Two persons, identified as Ghulam Ahmed Khawaja and Yaqoob Ali, who were arrested from Jammu District on January 17, were remanded in Police custody till January 25, according to Daily Excelsior. The arrestees had allegedly collected the consignment of Fake India Currency Notes (FICNs) from Pakistan border and brought it to Delhi in a train, an unnamed senior Police official said on January 18. With this, four persons have been arrested and Police is on the lookout for another person, Hassan, who allegedly went to Pakistan to meet counterfeiter Iqbal Kana, who is allegedly linked to Inter Services Intelligence (ISI). Police had on January 12 seized the FICNs consignment from two tempos in Dabri in south-west Delhi and arrested two persons Ash Mohammed and Zeeshan Khan.

Sessions Judge Poonch Kishore Kumar on February 1 awarded life term to a man and his son for hiding a militant in his house who had shot dead a civilian and one Security Force personnel during searches in Mendhar area of Poonch District in Jammu and Kashmir, reports Daily Excelsior. The judge awarded life imprisonment to Mohd Rafiq (Govt teacher) and his son Rayees Hayat, residents of village Keneti Banola in Mendhar tehsil (revenue unit). The judge observed that the accused persons beyond any doubt had hidden the militant at their house and during searches huge quantity of arms and ammunition was recovered from the almirah. It indicated that he used to help terrorists. The accused persons were convicted for the commission of offence under Section 302 RPC read with Sections 120-B and 307 RPC and sentenced to undergo life imprisonment and fine of 25,000 and 10 years rigorous imprisonment for the commission of offence under Section 307 RPC.

A local court in Jammu on February 24 charged Jammu and Kashmir Liberation Front (JKLF) chief Yasin Malik under the Prevention of Terrorism Act (POTA) for allegedly raising funds to strengthen militancy in the State, reports Times of India. Additional sessions judge (Jammu) Sanjay Parihar charged Malik with raising funds to strengthen "armed activity" in the State and "to strike terror among people''. Malik pleaded not guilty to the charges. Malik was charged with allegedly deputing two people - Mushtaq Ahmad Dar and Shameema - to collect USD 100,000 from Kathmandu (Nepal) in 2002. The money was recovered from them after they were arrested later that year. Though POTA was repealed in 2003, cases registered under it prior to that can still be pursued.

A Delhi court on April 17 commenced the trial of a close aide of All Party Hurriyat Conference-Geelani (APHC-G) leader Syed Ali Shah Geelani, Ghulam Mohd Bhat, and three others, for allegedly running a hawala (illegal money transfer) racket to fund Hizb-ul-Mujahideen (HM) in Jammu and Kashmir (J&K). The three other accused include Mohammad Siddiq Ganai, Ghulam Jeelani Liloo and Farooq Ahmed Dagga. The court had framed charges against all the four accused under various sections of the Unlawful Activities (Prevention) Act on March 3, 2012. The National Investigation Agency (NIA) in 2011 had filed the charge sheet against the four, indicting them for procuring over INR 45.7 million from Pakistan through hawala channels within three years after 2008 for funding the terrorist activities in the Valley. Detailing their modus operandi, the NIA had said Ganai developed a close relationship with Delhi-based Raj Kumar and his brother-in-law Rajeev Nankani and motivated them to collect money on their behalf from hawala operatives in New Delhi. "Between November 2008 to October 2010, Raj Kumar alone collected Rs 2.25 crore [INR 22.5 million] in various instalments from hawala operators here," the charge sheet had said. The Special Cell of Delhi Police on January 22, 2011, had arrested Srinagar-based lawyer Bhat, Ganai, Liloo and Dagga from J&K on a tip-off that they were carrying hawala money, allegedly meant for the HM. It had also recovered INR 2.12 million 1 from them.

Principal Sessions Judge (Jammu) Jang Bhadur Singh Jamwal acquitted two alleged Over Ground Workers (OGWs) of LeT, Mohd Amin and Shakar Hussain, both residents of village Dhanwan in Rajouri District, as the prosecution failed to connect the accused with the commission of offence. After hearing both the sides, Principal Sessions Judge observed, "There is no evidence to prove that the letter written on the letter head of the militants was recovered from any of the accused. There is also no evidence on record that the accused were found negotiating with any militant organization or any member of any such organizations or in any manner had any links with such organization and as such cannot be held to be enemy agents. There is also no evidence of conspiracy with any militant organization and had ever supported their cause directly or indirectly prejudicial to the interest of the Country or the State."With these observations, Court acquitted both the accused of the charges leveled against them. According to Police case, Mohd Amin and Shakar Hussain were involved in anti-national activities and providing secret information regarding SFs to the militants and elements hostile to the Country.

Principal Sessions Judge (Jammu), Jang Bhadur Singh Jamwal, on June 27 denied bail to three Hizb-ul-Mujahdeen (HM) militants, identified as Sheeraj Ahmed, his wife Faiza Begum and Ghulam Ali, according to Daily Excelsior. According to the Police case, Sheeraj Ahmed and Ghulam Ali crossed the border in Poonch in the year 2000 and 2004 respectively and went to Pakistan for getting arms training. In Pakistan, Sheeraj entered into wed-lock with Faiza Begum and thereafter trio crossed over to India via Nepal before entering Jammu and Kashmir. However, they were arrested by Chanderkote Police on February 1, 2009. With their arrest, Police foiled plans to cause damage to infrastructure of Baglihar Hydroelectric Project.

A Jammu court on July 28 sentenced a former Hizb-ul-Mujahideen (HM) 'commander' and Pakistani national to nine years of imprisonment, according to The Times of India. Principal Sessions Judge Jang Bhadur Singh Jamwal awarded the term to Noor Ahmed Baloch and imposed a fine of INR 10,000 on him. Baloch, a resident of Chak Zahir Peer in Khanpur (Pakistan), was arrested in Doda District on October 26, 2004, where he was operating as a HM ‘area commander’. On the day, Police recovered a Chinese-made pistol among other things from his possession. Codenamed as Rashid, Baloch had obtained militant training in Pakistan occupied Kashmir (PoK) and was operating in Doda hills in the state.

Principal Sessions Judge Udhampur (Udhampur District), A K Koul awarded 10 years imprisonment to Mohd Yousuf alias Mithu, a close associate of Lashkar-e-Toiba (LeT) ‘commander’ Qari. According to the prosecution case, Yousuf, a resident of Basantgarh in Ramnagar, was arrested by Security Forces (SFS) on August 10, 2003, in village Bhagni along with grenade. During investigation, it came to fore that Yousuf was assigned the task of hurling the grenade on Police party which he could not do because he was unable to pull the pin of the grenade. He was also involved in an attack on Police Station Basantgarh in 1996. He was arrested from Pathankot in 1999 and was jailed for two years. After being let off, he again indulged in militant.

Police busted a Lashkar-e-Toiba (LeT) module in the Budgam District by arresting six militants, reports Daily Excelsior reported on October 2. The arrestees, identified as Zahoor Ahmad Khan alias Zubair, Barkat Ahmad Malik alias Abu Talha, Assadullah Dar alias Assad, Aijaz Ahmad Dar alias Imran, Rouf Ahmad Dar alias Rafeeq and Farooq Ahmad Mir, as per investigations, were found involved in the burning of Baba Hanief-ud-din shrine at Ratsuna in Beeru on July 15, 2012, and a Masjid (mosque) in Narbal Magam, both in Budgam District. Police said Farooq Ahmad Mir confessed before the Budgam Judicial Magistrate that he was directed by the LeT militants in Pakistan to burn the religious places to ignite an agitation like that of 2010. Mir had travelled to Pakistan's Faisalabad in early 2012 and met LeT men there. His travel was facilitated by Zahoor Ahmed of Arth of Budgam District, Police added. Mir told his interrogators that the LeT militant Waleed (in Pakistan), wanted to start an agitation similar to that in 2010 by targeting Masjids and Shrines in Kashmir valley. On Mir’s tip-off, five others were arrested and they are being interrogated.

Principal Sessions Judge (Jammu), Jang Bahadur Singh Jamwal on October 4 acquitted alleged militant of Khalistan Zindabad Force (KZF) as prosecution failed to prove its case, Daily Excelsior reported. According to the Police case, KZF militant, Tej Paul Singh, was arrested by Gandhi Nagar Police (Jammu) as soon as he entered the State for carrying out terrorist activities. During interrogation, he disclosed that he had kept concealed AK 56 rifle, five magazine, 109 cartridges in his house. Accordingly, the arms and ammunition were recovered and after completion of investigation challan was presented in the Court of law. After hearing both the sides, Principal Sessions Judge observed, "There is no evidence on record to connect the accused with the commission of offences and the prosecution has failed to prove its case", the Court observed and acquitted the accused of the charges leveled against him.

Additional Session Judge, Srinagar, T K Watal in his order said the prosecution had failed to prove the charges against the accused for their role in the attack on high security Tulsi Bagh Government quarters. As reported earlier, a terrorist assassinated the Minister of State for Education, Dr. Ghulam Nabi Lone, while Communist Party of India-Marxist (CPI-M) legislator, Mohammed Yousuf Tarigami, escaped unhurt in a similar attempt in Tulsibagh area on October 18. Two Security Force personnel and a civilian were also killed in the incidents.

Principal Sessions Judge, Ramban District, M. A. Chowdhary on September 29 awarded 14 years imprisonment and fine of INR 20,000 to two Jaish-e-Muhammad (JeM) militants, reports Daily Excelsior. The Judge observed, "Having due regard to the facts and circumstances of the case, court is of the considered opinion that the interests of justice shall be served with a sentence of imprisonment for a period of seven years and fine of INR 10,000 under Section 307 read with Section 34 RPC and Rigorous imprisonment for a period of seven years and fine of INR 10,000 for the commission of offence punishable under Section 27 (2) Arms Act". The Court clarified that both the sentences will run concurrently. According to the Police case, these two militants namely Mohd Shaheen code Aarif, son of Abdul Gani Naik of Manjoos in Banihal and Badar Din code Umar, son of Nazir Ahmad Wani of Tanta in Thathri surrendered before the Security Forces following a gun battle in Dheda under the jurisdiction of Gool Police Station on April 4, 2005. Subsequently, a case was registered and after completion of investigation, challan was presented in the Court of law.

Principal Sessions Judge, Poonch, Kishore Kumar has awarded life imprisonment to one Mohd Nayeem Anwar alias Shahzad alias Asaf Safadar alias Abu Maz, a resident of Lahore (Pakistan), for his involvement in murder and attempt to murder cases, reports Daily Excelsior. The accused was facing trial for the commission of offence under Sections 302/307 RPC and 7/25, 26, 27 Indian Arms Act, since 2003. He was found guilty for his involvement in killing of a Jammu and Kashmir Police personnel Rajesh Kumar and causing injuries to two other at Mohalla Pathana in Poonch District on July 11, 2003. As reported earlier, the Police was patrolling the area in the forest near Pathana Mohalla when the militants opened fire. The court however rejected the plea of death penalty as the case does fall in the category of rarest of the rare case.

He was arrested following gun battle with Police and Border Security Force (BSF) in Jhangar area of Ramnagar tehsil (revenue unit) (Jammu and Kashmir) on August 20, 2007. The HM militants were involved in the killing of Border Security Force (BSF) Inspector Dharamvir Sharma on October 26, 1990, within the limits of Nishant Police Station (Srinagar District). On October 27, 1990 the dead body was disposed off as unidentified. However, on the same day, Deputy Commandant 24th Battalion of BSF lodged a report with Nishat Police regarding the missing of Dharamvir Sharma. On the basis of clothing and photographs, the dead body was later identified as that of Inspector Sharma. The militants, according to The Hindu, are affiliated to Jammu and Kashmir Liberation Front (JKLF) and not HM.

According to the Police case, on June 7, 2004, Taj, along with five-six other militants of the outfit barged into a house at Khaitan Draba and started indiscriminate firing on three Special Police Officers (SPOs), including Mushtaq Ahmed. In the firing, Mushtaq Ahmed died while as other two SPOs managed to escape from the house. Taj was arrested during the course of investigation.

The court held, “in the interest of justice, prosecution evidence is closed now and consequently the persons who faced trial are acquitted with honour from the charged offences of TADA Act and RPC.” Those who were acquitted by the court include Abdul Hamid Bakshi, Abdul Qayoom Bhat, Parvaiz Ahmad Dar, Nazir Ahmad Dar, Istiyaq Ahmad Chinkar, Muhammad Shafi Rather, Zahoor Ahmad Chiloo, Nazir Ahmad Peerzada, Farooq Ahmad Gojri and Mushtaq Ahmad.
