In his article in The News the Qazi leveled allegations against the present government saying it was seeking the help of US government in the worst bloodshed in Afghanistan. On the other ground for his arrest, the detention order says, provocative speeches by the Qazi, when tensions were running high with India, "will harm national solidarity in the existing delicate situation". Qazi Hussain Ahmad was first placed under house arrest November 3, 2001. The government has since then been extending his detention.

The Federal government has reportedly directed the administrators of more than 1,750 madrassas (seminaries) in the North West Frontier Province (NWFP) to stop admitting Afghan children and elders and other foreigners, failing which they would face closure. News reports have mentioned that the Jamaat-Ulema-e-Islam (JuI-Fazlur Rahman faction) directly controls 75 per cent of the seminaries in which majority of the students are Afghans. There was earlier no restriction on admission of refugees to the seminaries, but in the wake of reported entry of Taliban and Al Qaeda cadres from across the border into Pakistan, the government has imposed a ban on their admissions. Reports submitted to the government warned that madrassa students, who went to Afghanistan for Jehad, might return to become a potential threat to the internal security of the country. The Federal government is also expected to close down all madrassas which had maintained any kind of link with terrorist activities and sectarian violence. According to media reports, there are approximately 300,000 students in these seminaries.

The Punjab government on January 28 arrested Qazi Hussain Ahmad, Chief of Jamaat-e-Islam (JeI) when he arrived at the Lahore Airport after his release from North West Frontier Province (NWFP). "Following the release orders by Supreme Court, Qazi was brought to Islamabad from a Peshawar Hospital in the morning and then sent to Lahore by a PIA flight with two police officers," said a JeI leader. Although media reports have said that officials have not indicated the charges for his arrest, Jamaat sources pointed out that the case was regarding protests during the visit of Indian Premier Atal Behari Vajpayee in February 1999. Earlier, the NWFP government on the same day withdrew the detention order against Qazi Hussain Ahmad and handed him over to the Punjab police after keeping him in custody for more than two months.

According to news reports, a new Jihadi outfit 'Al-Saiqa' has threatened to carry out attacks on the law enforcing agencies in Pakistan. It also declared Pakistan as 'the home of war’. Reports added that the new group attacked a Frontier Constabulary (FC) patrol party with rockets launchers and sub machine guns at Thakot - Batagram in the North West Frontier Province (NWFP) on January 25 resulting in injuries to an unspecified number of personnel. Eight hand-written Urdu pamphlets criticising the Musharraf regime’s policies were recovered from the incident site. They were marked by 'Al-Saiqa' saying, "Stop meddling in the affaris of Deeni Madaris, the religious institutions are the fort of Islam and we are its soldiers…The guerrilla war in Pakistan will continue till the Islamic revolution, now the bullet will not stop, every Muslim should know that initially every guerrilla war is taken in a casual way but it expands gradually…We take prior responsibility of every attack and killings of the law enforcing agency men in Pakistan."
