Chairman KP Oli of the ruling Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) formally proposed the Madhesh-based parties affiliated to the ‘Samyukta Loktantrik Madhesi Morcha’ to join the government during a meeting at the CPN-UML Parliamentary Party Office in Kathmandu on December 1, reports Ekantipur.com. The alliance of Madhesh-based reiterated its previous stance of not joining the government unless a new constitution was formed. Chairman of Sadvawana Party, Rajendra Mahato, turned down Chairman KP Oli’s proposal saying the parties aligned to the Madhesi front will not join the government. “We instantly rejected the UML’s proposal of national unity government,” he said, adding, “We will not even utter the letter ‘G’ of government until a constitution is drafted.”

On December 1, organising a press conference in Kathmandu, Netra Bikram Chand formally announced formation of the Communist Party of Nepal-Maoist (CPN-M), reports The Himalayan Times. Chand also announced to organise first national convention of the new party from January 7-10, 2015. The new party includes former leaders of Communist Party of Nepal-Maoist (CPN-Maoist), including Khadga Bahadur Bishwokarma, Ishwari Dahal, Dharmendra Banstola, Tilak Pariyar and Santosh Budha. Further, Chand said the party has no plans to launch an armed revolt, adds Myrepublica. Chand, however, clarified that his party is ready to retaliate if the government tries to suppress their struggle. “We are ready to wage war, sit for talks or even shake hands to institutionalize the achievements of the decade long people´s war,” Chand said. The new party has also asked the government to recognize it as a parallel force. “The major theme of the peace process was coexistence and cooperation. Thus the state should be ready to revamp the army, judiciary and administration,” reads the statement. Chand threatened to revive insurgency-era parallel government if their demands are not met.

On December 1, various conflict victim organisations accused the government of ignoring those who were rendered disabled by the decade-long conflict, and also warned of launching stern protest if their demands were not addressed immediately, reports The Himalayan Times. The conflict victims also submitted a memorandum to Ministry of Peace and Reconstruction, Kathmandu, calling for preparing data of people who were rendered disabled during the conflict. Their demands include ensuring participation of the victims in all justice process and long-term plans and policies for those living with disability among others. Free treatment, education and other services are some of their other demands. They have also demanded rehabilitation for the conflict victims and disabled-friendly environment among others.

On December 7, the Madhes-centric parties have reiterated their calls for ensuring identity-based federalism through Constituent Assembly (CA), reports Ekantipur.com. Members of the ‘Samyukta Loktantrik Madhesi Morcha’ have decided to intensity strategies both within and outside the CA for timely promulgation of the new statute. The alliance of Tarai parties, while making its working procedure and strategies public, also stressed that the constitution should be made in consensus. The Morcha clarified that if any concept is to be made public it has to be done in consent with the alliance. The decision comes at a time when the Upendra Yadav-led Madhesi Janadhikar Forum-Nepal (MJF-N) submitted a separate nine-state proposal to the Constitutional-Political Dialogue and Consensus Committee (CPDCC).

Bodde at the PM’s official residence at Baluwatar, Kathmandu on December 8, according to PM Koirala’s press convenor Prakash Adhikari, reports Nepal News. “US President Obama is visiting South Asia in January 2015. If he can visit Nepal even for a short period, it would boost up the morale of all democratic forces of Nepal,” the PM said. Besides, the talks were focused on smooth diplomatic relations between Nepal and US, constitution building process, potential international investment in Nepal and the matters of mutual interest.

At an interaction programme at Reporters' Club in Kathmandu on December 9, leaders of different political parties are still vacillating between consensus and voting to deliver a new constitution within the ruling party's self-imposed deadline to craft a constitution by January 22, reports The Himalayan Times. Nepali Congress (NC) spokesperson Dilendra Badu said the parties would decide the process for settling the disputed and contentious issues by this December 11. Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Secretary Pradip Gyawali, also present at the programme, said the parties would try to craft the new constitution through consensus. However, if consensus proved elusive then voting was the only alternative. He said that the constitution was a document of agreement and therefore it could be amended even after the promulgation. Unified Communist Party of Nepal-Maoist (UCPN-M) leader Agni Sapkota, said the seven-province model submitted by NC and CPN-UML was marginalized and oppressed groups. Adding his party was against the voting process he contended the new constitution could be crafted on the slated time if these issues could be finalized through consensus among various parties.

Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Chairman KP Sharma Oli at a press meet held at the party head office in Kathmandu on December 17 said that his party would strongly lobby for producing a new constitution by January 22 and that the disputes would be decided through voting in the Constituent Assembly (CA) if consensus still eluded, reports Republica. Oli, flanked by other senior most leaders of the party, said that the disputes should be decided as per the rules of the Interim Constitution and the CA regulations. Nepal Bar Association (NBA), the umbrella organization of lawyers across the country, has concluded that the recently promulgated Truth and Reconciliation Commission (TRC), Commission for Investigation of Disappeared Persons Formation Act 2014 needs amendment, reports Myrepublica. An expert committee formed by NBA under the leadership of former Justice Pawan Kumar Ojha had conducted a study on whether the act was in line with international standards and the Supreme Court verdicts in cases related to transitional justice. NBA launched the report amidst a program in the capital, Kathmandu, on December 19. “Truth, justice, reparation and assurance of no recurrence of human rights violations are the four pillars of transitional justice. They should not be accepted as alternatives to each other but complementary to each other,” reads the synopsis of the report. “The Comprehensive Peace Accord has also accepted it but the act has not maintained the balance between the four pillars,” it reads further. The expert panel has concluded that the act overlooks the verdicts of Supreme Court and commitments made at the international level.

Chairperson of Constitutional-Political Dialogue and Consensus Committee (CPDCC) and Unified Communist Party of Nepal-Maoist (UCPN-M) senior leader Baburam Bhattarai has urged political leaders to ensure that the past achievements of Nepal are institutionalized in the process of enacting a new constitution in haste, reports Nepal News. Speaking at a human rights program in Bhaktapur on December 20, Bhattarai said it is not important as to whether the constitution would be promulgated on January 22 or February 22, but the main thing is to ensure that the constitution would be good enough. “Until there is an understanding on the issues of federalism, form of governance, electoral system and identity, a constitution cannot be brought into effect,” Bhattarai said. “Nepali Congress and CPN-UML are more concerned about issuing a constitution on January 22, 2015. They are working in haste. We have to be cautious that such haste may not be helpful in institutionalizing the past achievements.”

UCPN-M leader Narayan Kaji Shrestha said they left the meeting as the ruling NC and CPN-UML were leading the discussions towards putting the issues of contention to constitutional provision of voting rather than drafting the constitution on consensus. “The ruling partners opined to go for process, but going to process will not end the current deadlock situation of the country,” leader Shrestha said. The ruling and opposition parties in the Constituent Assembly (CA) are at odds over how much more time to give for consensus efforts on promulgating new statute, reports Myrepublica. While the ruling parties are for promulgating new statute by January 22 even it calls for voting process in the CA, opposition parties have maintained that consensus efforts should be continued until there is consensus among all parties on constitutional issues. Speaking at a debate organized by the Federation of the Nepalese Chamber of Commerce and Industry (FNCCI) in Kathmandu on December 22, the opposition parties even warned that failure to promulgate new statute through consensus will invite fresh conflict in Nepal. “We are ready to move ahead with consensus to bring new statute. But how long should we wait as our efforts in the Constitutional Political Dialogue and Consensus Committee (CPDCC) have so far failed to yield any result?” asked Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) Vice Chairman Bhim Rawal. Rawal argued it would be tantamount to undermining the mandate given to the CA by the Nepali people if this CA also failed to produce a new constitution under the pretext of consensus. Nepali Congress (NC) Vice President Ram Chandra Paudel alleged that opposition parties were interpreting consensus to suit their own interests. “Opposition parties have to either be flexible to reach consensus or they should agree on a process [to promulgate new statute]. It is not good to block both consensus and voting processes in the CA,” he said. Paudel said although the Unified Communist Party of Nepal-Maoist (UCPN-M) leaders walked out of the meeting on December 20, the ruling parties will continue negotiations with the opposition parties as last-ditch efforts to bring the new statute in consensus. “We are committed to addressing concerns of all groups. Let´s resolve the dispute related to constitutional issues in a practical manner,” Paudel said.

Inaugurating the 41st general convention of Nepal Jaycees in Banepa of Kavre, Koirala said Nepal cannot afford as many as seven Pradeshes once it adopts the federal structure. "Top political leaders are holding a discussion to reduce the number of Pradeshes," Koirala said. The Prime Minister was of the view that more Pradeshes increase expenses of the state. While the national Parliament meeting hall has been rented, it will be ridiculous to federate the nation with more Pradeshes, Koirala argued.
