Charitha Gunaratne, a former Colombo Municipal Councilor and a lawyer has filed a Fundamental Rights (FR) petition in the Supreme Court (SC) seeking an interim injunction against holding a general election amid the coronavirus pandemic, reports Colombo Page on May 2.The petitioner requests the SC to declare that the gazette notification issued by the Election Commission (EC) announcing the general election on June 20 is unconstitutional and invalidate the gazette notification.Chairman of the EC Mahinda Deshapriya and its members N.J. Police Media Spokesman SSP Jaliya Senaratne said that Police arrested another suspect linked to the Easter Sunday terror attacks, reports Daily Newson May 3.Investigations have revealed that the suspect was a trustee of a training centre in Kalpitiya in Puttalam District, North Western Province where the ringleader of the Easter attacks, Zahran Hashim, had conducted lectures.The Police Spokesman noted that this training centre had been operating under the guise of a Non-Governmental Organisation (NGO) and the arrested suspect had been operating as its trustee.

The Acting Inspector General of Police (IGP) has ordered the Terrorist Investigation Division (TID) to conduct a full investigation into the Non-Governmental Organization (NGO) headed by the lawyer, who was arrested and detained by the Criminal Investigations Department (CID) as a suspect in the Easter Sunday attack, reports Colombo Page on May 6.The investigation into the NGO was ordered since the NGO was largely funded by two suicide bombers who carried out the Easter Sunday attacks on churches and hotels on April 21, 2019.It has been revealed that the head office of the NGO is located in a building purchased by the bombers.The CID has received several reports that Mohammed Saharan, who allegedly planned the suicide attack on Easter Sunday has visited the building. The CID is conducting an investigation into the incident. The TID has been assigned to investigate the activities of the NGO.

The European Commission has de-listed Sri Lanka from its list of High Risk Third Countries with Anti- Money Laundering and Countering the Financing of Terrorism (AML/CFT) Strategic Deficiencies published on May 7, reports Colombo Page.Sri Lanka was listed as a high risk third country by the EU in February 2018, subsequent to Sri Lanka being identified by the Financial Action Task Force (FATF) as a jurisdiction with strategic AML/CFT deficiencies in its Compliance Document which is more commonly identified as “the Grey List” in October 2017.Upon listing, a time bound Action Plan to address the strategic deficiencies identified was assigned to Sri Lanka.Since the listing by the FATF, the Financial Intelligence Unit (FIU) together with other stakeholders had taken a series of effective and tangible steps to implement the FATF Action Plan well within the given time frame and accordingly, the FATF delisted Sri Lanka from its Compliance Document (a.k.a. “the Grey List”) at its Plenary held during 13-18 October 2019 in Paris.The revised list of EU high risk third countries together with an Action Plan for comprehensive Policy on preventing money laundering and terrorist financing will be forwarded to the EU Council and Parliament for adoption.

A special team of the Criminal Investigations Department (CID) of Police on May 9 arrested a Hajjiyar, identified as Mohamed HanifaHaja Mohamed, who had given a land in Trincomalee for providing firearms training to Muslim youths, reports Colombo Page.The CID stated that the suspect was arrested from Thoppurcity of Trincomalee District in Eastern Province. CID revealed that five youths from Mawanella have been given firearms training in 2017 in the land given by the suspect Mohamed HanifaHaja Mohamed. CID also revealed that the Hajjiyar had also provided the T-56 weapon for the training.The CID says that the land at Thoppur is run as a livestock farm and a person identified as Sadiq, who is a key disciple of the suicide bomber and National ThowheedJammath(NTJ) leader Saharan, has given weapons training to the youths in the premises.

Tamil National Alliance (TNA) on May 12 sought the release of “political prisoners” who were arrested — some convicted — for their alleged association with or role in the rebel Liberation Tigers of Tamil Eelam (LTTE) during the civil war, reports The Hindu. TNA spokesman and former Jaffna parliamentarian M.A. Sumanthiran handed over a list of the detainees under Sri Lanka’s controversial Prevention of Terrorism (PTA) Act to Prime Minister Mahinda Rajapaksa. “There are 96 political prisoners in all and 47 of them were convicted. Only a presidential pardon can release them,” he said, referring to the Sri Lankan President’s discretionary power to grant amnesty.

General Secretary of the United National Party (UNP) Akila Viraj Kariyawasam on May 21 filed a Fundamental Rights (FR) petition in the Supreme Court stating that the fundamental rights of his and the people of the country are violated by the failure to convene the new Parliament for more than three months after the dissolution of the eighth Parliament, reports Colombo Page. The Attorney General on behalf of the President and the Attorney General are named as respondents. The UNP General Secretary in his petition requested the apex court to issue an injunction invalidating the gazette notification issued by the President on March 2 dissolving the eighth Parliament. The petition further states that after the dissolution of the eight Parliament, the Elections Commission decided to hold the election for the ninth Parliament on June 20. It points out that the election date is after three months from the date of the dissolution of Parliament and the decision of the Election Commission is illegal. The petitioner states that the new parliamentary party should be summoned not less than three months after the dissolution of the Parliament, but the failure to do so and the absence of the old Parliament is a violation of the Constitution. The petitioner notes that according to the Constitution new Parliament should be summoned not later than three months after the dissolution of Parliament. Failure to do so and not reconvening the old Parliament is a violation of the Constitution, the Petitioner adds.

A senior Army Intelligence officer has told the Presidential Commission investigating into the Easter Sunday attacks that former Criminal Investigation Department (CID) Director SSP Shani Abeysekera had not permitted to question those who were allegedly involved in extremist activities and conduct further investigations into them, reports Daily News on May 31. He said this when inquired by Commission President, Court of Appeal Judge Justice Janak De Silva. He said Mohammed Jameel who blew himself at the Tropical Inn lodge in Dehiwala has been proven to be involved in extremist activities. The witness said a team led by him succeeded in reaching the house of this suicide bomber’s house and question his wife within an hour of the blast. He also said that they have received information of Mohommed Ibrahim and Mohammed Jameel for having been involved in extremist activities from 2015. These suicide bombers were involved in the Dematagoda and Dehiwala blasts.
