The Union Ministry of Home Affairs proscribed the Assam-based National Democratic Front of Bodoland on November 23, 2002. Following is text of the proscription.
Whereas, the Bodo Security Force since rechristened at National Democratic Front of Bodoland (hereinafter referred to as the NDFB) has as its professed aim, the ‘Liberation’ of Bodoland resulting in bringing about the secession of the said areas from India, in alliance with other armed secessionist organisations of the North East Region and to carry on struggle for the National Liberation of the Indo-Burma region in alliance with like-minded organisations of that region and thereby, the secession of Bodoland from India;
And whereas, the Central Government is of the opinion that the NDFB has –
(i) indulged in various illegal and violent activities intended to disrupt or which disrupt the sovereignty and territorial integrity of India in furtherance of its objective of achieving a separate Bodoland;
(ii) aligned itself with other unlawful associations like the United Liberation Front of Asom (ULFA) and the National Council of Nagaland (NSCN) to create a separate Bodoland;
(iii) in pursuance of its aims and objectives, engaged in several unlawful and violent activities during the period when it had been declared as an unlawful association, thereby undermining the authority of the Government and spreading terror and panic among the people;
And whereas, the Central Government is further of the opinion that the violence activities include–
(i) large scale violent and terrorist incidents including 275 killings attributed to the NDFB during the period form 23.11.2000 to 30.6.2002.
(ii) indulging in extortions of money from businessmen, government officials and other civilians in addition to acts of kidnapping for ransom with a view to finance and execute plans for creation of a separate Bodoland;
(iii) embarking on a systematic drive for recruitment of fresh cadres and revamping the district, anchalik and sakha committees, while continuing its terrorist and insurgency activities;
(iv) publishing clandestine magazines highlighting the goal of the outfit and alleging exploitation by the Central Government and inciting the people to join the so-called liberation struggle thereby subverting their loyalties;
(v) instructing its cadres to compile the list of police informers/Government collaborators to identify targets for retaliatory action against them;
(vi) carnage and ethnic violence resulting in killings, destruction of property and exodus of thousands of non-Bodos inhabiting in Bodo dominated areas in Assam from Bongaigaon and Barpeta districts with a view to spread panic and insecurity among non-Bodos and forcing them to migrate from Bodo areas;
(vii) establishing camps and hideouts across the country’s border to carry out its secessionist activities;
(viii) obtaining assistance from anti-India forces in other countries to procure arms and other assistance in their struggle for creation of a separate Bodoland;
And whereas, the Central Government is also of the opinion that for the reasons aforesaid, the activities of the NDFB are detrimental to the sovereignty and integrity of India and that it is an unlawful association;
Now, therefore, in exercise of the powers conferred by sub-section 91) of Section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) the Central Government hereby declares the National Democratic Front of Bodoland (NDFB) to be in unlawful association;
And whereas, the Central Government is also of the opinion that unless the unlawful activities of the NDFB are kept under control, the organisation may re-group and re-arm itself, make fresh recruitments indulge in violent, terrorist and secessionist activities, collect funds and endanger the lives of innocent citizens and security forces personnel; and therefore, circumstances do exit which render it necessary to declare the NDFB as an unlawful association with immediate effect;
And whereas, the Central Government, having regard to the activities of the NDFB mentioned above and to meet the sustained and ever increasing violence committee by this outfit in the recent past against the police, the armed forces and the civilians, is of the firm opinion that it is necessary to declare the NDFB to be an unlawful association with immediate effect and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of Section 3, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect from the date of its publication in the Official Gazette.
