Vinayagamoorthy Muralitharan alias Karuna Amman, who was Special Commander of the LTTE in Batticaloa and Ampara Districts, said that the rift between him and LTTE leader Velupillai Prabhakaran took place in December 2002 when the LTTE chief accused him of "betrayal" of the kind Mahendrarajah alias Mahattaya was accused of in the early 1990s, reports Daily News on November 2. Mahattaya was later executed. Prabhakaran was livid with Karuna for persuading his chief negotiator, Anton Balasingham, to sign the December 5, 2002 "Oslo Declaration" which had committed the LTTE to "exploring the possibility of finding a political solution based on a federal structure within a united Sri Lanka." Defending his action, Karuna said that he supported the signing of the Declaration only to "save the Liberation Tigers of Tamil Eelam from isolation" by the international community which had become hostile to armed movements following the September 11, 2001, terrorist attack in New York.

Anandasangaree, the leader of Tamil United Liberation Front (TULF) appealed to President Maithripala Sirisena for the immediate release of over 200 Tamils, who have been detained in the country's jails since the end of the war in 2009, reports Colombo Page on November 3. The TULF leader in a letter addressed to the President said media reports have said that 90 percent of the detainees have admitted their guilt. He said his "frank opinion" is that all of them should be unconditionally released because the entire Tamil community is of the understanding that this is a part of the deal the Tamil National Alliance (TNA) had with the Government. "The entire Tamil community will get disappointed if they are not released," Anandasangaree said.

21 Liberation Tigers of Tamil Eelam (LTTE) suspects detained in prisons under the Prevention of Terrorism Act (PTA) on November 4 have requested the courts to release them without rehabilitation, reports, Colombo Page. When 23 LTTE suspects, who are in remand custody on alleged involvement in LTTE terrorist activities, were produced in the Colombo Magistrate’s Court, it was revealed that only two of them were willing to undergo rehabilitation. The other suspects have said that they oppose the rehabilitation and demanded the court to release them. They said they will resume the death unto fast if they were not released.

Amnesty International (AI) on November 8 called on the Government to fully cooperate with the United Nations Working Group on Enforced and Involuntary Disappearances (UNWGEID), which will be arriving in Sri Lanka on November 9 for its first visit to the island in 15 years, reports Colombo Page. The UN Working Group will undertake an official visit to Sri Lanka from 9 to 18 November 2015, at the invitation of the Sri Lankan Government. Issuing a statement, the AI said "It should acknowledge the significant challenges to accountability that persist in Sri Lanka and clearly articulate its own limitations as well. The Government of Sri Lanka should facilitate these exchanges and direct all officials to cooperate fully with the delegates."

31 former Liberation Tigers of Tamil Eelam (LTTE) combatants who were released on bail on November 11 were taken back to the prison after no one posted their bail, reports Colombo Page. After receiving directions from the Attorney Generals Department, the courts granted bail to the 31 suspects detained under the Prevention of Terrorism Act (PTA). The Colombo Chief Magistrate's Court released the suspects on two surety bails of SLR 1 million each. The 31 suspects were handed back to the prison officials as their bail applications were not signed. Earlier, the Tamil prisoners, who temporarily suspended the hunger strike launched in jails across Sri Lanka in October demanding their immediate release, have resumed the strike after the Government did not release them as promised, reports Colombo Page on November 10. Some 200 Tamil prisoners including former LTTE combatants at the main prison in Colombo on went on a hunger strike demanding the Government to immediately release them. They suspended their fast after the President Maithripala Sirisena promised to release the former LTTE cadres imprisoned for minor offenses before November 7 and expedite the others' cases. However, the release did not take place as expected.

He said “As a leader of the Tamil Progressive Alliance (TPA), I will not be happy till all the 217 are pardoned and released. But we have to move step by step taking into account the strength of those forces in the country which are aligned with Mahinda Rajapaksa and which are using the prisoner release issue to tarnish the image of the Sirisena government. It is hoped that the proposal to release the detainees after rehabilitation will be accepted by all, just as the release of 12,000 LTTE cadres by the Rajapaksa government was.”

President Maithripala Sirisena at a special discussion held at the Presidential Secretariat on November 11 said that the Government gives priority to the resettlement process for the displaced persons in the North and the East and stressed the need to provide solutions to the matters regarding the resettlement, reports Colombo Page. The President meeting with the relevant Ministers and Government officials gave instructions to schedule the meeting of Resettlement Committee comprising the Governors of Northern and Eastern provinces, within the next two weeks to look into matters pertaining to each area. The President further instructed the relevant persons to not only depend on reports of Divisional Secretaries but to discuss matters relating to divisional levels and suggest proposals at the National Committee headed by the Resettlement Minister and to submit a proposal for solutions to him.

The United Nations Working Group on Enforced or Involuntary Disappearances (UNWGEID), which is on a mission to Sri Lanka, has commenced a visit to Mannar District in the Northern Province to probe the disappearances during the war, reports Colombo Pageon November 12. The five-member Committee has met with the families of the missing and disappeared in Mannar and the surrounding area during the war. The Committee has also inspected the mass grave at Thiruketheeswaran in Mannar where skeletal remains of 81 people were unearthed during excavation. The Committee is scheduled to tour Kilinochchi and Jaffna Districts in the next few days.

They are a section of the 31 ex-LTTE detainees, who were earlier released on strict bail conditions by the Colombo Magistrate’s Court on November 11 but had to return to prison because they were unable to provide sureties as specified by Court.

Northern Province staged a complete shutdown on November 13 to protest the Government's failure to release the Tamil prisoners detained under the Prevention of Terrorism Act (PTA), reports Colombo Page. Shops and businesses in Jaffna and Vavuniya Districts remained closed in support of the detainees who have been on a hunger strike demanding their release. The streets remained deserted in the busy Jaffna town while the public transport was at a standstill. Schools in the Tamil dominated Jaffna town were also closed while banks and all public institutions were shut down in support of the protest.

The Government is planning to replace the Prevention of Terrorism Act (PTA) with fresh legislation modeled on the Patriot Act of the United States, reports Daily Mirror on November 16. The PTA was used as a legal tool to deal with Liberation Tigers of Tamil Eelam (LTTE) terrorism at that time. However, there were criticisms by some sections over the retaining of the Act even after the war was over. Critics have dubbed it ‘a draconian piece of legislation’ that undermines individual freedom in the post war context. Accordingly, the Foreign Affairs Ministry, the Justice Ministry and the Legal Draftsman’s Department are working in this direction at the moment.

Colombo Additional Magistrate Aruni Attygalle ordered to release the suspects on two sureties of SLR one million each. The court ordered the released prisoners to confirm their permanent addresses and to inform the court if there was any change in their permanent addresses. The United Nations Working Group on Enforced or Involuntary Disappearances (UNWGEID) concluding its visit to Sri Lanka on November 18 said that they found an ‘unofficial’ detention centre operating within the confines of a Navy camp in Trincomalee District where detainees had been held for prolonged periods and likely tortured, reports Daily Mirror. Underground cells where victims were interrogated and cell walls with dates engraved by distressed detainees were among the unnerving images that met the independent experts of the UNWGEID when they visited the secret detention centre, accompanied by some Criminal Investigation Department (CID) officials as part of their ten-day mission. The independent experts said there were 12 cells in the sector of the detention facility that they visited, the interiors of which indicated that the detainees were probably held in the locations for prolonged periods. Meanwhile, UNWGEID on November 18 said that the Government needs to make sufficient efforts now to address the enforced disappearances and provide justice to the victims, reports Colombo Page. The Group "The chronic pattern of impunity still exists in cases of enforced disappearance and sufficient efforts now need to be made to determine the fate or whereabouts of persons who have disappeared, to punish those responsible and to guarantee the right to the truth and reparation. The Government will need to adopt bold steps to reach out to and create confidence in the victims."

Media Minister Gayantha Karunathilaka on November 19 said that the Government will launch special projects to improve the living conditions of the people in the war-ravaged Northern Province, mainly in the islets off the Jaffna peninsula, reports Colombo Page. The Minister said the cabinet of ministers has granted approval to a proposal submitted to the cabinet by Minister of Rehabilitation and Resettlement D.M. Swaminathan to implement 10 projects to upgrade the living status of these communities. There are more than 15 islands including Delft, Pungudutivu, Nainativu, Analaitivu and Mandaitivu around the Jaffna peninsula in the Northern Province. People are residing in six of these islands and 15,000 families in total live in these islands. They have to spend lot of money and time for travelling to the mainland due to the existing inefficient transportation, which is mainly by boats. The proposed projects include upgrading the transport system in these areas for families to travel from the islands to the mainland.

The previous government on March 21, 2014, listed 16 organizations and 424 individuals under the UN Act No: 45 of 1968. The Extraordinary Gazette notification issued by the Secretary to the Defense Ministry replaces the previous notification and bans eight organizations and 155 individuals. Swaminathan on November 20 said that the Attorney General's Department will complete formalities to release 20 more Tamil prisoners detained under the Prevention of Terrorism Act (PTA), reports Colombo Page. The decision to release another 20 suspects was taken following the talks held on November 20 between the Minister of Prison Reforms and the Attorney General. The 20 suspects will be sent to the Rehabilitation Centre Poonthottam Vavuniya at the Bureau of the Commissioner General of Rehabilitation for one year to undergo rehabilitation and receive vocational training. The first six months of the program would involve psychosocial training, followed by a vocational course to help the rehabilitated persons fend for themselves and lead normal lives.

Even the funeral of 18-year-old Rajeswaran Senthooran who apparently committed suicide demanding an independent Eelam and the rehabilitation and release of detained LTTE suspects was peaceful. It was not a huge public affair as such funerals have been a few years ago. Neither Northern Province Chief Minister C V Wigneswaran nor Tamil National Alliance (TNA) leaders issued any condolence statement. However, the Chief Minister said he didn’t think Colombo would change its unsympathetic stance on the prisoner release issue after Senthooran’s suicide. There was no overt military or police presence in Jaffna, including in the sensitive university area, to prevent people from mourning the death, report said.
