A Delhi Court has allowed West Bengal Police to take the custody of four terrorists of the Harkat-ul-Jehadi-e-Islami (HuJI), wanted in connection with the abduction of a businessman and for carrying out other subversive activities in the State. Granting transit remand of the four terrorists, arrested by Delhi Police on January 31 and February 6, the court asked the West Bengal police to produce them before the Sub-Divisional Judicial Magistrtae, 24 Pargana (south), in Kolkata before March 15, 2002. Earlier, the court had issued the production warrant for three Pakistani nationals and a Bangladeshi who were arrested for illegally entering the country to carry out subversive activities. The four terrorists were booked by the Delhi police under the Prevention of Terrorism Ordinance (POTO) and had confessed that they had entered India to carry out subversive activities.

The West Bengal Criminal Investigation Department arrested a terrorist of the Hizb-ul-Mujahideen (HM) from Howrah railway station in Kolkata on March 2 night. Earlier, on the same day, police had arrested two HM terrorists in Kolkata. Official sources said the police also seized a huge quantity of plastic explosives from him. The terrorist, also an active member of the Students for Islamic Movement of India (SIMI) was part of the seven-to-eight-member-strong gang assigned with the task of carrying out subversive activities in and around Kolkata, State police sources said.

One of the arrested terrorists, Haseeb Raza, was also reported to be a founder member of the Students Islamic Movement of India (SIMI). News reports speculated that the two may be linked to the attack on the Sabarmati Express at Godhra in Gujarat on February 28.

Three Bangladeshi intruders were killed by Border Security Force (BSF) personnel at Baraguria village, Uttar Dinajpur district, on March 3. A senior BSF official, while talking to the media, said a group of 10 to 15 intruders had crossed the unfenced border under the cover of darkness. When challenged by the BSF, the intruders, equipped with choppers, iron rods and lethal weapons attacked the BSF personnel who opened six rounds of fire killing three on the spot. The others managed to escape.

A special Terrorist and Disruptive Activities (Prevention) TADA court in Mumbai, on March 4, issued a fresh non-bailable warrant against Abu Salem Abdul Qayoom Ansari alias Abu Salem, the absconding underworld don and an accused in the 1993-Mumbai serial bomb blast case. The warrant was issued on a submission made by the Central Bureau of Investigation (CBI) that efforts made to trace Abu Salem had turned futile. The CBI informed that the warrant issued in 1994 against Abu Salem had already been forwarded to their counterparts in the United Arab Emirates (UAE) but it had not been returned. The court, however, felt that in the interest of justice it was necessary for the CBI to produce Abu Salem before the court and, therefore, it would be fit and proper to issue a fresh non-bailable arrest warrant against him.

According to Gujarat police sources, preliminary investigations into the February 27-massacre on board the Sabarmati Express in Godhra point to the involvement of Pakistan’s external intelligence agency, the Inter Services Intelligence (ISI), and some of the 28 persons arrested in connection with the attack traveled abroad recently. 58 persons were killed in the massacre. Talking to the media in Godhra on March 4, the Deputy Inspector General of Police (DIGP) (Anti-Terrorist cell), Vipul Vijay referred to the possibility of ISI's involvement in the attack but refused to give details. He said the cases of those among the 28 persons who have been travelling abroad will be pursued vigorously without relying only on the local police. "We have certain names who have been travelling abroad. They are very prosperous. They are carrying duplicate papers and we will pursue these cases vigorously", he said. He also said some of the arrested persons have links with the Ahmedababd-based underworld don, Abdul Lateef.

While terrorist activities are unconscionable and should be eradicated forthwith, the challenge is to understand the root cause of those despicable acts and deal with them appropriately". According to media reports, Mumbai Police Commissioner MN Singh, who returned from a 12-day visit to London and New York on February 6, is believed to have gathered corroborative evidence to establish Muhammed Afroze’s links with the Al Qaeda terrorist network. Afroze was arrested by Mumbai police on October 2, 2001. During interrogation he had reportedly told the police that he was part of the pilot’s squad, which was supposed to hijack a London-Manchester flight from Heathrow airport in London on September 11, 2001 and ram it to British Parliament. The plan was, however, called off at the last moment. Police sources said Singh had visited several places in London, including hotels and homes where Afroze reportedly stayed in September last year. He also met the police chiefs of London and Washington, besides interacting with several officers from the Federal Bureau of Investigation (FBI) and the London police. A senior police official said, "Singh’s visit has been a hectic one, but it was successful. He has brought information, which will make the case stronger". Earlier, the Mumbai police had sent a team to Australia to visit places where Afroze had reportedly stayed between August 1997 and December 1998. The officers had returned after conducting a detailed inquiry at the pilot training school where Afroze had enrolled for a course in flying.

Accused by some members of legislating a harsh law to curb basic liberties, the government said that without POTO the war against terrorism would have no meaning. Responding to the criticism of the Bill, Union Law Minister Arun Jetley said an effective law was required to blunt the edge of the terrorist campaign which had claimed more lives than the four full-scale wars the country had fought since Independence. Giving details, he said that while 45,468 lives were lost in the four wars, terrorism in the past 15 years claimed 61,031 lives. He added that 600,000 people had been rendered homeless by terrorism in different parts of the country. The cost of fighting cross border terrorism, according to the Minister, was an estimated Rs. 450 billion. The volume of explosives seized by the security forces from terrorist elements in recent years was 48,000 tonnes. “With that kind of explosives in terrorist hands every inch of India would have been taken care of “, Jetley said, claiming an extraordinary situation requires an extraordinary response. Earlier, moving the Bill for consideration, Union Home Minister LK Advani said the shortcomings of the Terrorist and Disruptive Activities (Prevention) Act TADA had been eliminated in the proposed Bill removing scope for abuse and violation of human rights. He said the government had incorporated all the inputs from the Supreme Court’s judgement of TADA as well as suggestions from the National Human Rights Commission (NHRC) in an effort to minimise potential abuse.

These agencies, which have also been on the trail of Osama bin Laden and the Al-Qaeda network, have found some linkages between Davey, international arms dealers and terrorist outfits, reports said. The US State Department Protective Intelligence division had, while investigating the "Purulia Project", reportedly found that, in order to escape police, Kim Davey had got a plastic surgery done in Hongkong. Later, he reportedly escaped to Sudan and has been working in close nexus with Sudanese Peoples Liberation Army (SPLA). The SPLA is an anti-American, Islamic organisation which has close links with the Al Qaida. Reiterating its support for Nepal’s fight against insurgency, India on March 21 offered ‘ equipment and training’ to Nepal for combating Maoist insurgents. This assurance came during the ongoing visit of Nepalese Prime Minister Sher Bahadur Deuba. While the details of the offer have not been disclosed, official sources indicated that both the countries have agreed for co-operation in intelligence sharing and border surveillance. Both the countries have also agreed to conclude their ongoing negotiations on a revised extradition treaty as also a treaty on mutual legal assistance. The treaties are expected to help India take action against Maoist leaders and sympathisers based in India. India has also reportedly conveyed its concern to Nepal on the activities of Pakistan’s Inter Services Intelligence (ISI) directed against India on Nepalese soil and ISI infiltration into India through Nepal. These concerns were conveyed to Deuba when Union Home Minister L K Advani called on him on March 21. Deuba also met the President, Vice President, Prime Minister, External Affairs Minister, the Commerce Minister and the Defence Minister. The Bill, passed by the Lok Sabha, the Lower House and rejected by the Rajya Sabha, the Upper House, now goes to the President for being signed into law and will replace the Prevention of Terrorism Ordinance (POTO). After this formal approval, it will be called the Prevention of Terrorism Act (POTA). The Act will have a life of three years and provides various strict provisions for preventive detention without bail of suspected terrorists. It also makes confessions to senior police officers as legal evidence in the trial court.

A resolution to this effect was adopted by the IPU at its 107th Conference in Marrakesh (Morocco) on a proposal moved by India in the aftermath of the December 13, 2001 attack on its Parliament and supported by many other nations. "Every state has the duty to refrain from organising, instigating, assisting or participating in terrorist acts in another State, or acquiescing in terrorist activities on its territory," the resolution said. It also stated that terrorist acts could not be justified under any circumstances and drew an explicit link between terrorism and the undermining of democracy and the rule of law.

Earlier, Afroz had been booked under POTO. But on March 26, the prosecution had sought the court’s permission to drop the POTO case against Afroze. Quoting an anonymous press counselor of the Royal Bhutanese Embassy in New Delhi, media reports said, on March 27, the Bhutan King Jigme Singye Wangchuck visited the United Liberation Front of Asom’s (ULFA’s) Phakupang camp twice – on February 15 and 16, in order to, pursue them to vacate the camps in the kingdom. The king reportedly had talks with ULFA chairman Aurobindo Rajkhowa and political advisor B Borgohain on the issue. According to reports, an official reply from Bhutan's director for bilateral affairs Daw Penjo said, "In February this year, His Majesty visited the security affected areas in Samdrup Jongkhar and Sarpang districts." Reports also said the King also verified that the four ULFA camps, as was agreed in June 2001, were closed down. The same was later confirmed by him. However the official denied that the King had attended any feast with the ULFA terrorists. He said ,"feast was a figment of imagination and baseless." However, Indian intelligence sources dispute this statement. His visit was necessitated by the consistent Indian pressure on Bhutan to ask the terrorist outfits, including the National Democratic Front of Bodoland (NDFB) and the Kamtapur Liberation Organisation (KLO) besides ULFA, who maintain training camps in the Kingdom, reports added. The first two have reportedly a combined strength of 2,000 in these camps.

A senior Maharashtra police official, while speaking to the media on March 29 in Jalgaon, said that an activist of the proscribed Students Islamic Movement of India (SIMI) from Bihar had planned to blow up the Howrah bridge in Kolkata, West Bengal. He said, "It was revealed during interrogation that Hasib Raja, one of the prime members of SIMI’s central advisory committee, was working as a brain for the organisation". Raja was arrested on March 18 in Kolkata by a special police squad and half a kilogram of RDX was seized from his possession. It was with this RDX that Raja reportedly planned to blow up the Howrah bridge, but his plan was foiled. Earlier, he had reportedly sent six city youth to Jammu and Kashmir to fight in the name of jehad.

According to the Comptroller and Auditor General (CAG), huge funds earmarked for combating terrorism were found to have been diverted by the Army's Eastern Command authorities to purchase vehicles, television sets, video cassette recorders, computers and generators. The CAG report says that the Eastern Command purchased consumer goods worth Rs 6.79 crore over a period of three years from 1998 to 2001 from the Rs 10 crore annual fund given to Army commanders by way of special financial powers. "These funds are allocated to meet urgent and immediate requirements of counter-insurgency operations and internal security duties," the CAG observed as it indicted the Army for diverting the funds to purchase consumer goods saying these should have been purchased under normal over-heads. Commenting that these funds were meant to acquire cutting edge weaponry for the counter insurgency forces, the CAG said even in such purchases, the command had procured stores worth over Rs 3.12 crore which were found to be sub-standard and defective. "Procurement of substandard items has failed to provide proper security cover to troops engaged in counter-insurgency operations," the report said.

A city court in Jalgaon on March 30 remanded to police custody an activist of the proscribed Students Islamic Movement of India (SIMI), Hasib Raja, who had allegedly planned to blow up the Howrah bridge in Kolkata, West Bengal. According to police sources, Raja, who was arrested in Kolkata on March 17 and brought to Jalgaon was earlier remanded to police custody till March 30 by a local court. During interrogation, he reportedly disclosed that he was one of the prime members of SIMI’s central advisory committee.
