An extraordinary gazette notification on March 1 issued extending the term of the Presidential Task Force for ‘One Country - One Law’ concept by three months, reports Daily Mirror. The Task Force's activities were to end on February 28 and a decision to extend its duration was issued by the Secretary to the President Gamini Senaratne. The decision of extension was made to complete the task assigned to the aforesaid Task Force efficiently within an appropriate action plan and to seek the views of the public and the panels of experts covering all the provinces of the country.

Foreign Minister G.L. Peiris delivering a statement at the High-Level Segment of the 49th Regular Session of the United Nations Human Rights Council (UNHRC) on March 1 in Geneva said that the evidence gathering mechanism established by the UNHRC resolution at the 46th session creates obstacles to the reconciliation efforts and polarizes the society, reports Colombo Page. He pointed out that in a startling departure from the mandate which the UN General Assembly originally conferred on this Council, operative paragraph 6 of this resolution refers to a so-called evidence-gathering mechanism, a measure that was strongly opposed by a number of countries. “Such initiatives create disharmony both in the domestic and international arenas. It creates obstacles to reconciliation efforts, breeds hatred by reopening past wounds, and polarizes society,” Minister Peiris said rejecting the measure.

United Nations (UN) human rights experts on March 2 called for an immediate moratorium on the use of Prevention of Terrorism Act (PTA), and urged the Government to substantively review and revise the legislation to comply with international human rights law, reports Colombo Page. The experts said “There is a grave risk to the rights and liberties of people who may be detained arbitrarily, especially religious and ethnic minorities, and the use of the law may curtail political dissent with no effective due process guarantees. An immediate moratorium on the use of the PTA is required until the necessary amendments can be made.”

Human Rights Watch (HRW) in a statement released on March 3 said that President Gotabaya Rajapaksa is pursuing policies hostile to Tamil and Muslim communities, reports Tamil Guardian. “The Sri Lankan government is actively targeting minorities and civil society groups, while it protects alleged rights violators and undermines the rule of law,” said Meenakshi Ganguly, South Asia director of HRW. A former Liberation Tigers of Tamil Eelam (LTTE) ‘intelligence chief’, Thangavelu Nimalan was sentenced to life imprisonment on March 4 for allegedly possessing 2 kilograms of Research Department Explosive (RDX), reports Tamil Guardian. Colombo High Court delivered the sentence after a case was filed against Nimalan in 2011. A number of other cases have also been filed against Nimalan, including an alleged claymore attack on a Sri Lanka Special Task Force (STF) truck on May 28, 2007 in Ratmalana. These allegations remain under investigation.

The Core Group on Sri Lanka on March 4 said that progress since United Nations Human Rights Council (UNHRC) resolution 46/1 is limited, reports Colombo Page. Issuing a statement at the 49th session of the UNHRC, the Sri Lanka Core Group comprising Canada, Germany, North Macedonia, Malawi, Montenegro, the United Kingdom and the United States said in particular, slow progress by the Office of Missing Persons (OMP) in fully investigating cases since the release of the preliminary list of missing persons is troubling. The statement said “Our concerns over surveillance and intimidation of civil society persist and detentions, threats and intimidation of journalists and human rights defenders continue. It is crucial that civic space remains open.”

The Archbishop of Colombo Cardinal Malcolm Ranjith on March 7 urged the United Nations Human Rights Council (UNHRC) to intervene to ensure an impartial inquiry into the Easter Sunday attack in April 2019, reports Colombo Page. Addressing the UNHRC's 49th session in Geneva via video, Cardinal Ranjith also called on the UNHRC to help in devising a methodology to find out the truth behind the attack. He said although the attack, which killed 269 including 47 foreign nationals from 14 countries, was initially appeared to be the work of a group of Islamic extremists, but subsequent investigations revealed that it was part of a ‘grand political plot’. Cardinal Ranjith also said that the failure to reveal the truth even three years after the crime was committed was a serious violation of the basic human rights of the victims and urged the Council to continue gathering evidence.

A Cabinet meeting chaired by the President on March 7 approved the proposal made by the Minister of Justice to appoint 25 Boards of Inquiry to expedite the investigation into complaints received regarding missing persons, reports Colombo Page. The Office on Missing Persons (OMP) has been established in accordance with the provisions of Act No. 14 of 2016. Regional offices have been established in Matara, Mannar, Jaffna, Batticaloa and Kilinochchi and those offices have received 14,988 complaints on missing persons.

Speaker Mahinda Yapa Abeywardena informed Parliament March 8 that the Supreme Court (SC) has determined that several clauses in the Prevention of Terrorism Amendment (PTA) Bill are inconsistent with the Constitution and need to be amended before passing it as a law, reports Ceylon Today. The determination read out by Speaker Mahinda Yapa Abeywardena is as follows: Clause 2 of the Bill is not inconsistent with any provision of the constitution. Clause 3 of the Bill cannot be enacted into law unless the number of votes cast in favor amounts not less than 2/3 of the whole number of members, including those not present, as per the constitution. Clause 6 of the Bill, the SC holds that it cannot inquire into pronounce upon or in any manner called into question, the validity of section 11 of the PTA on any grounds whatsoever, in terms of article 83 of the constitution. Clause 10 of the Bill, the Sc holds that if amended as set out in the determination of the SC would cease to be inconsistent with any provision of the constitution. Clause 11 of the Bill, the SC had stated that there is no basis to hold Clause 11 of the Bill is inconsistent with the constitution. Clause 12 of the Bill, the SC is of the view that proposed section 26 (2) of Clause 12 in that form would be inconsistent with article 12 (1) of the constitution.

At the Interactive Dialogue on the written update of the High Commissioner for Human Rights on Sri Lanka, which concluded on March 7, 2022, Sri Lanka received overwhelming support from countries of the Global South, the Foreign Ministry said in a statement on March 8, reports Colombo Page. The countries of the Global South have expressed support for the Government’s significant efforts towards reconciliation and reiterated the importance of objective and constructive cooperation as the fundamental basis for multilateral engagement. Of the 45 countries that spoke at the Interactive Dialogue, 31 spoke in support of Sri Lanka, the Foreign Ministry said. Sri Lanka received cross-regional support from a broad spectrum of states of South, South East and Central Asia and the African Group. Addressing the UN Human Rights Council (UNHRC) on at the commencement of the interactive dialogue, Foreign Affairs Minister Prof. G.L. Peiris, while reiterating Sri Lanka’s commitment to continuing its voluntary international undertakings on human rights and engaging with the United Nations, including the UNHRC, referred to serious anomalies and weaknesses in the update presented by the High Commissioner.

Ali Sabry to award a one-time grant of SLR 100,000 to the closest relative of a missing person and has also recommended that the Registrar General’s Department issue a death certificate or a missing person’s certificate accordingly, reports The Morning. “On 14 March, Ali Sabry presented a Cabinet paper about missing persons. He has recommended that the Registrar General’s Department issue a death certificate or a missing person’s certificate. We also approved that a grant of Rs. 100,000 be given to the closest relative of the missing person,” Cabinet Spokesman Dullas Alahapperuma said at the weekly Cabinet press briefing. FR petitions filed against former President Maithripala Sirisena, former Prime Minister Ranil Wickremesinghe, former Defense Secretary Hemasiri Fernando, former IGP Pujith Jayasundara and others were taken for hearing before a seven-judge bench of the apex court. The Core Group on Sri Lanka Issuing a statement at the 49th session of the United Nations Human Rights Council (UNHRC) on March 4 acknowledged the first steps by Sri Lanka to address key reforms but noted that progress since UNHRC resolution 46/1 is limited. The Core Group on Sri Lanka while recognizing the challenges the country is facing due to the COVID-19 pandemic, continued to express concern about current human rights developments in Sri Lanka and stressed the importance of a comprehensive reconciliation and accountability process. The Core Group noted that new ‘One Country One Law’ taskforce risks undermining Sri Lanka’s pluralist society and urged Sri Lanka to ensure that this taskforce’s work is inclusive and non-discriminatory. The Core Group called for full cooperation with the UN High Commissioner for Human Rights and said it remains ready to support the Sri Lankan Government on the implementation of resolution 46/1. The Core Group on Sri Lanka comprises Canada, Germany, North Macedonia, Malawi, Montenegro, the United Kingdom and the United States.

The Colombo High Court on March 21 released retired doctor Shirley Herath, who was remanded on suspicion of placing a hand grenade in the All-Saints Church in Borella, on bail, reports Colombo Page. Colombo High Court Judge Manjula Tillekeratne ordered the release after considering a bail application filed on behalf of the retired doctor. Announcing the order, the High Court Judge stated that although the suspect was initially produced before the Magistrate’s Court under the Prevention of Terrorism Act (PTA), the plaintiff has decided not to pursue the charges so far. He further stated that the petitioner’s party has stated that there is a possibility of the High Court considering the bail application as it is pursuing charges against the suspect under the Offensive Weapons Act. Accordingly, the suspect was released on a cash bail of SLR 100,000 and two personal sureties of SLR 2.5 million each and the High Court Judge also ordered that the sureties should be residents of the Colombo District.

The National Investigation Agency (NIA) on March 29 filed a charge sheet in a special court at Poonamallee, Chennai against six persons, accused of attempting to revive the banned Liberation Tigers of Tamil Eelam (LTTE) organisation, reports The Hindu. Letchumanan Mary Franciska, Kenniston Fernando, K. Baskaran, Johnson Samuvel, G. Dharmendran and E. Mohan were cited as accused. The case was registered in 2021 by Q Branch CID Chennai and later taken over by the NIA on January 18. It pertains to a criminal conspiracy to revive the LTTE by committing forgery for cheating, besides using forged documents to divert funds, lodged in dormant accounts, to commit unlawful and terror activities. During investigation, it was found that Letchumanan Mary Franciska, Kenniston Fernando and Baskaran entered into a conspiracy with foreign entities to siphon off deposits in dormant bank accounts through Indian identity documents, obtained by forging, to revive, revamp and regroup LTTE in India and Sri Lanka. They were abetted by Johnson Samuvel, Dharmendran and Mohan in forging the documents, the charge sheet said.
