisions that guarantees five years’ terms for all representatives. Baburam Dahal, spokesperson for the SC, told “The petition was rejected as the Local Election Act clearly says the tenure of the local representatives will be counted based on the first phase of elections. The local representatives will have completed the five years tenure by upcoming elections as per the law. The argument presented by Sah, therefore, is baseless.” In 2017, local elections were held in three phases on May 14, June 28 and September 18.

In the 7,000-page judgment, judge AR Patel said it was a rarest of rare case, according to public prosecutor Amit Patel. A Delhi court on February 25 sent National Investigation Agency (NIA)’s former Superintendent of Police (SP), Arvind Digvijay Negi, Kashmiri human rights activist Khurram Parvez and others to judicial custody for a month in a case related to the terror funding in the Jammu and Kashmir Valley, reports Daily Excelsior. Special Judge Parveen Singh sent the accused persons to jail till March 24 after they were produced before the court on expiry of their custodial interrogation by the NIA. The agency had arrested Negi, a former SP of the NIA, for allegedly leaking secret documents to an Over Ground Worker (OGW) of the banned terror group, Lashkar-e-Toiba (LeT). The case was filed under various sections of the Indian Penal Code (IPC) and the stringent Unlawful Activities Prevention Act (UAPA), including those related to terrorism and terror funding. The NIA had alleged that the accused had been running a network of OGWs of LeT and recruited persons across India. In pursuance to conspiracy, the accused were in contact with their foreign based handlers and upon their directions were engaged in gathering intelligence on vital installations, security forces as well as identification of target locations for launching of terrorist attacks, the NIA said.

In a setback to the National Investigation Agency (NIA), the Chhattisgarh High Court on March 2 dismissed the probe agency’s appeal to quash or transfer the second First Information Report (FIR) registered in connection with the 2013 Maoist attack in Jheeram valley that had killed 29 persons, including several senior Congress leaders, reports The Indian Express. The FIR in question was filed by slain Congress leader Uday Mudliar’s son Jitendra Mudliar in 2020. A division bench of justices RCS Samant and Arvind Chandel passed the order, clearing way for the State Police to carry on with the investigation into the alleged conspiracy behind the attack. The central probe agency had moved the High Court after a special NIA court in Jagdalpur had rejected its plea. Reportedly, on May 25, 2013, Maoists ambushed and killed 29 persons, including senior leaders Nand Kumar Patel, Vidya Charan Shukla and Mahendra Karma, during a poll campaigning tour in Bastar. The Congress had alleged “a bigger political conspiracy” behind the attack, demanding an independent inquiry. A special National Investigation Agency (NIA) court in Dantewada District of Chhattisgarh on March 14 acquitted tribal activist Soni Sori and three others in a case filed against them by the Chhattisgarh Police in 2011 for alleged channelizing of ‘protection money’ to Naxalites [Left Wing Extremists, LWEs], reports The Pioneer. Special Judge (NIA Act) Vinod Kumar Dewangan passed the order on March 14. Besides Sori, the court also acquitted her activist nephew Lingaram Kodopi, construction contractor B.K. Lala and then Essar company official D.V.C.S. Verma, citing that the prosecution has failed to prove the charges against the accused. Therefore, in the absence of corroborative evidence, the accused are acquitted, the court said in a 76-page order. Sori and Kodopi were arrested on charges of acting as Communist Party of India-Maoist (CPI-Maoist) conduits and allegedly receiving "protection money" for the rebels from the Essar company. They were booked under the Indian Penal Code (IPC) sections 124 (A) (sedition), 121 (waging or attempting to wage war against government) and 120-B (criminal conspiracy) and the Unlawful Activities Prevention Act (UAPA) and the Chhattisgarh Special Public Security Act.

The Kerala High Court on March 17 quashed the charges slapped under the Unlawful Activities Prevention Act (UAPA) and under section 124A (sedition) of the Indian Penal Code (IPC) against Communist Party of India-Maoist (CPI-Maoist) leader Roopesh in three cases registered in Kuttiadi and Valayam Police Stations in Kozhikode District of Kerala, reports The New Indian Express. A Division Bench comprising Justice K Vinod Chandran and Justice C Jayachandran issued the order while allowing the petition filed by Roopesh seeking to quash the cases. The authority headed by a retired high court judge had recommended charging the section against the petition based on the letter of the home department on February 7, 2018. The sanction of the State Government in the first two crimes was on June 6, 2018, and in the other crime on April 7, 2018; both delayed. In the UAPA and the Rules framed thereunder, a specific time of seven days is provided. The Authority has to make a recommendation, after which the appropriate Government also has to issue a sanction within another seven days from the receipt of the recommendation, argued the petitioner. "Amidst the raging controversy as to the retention of offence of sedition in the IPC; which the naysayers categorise as a relic of the colonial past; a symbol of British hegemony and the votaries support in the wake of rising anti-national feelings under the cloak of liberal thought, the Government sat over a sanction for six months, violating the time frame prescribed in the rules," observed the Bench. The Bench held that the sanction under the UAPA granted after six months from the date of receipt of the recommendation of the authority is not a valid sanction. "We find the sanction order of the UAPA to be not brought out in time, as statutorily mandated and bereft of any application of mind; both vitiating the cognizance was taken by the Special Court," observed the court.

Chittagong Divisional Court on March 20 sentenced former Nayeb-e-Amir (Deputy Chief) of Hefazat-e-Islam (HeI) Mufti Izaharul Islam to two years in jail in a case filed by the Anti-Corruption Commission (ACC) for not disclosing his wealth statement, reports Dhaka Tribune. He has also been slapped with a fine of BDT 20,000, the default of which will result in an additional jail-term of two months. According to court sources, a notice was issued to Mufti Izahar on July 4, 2013, to submit a statement of his wealth. On September 17, 2013, ACC Deputy Assistant Director Mohammad Sirajul Haque, filed the case with Khulshi Police Station after Izahrul failed to provide the statement. On April 21, 2014, the ACC filed a chargesheet in the case and an arrest order was issued on April 26. The court framed charges against him on May 12, 2014, and he was arrested on August 7, 2015.

The Colombo High Court on March 21 released retired doctor Shirley Herath, who was remanded on suspicion of placing a hand grenade in the All-Saints Church in Borella, on bail, reports Colombo Page. Colombo High Court Judge Manjula Tillekeratne ordered the release after considering a bail application filed on behalf of the retired doctor. Announcing the order, the High Court Judge stated that although the suspect was initially produced before the Magistrate’s Court under the Prevention of Terrorism Act (PTA), the plaintiff has decided not to pursue the charges so far. He further stated that the petitioner’s party has stated that there is a possibility of the High Court considering the bail application as it is pursuing charges against the suspect under the Offensive Weapons Act. Accordingly, the suspect was released on a cash bail of SLR 100,000 and two personal sureties of SLR 2.5 million each and the High Court Judge also ordered that the sureties should be residents of the Colombo District.

Two persons including former Jamaat-e-Islami (JeI) Member of Parliament (MP) Abdul Khaleq Mondol and Khan Roknuzzaman have been given the death sentence on March 24 for crimes against humanity, including murder and rape, committed in Satkhira during the Liberation War in 1971, reports Dhaka Tribune. International Crimes Tribunal-1 (ICT-1), chaired by Justice Mohamad Shahinur Islam, announced the verdict. Khaleq Mondol was in the dock when the verdict was delivered while Roknuzzaman had been tried in absentia. In 1971, Khaleq was the organizer of Razakar forces in Satkhira, and Roknuzzaman was a member of that force. The prosecution had charged the two with a total of six counts of crimes against humanity, all of which had been proved beyond doubt, the tribunal said. The case was filed in 2015 and the tribunal started the trial on March 5, 2018.

An Anti-Terrorism Court (ATC) awarded a combined sentence of 33 years imprisonment to Jamaat-ud-Dawa (JuD) chief Hafiz Muhammad Saeed on April 7 in two cases of terror financing registered by the Counter Terrorism Department (CTD), reports Dawn. ATC Judge Ejaz Ahmad Buttar handed down the guilty verdict in two FIRs from 2019 under various sections of the Anti-Terrorism Act (ATA) of 1997. In one of the cases, the judge awarded five-year imprisonment each under sections 11-H (2), 11-I, 11-J (2), and 18 months jail under section 11-F (2) of the ATA. In the other case, the judge awarded a five-year sentence each under sections 11-N, 11-I, 11-J (2) and an 18-month jail term under section 11-F (6) of the ATA. The judge imposed a collective fine of PKR 340,000 on Hafiz Saeed in both cases. All the sentences will run concurrently.

Priyantha Kumara (49) was lynched by a mob of workers at a factory on December 3, where he was working as a manager, under the charges of blasphemy. As per details, the verdict was announced after hearing of the high-profile lynching case concluded at the Kot Lakhpat prison. Statements of more than 60 suspects were recorded in the lynching case. ATC in its verdict in the Priyantha Kumara case awarded death sentences to six convicts, 14-year-jail to seven others and two years of punishment to the other 76 accused of their alleged role in the case. An FIR (No. 8/22) was registered against 190 activists – 23 of them not named -- belonging to various nationalist groups at the Chachar Police station on the complaint of its Station House Officer (SHO), Sajidullah Kumbhar, under Sections 123-A, 124A, 153-A, 147, 148, 149, 109 and 505 of the Pakistan Penal Code; and 11/B and 6/7 of the Anti-Terrorism Act (ATA). The complainant stated in the FIR that the suspects raised anti-state and anti-army slogans at the programme. Firearms were also displayed at the event, he claimed, adding that slogans for separation of Sindh from the country were also raised. The Police on April 26 produced 87 of the suspects in the Jamshoro Anti-Terrorism Court (ATC), which remanded them in judicial custody for 14 days. The suspects included 25 women. A petition was filed by senior Bharatiya Janata Party (BJP) member of Legislative Assembly (MLA) and leader of opposition Dharamlal Kaushik questioning ‘constitutionality’ of the commission on April 13. Kaushik pointed out that the report of the Jheeram Ghati Inquiry Commission headed by Justice Prashant Kumar Mishra should have been tabled in legislative assembly within six months of its submission but without submitting the report, the state government reconstituted the judicial commission. The division bench of chief justice Arup Kumar Goswami and justice RCS Samant has also issued notices to the state government and the judicial commission and sought a reply. “The court after hearing the petition stayed the enquiry proceedings of the reconstituted judicial commission. Colombo Fort Magistrate Thilina Gamage, on May 18, has remanded four suspects, including Sri Lanka Podujana Peramuna (SLPP) Member of Parliamentarians (MPs) Sanath Nishantha and Milan Jayatilake, who were arrested in connection with the recent attacks on Maina Go Gama near Temple Trees and Gota Go Gama at Galle Face in Colombo, until the 25th of this month, reports Colombo Page. The Magistrate further stated that the bail applications of Sanath and Milan will be rejected under the Bail Act as the investigation into the suspects has not been completed and if they are released on bail there could be a public disturbance. In addition, the Magistrate ordered that former Western Provincial Councilor Amal Silva and an employee of the Dehiwala Mount Lavinia Municipal Council who were arrested in connection with this incident be remanded until the 25th and produced before an identification parade on that day. The chief of banned Jammu and Kashmir Liberation Front (JKLF) Yasin Malik was convicted by a Delhi court on May 19 under the stringent anti-terror law in a case related to funding of terror activities in Jammu and Kashmir (J&K), after he pleaded guilty to all charges framed against him, reports Daily Excelsior. Special Judge Praveen Singh posted the matter for May 25 to announce the quantum of punishment and also directed the National Investigation Agency (NIA) to assess Malik’s financial condition to determine the amount of fine that could be imposed. After the charges were framed in March, Malik on May 10 informed the court that he would not be contesting the charges levelled against him, including section 16 (terrorist act), 17 (raising funds for the terrorist act), 18 (conspiracy to commit terrorist act), and 20 (being a member of terrorist gang or organisation) of the Unlawful Activities (Prevention) Act (UAPA) and sections 120-B (criminal conspiracy) and 124-A (sedition) of the IPC. Malik faces the maximum punishment of a death penalty, while the minimum sentence for the offences committed by him is life imprisonment. The JKLF is a banned terror organisation under the UAPA. The case pertains to the conspiracy by Lashkar-e-Taiba (LeT) chief Hafiz Saeed and separatist leaders, including members of the Hurriyat Conference, who had acted in connivance with active members of banned terrorist organisations Hizbul Mujahideen, Dukhtaran-e-Millat and others to raise, receive and collect funds domestically and from abroad through various illegal channels, including hawala. The funds were for the purpose of separatist and terrorist activities in J&K to cause disruption in the Valley by way of pelting stones on security forces, systematically burning schools, damaging public property, and waging war against India.

On May 30, a special Central Bureau of Investigation (CBI) court in Mumbai of Maharashtra sent four accused involved in the 1993 Mumbai bomb blasts to judicial custody till June 13, reports India Today. The four accused identified as Abu Bakar, Sayed Qureshi Shoe Qureshi, Yusuf Bhatka alias Yusuf Bata were arrested by the Gujarat Anti-Terrorism Squad (ATS) on May 17 and later handed to CBI for further the blast case. All the four accused were involved in the smuggling and transporting RDX and other explosives used in the blasts and AK-56 rifles, bomb triggers and other weapons. On March 12, 1993, 12 coordinated bombs went off in the city, killing 257 and injuring 700 others. The Terrorist and Disruptive Activities (Prevention) Act court has convicted over 100 people in the attacks. Main accused Dawood Ibrahim and Tiger Memon are still at large.

The five accused — Akhlakur Rehman, Mohammad Azeemushan, Mohammed Osama, Mohammad Meraj, all four who are residents of Haridwar, and Mohsin Ibrahim Sayyed of Mumbai (Maharashtra) under sections of the IPC, the UA(P)A and the Explosive Substances Act. Musa, a resident of Labhpur in West Bengal’s Birbhum District, was arrested on July 4, 2016, from the Burdwan railway station by West Bengal Police’s CID wing for suspectedly radicalising youth to join the IS. NIA had filed a chargesheet against Musa on December 23, 2016, in the Bankshall court, accusing him of planning to attack foreigners frequently visiting the Mother House, the headquarters of the Missionaries of Charity, in Kolkata’s Mullick Bazar area. A three-judge bench of the Colombo High Court trial-at-bar, on June 20, ordered that a pre-trial hearing be held on August 4 against 25 suspects, including Naufer Moulavi, on charges including conspiracy to commit, aiding and abetting the suicide bombing on Easter Sunday, reports Colombo Page. The case was taken up before a three-judge bench comprising Damith Thotawatte, Amal Ranaraja and Navaratne Marasinghe, and the suspects including Naufer who were remanded at that time were also produced before the court. The bench directed that a preliminary hearing be held on August 4. The three-judge bench also directed the lawyers of the accused to file their bail applications two weeks before the next hearing. Subahani Haja Moideen, a Tamil Nadu based Islamic State (IS) operative who was arrested by the National Investigation Agency (NIA) in October 2016, trained with Mohammad Ghani Usman, a former bomb-maker of Lashkar-e-Toiba (LeT) who later joined IS and had become his best friend during five months of training in Iraq in 2015. Moideen, 37, convicted by an Ernakulam court in September 2020 for joining IS told investigators that he met Paris bombers including Abdelhamid Abaaoud (killed during the bombing) and Salah Abdeslam on his way to Iraq. To gather more details, a team of French investigators came to Kochi (Kerala) in December 2018 to interrogate Moideen about the training and his links with the Paris attack squad of the IS. In return, a NIA team had travelled to Paris in to question Usman, who, in the past, was close to LeT leadership; Indian agencies wanted to get further information from him on 26/11 Mumbai attacks.

On July 30, a special National Investigation Agency (NIA) court in Lucknow (Uttar Pradesh) has convicted five members of banned Students' Islamic Movement of India (SIMI) and sentenced them to a period ranging from three to over seven years of rigorous imprisonment in the 2014 Bijnor blast case, reports news18.com. In its judgment the court sentenced Husna, Abdulla, Raees Ahmad, Nadeem, and Furkan from three years to a maximum of seven years 10 months for various offences including stringent anti-terror law Unlawful Activities (Prevention) Act-UAPA in which they were booked. All five had confessed to their crimes on June 30 after which they were sentenced by the court. “The case relates to an explosion that had taken place in the house of Leelo Devi at Jatan Mohalla, Bijnor on September 12, 2014, and the criminal conspiracy hatched by members of banned organization SIMI to commit terrorist acts," an NIA spokesperson said in a statement on July 2.

A National Investigation Agency (NIA) court in Kochi (Kerala) on July 12, found three people, U K Hamsa, K V Abdul Razaq and M Midilaj, guilty of recruiting youth into the Islamic State (IS) with the intention of widening the terror outfit’s activities and wage war against the country, reports Hindustan Times. The quantum of sentence against the trio all from Kannur District of Kerala will be announced on July 15. The three were arrested by Police in Turkey while they were planning to cross over into Syria in 2016. They were extradited to India in November, 2016. According to the prosecution, Hamsa (60), acted as an ideologue and was involved in spreading IS ideology. NIA court judge Anil Bhaskar found the trio guilty under sections 38 and 39 of the Unlawful Activities Prevention Act (UAPA) (waging war against the country and supporting a terror outfit to weaken the country) and section 120 B (criminal conspiracy) of the Indian Penal Code (ipc). According to senior officials familiar with the probe, agencies had found that Hamsa, a professional cook popularly known as Biryani Hamsa, propagated IS ideology in north Kerala and helped radicalise at least 20 youth, whereabouts of some of whom are still unknown.

The convicted militant, Azizullah, had kidnapped 16 labourers who were working on a Jazz tower in Kurram District in June 2021. Later, 10 kidnapped men managed their release and escaped from captivity while the other six remained in the clutches of the TTP militants. In July 2021, the militants killed one labourer named Gulfaraz while they released the other five after receiving PKR seven million ransom. Azizullah was arrested during a raid in August 2021 and later the Counter Terrorism Department (CTD) recovered PKR 6.7 million of the ransom amount from him.

The Peshawar High Court on July 22 directed the Federal Government to respond to a petition seeking orders to stop it from making a deal with the terrorist outfit Tehreek-e-Taliban Pakistan (TTP) without the consultation of parents of those killed in the 2014 Peshawar Army Public School attack, reports Dawn. A bench consisting of Justice Lal Jan Khattak and Justice Fazal Subhan issued the order after preliminary hearing into the petition filed by mothers of four students and a woman teacher assassinated by the TTP militants in the APS attack on December 16, 2014. Advocate Ajoon Khan, whose son Asfand Khan was also killed in the massacre, appeared for the petitioners and said parents of the slain students and teachers were the victims of the most barbaric act of terrorism in the country’s history but they had still not been taken into confidence about the ongoing negotiations of the Government with the proscribed TTP. He requested the court to issue directives to the Government not to take any step of reconciliation with the TTP without taking him and the petitioners on board. The bench fixed July 28 for next hearing.

The inquiry of cases on both Maoists is transferred to District Court, and chargesheets on six cases under the limits of Shankaranarayana Police Station limits and one under Kollur Police Stations limits are already submitted to court. However, the criminal sections in these cases need to be inquired in District Court, hence, all the seven cases were ordered to be transferred to the District Court. B G Krishnamurthy submitted a written appeal to the court and requested to keep him in prison of Karnataka. In his appeal, Krishnamurthy stated that out of the four cases in Kerala, he has secured bail in one and he can go for inquiry from Karnataka for the remaining three cases. The Islamabad High Court (IHC) summoned the Prime Minister (PM) Shehbaz Sharif on September 9 over the issue of the missing persons, reports The Balochistan Post. The IHC said that making people disappear is the “biggest form of torture” and that the chief executive of Pakistan will be held responsible in case of enforced disappearance. PM Shehbaz told the court that: “I cannot say that all of the missing persons will be recovered, but we will leave no stone unturned. I will not give any lame excuse.” PM made these remarks before the IHC Chief Justice Athar Minallah during September 9’s hearing of petitions seeking the recovery of six missing persons. At the last hearing, the chief justice had directed PM Shehbaz to ensure the missing persons whose cases were being heard in the IHC were produced before the court before September 9. The IHC warned that the failure to do so would require the PM to appear in person in court and give an explanation. Addressing the PM, the Chief Justice said the court had ordered the Federal Cabinet multiple times on the issue, but its “response had not been what it should be.” In an apparent reference to Military Dictator Parvez Musharraf, Justice Minallah said: “A chief executive ruled in this country for nine years. He proudly wrote in his book that we sold our people to foreign countries.” The chief justice noted that the Federal Government had also constituted a committee – a body that was set up in May this year following the IHC’s orders to “deliberate a policy on enforced disappearances.” The chief justice also mentioned the missing persons’ commission, saying: “The families of missing persons are sitting here. They revealed a lot of things about the commission,” he said, adding that Defence of Human Rights in Pakistan Chairperson Amina Masood Janjua had “also told much about the commission to the court”. Instead of addressing the problems of the families of missing persons, Justice Minallah said, the commission continued “torturing” them. He said the court had also been told about the reservations of the Baloch students. Justice Minallah said the state should fulfil its responsibility toward its citizens. “The political leadership has to solve this issue,” he said. “The court has no other way but to only ask the executive [about the issue].” He questioned who the court should hold accountable for enforced disappearances. To this, the premier replied it was his duty.

The apex court’s decision said according to Article 35(1) of the Constitution, a case cannot be maintained against a sitting President and Ranil Wickramasinghe is entitled to immunity as the current President. It has been further stated in the judgment that a case cannot be maintained against a president who is holding the office of president and that the interim clause of the Constitution has been prepared for the head of State to carry out his official duties without any hindrance. On November 7, Police produced charge sheet against five persons, including three dead Lashkar-e-Toiba (LeT) militants, for abduction and murder of an Army soldier, Mohammad Sameer Malla, in Budgam District, reports Daily Excelsior. The five persons included Athar Illahi Sheikh, an Over Ground Worker (OGW) of LeT who is lodged in Kot Bhalwal Jail; Mohammad Yousuf Dar alias Kantroo, LeT ‘commander’ who was killed; Faisal Hafeez Dar, the LeT militant who was killed; Hilal Ahmad Sheikh alias Hanzullah who was killed and active Pakistani militant Ghazi Bhai alias Pathan Bhai alias Usman Bhai of LeT. An unnamed spokesman said that on March 7, 2022, Police Station Khag received a complaint about missing of one in-service Army soldier Mohammad Sameer Malla on leave and accordingly search of the missing person was started. After three days on March 10, 2022, upon specific information, dead body of the missing Army personnel was recovered who was found buried in a ditch in fields of village Labran Khag. A formal case was filed then. During the course of investigation Ather Illahi Sheikh was arrested who upon questioning admitted that he along with other four accused militants of LeT abducted Mohammad Sameer Malla and they tortured him which resulted in death of Mohammad Sameer Malla in an orchard of Labran village and buried the dead body of the victim in a ditch in nearby field. Later, three militants involved in the crime were killed in anti-militant operation in Village Malwa Kunzar on April 21-22, 2022 while 5th accused Ghazi Bhai alias Pathan is still at large.

S R Navandar, Special Judge, under Unlawful Activities Prevention Act (UAPA), Pune, on December 14, convicted Arun Bhelke on various counts with sentences to run concurrently, who was arrested on charges of being an active member of banned organisation Communist Party of India-Maoist (CPI-Maoist), reports The Hitavada. The Anti-Terrorism Squad (ATS) had arrested Bhelke and his wife Kanchan Nannaware, both hailing from Chandrapur in Vidarbha region, in September 2014. Bhelke and Nannaware were arrested from Kanhe Phata area in Pune Rural. Both were booked under various provisions of the Indian Penal Code (IPC) and UAPA. They were lodged in Central Jail, Yerwada. On January 24, 2021, Nannaware died after a prolonged illness. On December 14, Arun Bhelke was convicted under Section 420, 467, 468, 471, and 474 of the IPC and Sections 20 and 38 of the UAPA. Under the provisions of the IPC, he was sentenced to five years, seven years, five years, five years, and five years separately, with a fine of Rs 5,000/- in each provision. In default to pay the fine, his sentence included, simple imprisonment of one month under each of the cited sections of the IPC. Under the UAPA, he was sentenced to eight years with a fine of Rs 10,000-, in default of which simple imprisonment of two months. Under Section 38 of the UAPA, the court awarded sentence of seven years with fine of Rs 7,000/-, in default of which two months of simple imprisonment.

The Liberation Tigers of Tamil Eelam (LTTE) cadres who turned themselves in to the Government's Forces at the end of the war in May 2009 must appear in court by 2023, according to a Vavuniya High Court judgement on December 17, reports Tamil Guardian. After hearing the habeas corpus petition pertaining to five incidents of enforced disappearances, including Elilan, the LTTE's political leader for the Trincomalee area, the court rendered its decision. Elilan was given to the Sri Lankan military by members of his family after the war ended in 2009. The Sri Lankan Army testified during the preliminary hearing at Mullaitivu Magistrate's Court that they had a list of survivors but did not provide the list to the court. The Vavuniya High Court consequently agreed with the petitioner's claim that individuals who had surrendered were in the Army's care. As a result, they must either be brought before the court by March 2023 or the circumstances surrounding their forced disappearances must be disclosed.

The Delhi High Court on December 19, rejected former Popular Front of India (PFI) ‘chairman’ Erappungal Abubacker’s appeal against a trial court decision to deny his release on medical grounds and instead ruled that he will receive medical care but won't be placed under house arrest, reports News9Live. Abubacker is currently being held in judicial prison. The judgement stated that there was no legal provision for "home arrest" and ordered Abubacker to be "escorted safely" to AIIMS for an oncosurgery review on December 22.

Calling it an act of terror by a gang of radicalised men, the NIA said they wanted to make out an example of the murder which they committed on the grounds that Kolhe allegedly hurt religious sentiments. The accused had formed a terrorist gang, which was highly influenced by the ideology of brutality 'Gustakh e Nabi Ki Ek hi Saja, sar tan se juda' (beheading is the only punishment for those who insult the Prophet), the NIA said.

A court in Dumka District, on December 23, released Communist Party of India-Maoist (CPI-Maoist) cadre Sukhlal Murmu alias Praveer Da, who was jailed for blowing up a polling party's bus returning after holding elections and then firing indiscriminately and killing eight polling personnel including five Policemen near Asna village in Sarsajol in Shikaripada Block in Dumka District during Lok Sabha (Lower House of the Indian Parliament) elections 2014 (April 24, 2014), reports zeenews.india.com. This decision has been given by the court of Dumka Additional Sessions Judge I Ramesh Chandra. Praveer Da is currently lodged in Hotwar Jail of Ranchi while three others accused Budhnath Murmu, Tala Kudi Murmu and Baburam Baski are lodged in Dumka Central Jail, and one accused Som Murmu is currently out on bail. A special National Investigation Agency Government of India (NIA) court on December 24 sentenced two persons to five years imprisonment for attempting to recruit members for the terror group Hizb-ul-Mujahideen (HM) in Assam, reports The Assam Tribune. The court awarded the sentenceS to Mohammad Shahnowaj Alom alias Shahnawaj Alam and Omar Faruk. The Court convicted them under sections 120B of IPC, 18, 18B, 19, and 38 of the UA (P) Act and also imposed fine on them. During the course of the investigation, it was discovered that the accused had entered into a conspiracy to recruit members for raising a module of HM in Assam in order to strike terror in the minds of people through terrorist activities. The case was initially registered at Jamunamukh Police Station in 2018, and the investigation was later taken over by the NIA. On March 11, 2001, a chargesheet was filed against five accused following an investigation.

The National Investigation Agency (NIA) filed the charge sheet in a special NIA court in Hyderabad on December 30 against 11 Popular Front of India (PFI) activists, who were arrested from Nizamabad in Telangana for suspectedly organizing terror training camps and recruiting people for carrying out terror activities, reports The Statesman. Those named in the charge sheet are Abdul Khader, Abdul Ahad, Abdul Saleem, Shaik Shadullah, Feroz Khan, Mohammad Osman, Syed Yahiya Sameer, Shaik Imran, Abdul Mubeen and Mohammad Irfan of Telangana, and Shaik Iliyas Ahmed of Andhra Pradesh as reported by Hindustan Times. According to NIA investigations, the accused were running training camps under the guise of Yoga classes or beginner’s course for physical education where the youths were trained to use everyday articles such as knives, sickles and iron rods to kill people by targeting vulnerable body parts such as throat, head or stomach and for committing acts of terror. The eleven arrested PFI members have been charged under UAPA for organizing terror training camps and recruitment of persons for terrorist acts. They were accused of radicalizing gullible Muslim youths and recruiting them through speeches filled with hatred and venom against the Government of India as well as other organizations and individuals.

According to the investigation, Talib Shah recruited many youths in J&K and revived the militant ecosystem in the Chenab Valley and Pir Panjal areas of J&K on the instructions of Pakistan-based handlers. The accused are also involved in minority killings and instilling fear among the wider public. Two AK assault rifles, a pistol, seven grenades and a large quantity of ammunition were recovered from them.
