International Commission of Jurists (ICJ) on February 1 said that the Sri Lankan Government must repeal the draconian Prevention of Terrorism Act (PTA) as a new set of proposed reforms are woefully inadequate and overlook the most egregious provisions of the legislation, reports ICJ. Sri Lanka’s Government gazetted amendments to the Prevention of Terrorism (Temporary Provisions) Act No. 48 of 1979 (PTA) on January 27. Ian Seiderman, ICJ’s Legal and Policy Director said “The Government of Sri Lanka is once again scrambling to do its bare minimum ahead of another UN Human Rights Council session, in an attempt to deflect focus away from its failing human rights record. The fatally flawed PTA cannot be cured by these disingenuous reform attempts, but must be entirely repealed.” Sri Lanka’s human rights record will be discussed by the United Nations Human Rights Council (UNHRC) on March 3 in response to a report of the UN Office of the High Commissioner on Human Rights.

Opposition parties Samagi Jana Balawegaya (SJB), Janatha Vimukthi Peramuna (JVP) and Tamil National Alliance (TNA) representing Parliament on February 4 boycotted the 74th national Independence Day celebrations at the Independence square in Colombo city, reports Daily Mirror. SJB General Secretary Ranjith Madduma Bandara said “We decided to keep away from the main ceremony as we opposed the move to hold a grand ceremony which display aircraft and other military equipment at a time the country is facing a crisis especially in the economic front.” The JVP and the TNA MPs were also not present as they did during the last two years.

The legislation currently allows for unlawful detention practices where individuals can be detained for 18 months without charge, though some have been detained for decades.

Human Rights Watch (HRW) in a report released on February 7 slammed Sri Lanka’s Prevention of Terrorism Act (PTA), reports Tamil Guardian. The 59-page report slammed Sri Lanka’s use of the PTA, detailing how it has been utilised to detain Tamils and Muslims and suppress civil society on the island. The report notes how “twelve years since the end of the war the government is still targeting Tamils but also using the PTA against Muslims, particularly since 2019”. It also noted that the Government’s proposed amendments to the PTA would still leave it falling far short of international standards.

Appeal Court delivering the order granting bail to lawyer Hejaaz Hizbullah on February 7 emphasized the need for legislature to remove draconian elements of the Prevention of Terrorism Act (PTA) and said it is court’s duty to exercise jurisdiction until such time, reports Colombo Page. The Court said “Ultimately, it is up to the Legislature to ensure that the draconian elements of the law combating terrorism are dispensed with per modern day contexts. Until such time, it is the judiciary’s duty to employ existing legal provisions and constitutional powers to interpret the same elements in the interests of justice.” Describing the history of the Prevention of Terrorism Act, which was originally passed in 1979, the court said since then, four decades have passed, and the PTA has strayed far away from its historical context.

The Foreign Ministry on February 7 said that the proposed Bill to amend the present Prevention of Terrorism Act (PTA) which the Government of Sri Lanka intends to introduce in Parliament is a progressive step towards protecting fundamental rights, reports Colombo Page. The Foreign Ministry said “Upon it being passed into law, the bill amending the PTA would be a salutary piece of legislation that would amend the present Prevention of Terrorism Act, after almost 43 years since it was enacted and would be the most progressive step that would give persons subject to the said law, tangible protection towards securing, advancing and protecting their fundamental rights guaranteed under the Constitution.”

The European Union (EU) on February 8 urged Sri Lanka to reduce use of the Prevention of Terrorism Act (PTA) and release on bail those detained without charges, reports Colombo Page. During the 24th meeting of the Joint Commission of the EU and Sri Lanka held in Brussels, Sri Lanka reiterated its objective to achieve measurable, tangible and verifiable results on the ground in meeting its commitments. In this context, the EU welcomed the submission by the Government of Sri Lanka of amendments to the PTA. After the Bill was presented, Tamil National Alliance (TNA) MP M.A. Sumanthiran quoted the Justice Minister as saying that the PTA would be totally repealed. In response, the Foreign Minister said, “All these criticisms can be made on the floor of parliament when this Bill is debated. It is presented in keeping with the Standing Orders of this House. Any citizen of the country can challenge it in the Supreme Court. We have to await the determination of the Supreme Court. The petition was filed by the Center for Policy Alternatives (CPA) and its Executive Director, Dr. Paikiasothy Saravanamuttu. The Attorney General has been named as the respondent. The petitioner seeks the apex court to declare that certain provisions of the proposed bill are unconstitutional and a two-thirds majority in Parliament and a referendum are required to pass any provisions. According to the petitioner, a number of clauses in the bill adversely affect fundamental rights against arrest, torture and detention and that those rights are being restricted.

In a media release issued on the briefing of the Diplomats on the Road Map of the HRCSL for 2022 held at the Human Rights Commission Headquarters, the Commission said it believes that the offence of terrorism should be included in the Penal Code with a new definition for terrorism. “It is explicitly for those who threaten or use violence unlawfully to target the civilian population by spreading fear thereof to further a political-ideological or religious cause. The Commission advocates that terrorism should be investigated under the General Law of the country with necessary amendments,” the HRCSL said.

Rathnasingam Kamalakaran, Vaithiyalingam Nirmalan and Pathmanathan Ingaran are the three prisoners who began their hunger strike inside the prison. They were detained by Terrorism Investigation Division (TID) under the Prevention of Terrorism Act (PTA) on July 3, 2020, July 6, 2020 and on May 28, 2021. Police claimed that they had been attempting to commemorate Black Tigers’ Day, as well as aiding and abetting the production of explosives. Hundreds of Tamil political prisoners remain in custody, but exact figures remain unknown. TNA MP M. A. Sumanthiran on February 10 told Sri Lanka’s Parliament that there were 300 to 400 people detained under the PTA.

TNPF wrote in a letter “We reiterate that the core group which includes two members of the UN Security Council must initiate steps to table a resolution in the UN Security Council to refer Sri Lanka to the International Criminal Court to inquire into all crimes committed, including the crime of genocide against the Tamil people.” In the letter, the TNPF expressed their disappointment with the UN Resolution 46/1 which called on the Office of the High Commissioner for Human Rights (OHCHR) to "collect" as well as "consolidate, analyse and preserve” evidence that could be used in future war crimes trials and urged Core Group members to refer Sri Lanka to the ICC instead.
