Minister of Foreign Affairs Pradeep Kumar Gyawali, speaking at an interaction with media persons after his return from the 40th session of the United Nations Human Rights Council (UNHRC) on March 5, said the international community was confident about Nepal’s ability to take the transitional justice (TJ) process to its logical conclusion on its own, reports The Himalayan Times.Gyawali also made it clear that the Government had not felt necessary any external assistance in concluding the home-grown and nationally-led TJ process.“Of course, we need international goodwill, but we are capable of concluding the transitional justice process in our own original way,” Gyawali said. He also reiterated that the Government would consider five factors while taking ahead the TJ process — Comprehensive Peace Accord; Nepal’s national and international obligations related to human rights; decisions and orders of the Supreme Court; sentiments of conflict victims; and the Nepali context. “I have also said in my UNHRC address that there won’t be blanket amnesty in grave human rights violation cases,” Gyawali said.

The District Police arrested three ‘district leaders’ of the Netra Bikram Chand-led Communist Party of Nepal-Maoist-Netra (CPN-Moist-Netra) from Tulsipur in Dang District on March 5, reports The Himalayan Times.The leaders’ arrest comes at a time when the government has launched a crackdown on Chand-led party leaders following the detonation of an Improvised Explosive Device (IED) near the gate of Ncell head office in Nakkhu, Lalitpur, in which one person was killed and two others sustained injuries on February 22.According to the District Police Office, Dang, Chand-led party’s district party office member Pradip Oli, district secretariat member Ishwari Pandey and district party member Rudra Oli have been arrested as part of the investigation following the spike in incidents of forceful donations and violence in the district. The trio were arrested as they were attending a programme organised by the party in Tulsipur to felicitate the family members of martyrs and disappeared in the conflict. Earlier, South Asia Terrorism Portal (SATP) had reported that one person among the three people who were critically injured when an unidentified group detonated a bomb with the intention of blowing off the Ncell mobile tower at Nakkhu, Lalitpur on February 22 night, succumbed to his injuries.

The Kailali District Court, on March 6, handed down a life sentence to 11 people including Resham Lal Chaudhary, a lawmaker from the Rastriya Janata Party-Nepal (RJP-N), in connection with the 2015 Tikapur incident in which nine people were killed in a violent clash, reports The Kathmandu Post.The court also gave three years in jail each to 12 others and sentenced one person to six months in prison. Three have been acquitted. A single bench of District Judge Parashuram Bhattarai passed the judgment after a six-day hearing.Chaudhary was the main accused in the Tikapur (Kailali) incident that erupted on August 17, 2015 after a decision to put Kailali District in one province along with other seven hill Districts. The protest, largely branded the Tharuhat movement, led by Resham Chaudhary in Kailali was part of a larger movement that was going on for months in several Districts along the plains against what they called Kathmandu’s conspiracy to discriminate a large section of population of the Tharus, Madhesis and Janajatis.Around 45 people were killed during August and September in 2015 in the Tarai protests.

In a belated reporting, two weeks after a blast in Nakkhu, Lalitpur, an Improvised Explosive Device (IED) went off in Basundhara in Kathmandu late on March 8, reports The Kathmandu Post.Police said the blast occurred at around 7:40pm at the residence of Rohan Gurung, president of the Nepal Association of Foreign Employment Agencies.“The explosion destroyed a Landcruiser vehicle which was parked on the ground floor of his residence,” said Deputy Inspector General of Police (DIGP), Shailesh Thapa Kshetri. “The exterior of Gurung’s residence and those of their neighbours have also been affected by the explosion,” added Kshetri, the chief of the Metropolitan Police Office.

A team of Nepal Army personnel, on March 10, defused an improvised explosive device planted at Kamal Pokhari of Syuchatar in Nagarjun Municipality-10, reports The Kathmandu Post.According to Deputy Superintendent of Police (DSP), Hobindra Bogati, spokesperson for the Metropolitan Police Range, Kathmandu, locals had informed Police after they saw a suspicious object that looked like a partly buried pressure cooker at around 10am.“The pressure cooker contained explosives. Minister of Law, Justice and Parliamentary Affairs Bhanu Bhakta Dhakal,on March 10, said the two Transitional Justice (TJ) mechanisms would be restructured with institutional representation and participation of conflict victims, reports The Himalayan Times.Through an amendment to the Transitional Justice Act (TJA), the Government has extended the tenure of members of the two commissions till April 13 and tenure of the commissions by one year until February 2020, with provisions for another one-year extension.As per the act, a five-member recommendation committee headed by a former Supreme Court chief justice should be formed to recommend new members of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP). The recommendation will then have to be approved by the Cabinet.Victims have been voicing concerns about a possible vacuum in the commissions after the expiry of the tenure of their members on April 13 given the time-consuming process of the formation of the recommendation committee and recommending members. They also said that such a situation would result in the testimonies ending up in the hands of the bureaucracy, raising the chances of confidentiality of crucial evidences being compromised. The commissions have collected around 65,000 complaints.Minister Dhakal said the Government had begun the process of forming the recommendation committee.“The new commissions will be formed with institutional representation and participation of conflict victims,” he said at an event for the screening of a documentary titled ‘Unrelenting Pain’ organised by the Conflict Victims Common Platform. “The recommendation committee will be formed bearing in mind the victims’ sentiments, and the new commission members will be acceptable to all.”

Provincial Assembly lawmakers of Province 5 have drawn attention of the federal and provincial Governments about the criminal activities carried out by Netra Bikram Chand-led Communist Party of Nepal (CPN-Netra), reports The Kathmandu Post. Speaking at the special hour of the assembly meeting on March 10, Member of Parliament (MP), Dipendra Kumar Pun urged the Government to take steps to stop Chand party’s reign of terror. “People have been terrorised due to their threat. The Government is making preparations to form a five-member committee under the coordination of a former chief justice of the Supreme Court to select office-bearers to the Transitional Justice (TJ) commissions, reports My Republica on March 11. Minister for Law, Justice and Parliamentary Affairs, Bhanu bhakta Dhakal said the committee shall pick new office-bearers to the two TJ commissions constituted to establish the facts and truth of the conflict-time incidents. "The committee will select the persons to be nominated to the two commissions. Twelve years have already elapsed and now there should not be any delay in providing justice to the conflict victims," Minister Dhakal said. The Law Minister said that the committee is being formed in keeping with the constitutional provision of forming a five-member committee under the convenorship of former Chief Justice and comprising the former chair of the National Human Rights Commission (NHRC) or any other person recommended by the Chair and three members from among the conflict survivors.

A powerful cylinder bomb was detonated at the office of Bharatpur Metropolis-5, Torikhet Chitwan District on March 13, reports My Republica. According to Superintendent of Police (SP), Sushil Singh Rathore, also the Chief of District Police Office, Chitwan, the explosion smashed window screens of the ward office and destroyed official documents. The incident took place when there was massive mobilization of Police in the District. Police detained six persons immediately following the incident on charge of their involvement in the explosion. The Transitional Justice (TJ) bodies are likely to be left without any commissioners, at least for a certain period after mid-April, given the Government’s delay in forming a recommendations committee as provisioned by law, reports My Republica on March 16. It is mandatory to form a five-member recommendations committee headed by a former chief justice, in order to appoint members of the TJ bodies. But the Government has not formed the committee so far although less than a month remains for the expiry of existing terms. Former members of the recommendations committee and the conflict victims say the recommendations process may take at least a month even if the committee is formed right away. The appointment process will get prolonged further if the parties fail to agree on the names recommended by the committee. The recommendations committee headed by former chief justice Om Bhakta Shrestha and formed in September 2013 took six months to conduct the consultations process and prepared a roster of prospective candidates. “Once the committee is formed it has to follow certain international norms such as mandatory consultations with the victims, the stakeholders and the political parties. It will surely take at least one or one and half months to complete this process,” said PradipPokharel, a former member of the recommendations committee, “It seems the leadership vacuum at the commissions will remain even if the appointment process is started right away.”

Conflict victims have expressed displeasure over the Government’s decision to form a committee to recommend new members of the two Transitional Justice (TJ) mechanisms without holding any consultations with them, reports The Himalayan Times on March 28. A meeting of the Cabinet last March 25 had decided to form the committee led by former Supreme Court chief justice Om Prakash Mishra, according to a Cabinet source. Tenure of members of Truth and Reconciliation Commission (TRC), and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) expires on April 13. TRC Chairman Surya Kiran Gurung and member Lila UdasiKhanal have already tendered their resignation. However, the victims said the Government once again ignored them while taking such a crucial decision. The victims have long been complaining that the Government does not hold consultations with them while drafting/amending laws or taking crucial decisions related to transitional justice.

The CPN-Maoist-Chand issued a press release stating that it decided to call off the planned strike as Office of the Controller of Examination, Sanothimi, requested it to not create an obstacle in SEE. The outfit added that it was withdrawing its general strike as Nepal Bar Association, which was scheduled to elect its office bearers on March 30, also requested it to call off its protest. Over 475,000 students will take SEE on March 30.
