Five American nationals accused by Pakistan of having contacts with al Qaeda-linked groups pleaded their innocence on February 2, saying they were being ‘set up’ and tortured by the Federal Bureau of Investigation (FBI) and the Pakistani Police, reports Daily Times. The allegation was made in black and white as they arrived for a remand hearing at a high-security court in Sargodha in Punjab. However, the US embassy and a prison official have denied the allegations of mistreatment.

An Anti-Terrorism Court (ATC) in Sargodha in Punjab rejected the bail applications of five Americans, accused of having links with militants, on February 17 reports, Daily Times. The Americans were arrested from Sargodha in December 2009 by Police and law enforcement agencies on charge of plotting terrorist activities in Pakistan. The Americans were presented before the court amid tight security where they repeated previous claims of having been tortured in custody, a charge denied by Pakistani prison officials. Among the accused, two are of Pakistani origin, one Egyptian, one Yemeni and one of Eritrean origin. Judge Mian Anwar Nazir, after hearing the arguments, rejected the bail applications of the accused. The Prosecutor said that a Presidential decree states that suspects facing charges, which carry more than 10 years in prison, should not be granted bail.

A three-member Supreme Court bench on May 25 dismissed pleas of the Federal and Punjab Governments against the release of Jama'at-ud-Da'awa (JuD), the frontal organisation of Lashkar-e-Toiba, ‘chief’ Hafiz Saeed, maintaining that it was not a live issue, reports Daily Times. The bench comprising Justice Nasirul Mulk, Justice Jawwad S Khawaja and Justice Rahmat Hussain Jafferi dismissed the petitions against the Lahore High Court verdict that ended Hafiz Saeed’s house arrest. The bench observed that keeping a person in detention on mere concerns of threat was not justified. It observed that the Punjab Government had admitted to lacking sufficient evidence against Saeed and his involvement in any illegal activities after his house arrest ended. Justice Khawaja said, “If there is any material against him then its ok, but if he doesn’t create any law and order situation then the UN resolutions don’t provide grounds to detain him.” AK Dogar, lawyer for Hafiz Saeed, said his client was a peaceful citizen and the JD was a welfare organisation. “The prosecution has failed to prove its case,” he added.

The Federal Investigation Agency submitted in a court Rawalpindi on May 26 a supplementary investigation report on the assassination of former Prime Minister Benazir Bhutto accused the slain chief of Tehreek-e-Taliban Pakistan (TTP), Baitullah Mehsud, of masterminding the murder, reports Dawn. Anti-Terrorism Court-I Special Judge Malik Mohammad Akram Awan adjourned hearing till June 12 when the five arrested accused, Aitzaz Shah, Sher Zaman, Abdul Rasheed, Hasnain Gul and Rafaqat Hussain, will be formally charged. The FIA said in the report that a joint team was continuing its investigation into the hosing down of the crime scene, negligence, inadequate security measures and failure to conduct post-mortem on the body of Ms Bhutto. It will submit a report after completing the probe.

Five American nationals alleged to have been involved in terrorist activities were convicted by Anti Terrorist Court (ATC) Special Judge Mian Anwar Nazir on June 24 in Sargodha in Punjab, reports Daily Times. They were sentenced to a total of 15 years in prison and fined PKR 70,000 each. The judge handed down two prison terms for each person, one for 10 years on a criminal conspiracy charge, and the other for five years on the charge of funding banned outfits. The terms are to be served concurrently. The convicts, Rami Zamzam, Ahmed Manni, Aman Abdullah, Umar Farooq and Waqar Hussain were acquitted of three charges, including planning to wage war against the US and Afghanistan. Earlier, the court had acquitted one of the accused Khalid Farooq, the father of Umar Farooq convicted in the same case. Meanwhile, it has emerged that the five Americans were actually hired by Qari Saifullah Akhtar, the Ameer (Chief)of the Al-Qaeda-linked Pakistani jehadi group Harkat-ul-Jihad-al-Islami (HuJI).

Former City Police Officer (CPO) Rawalpindi Saud Aziz and former Superintendent of Police (SP) Khurram Shahzad were arrested from a courtroom in the case of Benazir Bhutto’s assassination of December 27, 2007, after the Anti-Terrorism Court rejected bails to the two former Police officials on December 22, reports Daily Times. Two points were raised during the hearing that as to why the persons deputed on the former Prime Minister’s security were removed from the scene and why the post-mortem was not conducted. Charges against the accused were framed that they were involved in the murder of the former Pakistan People’s Party (PPP) chairperson and former Prime Minister Benazir Bhutto. The counsels of the accused showed a statement that President Asif Ali Zardari had directed not to conduct the post-mortem. However, in April 2007, a United Nations (UN) panel accused the Government of failing to provide Benazir with adequate protection and said investigations were hampered by intelligence agencies and other officials who impeded “an unfettered search for the truth”.
