A Special Committee appointed by the Bar Association of Sri Lanka (BASL) to study the proposed 20th Amendment to the Constitution in its report said that certain provisions in 20th Amendment inimical to rule of law, reports The Island on October 3. The committee appointed on September 14, consisted of LMK Arulanandan PC (chairman), MM Zuhair PC, Prasantha Lal De Alwis PC, Nihal Jayawardene PC, Nalin Ladduwahetty PC, Maithri Wickremesinghe PC, Uditha Egalahewa PC, Mohan Weerakoon PC, ST Jayatunga PC, Priyal Wijeweera PC, Maurapada Gunawansha PC, Jagath Wickramanayaka PC and Shantha Jayawardana (Convenor). The committee has observed that the President being the repository of substantial powers under the Constitution should be held accountable for the exercise of those powers in accordance with the Constitution. Referring to the Clause 5 of the Bill about the imunity of the President, the BASL committee says no person is above the law and granting absolute immunity from suit contrary to all known principles of the rule of law.

The apex court announced that the confidential decision of the Court regarding the constitutionality of the Bill will be conveyed to the President and the Speaker of Parliament in due course. The petitions were heard for four days before a five-judge bench comprising Chief Justice Jayantha Jayasuriya, justices Buwaneka Aluvihare, Sisira de Abrew, Priyantha Jayawardena and Vijith Malalgoda.

Testifying before the Commission through video conference, former Army Commander said that he came to know about Zahran when he was serving as the Commander in Jaffna. “When I was in Jaffna DMI informed me about Zahran Hashim. That was why I'm saying the Military Intelligence had the capacity to find more details regarding to NTJ and its leader. 100 Members of Parliament (MPs) of Sri Lanka Podujana Peramuna (SLPP) on October 9 handed over letters to President Gotabaya Rajapaksa and Prime Minister Mahinda Rajapaksa calling for an investigation into the release of Riyaj Bathiudeen, reports Daily Mirror. In the letter, the MPs said Riyaj, the brother of MP Rishad Bathiudeen, was arrested in connection with the Easter Sunday attacks and he has been released by the Criminal Investigation Department (CID) in an arbitrary manner. The MPs said there is strong evidence against Riyaj though he was released by the CID on September 30 without even being produced in the courts. The MPs called for an investigation into the release of Riyaj and to re-arrest him. Riyaj Bathiudeen was arrested by the CID on April 14 on charges of aiding and abetting the terrorists involved in the Easter Sunday attacks.

The Sri Lanka Amarapura-Ramanna Samagari Maha Sangha Council on October 12 urged the Government not to pass the 20th Amendment to the Constitution as it has been established that it is a legal norm that seriously hinders the freedom and activism of human thought and returns to an undeveloped tribal society, reports Colombo Page. “The proposed 20th Amendment rejects the core of democracy, which is one of the progressive elements of humanity, hence it should not be enacted. A new constitution that protects the democracy and rule of law should be drafted,” the Sangha council in a statement. The General Registrars of the two sects informed their decision claiming that the proposed Amendment has many shortcomings.

A Sub Inspector (SI), attached to the Police Terrorism Investigation Division, told the Presidential Commission to Inquiry (PCoI), on October 16 said that Zahran Hashim and his group had planned to launch an attack using 20 suicide bombers, reports Daily News. Testifying further he said that investigations have revealed that the proposal of launching an attack using 20 suicide bombers was made during a discussion held on March 27, 2019, at a house in Sarikkammulla area in Panadura. Seven persons, including Zahran Hashim, was present during the discussion. He further said that the investigations also revealed that it had been suggested that the attacks should be carried out within 15 days from March 27, 2019, as the bombs assembled by Zahrans’s brother Rilwan were to expire during that period.

The Special Experts Committee to Draft a New Constitution headed by President’s Counsel Romesh de Silva has been allocated offices in the BMICH, and three senior officers of the Ministry of Justice have been appointed to the Secretariat of the Committee. Sittings of the committee have already commenced with meetings being held every Friday. Two formal weekly meetings have already been held. Cabinet approval has been granted to bring amendments to include the limit of Cabinet introduced in the 19th Amendment as it is in the 20th Amendment as well; to maintain the National Audit Act in the same manner and to table the emergency draft bills in Parliament and 14 days after including in the Order Paper. Supreme Court on October 20 decided that four clauses of the proposed 20th Amendment to the Constitution need a public referendum to be approved as they are against the people’s sovereignty, reports Colombo Page. Speaker Mahinda Yapa Abeywardena announcing the determination of the Supreme Court on the Bill entitled Twentieth Amendment to the Constitution said the Apex Court has determined that the Bill was consistent with the Provisions of Article 82(1) of the Constitution and requires a special majority to be passed as specified in Article 82(5) of the Constitution. The Supreme Court had however ruled that Clauses 3,5,14 and 22 in the amendment in their present form are inconsistent with Article 3 read with Article 4 of the Constitution and require a public referendum.

Commenting on the appeal on the Liberation Tigers of Tamil Eelam (LTTE) proscription in UK, in a statement issued by the Foreign Ministry of Sri Lanka on October 22 said that it has sufficient evidence to prove that the remnants of the LTTE and groups aligned with its terrorist ideology are active in foreign countries, working to incite violence and destabilise the country, reports Daily Mirror. The statement said Sri Lanka has been made aware of the Open Judgement by the Proscribed Organisations Appeals Commission (POAC) of the United Kingdom dated October 21, 2020. “The decision of the POAC arises from an appeal filed in May 2019 by an LTTE front organisation challenging the decision of the UK Secretary of State for Home Affairs dated March 8, 2019, which refused the application by the group to de-proscribe the LTTE from the list of Proscribed Organisations under the UK Terrorism Act of 2000. While the Government of Sri Lanka was not a party to these proceedings at the POAC and could not make direct representations, the Government has assisted the Government of the United Kingdom by providing relevant information with regard to continued terrorist activities. The Open Judgement of the POAC while allowing the Appeal, provides for further hearings, and the Government of Sri Lanka will continue to closely monitor the progress of the case in the UK,” it said.

The General Secretary of SJB Ranjith Madduma Bandara said in a Twitter post “The SJB has decided to expel from our parliamentary group members who voted in favor of the 20th Amendment, despite the party’s stand against it, effective immediately. The Speaker signed the blueprint of the constitutional amendment at around 11.30 am. Thereby the 20th amendment to the constitution will be implemented in full from October 29. On October 22, the Parliament approved the second reading of the Bill with 156 in favour and 65 against. Subsequent to the Committee Stage, the third reading was passed with a majority of two-thirds after having taken a division, 156 in favour and 65 against with 01 absent.
