Nepal is currently the biggest hub for the India-based terrorist group Indian Mujahedeen, claimed the US State Department claimed, reports Republica on November 5. Releasing a country report on terrorism, the State Department stated "IM’s stated goal is to carry out terrorist actions against Indians for their oppression of Muslims. IM has also expanded its area of operations into Nepal, which is now the biggest hub for IM operatives." In its report, the State Department said that the IM maintains ties to other terrorist entities including Pakistan-based Lashkar-e- Toiba (LeT), Jaish-e-Mohammed (JeM) and Harkat-ul-Jihad-al-Islami (HuJI).

No casualties or damages were reported. According to sources, the explosion took place when Bidya Bhattarai, a House of Representatives (HoR) candidate of Nepal Communist Party (NCP) from Kaski Constituency-2 entered the Office of the Chief Returning Officer to file her nomination for the upcoming by-elections. Police on November 10 arrested 20 cadres of Netra Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) for staging demonstration in Kathmandu city of Kathmandu District in Province No. 3 against a recently published Indian political map that has depicted Kalapani region as Indian Territory, reports The Himalayan Times. CPN-Maoist-Chand had on November 6 declared to take to street to protest the issue. About eight months after its formation, the Recommendation Committee headed by former Chief Justice Om Prakash Mishra is all to recommend prospective candidates to the Government, reports Republica on November 16. A meeting of the committee held on November 15 has decided to publish the names of all applicants on November 17 and give the public five days to file complaints, if any, against the candidates. A total of 57 individuals have submitted applications seeking appointment as members or chiefs of the two transitional justice bodies — Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP). Among the applicants, three are said to be former members of the TJ bodies — TRC and CIEDP. They are seeking a second stint.

The meeting of the committee formed to recommend the names of the officer-bearers for the Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP) has decided to make public the recommended names on November 18 (today), reports My Republica. According to the committee's member Sharmila Karki, the meeting will make public the names of persons recommended to be the office-bearers of the TRC and CIEDP on Monday (November 18). They will be given a period of five days in case anyone files a complaint against them, which, she said, would help make the final recommendation. Karki shared that the committee has received applicants even from those who already served in these committees while some are new. Similarly, the committee had also received the candidates' names recommended by various related organizations. The incumbent Government had formed the recommendation committee in the coordination of former Chief Justice Om Prakash Mishra last April to recommend the candidates for the Transitional Justice (TJ) mechanism.

As the committee to recommend the members of two Transitional Justice (TJ) bodies, on November 18, published a list of 61 aspiring candidates, conflict victims opposed the move stating that the independent committee acted as per the direction of political parties, reports The Himalayan Times on November 19. A meeting between top three leaders — Prime Minister KP Sharma Oli, Nepal Communist Party (NCP) Co-chair Pushpa Kamal Dahal and Nepali Congress (NC) President Sher Bahadur Deuba — had last week decided to retain old members at the Commission on Investigation of Enforced Disappeared Persons (CIEDP). The meet had also decided to make two new appointments at the Truth and Reconciliation Commission (TRC), Ganesh Datta Bhatta as chair and Gangadhar Adhikari as member, while retaining rest of three old members. The committee then published a list of candidates in line with the same agreement. As per the political understanding, the TRC will have Ganesh Datta Bhatta as its chairperson and Gangadhar Adhikari, Madhavi Bhatta, Shree Krishna Subedi and Manchala Jha as members. Madhavi Bhatta had filed her application at the recommendation of institutions for the post while names of Ganesh Datta Bhatta, Adhikari, Subedi and Jha were added to the list by the committee itself in line with its working procedure. Former TRC chairperson Surya Kiran Gurung and member Lila Udasi Khanal had already resigned. The TRC will have Lokendra Mallick as its chairperson and Bishnu Pathak, Bijul Kumar Bishwakarma, Nara Kumari Gurung and Aai Bahadur Gurung as members. While Pathak and Bishwakarma have filed their applications for the post, the committee has added Mallick, Nara Kumari Gurung and Aai Bahadur Gurung to the list. The committee had received a total of 57 applications for the posts, of which three were rejected due to inadequate documents, said the committee’s Spokesperson Sharmila Karki. The committee then added seven new names, taking the tally to 61. The conflict victims and rights organisations opposed the move, stating that the commission members should have been appointed on the basis of process and criteria and not on the basis of political understanding.

The National Human Rights Commission (NHRC) on November 20 said that civilians, who fell victims to the atrocities of both warring parties during the Maoist insurgency, were yet to see justice due to failure on the part of the Government to initiate action against the perpetrators of gross rights violations, reports The Himalayan Times. “The NHRC reiterates its stance that justice should be delivered to victims of conflict. Any decision or action that may harm the sensitivity of the victims will never be acceptable. The rights body will continue to play its role to ensure the rights of victims,” read a press note issued by the NHRC 13 years after the Comprehensive Peace Accord was signed.

Co-chairman of Nepal Communist Party (NCP) Pushpa Kamal Dahal while addressing a programme organised by Conflict Victims Common Platform in Kathmandu on November 21 said there would be new office bearers in the Truth and Reconciliation Commission (TRC), but former office bearers of the Commission of Investigation on Enforced Disappeared Persons (CIEDP) could be reappointed, reports The Himalayan Times. Dahal said he wanted the former office bearers of the CIEDP to be reappointed as they had told him they would conclude their investigation in six months and there were not many complaints against them unlike office bearers of the TRC.

An explosive device placed under the car belonging to Shiva Prasad Acharya, ward chief of Pokhara-33, exploded on November 25 in Kaski District of Province No 4, reports The Himalayan Times. The privately-owned car (Ga 2 Cha 426) was parked in front of his house at Gharipata. The front part of the car has been damaged in the blast; however, no human casualties have been reported. It has been suspected that the explosive device might have been placed by the cadres of Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand).

Conflict victims had requested the NHRC time and again to withdraw its member to pile pressure on the Government to make the appointment process transparent. Former chairman of Conflict Victims Common Platform (CVCP) Suman Adhikari said “If the NHRC was really concerned about political influence in the appointment process, it should have intervened before the publication of the list by withdrawing its nominee from the panel. Since the list has been published including candidate’s parties have agreed to, selection will have to be done from among them. The HNRC has already failed, so its statement is meaningless.” Senior Vice-president of Conflict Victims National Alliance (CVNA) Phanindra Luitel also said “We time and again requested the NHRC to withdraw its nominee from the committee citing political intervention. We demanded annulment of the committee itself. We staged sit-in various times. And now the NHRC comes with a statement, having endorsed the list of 61 candidates. It’s disgraceful.”

Issuing a joint press statement, four rights organizations - the International Commission of Jurists, Amnesty International, Human Rights Watch, and TRIAL International – on November 26 said Nepal has made no substantial progress on questions of justice, truth, and reparations for victims of gross human rights violations and abuses during its 10-year conflict, reports The Himalayan Times. They were particularly concerned about the recent moves that suggest the Government would move ahead and appoint commissioners without making necessary legal reforms to framework. “It is deeply disappointing that the government had repeatedly attempted to appoint commissioners without adequate consultation and transparency. The commissions will not gain trust of the victims and the international community if the political parties continue to interfere in the appointment process,” said Biraj Patnaik, South Asia Director at Amnesty International.

National Human Rights Commission (NHRC) on November 26 set conditions for continuing to be part of the recommendation committee to pick members of two transitional justice bodies, reports The Himalayan Times. The conditions put forth by the NHRC were amendment of the Transitional Justice Act as per the Supreme Court verdicts and international standards, consideration of victims’ sentiments, neutrality of the recommendation committee, fairness, transparency and credibility. It will continue to be part of the committee only if its conditions are met, said the NHRC. The NHRC issued the statement after the recommendation committee on November 18 published the list of aspirants for members and chairpersons of the Truth and Reconciliation Commission (TRC) and the Commission of Investigation on Enforced Disappeared Persons (CIEDP).

The victims of the decade-long insurgency on November 28 demanded an immediate dissolution of the recommendation committee formed to recommend office-bearers in the two transitional bodies, reports Kathmandu Post. Organising a press meet in the Capital Kathmandu, they asked the Government to amend the Enforced Disappearances Enquiry, Truth and Reconciliation Commission Act 2014 first before starting a new selection process based on the revised Act. “It is evident that no competent people will get appointed in the transitional justice commissions unless the government and the political parties stop their interference. The current selection process should be immediately stalled,” said Suman Adhikari, founding chairperson of the Conflict Victims Common Platform (CVCM). Bhagi Ram Chaudhari, chairperson of the platform “No one can stop the conflict era cases from getting internationalised if the government and the parties don’t correct themselves.” He reminded the Government that around 9,000 cases related to severe human rights violations had been filed at the United Nations which could be tried in the international courts if Nepal fails to conclude the transitional justice process. Under the principle of universal jurisdiction, states may make it possible for their domestic criminal justice system to investigate and prosecute crimes such as torture, committed by any person, anywhere in the world.

Former Maoist child combatants who were disqualified from the Army integration process during verification by the UN on November 29 threatened to launch a legal battle against the Government for their rights, reports Republica. Speaking at an interaction entitled “Use of child soldiers in war: international practices and domestic remedy”, former child soldier, Asim Limbu, who now leads the Discharged People’s Liberation Army Nepal (D-PLAN) Struggle Committee said they are working to take the Nepal government to the Supreme Court. “We have been fighting for our rights for several years now, and will continue to do so. This event is a first step toward filing public interest litigation at the Supreme Court,” said Limbu. In 2007, over 4,008 ex-child soldiers were disqualified by the United Nations in course of integrating and rehabilitating the then Maoist combatants.

Locals said a bomb exploded near the voting centre at Saraswoti Tika Secondary School at 7:45 am. Similarly, an IED was detonated near Nawa Prabhat Secondary School Pokhara at 7:30am. Another explosive device went off near Shanti Secondary School at Chhaharepani of Pokhara-16, at 8:00am. A bomb was also detonated near the voting centre at Pokhara-16 at 1:30pm while voting was underway. However, no casualties, have been reported. Explosives had gone off at the voting centres despite tight security. According to Kaski Chief District Officer (CDO), Ramesh Kumar KC, votes were cast at 32 voting booths and 82 voting centres at 11 wards in Kaski constituency-2.

The Conflict Victims Common Platform (CVCP) has written a letter to the House of Representatives, requesting it to call a meeting of the Parliamentary Committee and ensure that the committee formed to recommend commissioners of two transitional justice bodies carries out its duties and responsibilities in a fair manner, reports The Himalayan Times on December 1. The letter written by CVCP to the Parliament read, “The committee has even recommended those names, who were dismissed by the lower House on the ground of their incapacity and inefficiency. Continuity of the old faces already deemed incompetent to hold the position of commissioners has played with the sentiments of the conflict victims. It is also in contravention of the Transitional Justice Act passed by this Parliament. Therefore, we want the House of Representatives to call a meeting of the concerned Parliamentary Committee and seek clarifications from the committee members in this regard, besides directing them not to act contrary to the existing law.”
