The SC on January 5 issued an order, in which it has instructed the concerned Government authorities to arrange people’s right to ‘no vote’ implying that people can cast ‘negative vote’ during election, reports Nepal News. A division bench of justices Kalyan Shrestha and Prakash Wasti delivered the order responding to a writ petition filed by Bikash Khadka on behalf of Campaign against Crime and Terrorism. As per the apex court order, citizens will have the choice to negatively mark any candidate during election and stamp him/her as ‘unwanted’. Negative voting will not allow the particular candidate to get elected. This provision is expected to reduce crime, corruption and terrorism in politics, as the voters can say ‘no’ to those whom they do not like to see as their representatives.

He said that making amendments to the CA regulations, electing new President, Vice-President, CA chair and vice-chair, and Prime Minister should be done immediately after the new House session is commenced.

The first meeting of the Maoist PP after the November CA election has discussed the name of Krishna Bahadur Mahara as PP leader. But he has been criticized in the party for centralizing all power in him.

Constituent Assembly (CA) members said that there is no need to include the provision of conscription for adults above 18 years in a new constitution, arguing that doing so would lead the country towards militarisation and conflict, reports Ekantipur.com. The CA members expressed such opinions commenting on the report of National Interest Protection Committee of the erstwhile CA presented by the Committee to Study and Determine Constitutional Records on May 20. In the previous CA, Unified Communist Party of Nepal-Maoist (UCPN-M) and Nepal Workers and Peasant Party had proposed making conscription mandatory as a measure to safeguard the country. The proposal was opposed by Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML). Instead of military training, the CA members have suggested imparting vocational and employment-related trainings to the youth.

Major parties have come up with flexible positions on forms of governance and federalism in the ongoing backdoor negotiations raising hope of possible compromise, cross-party leaders said in Kathmandu on September 3, reports Ekantipur.com. Reaching a consensus by the September 6 deadline may appear difficult, but the parties are making progress towards forging consensus, the leaders claimed. A source privy to the development said that all parties seem ready to make compromise, mainly on forms of governance and federalism. According to a leader, Unified Communist Party of Nepal-Maoist (UCPN-M) leaders have hinted that they could accept an eight-province model of federalism from their current position of 10 if the ruling parties agree to address the issue of ethnicity-based federalism. The ruling parties, which are pushing for seven provinces, may ultimately agree on eight provinces, the leaders said. The Madhesi parties have already agreed on two provinces in Madhes.

On September 7, a committee of the Nepal Constituent Assembly (CA) asked for extension of deadline to settle disputes related to the new Constitution, reports The Hindu. Chairman of the Constitutional Political Dialogue and Consensus Committee (CPDCC) Baburam Bhattarai handed over the committee’s reports to CA Chairman Subas Nembang - one dealt with issues that claimed agreement between the political parties and the other on issues the parties failed to reach consensus by the deadline of September 6. Bhattarai requested Nembang to extend the deadline for the committee to reach consensus on contentious issues of the statute. The move comes after Nepal’s three major political parties, the Nepali Congress (NC), the Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) and the Unified Communist Party of Nepal-Maoist (UCPN-M), failed to forge consensus on the contentious subjects in the new Constitution - federation, governance system, electoral system and judiciary.
