Government Defence Affairs spokesperson Minister Keheliya Rambukwella stated on October 1 that the Government was seriously considering an alternative land route for civilian movement to Jaffna since there is no possibility of re-opening the A-9 road under present conditions. He said the Government, for two reasons, has not given consent for the opening of the A-9 road from Omanthai and Muhamalai despite repeated requests by the LTTE through the Norwegian facilitators and the Sri Lanka Monitoring Mission. "First, we are concerned about the safety of the civilians due to crossfire between the Security Forces and the LTTE in Muhamalai. Second, the Government is also concerned about the extortion by the LTTE of people using the A-9 road at Muhamalai and Omanthai entry exit points," he added. He emphasized that any decision to open the A-9 road will be based on providing a security guarantee for the civilians using the A-9 road and the immediate termination of LTTE extortion of the road users, adding, "Due to this reason the Government is seriously considering opening a new land route via Mannar - Sanguppidy road to facilitate the free flow of goods and other essential items to Jaffna and Kilinochchi."

Because of lack of leadership, poor cadres are becoming easy victims. With my departure, Prabhakaran is facing serious drawbacks. He has lost good calibre recruits and committed leadership which had obtained major victories for the LTTE. The failure was due to lack of leadership," Karuna maintained. He warned, "The wounded Tiger is a dangerous Tiger, holding its paws tight to pounce at the right time. LTTE is desperate. In desperation, they will do desperate things." On the form of settlement he wanted, he said: "We are not for a separate state of Eelam. We are for a united Sri Lanka under a federal constitution. We need a clearly defined constitution which recognizes the North and East. It should provide extensive devolved powers to the Tamils to run an administration of their own."

The Secretariat for Co-coordinating the Peace Process (SCOPP) in a statement released on October 5 said, "The Government of Sri Lanka, having considered the message conveyed to it by the Norwegian facilitator that the LTTE is agreeable to resume talks, has accommodated the suggestion to hold talks on October 28 and 29 in Switzerland," adding, that it informed the facilitators that consistent with its repeated commitment made at the highest levels of its willingness to engage in discussions to resolve the conflict, it proposes to engage in a discussion of substantive issues with the LTTE with a view to obtaining a permanent solution. The SCOPP has repeatedly and sincerely requested the LTTE to return to the negotiations and the LTTE has consistently refused to do so without giving reason and “Instead, the LTTE, in the course of a campaign of violence lasting months, has committed blatant violations of its own commitments,” the statement added further. The SCOPP also indicated to the Norwegian facilitators that “if at any time the LTTE undertook actions of an offensive and provocative nature, the government reserves the right to take countermeasures in the interests of national security.”

According to reports, these SLA personnel went missing during the continued clashes between security forces (SFs) and the LTTE in the Batticaloa district which erupted on October 6 when the outfit cadres launched a heavy ground attack using artillery, mortar and small arms on Army detachment at Mankerni and Kajuwatta. As reported earlier, 60 LTTE cadres, including child soldiers, and two soldiers were killed in the fighting. An unspecified number of LTTE cadres and 15 soldiers were injured. Meanwhile, the ICRC stated that the LTTE informed them that 14 dead bodies of ‘Colonel’ Karuna cadres were in their possession. Denying allegations by LTTE political head S.P. The Defence Ministry said, "Troops are consolidating their positions after fierce gun battles that lasted for over five hours. Intermittent fighting however still rages on. Ground troops confirmed that a large number of terrorist dead bodies were also found scattered around their forward defence lines. Troops were compelled to launch those defensive measures as a result of the increased bout of LTTE violence against members of the Security Forces, disrupting the regular opening of the A-9 Highway." The toll is likely to increase as several of the injured are reportedly in a serious condition. The massacre occurred at the entry point to east and Trincomalee district. The Defence Ministry said LTTE terrorists rammed into the naval convoy at Digampatana in Habarana around 1.30 p.m (SLT). The military said, "A huge explosion has occurred causing severe destruction to both naval personnel and the civilians in the area." The convoy comprising 24 buses was at the Digampatana rendezvous point when the attack occurred. The Ministry said over 340 unarmed naval personnel were believed to be present at the location. Naval sources said 13 buses had been damaged. In a statement, a spokesperson for the Secretariat of President Mahinda Rajapakse said the incident was yet another example of the LTTE's cowardly use of extreme violence against unarmed services personnel. "The suicide truck attack at Habarana was in a civilian area away from the area of armed confrontation. This was further proof of the LTTE's unmitigated commitment to violence to achieve its ends and was in total disregard of international demands for it to abandon violence and seek peaceful means to achieve its goals," he said.

A five-member Bench of the court, headed by Chief Justice Sarath N. Silva, gave the ruling on a petition filed by three Janatha Vimukthi Peramuna members, according to The Hindu. It said the President had no powers to effect a merger of provinces under Emergency Regulation, and only Parliament could decide on the subject. The court referred to the two conditions laid by the 1987 India-Sri Lanka Accord before considering merger — cessation of hostilities and laying down of arms by militant groups. It said the President went ahead with the merger, though the conditions were not met with after the Liberation Tigers of Tamil Eelam (LTTE) violated cease-fire. The judges, invoking "equal protection of law," said unlike the other seven provinces in the island nation, voters of the merged provinces had been deprived of their right to vote for the Provincial Council. There had been no election to a council in the northeast since 1988. The court said material provided by the petitioners resulted in "volumes of material to establish the divisions that existed in historic times and that the eastern province was part of the Kandyan Kingdom at the time of British conquest." At a press conference after the talks, Sri Lanka's chief negotiator, Health Minister Nimal Siripala de Silva, regretted that the LTTE has made the talks contingent upon a condition while agreeing for unconditional talks, adding, "The Government has not given up hope." Prabhakaran, would spell out the outfit’s next course of strategy in his annual speech due on November 25. He said that the LTTE delegation cancelled its planned visit to Norway and Iceland and will return to Sri Lanka soon, adding, “Our people are anxious to know firsthand from us what happened in Geneva.” He added, “Whether there will be war or peace in Sri Lanka now is in the hands of the Sri Lankan government, but the Tigers were fully prepared to meet "any eventuality." Prasad Samarasinghe said that the Navy spotted a suspicious boat near the Talaimannar seas and when it defied an order to stop, the Navy fired and destroyed the boat.
