Doctor Shakil Afridi, who helped the Central Investigation Agency (CIA) find slain al Qaeda leader Osama bin Laden, on December 1 demanded better conditions in prison and complained of being falsely implicated in a treason case, reported The Express Tribune quoting his lawyer Samiullah Afridi. He was initially sentenced to 33 years in jail and given a fine, but a court in Peshawar overturned his sentence in August, 2013 and ordered a retrial. “I am perhaps the first Pakistani who has been denied access to his lawyer. What kind of justice is this?” he asked in a letter.

The Federal Minister for Information Pervaiz Rashid said on December 1 that the protest against NATO supplies by Pakistan Tehreek-e-Insaf (PTI) and its allies will create problems for Pakistan on international level, reports The Express Tribune. “It is everyone’s right to protest, but blocking the supply line through street power would earn a bad name for the nation,” Rashid said. Lashing out at Imran Khan and his party, the Federal Minister said if protests against Nato supplies was a good move, why the PTI Government and leadership in KP did not participate in the protest. He said protests on the roads would turn the workers of PTI towards violence.

On December 2 cases were registered against Pakistan Tehreek-e-Insaf (PTI) and Jama’at-e-Islami (JeI) workers for breaking the seal of a NATO container bound for Afghanistan during the sit-in at Hayatabad toll plaza in Peshawar, reported The News. The driver of the NATO container protested against the PTI and JeI workers breaking the seal and stated that the Afghanistan bound container was carrying cooking oil. JeI leader, Kashif Azam and PTI camp in charge Malik Raees are named in the FIR. Meanwhile, a container, dispatched for officials in Kabul Province of Afghanistan, was sent back by protesters from Hayatabad Toll Plaza on December 2, reports The Express Tribune. The United States (US) Embassy in Islamabad said they received the information and were looking into the matter. The container was stopped before crossing the sit-in camp near a terminal and documents were produced for the PTI, JeI and Awami Jamhoori Ittehad Pakistan (AJIP) activists at the toll plaza. All of them were allowed to move on after the documents produced proved they were carrying ordinary goods.

The Acting Defence Secretary, Major General (retired) Raja Arif Nazir, informed the country’s highest court on December 2 about the death of two of the 35 detainees the court had ordered to be produced, reports Dawn. He said that Sardar Ali had died on December 29, 2012 and Nadir Khan on July 1, 2013 at the Lakki Marwat Internment Centre inside the Malakand Garrison. They died of natural causes and the bodies had been handed over to their families in accordance with the procedure, he said, adding that the whereabouts of the other 33 were being ascertained. But the court said the death of the two detainees was evidence suggesting that the rest were also in the custody of intelligence agencies. The revelation has given an entirely new, and more disturbing, dimension to the issue of missing persons as for the first time the Government has accepted that some of those reported missing for years were not only in the custody of armed forces, at least a couple of them have died in detention under unexplained circumstances. The Supreme Court said it was a “custodial killing” for which the Agencies concerned would be held responsible. The internees, along with one Yasin Shah, were to be produced before a three-judge bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Jawwad S. Khawaja and Justice Amir Hani Muslim. It ordered Defence Minister Khawaja Asif, who was present in the court, to ensure production of the 33 persons on December 3, 2013 positively without any excuse. Pakistan Tehreek-e-Insaf (PTI chief Imran Khan on December 3 said his party was considering blocking NATO supply routes in other provinces as well, reports The Express Tribune. “PTI may block NATO supply routes in Punjab and Balochistan as supply is being carried out via Chaman border,” said Imran, while talking to The Express Tribune. Earlier, addressing a protest camp at Hayatabad Toll Plaza, Imran poignantly questioned why the federal government failed to implement the resolutions passed in both Provincial and National Assemblies against United States (US) drone strikes in Pakistan. “National and Khyber-Pakhtunkhwa assemblies had unanimously passed resolutions terming drone strikes a blatant violation of international law and Pakistan’s sovereignty,” he said, adding that the supply route would remain closed until the US stopped drone attacks. Claiming that the US was creating hurdles in the peace process, the PTI chief said ‘the so-called ally’ did not want to bring peace to the region. He clarified that the protest sit-ins to block the NATO supply routes did not mean waging a war against the US. It was only to give a message to the world that US was violating international law. “They [Americans] fire missiles but Pakistani people and law enforcing agencies have to bear the consequences,” he said, adding that the K-P was on the verge of destruction, as six million tribesmen had to leave homes for safer places.

A participant said that there was no need to continue with sit-ins as the US Government had announced to suspend movement of NATO supply trucks out of Afghanistan via Khyber Pakhtunkhwa. The eight vehicles which traversed the border at Khyber Agency had been parked at the NATO terminal at Torkham before the PTI sit-ins started on November 23, 2013 and were waiting for customs clearance. Torkham political administration official Mairaj Khan confirmed the containers had reached the terminal on November 22, 2013 and had been awaiting clearance. Khan added six containers were allowed to cross into Afghanistan on November 27, 2013 while the two other containers crossed the border early on December 4, 2103 morning.

After nearly eight years of a myriad of missing persons’ cases filed in the apex and high courts, a long-awaited judgment was passed by the Supreme Court on December 10, officially declaring prolonged and unannounced detention by Security Forces and intelligence outfits illegal, reports The Express Tribune. The three-judge bench, led by Chief Justice Iftikhar Muhammad Chaudhry, ordered Prime Minister Nawaz Sharif as well as the Governor and Chief Minister of Khyber-Pakhtunkhwa to ensure the recovery of the missing persons in seven days and submit a report before the Supreme Court’s registrar – and only after strict action was initiated against those found responsible for the enforced disappearances. The judgment in the 35 missing persons’ case also highlighted that the stance of army authorities that 35 missing persons were not in their custody proved to be false as they had made three contradictory statements before the court and they only produced seven persons out of the 35, the court observed. It was stressed that no intelligence or security agency, including the Inter-Services Intelligence (ISI), Military Intelligence (MI), Intelligence Bureau (IB) and the Frontier Corps, could forcibly detain any person secretly for a longer period without sharing information about his whereabouts. The verdict passed the responsibility to the Civilian Government to ensure the recovery of the missing persons and for action against those who caused them. Since no law exists for the detention of the undeclared interned persons except for in Khyber Pakhtunkhwa, the rest of the provinces should also come out with proper legislation to discourage the tendency of enforced disappearances, according to the judgment.

While submitting the 25-page report of the Task Force on Missing Persons to a bench comprising Justice Mian Fasihul Mulk and Justice Musarrat Hilali, Deputy Attorney General (DAG)( Muzamil Khan said 643 people were shifted to internment centres in Khyber Pakhtunkhwa and 64 to such centres in tribal areas. He said members of the task force formed by the Interior Minister in July 2013 had visited internment centres to verify the information about internees. Hearing 425 habeas corpus petitions related to enforced disappearance, the bench directed the DAG to match the names of the detainees mentioned in the petitions with those pointed out in the report to know how many ‘missing persons’ had been shifted to the internment centres. It later fixed the next hearing into the cases for January 14, 2014 asking the DAG to provide the report to the court after conducting tally of the names. Senior Superintendent of Police (SSP) Operation Najeebur Rehman Baghvi claimed that Police had also recovered 17,895 SIMs from their possession. “These people [suspects] have been living in Pakistan for a long time and are involved in the business [of illegal Afghan SIMs] for the past two years and they had created an international gateway for phone calls inflicting millions of rupees in losses to the national exchequer,” he claimed, arguing that their boss was living outside of Pakistan. “Afghan SIMs sold by these people are used in crimes including kidnapping-for-ransom and extortion as well as other crimes,” Baghvi said, adding that the suspects will now be handed over to the Federal Investigation Agency (FIA) for further investigation.

According to details, in the first attack, the Deputy Superintendent of Police (DSP) Tariq Khan said that the first bomb exploded near Chakriali on Jail Road, nearly a kilometre away from Police Lines. Imran Khan expressed concern over the Federal Government’s attitude on Chuck Hagel’s statement. Hagel had said United States (US) lawmakers could withhold military assistance if the Pakistani Government did not ensure security for NATO supply routes. Khan, however, claimed the assistance was part of the support fund as the Pakistan military was sent to fight in the tribal areas on the request of the US and they cannot stop the aid. The party chairman blamed the US for sabotaging a possible peace initiative with the Taliban. “They don’t want us to bring peace back to our region,” he said, adding, “We took a step forward and they (the US) attacked the Taliban.
