The first ever meeting of the Provincial Assembly (PA) was held at the headquarters of Province 3 in Hetauda on February 1, reports Kathmandu Post. The event is another move towards implementing the federal structure outlined in the constitution adopted in 2015. The Province 3 assembly will meet next at 3pm on February 10. The session chaired by senior-most member Dormani Poudel appointed Roj Raj Pandey, joint-secretary at the PA secretariat, as the election officer. All the 110 members elected from Sindhuli, Ramechhap, Dolakha, Sindhupalchok, Kavre, Rasuwa, Nuwakot, Dhading, Kathmandu, Bhaktapur, Lalitpur, Chitwan and Makwanpur districts attended the first session in Hetauda.

The meetings were concluded by fixing the dates for the election of speaker and endorsing the interim work procedure-2018 on Provincial Assembly proceeding. The assemblies of Province 2 and 5 have set February 14 as the date for the election of their speakers while the assemblies of Province 6 and 7 have set February 12 as the date for electing their speakers.

The Cabinet on February 5 extended the tenure of two transitional justice mechanisms — the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP) — by one year, reports The Himalayan Times. The two bodies whose tenure ends on February 10 had applied for a one-year extension as provisioned in the ordinance endorsed by President Bidhya Devi Bhandari on January 19. The ordinance adopted on January 19 had provisioned that the Government could extend the tenure of the TRC and the CIEDP by one year if the two mechanisms request for a term extension stating valid reasons for their failure to complete their jobs in the stipulated time. The two bodies had cited human and financial resource crunch, lack of necessary legislation and non-cooperation from political parties and the government as reasons for their failure to complete their tasks on time.

The National Human Rights Commission (NHRC) unveiling a 11-point recommendation concerning transitional justice on February 5 asked the Government to come up with a law criminalizing conflict-era torture and enforced disappearance so as to prevent a situation of conflict-era victims seeking justice through international institutions, reports Republica. NHRC Chairman Anup Raj Sharma urged all the authorities concerned including the Government to amend the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act taking into consideration the Supreme Court's ruling to criminalize torture and disappearance and remove the statute of limitations for registering conflict-era cases and also international human rights law. “If the laws are not amended to ensure justice within the country, the conflict-era victims will be forced to seek justice from beyond the borders. It won't do any good to the country. So, we ask the government to heed our suggestions and move forward in an appropriate way for ensuring transitional justice,” he said.

The EC said that 1,669 votes were cast out of total 1,677 votes, while eight voters remained absent in the election. In the Electoral College established in each province, Chairperson of the Rural Municipality, Vice-Chairperson of the Rural Municipality, Mayor of the Municipality, Deputy Mayor of the Municipality and Members of the Province Assemblies were the voters of the NA.

A left alliance source said the CPN-Maoist Centre was focusing on unification before the formation of a new Government mainly because it believed that unification would be easier if it happened before the formation of a new government. “Once a new government is formed, unification might get complicated,” the source added.

The EC on February 8 said it would submit the final election result to President Bidhya Devi Bhandari by February 14, reports The Himalayan Times. Election Commissioner Narendra Dahal told that the poll panel would announce parliamentary proportional representation election result on February 9 and write formal letters to political parties to recommend names of winners within three days from the closed list they had submitted prior to the election. As per the constitution, the EC has to submit result of the election of the parliamentary election within a week of announcing the final result.

The CIEDP said the new window will be open from February 13 to March 14. The move following requests from conflict victims who failed to file their complaints previously due to various reasons. The victims can also register their complaints at the CIEDP office in Pulchowk, Lalitpur, and at the Local Peace Committees based in 75 Districts. “As our term has now been extended, we decided to open the new complaint registration window as we are still receiving complaints from victims. The EC also submitted a report of the final Lower House elections results both under the first-past-the-post (FPTP) and PR categories to the President. While 110 members were elected under the PR category, 165 under the FPTP system, giving the final shape to the 275-member strong Lower House and paving the way for Government formation.
