Cachar Police arrested nine persons, including a woman from different places on January 16 midnight for being allegedly involved in abductions and extortion in Barak valley, reports The Telegraph. The nine arrested persons - mastermind Bapan Mazumder (31), Akhtar Hussain Laskar (35), Imran Hussain Raj Barbhuiya (27), Shammim Choudhury (22), Santo Roy alias Shaymal Sarkar (22), and his wife Mahi Deb (20), Moinul Haque Barbhuiya (30), and Abdur Rahman Tapadar (22), including Tiklu (28) - were sent to seven-day Police custody by a Silchar court on January 18. Cachar Superintendent of Police (SP) Rajveer Singh said that the gang used Mahi to lure men and then abduct them. The racket was busted after the Police started an investigation into the abduction of college student Sohail Ahmed Laskar of Saidpur village of Cachar District.

The National Investigation Agency (NIA)on March 14, submitted a supplementary chargesheet before the Special NIA Court in Guwahati (Assam) against three I.K. Songbijit faction of the National Democratic Front of Bodoland (NDFB-IKS) militants in connection with the killing of five Adivasi people at Pakhriguri village under Serfanguri Police Station in Kokrajhar District on December 23, 2014. The accused are Amal Mushahary alias Aogoi, Kamakhya Daimary alias Kwnasong alias Konkor alias Kanta and Jeba Basumatary alias Jangsha Borgoyari alias Lambu alias Ziba Borgoyari. It may be mentioned that the NIA had earlier filed a chargesheet against ten accused in connection with the case. The NIA court has also framed charges against all of them. The NIA also filed another chargesheet and one supplementary chargesheet on March 14 in connection with an arms recovery case on June 5, 2013 at Sairang in Aizawl against one Rohmingliana alias Hmingtea alias Hminga.

A tribunal set up by the central government has upheld the ban on Khaplang faction of National Socialist Council of Nagaland (NSCN-K) for five years, reports Nagaland Post on March 31. The Centre had set up the Unlawful Activities (Prevention) Tribunal comprising of a Delhi High Court judge for adjudicating whether there is sufficient cause for declaring NSCN-K an unlawful association under sub-section (1) of Section 3 of the Unlawful Activities (Prevention) Act, 1967. The Union Ministry for Home Affairs (UMHA) had on September 16, 2015 declared NSCN-K an unlawful organisation for a period of five years under this law. It said the group had unilaterally abrogated the ceasefire with the Centre and conducted an attack on Army on June 4, 2015. The Centre also blamed the NSCN-K for an ambush on the Assam Rifles in May that left eight Security Force (SF) personnel dead. The ban will pave the way for the National Investigation Agency (NIA), which is probing the June 4, 2015 ambush, to freeze the assets and properties of NSCN-K leaders in India. According to officials, NSCN-K had abrogated the 14-year-old ceasefire with the Centre on March 27, 2015 and carried out several attacks on SFs in Nagaland and outside.

Eighteen cadres of three militant groups, Khaplang faction of National Socialist Council of Nagaland (NSCN-K), Kanglei Yawol Kanna Lup (KYKL) and Kangleipak Communist Party (KCP) who were listed as accused in June 4 ambush in Chandel District, were summoned to appear in the court of special judge, National Investigation Agency (NIA), Manipur on April 4 next, reports The Nagaland Post on March 4. NIA court issued proclamation orders against the accused persons including top leaders of NSCN-K ‘chairman’ SS Khaplang Pangmei alias Khaplang, KYKL ‘chairman’ Namoijam Okendro and KCP ‘president’ Kshetrimayum Noyon alias Hemanta. The proclamation orders, it was stated that the warrant of arrest issued against them were returned as they were not found and the judge was satisfied that they have absconded or concealing themselves to avoid the service of the said warrants. They were asked to appear before the court in Imphal’s Uripok Cheirap Court Complex to answer the charges leveled against them on April 4, 2016.

Issuing the directive, Justice SR Sen on April 22, said that he was not happy with the reasons shown by the Judicial Magistrate First Class for the delay. Earlier in November, 2015, the High Court had directed Judicial Magistrate First Class, East Khasi Hills, to complete the trial within five months.

In the first case, the tribunal identified one Ramani Das, owner of Badya Bhandar of Nalbari Thana Chowk as a Bangladeshi national on April 29. Das had failed to produce valid documents regarding his citizenship despite repeated notices by the court. After a few days, another woman Chandra Banu alias Barbala Char under Mukalmua circle was picked up on May 6. The woman had also failed to submit valid documents in support of her citizenship. The documents produced in the NRC application were also found fake. The court directed the Nalbari Police to hand over the woman to the Border Security Force (BSF) to keep her in the detention camp of Kokrajhar District.

The special designated Terrorist and Disruptive Activities [Prevention] Act (TADA) court in Guwahati on May 25 acquitted the United Liberation Front of Asom (ULFA) founder ‘general secretary’ Anup Chetia in three cases registered against him under TADA, reports The Times of India. This includes the sensational murder case of Surrendra Paul that stunned the country, shook up the tea industry and led the State to President's Rule in the 1990s. Chetia, along with five others, including the outfit's elusive ‘commander in charge’ Paresh Baruah and ‘chairman’ Arabinda Rajkhowa, were accused of the killings. With Chetia's acquittal, now the lone accused in the case is Paresh Baruah. Rajkhowa and others were already acquitted in the case on the 'benefit of doubt' in 2012. The other two cases in which Chetia was also given a breather included the sensational murder cases of city-based businessman and former president of Kamrup Chamber of Commerce Girdharilal Harlalka in 1988 and the killing of three persons, including the wife of a top cop and a personal security officer, at Chabua in Dibrugarh District in 1989. The National Investigation Agency (NIA) Special Court at Guwahati on June 8 convicted 18 members of the United National Liberation Front (UNLF), including its chairman Raj Kumar Meghen, under various sections of the Unlawful Activities [Prevention] Act (UAPA) and the India Penal Code (IPC) for various offences, including criminal conspiracy of terrorist acts and waging war against the Government, reports The Sentinel. The members of the outfit have been sentenced to rigorous imprisonment ranging from seven to 10 years for hatching criminal conspiracy of terrorist acts in Assam and Manipur and waging war against the Government of India. The NIA had submitted two chargesheets in the case, charging 25 persons for their involvement in terrorist conspiracy and waging war against the Government. Of these, 18 persons faced the criminal trial while the remaining seven are absconding.The Assam Tribuneadds that the case relates to a search conducted on April 30, 2010 at a rented house in Guwahati in which two persons including Khundong Tomba alias Bikramjit, vice chairman of the outfit and Y Nabichand, another UNLF cadre were arrested and a laptop, three pen drives, one mobile phone, one wireless internet connection and INR 50,000 in cash were recovered from their possession. In the subsequent investigation, NIA and Assam Police arrested 20 more members of the UNLF, who were charged with hatching terrorist conspiracy in Manipur and Assam. It was alleged that the outfit had indulged in large scale extortion from Government officials, recruitment of cadres, purchase of arms and ammunition, for waging war against the Government.The NIA also arrested UNLF chairman Raj Kumar Meghen alias Sanayama and a large number of digital articles like laptop and mobile phones were recovered from him and other cadres, which revealed financial dealings of the organisation as well as money trail of investments by the organisation.

Songbijit faction of the National Democratic Front of Bodoland (NDFB-IKS) militant, identified as Pradip Brahma alias Pwler for killing seven people, including four women and two children in Balapara village of Kokrajhar District on May 1, 2014, reports The Telegraph. The 26-year-old accused, Pradip Brahma was convicted by NIA special judge M.K. Bhattacharjee under Sections 302, 307 and 368 of the Indian Penal Code (IPC) and Section 16 of the Unlawful Activities (Prevention) Act [UAPA]. "He was sentenced to life imprisonment and Rs 5,000 as fine. In case of default in payment of fine, he will have to undergo imprisonment for another three months," said Dilip Kumar Das, special public prosecutor of NIA. Brahma, who hails from Besorkona village under Bagribari police station of Kokrajhar, is a commander of Monglajhora section of the Dhubri platoon of the outfit's 14th battalion.

The Supreme Court (SC) on July 8 said the Army and paramilitary forces cannot use “excessive and retaliatory force” in Manipur and such instances must be probed, reports The Shillong Times. The bench also asked the amicus curiae to furnish details of alleged fake encounters in Manipur. The bench said it was open to the Army to conduct its own inquiries into the allegations of fake encounters in Manipur. The court said it will also examine the claim of National Human Rights Commission (NHRC) that it was a “toothless tiger” and needed more powers. The apex court was hearing a petition by one Suresh Singh seeking repeal of the Armed Forces [Special Powers] Act (AFSPA) that grants special powers to the Indian Armed Forces in “disturbed areas”.Earlier, the court had said the fact that compensation has been paid to the next of kin of victims of encounter killings by security forces in Manipur “amply indicate” that such encounters were fake. It had asked Manipur Government to appraise the court of the steps taken after compensations were paid to the kith and kin of the deceased. The court had then also asked the Centre, Manipur Government and NHRC to submit a comprehensive report on alleged fake encounter cases in the state, including 62 such cases where First Information Reports (FIR) have not even been lodged.

The Court also directed that the words, ‘the individual is absconding’ be deleted from the statement issued by the State Police on June 2. The High Court of Meghalaya slammed a lower trial court for granting bail to an accused who was allegedly involved in the abduction of a senior citizen, Arabindra Kumar, from Jail Road earlier this year, reports The Shillong Times on October 15. Aggrieved with the order of the lower court granting bail to the accused, the State Police approached the High Court seeking redressal of their grievances. The lower court had granted bail to accused Nurul Haque for a sum of INR 50,000 on the ground that the Investigation Officer had failed to submit the remand report. During the hearing on October 14, the counsel for Meghalaya Police and the State Government vehemently challenged the impugned order and said that the remand report could not be submitted as the investigation Officer, K.P Singh, had gone to Tripura in connection with the same case for arresting the other co accused persons and to collect the information for the purpose of investigation. Justice S.R Sen in his order observed that the trial court has failed to appreciate the criminal jurisprudence, but rather passed an order in a very whimsical manner by passing a statutory provision of the Code of Criminal Procedure (CrPC).

These three JMB cadres, Jahidul Islam, Yusuf Sheikh and Sahidul Islam, who were arrested by the West Bengal Police Special Task Force in connection with the October 2, 2014 Burdwan blast, were brought to Assam by the State Police to extract possible information from them about the group’s network in the State. On December 2, these three cadres were produced at the CJM Court which sent them to seven-day Police custody.On this issue, Assam Police Additional Director General of Police (ADGP) Pallav Bhattacharjee said, “We have an information that 15/20 youths were working in Assam on behalf of JMB, but they are absconding,” adding, “the JMB aims to create a new district by curving out areas from Assam and West Bengal.”Meanwhile, during past one week huge old Fake Indian Currency Notes (FICNs) of INR 100 denomination have surfaced in Tinsukia markets in Tinsukia District causing serious concern for general public, reports The Sentinel on December 2. On completion of the 14 days remand, the two leaders were produced in the court of Chief Judicial Magistrate (CJM) Imphal East District on December 8, which remanded them to 15-day judicial custody. But a team of Tadubi Police station personnel of Senapati District re-arrested them in connection with another case registered with the Police Station and took them into custody for five days, that is, till December 14. The case was related with setting ablaze of a chick-feed laden truck (MN01-0444) on November 21 morning at Tadubi area along the National Highway-2 (NH-2).On the other hand, Security Forces (SFs) escorted back hundreds of Imphal-bound vehicles on NH-2, NH-102 and NH-37 as the ongoing indefinite economic blockade imposedby the UNC crossed one month, adds The Sangai Express.
