The Court made this statement when it examined a petition filed by the Tamil Democratic Party requesting the Court to issue an interim order to postpone the elections. The petitioning political party’s nomination for the Trincomalee district had been rejected and the party states that the decision was illegal. However, the Election Commissioner protesting the petitioners request said the election should not be postponed at this stage as the postal voting has already been completed. The election is scheduled to be held on May 10.

The Liberation Tigers of Tamil Eelam (LTTE) continued to finance itself with contributions from the Tamil Diaspora in North America, Europe, and Australia, by imposing local "taxes" on businesses operating in the areas it dominates and reportedly by extortion operations in the Government-controlled areas, the US State Department said on May 1, according to Daily News. The Department's just-released Country Report on Terrorism 2007 said the LTTE also used Tamil charitable organizations as fronts for its fundraising. After a period of targeting Sri Lankan military and official personnel throughout 2007, the LTTE appears to have recently resumed its targeting of civilians, the report noted. It said the Government took effective control of the Eastern Province in midyear, but the LTTE continued to control much of the north and carried out attacks throughout the country. The Sri Lankan Army remained deployed across the country in all areas it controlled to fight the insurgency. The Special Task Force police were deployed both in the East and in strategic locations in the West. In general, the LTTE did not intentionally target US citizens or assets, limiting attacks to Sri Lankan security forces, political figures, civilians, and businesses. However, attacks occurred within the vicinity of the US embassy and personnel; the US Ambassador was travelling in a helicopter that came under mortar fire in February. The LTTE subsequently apologized for the incident, the report added. It recalled that Sri Lankan cooperation with the FBI resulted in arrests of persons charged with material support to terrorist groups.

A Royal Canadian Mountain Police (RCMP) affidavit, made public on May 2 by the Federal Court, has revealed the Canadian operations of the LTTE, according to Daily News. "Inside the school auditorium, the Liberation Tigers of Tamil Eelam (LTTE) flag had been raised in a solemn ceremony and the audience of 600 people had heard a taped address from the outfit’s leader, Velupillai Prabhakaran. Then an undercover RCMP officer watched as "a Caucasian male" approached the podium. The male praised [Foreign Affairs Minister] Maxime Bernier and spoke about the position of the government, which is to favour the non-violence, diplomatic solutions to the conflict, etc.," said the affidavit. The school auditorium address was reportedly typical of the LTTE strategy of using everyone from Canadian political figures to ordinary Tamils visiting family in Sri Lanka to advance their cause. An LTTE operations manual seized by the RCMP in 2006 and made public for the first time in court documents unsealed on May 2, reveals that foreign politicians are central to the group’s propaganda battle. Police uncovered the operations manual in a 2006 raid on World Tamil Movement’s (WTM) properties. Dated April 1, the affidavit supported a federal application to seize the WTM, Montreal headquarters as well as its bank accounts, saying the assets were being used to finance terrorism. The affidavit describes the WTM as a "foreign branch" of the LTTE.

It said that intense use of heavy artillery shells by the LTTE in the north-eastern Welioya, northern Wanni and Jaffna fronts has raised fresh concerns about the outfit’s ability to replenish their dwindling armoury regularly. "They (intelligence reports) paint a gloomy picture, revealing that the LTTE had unloaded three shiploads of arms during the months of February and March," it said. Quoting a recent report filed by the Directorate of Military Intelligence (DMI) and presented to the National Security Council, the media report said a shipload of arms was smuggled to Wanni on March 12. Another report by the State Intelligence Services (SIS) stated that two vessels had been unloaded by the LTTE during Feb 16-17. These consignments were transferred to trawlers from ships anchored in the deep seas and unloaded in Chalai, Mullaitivu and Veththilaikerny on the north-eastern coast, the report added. According to the media report, the recent developments in the battlefront appear to substantiate the findings of these two reports with the significant increase in artillery and mortar attacks by the LTTE being observed during recent battles, including the one that left over 200 combatants killed and nearly 1000 wounded on both sides in Muhamalai in the northern Jaffna Peninsula April 23.

Wiltshire Police sources said that Shanthan was arrested by the anti-terrorist units of the metropolitan Police together with Wiltshire Police at Swindon in the Wiltshire Constabulary on May 6 in a pre-dawn raid. He was re-arrested after three more people were detained for questioning on April 29. Shanthan was earlier arrested on June 28, 2007, before being released on bail on November 22, 2007. Shanthan was alleged to have been operating with Anton Balasingham very closely to build up the outfit in London. National Post reports that the Royal Canadian Mountain Police (RCMP) counterterrorism investigators in Toronto have seized a letter signed by the LTTE chief Velupillai Prabhakaran directing Canadian Tamils to send him Canadian $3-million, according to police files released on May 6 by the Federal Court. The letter, found during a search of the Toronto office of the World Tamil Movement, discusses the need to "intensify the struggle" and ensure that Tamils are "strong enough" to fight "with our full breath," according to the newly unsealed files. On May 6, the Crown prosecutors handed defence lawyers hundreds of pages of documents and photos outlining the results of an RCMP investigation into alleged LTTE fundraising around Toronto. Included among the papers was a letter seized from the Toronto office of the World Tamil Movement. The letter, on the LTTE letterhead and signed by V. Manivannan, who heads the group's International Secretariat, is a thank-you latter for earlier donations which says the donations were "invaluable in retaining our military strength." "Every cent you gathered by going house to house enabled us [to] defeat the enemy in the battlefield, and we look up on you with gratitude," says the letter. The two-page letter goes on to ask for more funds, saying "the time has come to rebuild our armed forces." It is dated Sept. 19, 2004, when a now-collapsed cease-fire between the outfit and the Sri Lankan Government was still in effect. "We have to rebuild the strength of our Liberation Movement. The four were arrested under anti-terrorism laws and are accused of owning computers, radio equipment and high-power magnets for terrorist purposes, AFP reported from London. The men were arrested under the Terrorism Act 2000 in the last two weeks as part of a long-term police investigation into activities linked to the LTTE. Three were detained at the end of April 2008 in raids at homes and business addresses in Wales and London. A fourth was arrested this week in the Swindon area of southwest England. All the four have been charged with conspiring to receive equipment for terrorist purposes between January 2003 and December 2006. Other items which they are accused of procuring include laptops, head torches, circuit boards, lithium coin cell batteries, GPS (global positioning systems) and antenna equipment, transceivers, radios and navigation systems. The four men were identified as Arunachalam Chrishanthakumar alias AC Shanthan, 51; Jegatheswaran Muraleetharan alias Muralee Tharan, 46; Jeyatheswaran Vythyatharan alias Vithy Tharan, 39; and Murugesu Jegatheeswaran alias M Jegan, 33. He now remains under immigration detention powers, a British High Commission statement said. "We are deeply concerned that Karuna and his faction have allegedly been responsible for murder and abductions and are still believed to be involved in intimidation and child recruitment. The Crown Prosecution Service has advised the Metropolitan Police Service that there is insufficient evidence to provide a realistic prospect of conviction for any criminal offences in the UK," the High Commission stated. Karuna Amman, who was in prison in UK on immigration charges, has been transferred to an immigration detention centre, adds Colombo Page. He was arrested on November 2, 2007, entering Britain with a forged diplomatic passport. He had served half of his nine-month sentence after being found guilty of identity fraud.

The United People's Freedom Alliance (UPFA) won the first ever Provincial Council Election in the East, securing 20 (18+02 bonus seats) out of 37 seats on offer, while polling 52.21 per cent of the total votes, Daily News reported. The United National Party (UNP) which obtained 42.38 per cent of the total valid votes got 15 seats while the Janatha Vimukthi Peramuna and the Tamil Democratic National Alliance secured one seat each. The UPFA won two out of the three districts, - Batticaloa and Ampara while the Trincomalee district was won by the UNP. A total number of 591,676 (65.78 per cent) voters exercised their franchise out of a total of 982,721. However, the number of rejected votes was quite high with 54,780 (8.47 per cent) getting annulled. Out of 10 polling divisions in the East, the UPFA won in seven (Batticaloa, Kalkudah, Pandirippu, Ampara, Sammanthurai, Pothuvil and Seruwila while the UNP won three (Muttur, Trincomalee and Kalmunai). In the Batticaloa district, the UPFA secured six of the 11 seats available, with a lead of 46,739 votes over its closest rival the UNP (58,602), which got four seats while the TDNA won one seat polling 7,714 votes. In Batticaloa, all three polling divisions were won by the UPFA, namely Batticaloa, Kalkudah and Pandirippu, where the total voter turnout was 61.17 per cent. The UNP (70,858) defeated the UPFA (59,298) in the Trincomalee district where it won five seats against the four won by the latter. The JVP which polled 4,266 secured one seat. In Ampara, the UPFA won with a majority of 22,975 votes securing eight seats while the UNP got six. The UPFA also won three out of the four polling divisions with the UNP winning in Kalmunai.

Maheshwari, a consultant to the EPDP leader and Social Welfare Minister Douglas Devananda, was visiting her ailing mother. "Ms. Maheshwari had gone to Jaffna along with some relatives to see her mother. As per our information, three men in military uniform came to the house and wanted to search the house. President Mahinda Rajapakse on May 13 said that his Government was ready for talks with the Liberation Tigers of Tamil Eelam (LTTE), provided the latter is ready to give up arms and demonstrate "genuine intent" to evolve a political solution, reports The Hindu. Speaking at the Oxford Union, Rajapakse referred to the recently-concluded elections for the Eastern Provincial Council and said though many observers said the LTTE was invincible, the Government had freed the province from "terror". "As our forces seek to defeat and disarm the LTTE, we are firm in our resolve to have a negotiated solution to the crisis. I do not believe in a military solution. We have attempted talks with the LTTE on several occasions — thrice since my election as the President — but they have not reciprocated. They have always left the talks with lame excuses. We are still ready to talk, once we are certain of their genuine intent for a political solution and their readiness to give up arms," the President added.

In an interview with Daily News, the Sri Lanka Freedom Party Assistant Secretary Minister Dullas Alahapperuma said there was no change in their earlier stance that the party which obtains the highest number of seats will be entitled to nominate the Chief Minister. "According to the final result of the election, the Tamil Makkal Viduthalai Puligal (TMVP) has emerged with the highest number of seats…," Alahapperuma stated, adding, that the important question one should consider was what made it possible for the Government to hold elections and establish democracy in the East. Karuna has reportedly been released from a British prison after serving a three month jail sentence for breaching immigration laws while entering the country. He has now been transferred to an immigration detention centre. Sources said that Karuna will move to another country by applying for political asylum, as soon as he is deported from Britain, instead of returning to Sri Lanka.

In an interview to Lankapuvath, he said that the TMVP had identified the LTTE as a terrorist organisation and would never get involved with the outfit’s brutal terrorist activities. He said that some media organisations had wrongly branded them as LTTE supporters. Daily Mirror reports that Pillayan has denied his involvement in the 1998 LTTE attack on the Dalada Maligawa and expressed disappointment over growing criticism of his visit to the temple and calls for him to apologise for the attack. "I am disappointed that some sections see this as some sort of political gimmick. I am visiting all religious institutions purely to strengthen ties between the communities. This should be welcomed instead of being criticised," Azad Maulana quoted Pillayan as saying. Pillayan said the intelligence unit of the LTTE masterminded the operation and that it was a regrettable incident. On January 25, 1998, the LTTE had carried out a suicide attack on the temple killing eight civilians while injuring 25 others and causing damage to the temple structure.

Child Soldiers Global Report 2008 published by the Coalition to Stop the Use of Child Soldiers, a non governmental organization based in London, said that the LTTE, which had recruited under-age fighters for many years, pledged on June 18 2007 to rid its ranks of all under-18s by the end of 2007. However, LTTE had not committed to the full release of children under 18, it said. The report also accused the Tamileela Makkal Viduthalai Puligal (TMVP), LTTE break-away faction founded by ‘Colonel’ Karuna and presently led by Eastern Province Chief Minster Pillayan, too for forcibly recruiting and using children. "Children in the east of the country were forcibly recruited and used by the Karuna group, a breakaway group of the LTTE, with the complicity of, and in some instances actively working with, the security forces," it said. It blamed the Sri Lankan Government for not making any arrests so far of cadres of the LTTE or Karuna group in relation to child recruitment saying that the police often refused to accept complaints from parents of abducted children.

At least 14 Liberation Tigers of Tamil Eelam (LTTE) militants were killed 42 others injured as security forces (SFs) captured one of the outfit’s major strategic bases known as "Munnagam" in the Janakapura area of Vavuniya district on May 29. Military spokesman Udaya Nanayakkara told Daily News, "The LTTE cadres facing fierce attacks and resistance from the Security Forces fled from Munnagam, six km ahead of north Janakapura, Welioya FDLs. At least 14 Tiger cadres were killed and 42 others injured while a soldier was killed and seven others injured in action." The Munnagam base was used to coordinate and launch attacks against the SFs and was considered as a backup base of the LTTE, he added. "The terrorist base, half a square acre in size consisted of three permanent buildings, three command 'bunkers' each of which was 15 feet x 10 feet x 8 feet and two observations turrets. The other facilities consisted of a large kitchen, storage rooms and complete with an underground trench system linking each other," informed the Media Centre for National Security.

The security forces (SFs) foiled a pre-dawn sea attack by the Liberation Tigers of Tamil Eelam (LTTE) sinking three Sea Tiger (the sea wing of the LTTE) boats and killing at least 15 militants on May 29 (today), reported Colombo Page. A combined Army-Navy operation at the Chiraththivu islet of Jaffna district foiled an attempt by the LTTE to infiltrate the military detachment located between the Jaffna mainland and the Mandaithivu Island from the sea. Defence reports said that the Sea Tigers launched a second attack in six boats towards the same islet from the Pooneryn area. Troops repulsed the offensive sinking three boats and heavily damaging another which sank in the shallow waters at around 2am (SLT). Meanwhile, the pro-LTTE Website Tamil Net said that 13 navy personnel were killed in the incident. It also reported that the raid was launched at 1:25am and the camp was brought under LTTE control at 2am.
