ATS told the court on January 1, that the conspiracy to cause serial bomb blasts on Jangli Maharaj Road was hatched by the seven arrested suspects in Saudi Arabia, reports The Times of India. The ATS said the custodial interrogation of the suspects, revealed that they were constantly in touch with the absconding suspects, Fayyaz Kagzi, Riyaz Bhatkal and three others involved in a string of terror attacks in India so far. Investigations also revealed that one of the absconding suspects is a militant of the terror outfit Lashkar-e-Toiba (LeT) and he is involved in inciting youths from Aurangabad, Beed and Ahmednagar (three District of Maharashtra) to indulge in terror activities. A Pakistani national, identified as Mohammed Hussain alias Julfikar Ali, who was on death row since 2006 until the Supreme Court set aside his conviction and ordered his retrial in August, 2012, was acquitted by a Sessions Court in New Delhi on January 4, reports The Hindu. The court noted “substantial lapses” in the Delhi Police investigation into the 1997 blast in a Blueline bus near Punjabi Bagh in West Delhi killing four persons and injuring 24. Among the lapses, Additional Sessions Judge Pawan Kumar Jain found that the Delhi Police did not prepare a site plan, did not consider taking photographs of the inner portion of the bus, exhibits lifted from the spot were not sealed and no effort was made to prepare the sketch of the suspect. “The prosecution has failed to bring home the guilt of the accused beyond the shadow of reasonable doubt,” the Judge said.

Mumbai Police arrested two persons, identified as Farooq Naiku and Mohammed Talukdar, suspected to be linked with Hizb-ul-Mujahideen (HM) from a guest house at Masjid Bunder in Mumbai (Greater Bombay District) along with Fake Indian Currency Note (FICN) worth INR 27, 200 on January 16, reports Indian Express. They were produced before a local court the next day and remanded in Police custody till January 23, 2013. During interrogation of the accused, it was revealed that Farooq was an active HM militant and he along with Mohammed were actively involved in FICN circulation, narcotics trade, hawala (illegal money transfer) and terror activities. They had also carried out recce of various vital installations across the country. Farooq has been to Pakistan and Pakistan occupied Kashmir (PoK) via Wagah border in Amritsar (Punjab) on several occasions since 2001 form training. Officially, he has crossed the Indo-Pak border three times. Farooq had been reporting to a HM "commander" in Jammu and Kashmir (J&K) and also took part in the agitation over the Amarnath land transfer controversy in the state in the year 2008, Police added. Joint Commissioner of Police (Crime) Himanshu Roy said, "We have evidence that he has photographed Uri Dam, Uri power project, Baramulla Bridge and graves of terrorists killed during operations by security forces… He had even attempted to infiltrate into the Indian Army”. Farooq has been tasked with gathering information related to Indian troops' movements in J&K, public protests and other developments. He passed on the information either through telephonic conversations, mails or by crossing the border, to his Pakistani handlers and intelligence agencies. The second accused Talukdar, who hails from Assam, is also suspected to be an active member of the terror outfit and had been helping Farooq in FICN operations. "We are ascertaining Talukdar role in detail," Roy said, adding Police were trying to find out if the accused had played any role in violence in Azad Maidan (Mumbai) on August 11, 2012.

A local court in Mumbai (Maharashtra) has transferred the case of the Lashkar-e-Toiba (LeT) operative Sayed Zabiuddin Ansari alias Abu Jundal to a sessions court, paving the way for the beginning of a trial against him in the November 26, 2008 (26/11) Mumbai terror attacks case, NDTV reports on January 22. According to Police, Jundal, a resident of Beed District in Maharashtra, was present in the makeshift control room in Pakistan and gave instructions to ten Pakistani terrorists, including recently executed Ajmal Kasab, involved in the 26/11 attacks. The Crime Branch had filed a 14,676-page chargesheet in Mumbai’s Esplanade court against Jundal mentioning in detail the role of Pakistan's Inter-Services Intelligence (ISI) and LeT operatives before, during and after the attacks. The charge sheet also contains the Jundal’s confessional statement made before a magistrate, besides the details of his confrontation with Ajmal Kasab. According to Crime Branch, Jundal had revealed that LeT training camps enjoyed full support from local and Federal Police and paramilitary organisations in Pakistan. fLeT

A United States (US) federal court, on January 24, sentenced Pakistani-American Lashkar-e-Toiba (LeT) operative David Coleman Headley aka Daood Gilani to 35 years in prison for his role in Inter-Services Intelligence (ISI)- LeT sponsored November 26, 2008 (26/11) attack on Mumbai (Maharashtra), with the judge expressing unhappiness over the prosecution seeking a relatively light term given the magnitude of Headley's offences, reports Economic Times. Headley was ordered to serve 35 years, followed by five years of supervised release by US District Judge Harry Leinenweber. "Mr Headley is a terrorist," the judge said while imposing the sentence in the court. Leinenweber also said, "He commits crime, cooperates and then gets rewarded for the cooperation. No matter what I do, it is not going to deter terrorists. Unfortunately, terrorists do not care for it. I do not have any faith in Mr Headley when he says that he is a changed person now. I do believe that it is my duty to protect the public from Mr Headley and ensure that he does not get into any further terrorist activities. Recommending 35 years is not a right sentence."

"We are not having any apprehension anywhere in the country. In Jammu and Kashmir, the state government is taking steps. We are in touch with them," the Union Home Secretary said. Supreme Court today (March 21) upheld death penalty to March 12, 1993 Mumbai (Maharashtra) blasts case (which killed 257 people and injured 700) mastermind Yakub Memon, reports IBNLive. The apex court reduced death sentence of 10 others to life imprisonment. Yakub is brother of Ibrahim Mushtaq 'Tiger' Memon, one of the prime accused of the attacks. Yakub Memon was convicted in the 1993 Mumbai blasts case and has been in jail since he returned to India and surrendered in 1994. Supreme Court observes, "Yakub Memon and all absconding accused including Dawood Ibrahim were archers and rest of the accused were arrows in their hands." Supreme Court says, "Police, customs and coastal guards are also to be blamed for 1993 Mumbai blasts." Court further added that the training of convicts materialised in Pakistan. The apex court adds that management and conspiracy of 1993 blasts were done by Dawood Ibrahim and others in Pakistan. Supreme Court says that Pakistan's intelligence agency Inter-Services Intelligence (ISI) was also involved in the 1993 blasts. Supreme Court upheld life terms of 17 convicts in the 1993 Mumbai blasts case and commuted death sentence of 10 convicts to life imprisonment on the ground that the convicts were behind bars for 20 years and their economic condition was weak. Supreme Court asks all accused to surrender within four weeks. Actor Sanjay Dutt is also sentenced for five years in jail by the Court. However, the apex court has reduced his sentence from six years to five. Sanjay has not been granted any probation and will have to spend three years and six months in jail.

Javed Mozawala, a visa agent from Mazgaon (Mumbai District) in Maharashtra who was arrested on December 8, 2010, on charges of spying for Pakistan, was convicted under the Official Secrets Act by a sessions court on July 15, and sentenced to seven years' rigorous imprisonment, reports Mumbai Mirror. The court upheld the prosecution's contention that Mozawala, provided information regarding key defence establishments and public infrastructure to his handlers posted at the Pakistan High Commission in Delhi, and convicted him for spying, establishing contacts with foreign agents, and abetting violation of secrecy under sections 3(1)(c), 4(2), and 9 of the Act. The court, however, didn't find him guilty of criminal conspiracy under the Indian Penal Code (IPC). At the time of arrest he was found in possession of incriminating documents that included maps and photographs of Western Naval Command in Mumbai (Maharashtra), another defence establishment in Lonavala, the Bandra Worli Sea Link, and the Koyna Dam in Satara. The investigators also found pen drives and CDs that contained coded telephone numbers of 87 defence establishments across the country, besides a handbook which listed tips on how to not raise suspicion, evade arrest, and communicate with other aides through cryptic emails. The Crime Branch said Mozawala was being 'handled' by one Abdul Latif alias Bhatti in the Pakistan High Commission, who went missing a few months before he was arrested.

The National Investigation Agency (NIA), probing conspiracy of Indian Mujahideen (IM), in its first chargesheet filed on July 17, traces the origins of the banned outfit and details its agenda but fails to find any exhaustive evidence, according to Indian Express. The 42-page chargesheet was filed in a case against 12 IM operatives, including Yasin Bhatkal, Riyaz Bhatkal and Iqbal Bhatkal registered in September 2012. In what reads like a compilation of previous chargesheets filed by various state police and the special cell of Delhi Police, it states that "IM was formed in or around 2003 end in the wake of communal mobilisation due to factors like Babri Masjid demolition and Gujarat riots". According to the NIA, IM was formed after a group of certain ultra radicalised Muslim youths segregated themselves from Students Islamic Movement of India (SIMI). Without substantiating, NIA claims, "Source information revealed that IM is receiving regular funding from abroad..." It goes on to say that IM is undertaking "large-scale recruitment" for acts of terror with "active support from their Pakistan-based associates and sleeper cells within the country". NIA further says, "IM does not believe in the Constitution and believes in waging war against India." However, the NIA has no idea on the means of communication used by the outfit to contact its cadre. The chargesheet says the group recruits cadre by "engaging them in discussions".

These boys had not only been trained by LeT in 2008, but had also taken part in an armed action against the security forces in the Lolab forests of Kupwara which had resulted in the death of the four of the five youth," said an NIA officer.

Pakistani prosecutors on December 5 sought contempt proceedings against the lawyer of the seven accused charged with involvement in the Mumbai 2008 terror (also known 26/11) attacks for claiming that the evidence in the case was a ‘sham’, reports Niticentral.com. “We have prayed for contempt proceedings against the defence counsel as he violated the court’s order by holding a Press conference,” Special Public Prosecutor Chaudhry Mohammed Azhar said. “They (defence lawyers) had themselves sought an in-camera trial in the case and they violated this,” he added. The prosecution sought the contempt proceedings during December 5 hearing of the Mumbai case by Anti-Terrorism Court at Adiala Jail in Rawalpindi. A witness was also cross-examined during the hearing. “One witness was cross-examined and our prayer (for contempt proceedings) will be taken up at the next hearing on December 11, 2013” Azhar said. The new lawyer Raja Rizwan Abbasi of the seven accused, including Lashkar-e-Toiba (LeT) ‘commander’ Zaki-ur-Rehman Lakhvi, told a news conference in Islamabad that the evidence provided by India was a ‘sham’. “The dossiers provided by India are information and not evidence as needed by the court. The evidence provided by India is sham,” Raja Rizwan Abbasi said. Prosecution sources said they would not react publicly to Abbasi’s claims but would take them up legally. Lakhvi, Abdul Wajid, Mazhar Iqbal, Hammad Amin Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younas Anjum were arrested in July 2009 for their alleged role in the Mumbai attacks. Pakistan has acknowledged that the conspiracy behind the attacks was hatched on its soil. However, it claimed India has not provided enough evidence for action against the accused, a charge vehemently denied by New Delhi.

The investigation into an alleged Lashkar-e-Toiba (LeT) plot to attack Hindu elements that led to the framing of charges against 12 Muslim youths from Karnataka, Andhra Pradesh and Maharashtra has reached a dead end as eight more wanted persons, including several with links to an older generation of terrorist incidents in India, are based abroad, Indian Express reported on December 20. The authorities have issued Interpol Red Corner Notices for the arrest of the eight. An Interpol notice is also likely to be issued against a ninth missing person, identified only as Motu Doctor, when the National Investigating Agency (NIA) identifies him in the course of a supplementary chargesheet to be filed in a couple of months. Among the eight persons wanted in the Bangalore case is a man referred to by some of the accused as Professor who has been identified in the NIA chargesheet as Farhatullah Ghori, also an accused in the 2003 attack on the Akshardham Temple. Sources said he was in Pakistan and was a key link to extremist outfits there. Another wanted person is Mohammed Bhai alias Abdul Bari alias Abu Hamza, who is the main accused in a blast outside the Dilsukhnagar Sai Baba temple in Hyderabad in 2002 that killed two. He is in Saudi Arabia and is linked to the creation of the Muslim Defence Force in Tamil Nadu, a precursor to the emergence of the Al Ummah. Bari's brother Furkhan Bhai, Osman bin Siddiqui alias Abu Hanzala, an alleged financier of LeT networks in India, and Asad Khan alias Abu Sufiyan, who has a terrorist case record in Hyderabad, are the other wanted persons. They are from an older generation of alleged terrorists. The three others against whom Red Corner Notices have been issued are Abdul Majed, the youngest brother of Abdul Shahed, an LeT linked terrorist killed in Karachi in 2007, Usmane Ghane, a doctor and Mohammed Shahed Faisal, an engineer. Sources said dentist Imran Ahmed, who was arrested recently in the conspiracy case following his return from Saudi Arabia, had confirmed that the persons against whom Interpol notices have been issued were part of a group that frequently met in Saudi to discuss developments in India with regard to Muslims, among other issues. Earlier, Mohammed Akram, who is considered a key figure in the alleged LeT plot, had told investigators that the conspiracy was hatched in the course of meetings held with the Gulf-based individuals. Sources said further progress in the case would depend on the availability of the Gulf and Pakistan based men.

Indian Mujahideen’s (IM) ‘operational chief’ in India, Yasin Bhatkal, who was arrested on August 28, 2013, during his interrogation admitted that IM operatives, especially Tehsin Akhtar alias Monu, would target foreign tourists in Rajasthan, Delhi, Maharashtra, Goa and other states, reported The Times of India on December 22. The IM members would also attack Jews, especially tourists from Israel, Yasin claimed, according to a top official. According to sources, Yasin claimed the IM was closely associated with al Qaida and was working to distance itself from ISI. "The passion (among IM leaders) for fighting in NATO forces in Af-Pak region by becoming part of al Qaida and distancing from ISI are some of the new trends in the IM based in Pakistan, which is also leading to a split of the outfit," Yasin told interrogators. To the surprise of Indian agencies, Yasin disclosed that Mohammad Sajid (Bada Sajid), who was involved in the Delhi 2008 serial blasts and was present in Batla House, is fighting in FATA (Federally Administered Tribal Areas) region in northwestern Pakistan. "He (Bada Sajid) was even wounded in the fight there," Yasin said. Yasin was friends with Bada Sajid, Atif Ameen and Chota Sajid, members of the IM's Azamgarh module, and had made bombs initially with them for Delhi, Jaipur, Ahmedabad and Surat blasts in 2008. Bada Sajid fled India after the Batla House encounter, in which Chota Sajid and Ameen were killed. Yasin told intelligence officials that the "conflict and bickering for change in the command of IM is apparent". He gave names of IM members who are having ideological differences with the outfit's leadership in Pakistan. "The group comprising Afifi alias Mota Bhai, Sultan, Safi and Farhan are upset about activities of Iqbal Bhatkal," he told agencies. During his custody in NIA, Yasin had given primary details of IM's association with other terror outfits including al-Qaida. Giving an account of his conversations with Riyaz Bhatkal, he said, "Riyaz talked of going on a tour to meet al Qaida and that he wanted to discuss about the journey. He mentioned that he couldn't go to Tehrik-e-Taliban Pakistan (TTP) and that he will join hands with al Qaida. He explained that there were two types of Taliban - one was of Afghanistan and the other of Pakistan. All in Pakistan were supporting the Taliban of Pakistan. Al Qaida was also supporting the Taliban-Afghanistan. But the Taliban of Afghanistan talked only about Afghanistan and not about other places. Riyaz said they (Taliban-Afghanistan) had their priorities in Afghanistan. He said Taliban of Afghanistan were clear that they would not let their land to be used against others." Yasin claimed Riyaz told him that they (IM) would be under the al Qaida and that he was going to Waziristan.
