Commission of Investigation on Enforced Disappeared Persons (CIEDP) on September 1 urged Prime Minister Pushpa Kamal Dahal to amend the Truth and Reconciliation Commission (TRC) Act, 2014 pronto, reports The Himalayan Times. Holding a meeting with the Prime Minister, the CIEDP members said the amendment would be necessary to effectively carry out its duties as the current law was not clear and complete enough. Democratic Madhesi Front (UDMF) on September 2 seeks Government to withdraw charges against 491 people who were indicted during the Madhes movement, reports The Himalayan Times. A task force formed by the UDMF met Joint Secretary at the Ministry of Home Affairs and gave the details of 491 people who face criminal cases in the Tarai Districts, urging the ministry to withdraw their cases. UDMF task force member Ram Naresh Ray said the Government had assured the UDMF that those cases, which had not reached the court yet, would be withdrawn soon, while it might take some time to withdraw cases that were sub judice in courts.

Two agitating forces - the Federal Alliance (FA) and the Untied Democratic Madhesi Front (UDMF) - decided to observe a ‘black day’ on September 19 the day that the constitution was promulgated, reports The Himalayan Times. The two outfits stated this in their press releases issued on September 4. The UDMF issued a press release saying that an anti-people constitution was imposed on September 20 last year against the interests of marginalised communities including Madhesi, Tharu, indigenous nationalities, Muslims, and Dalits. The front said that it would observe ‘black day’ to protest the constitution. The FA and the UDMF said they would organise protest programmes in all Districts on September 18 and observe a blackout from 7.30 to 8:00pm on September 19. On September 20, the UDMF will observe a candle light vigil for those who lost their lives during the Madhes movement. The front also directed its District chapters to organise programmes on the days and at the sites where people were martyred during the Madhes movement. The FA decided to hoist black flags in VDCs, Municipalities and District headquarters during the day and observe blackout from 7.30 to 8:00pm on September 19. On September 20, the front will organise programmes in all the Districts in memory of those who were martyred during the Madhes movement.Meanwhile the FA has also formed an 11-member committee under Sadbhawana Party (SP) Chair Laxman Lal Karna to prepare a draft of the constitution, reports The Himalayan Times on September 5. Members of the committee include Lalbabu Raut, Brikhesh Chandra Lal, Ram Naresh Ray, Keshav Jha, Gopal Dahit, Kumar Lingden and Prem Bahadur Khati.

The Supreme Court (SC) on September 8 issued a show cause notice on a writ petition filed by four advocates, demanding that the Government make public its work plan relating to all three levels of elections and announcement of election dates, reports The Himalayan Times. The order was passed by a single bench of Justice Ananda Mohan Bhattarai. The petition was filed recently by advocates Chandra Kanta Gyawali, Liladhar Upadhyay, Bimal Gyawali and Shashi Karki. Petitioner Gyawali said that they have said in their writ petition that provincial, local and general elections should be held before January 22, 2017 but the Government had not made public its election work plan, neither had it made legal and other structural preparations for the same.

The Nepal Federation of Indigenous Nationalities (NEFIN) on September 11, submitted a memorandum to Prime Minister (PM) Pushpa Kamal Dahal and demanded 11 amendments to the Constitution in order address concerns of indigenous nationalities, reports The Himalayan Times. The delegation headed by NEFIN President Nagendra Kumar Kumal reached the Office of the Prime Minister and Council of Ministers and demanded amendments to constitutional provisions to ensure participation of the nationalities in state organs and governance system. The demands include adoption of identity as a principal base for state restructuring, naming provinces and other local bodies on the basis of historical, linguistic and cultural identities of ethnic groups living there, 60 per cent allotment of Parliamentary seats for proportional representation system, recognition to one-horned rhino as the national animal among others. Meanwhile, the Federation also included 10 others points in the memorandum and urged the PM to immediately address them. They demanded that a separate ministry be formed to look into issues of indigenous nationalities and education in mother tongues be ensured, among others. The ethnic leaders also demanded that proportional representation should be ensured while making political appointments at various constitutional bodies.

stakeholders in Khotang have floated three models for restructuring local bodies, reports The Himalayan Timeson September 14. Despite the proposal of the Restructuring Commission to form up to nine bodies, two of the proposals submitted have proposed 13 and 10 local bodies, while the next one is in line with the commission’s proposal of nine local bodies. According to the Local Bodies Restructuring Technical Committee Coordinator and Local Development Officer Nishchalraj Pande, it was not possible to propose a single model owing to differences among the political parties. “As the political parties couldn’t concur on the nine bodies’ model unanimously, we had to send all three proposals to the commission,” said Pande. Pande added that the 13-bodies and 10-bodies models propose two municipalities and 11 village assemblies and two municipalities and eight village assemblies respectively. While, the nine-body model has also retained the number of the proposed municipalities, it has proposed seven village assemblies. “All the political parties except for UML are in favour of the 10 and 13-body models, while we have also sent another proposal following the commission’s suggestion to form only nine local bodies,” said Pande.

Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) leader Surendra Pandey on September 13, said, the Government needed to issue a white paper to the public justifying the need to amend the statute, reports The Himalaya Times. Speaking to journalists at a function organised by Press Chautari Nepal, Khotang chapter, Pandey argued that the ruling parties needed to issue white paper to the people clarifying how they were going to amend the constitution. Pandey also accused the ruling parties of not being clear about Pradesh delineation, and distribution of naturalised citizenship, among others. “It is obvious that the statute can be amended. However, the government must make public the concrete grounds,” said former finance minister Pandey. He also charged the ruling Nepali Congress (NC) and the Communist Party of Nepal-Maoist Centre (CPN-Maoist Center) of being unclear about whether to split Sunsari and Kailali Districts, among others. “We doubt that the ruling parties will come up with a common recommendation.

During a meeting with the PM on September 14, leaders of the United Democratic Madhesi Front (UDMF) and the Federal Alliance (FA) expressed dissatisfaction over the PM not organizing even a single meeting to formally discuss the matter of constitutional amendment. "I told the PM clearly that we had voted for him in the prime ministerial election as he had agreed to address the demands of the Madhes movement and amend the Constitution. However, he is yet to hold a single meeting with the UDMF regarding this issue. Therefore, I told him that we cannot continue our support to the government if he keeps on delaying in this regard," said Anil Jha, chairman of Nepal Sadbhavana Party (NSP).Meanwhile, PM Pushpa Kamal Dahal told leaders of the UDMF and FA that if the current coalition Government failed to address the agenda of Madhesis and Janajatis, its relevance would end, reports The Himalayan Times. Tarai Madhes Democratic Party (TMDP) leader Sarvendranath Shukla, who attended the meeting, said the PM also told the leaders of agitating forces that he was aware that his Government should succeed in addressing the issues of Madhesis and Janajatis. “If this coalition government fails to address the issues of Madhesis and Janajatis that would mark the failure of 60 per cent of force of the Parliament. "The staffers at the commission have gone through more than 25,000 complaints so far and categorized them as per the crime. While looking into the 25,000 complaints, the staffers have presented around 800 files to the commission to decide whether to put them on hold or not," said TRC Commissioner Shree Krishna Subedi. Likewise, the Commission on Investigation of Enforced Disappeared Persons (CIEDP) has been scanning at least 1200 complaints at present. “The CIEDP has received 2,870 complaints on disappeared persons. We have started preliminary investigation into at least 1,200 complaints and collected ante-mortem data of at least 42 disappeared persons from the Kathmandu Valley. We are entering the collected data in our database. We'll start full-fledged investigation on the complaints soon," said Professor Bishnu Pathak, the spokesperson of the commission.

CIEDP Spokesperson Bishnu Pathak said the Government had assured it would make available at least 70 staffers when the body was formed in February 2015. But CIEDP eventually got only 42 employees, most of them support-staff and drivers. “About a dozen civil servants were deputed at CIEDP. Locals, who were at the site to observe the road construction process, had informed Police after spotting the bullets. Conflict victims have become concerned about preparations to remove ‘crime against humanity’ from the heinous crime category in the amendment draft bill of the Commission of Investigation on Enforced Disappeared Persons (CIEDP) and the Truth and Reconciliation Commission (TRC) Act, which is being tabled in the Parliament soon, reports The Himalayan Timeson September 27. Attorney General Raman Kumar Shrestha accepted that homework was on to amend the exiting CIEDP and TRC Act, by removing ‘crime against humanity’ from the heinous crime category. Suman Adhikari, chairman, Conflict Victims Common Platform on Transitional Justice-Nepal, said that ‘crime against humanity’ shouldn’t be de-listed from the category of heinous crimes. Rather, it should be clarified what sort of crimes fall under ‘heinous crime’. “In the existing Act, crime against humanity is considered a heinous crime. We shouldn’t remove it from the Act, rather it should be defined clearly,” Adhikari said. He also said other crimes such as forcible use of children in the insurgency, should also be considered a serious crime that happened in the decade-long Maoist insurgency from February 1996 to November 2006. In the existing CIEDP and TRC Act, crime against humanity is termed a heinous crime, along with rape, killing, torture and enforced disappearances. The draft has classified crimes other than these four heinous crimes as ‘other crimes’, by providing space for general amnesty to the perpetrators. The proposed amendment bill is awaiting final endorsement from the Ministry of Law, Justice, and Parliamentary Affairs to be able in the House.

Sadbhawana Party (SP) Chair Rajendra Mahato, who attended the UDMF meeting, said they decided not to accept elections unless their demands were addressed. Mahato said the UDMF also decided to remind the Prime Minister (PM) about the need for immediately tabling a constitutional amendment bill in the Parliament. “We have decided that the top UDMF leaders will meet the PM and remind him of the need to table a constitutional amendment bill soon as per the spirit of the three-point agreement,” Mahato added. He said the UDMF was not happy with the Government because it had not met other demands such as withdrawing false cases against cadres of the front and declaring 16 more victims as martyrs.

He also said that the elections of all three tiers would take place on time on the basis of a national consensus.Meanwhile, United Democratic Madhesi Front (UDMF) in a meeting held between the Prime Minister and the UDMF on September 27 warned of a strong agitation unless the Government implements the three point pact immediately. The UDMF leaders questioned when the three-point agreement will be implemented, when the arrested will be released and how the government will conduct local elections without resolving the issues related to the delineation of federal states. The UDMF strongly objected to three major parties for reaching a deal on restructuring of the local bodies based on the existing area clusters. Responding to a writ petition filed by 15 conflict victims a single bench of Justice Hari Krishna Karki issued the interim order and asked defendants to appear at the next hearing on the petition to discuss whether or not to continue the interim order. According to the petitioners, the guidelines call for putting cases on hold on the ground of lack of evidence or adequate details. They also claimed that the guidelines call for putting on hold even insurgency-era cases if these are not directly related to the conflict parties - security forces and insurgents.
