Communist Party of Nepal (Maoist) leader Baburam Bhattarai, in an interview to the BBC, said that the Maoists would have to respect the decisions of a constituent assembly if elections to it were "free and fair". He added that, "We think this is a step forward in our democratic movement, but it's still worryingly ambiguous… It's not clear whether the constitutional assembly would be conditional or unconditional - that means whether it will be sovereign, free to decide on anything including the abolition of the monarchy, or the continuation of monarchy… Our point of view is that it has to be a sovereign constituent assembly which can decide on the abolition of monarchy, and an institutionalised democratic republic." However, "If the elections are free and fair, one has to respect the result of the elections. Then of course we will abide by the verdict of the people. But we don't believe that the verdict will go in favour of the king."

Reciprocating the Communist Party Nepal-Maoist’s three-month-long unilateral truce, the Government announced a cease-fire on May 3 and also invited the Maoists for talks. Deputy Prime Minister K. P. Sharma Oli said, “We have taken a political decision according to the spirit of the jan andolan (mass uprising). That, of course, is ceasefire and removal of red corner notices issued against certain Maoist leaders.” Elaborating on the time period, Oli informed that “it will be in force until further decision on the issue”.

Prime Minister Girija Prasad Koirala said that the Maoists can be included in an interim Government in the future and they can take part in elections to a Constituent Assembly. “In future, of course, the Maoists can be included in the interim government and should be brought for elections to a Constituent Assembly,” Koirala said after a meeting with the Norwegian Minister for International Development, Erik Solheim. The latter expressed his country’s willingness to assist Nepal in conflict resolution and economic recovery. He, however, ruled out the possibility of Norway mediating in the talks.

Welcoming the Government cease-fire and the withdrawal of Red Corner Notices and the terrorist-tag, Maoist Chairman Pushpa Kamal Dahal alias Prachanda said on May 4 that his party would sit for talks with the Government. Prachanda also said his party has forwarded a draft of a code of conduct to be adhered to by both the sides during the period of talks. “I hope that the code will be implemented honestly,” he said in a statement. “We welcome the government’s decision and the party decides to sit for talks to find a negotiated settlement keeping in mind the 12-point understanding and the spirit of the people’s historical movement,” Prachanda said. He further added that his party was also ready to peacefully re-organise the ‘People’s Liberation Army’ to a new national army as per the “people’s democratic aspirations.” He also hoped that the existing Parliament, Constitution and the Government would be dissolved and an interim Government formed after preliminary talks.

The panel has been asked to name those persons in the previous regime who used force to thwart the rallies. The Government has also discussed the possibility of withdrawing court cases against a number of people filed under various charges, including sedition.

A statement issued by Chairman of the CPN-Maoist, Prachanda, on May 13, today, stated that the Maoist roadmap to hold talks with the government is: declaration of a ceasefire; finalisation of code of conduct; formation of talks team; release of political prisoners; starting talks; dissolution of the old parliament, constitution and government; formation of an interim guideline and government by holding a political conference with representation from the political parties, civil society and renowned personalities of different sectors; setting of electoral constituencies by ensuring the representation from people of all classes, castes, sectors and genders; holding constituent assembly elections under reliable international supervision; and restructuring of the whole state structures including the People's Liberation Army and the Royal Nepalese Army as per the popular mandate expressed through the (constituent assembly) elections. The statement also said that all the above decisions were taken by a special meeting of the central committee of the Maoist party. On May 17, the House of Representatives (HoR) passed a proposal, tabled by Prime Minister Girija Prasad Koirala, depriving the King of privileges enjoyed by him and declared the reinstated House as “supreme.” According to the proposal, the provision of Supreme Commander-in-Chief of the Royal Nepalese Army being held by the King has been scrapped, thereby depriving the King of his control over the army. The proposal also dissolved the Raj Parishad Standing Committee. The proclamation also said that the full executive power will lie to the parliament. The monarch will not have any authority to enact the law concerning royal succession, which will be done by the parliament. The declaration scrapped the provision that the King’s acts could not be challenged before the parliament and the Court. Another major change made by the proclamation is changing the name of the Royal Nepalese Army into Nepali Army, and replacing “His Majesty’s Government” with the “Government of Nepal”. The King will no longer convene a session of the parliament as stipulated in the constitution. The cabinet will decide about the appointment of the army chief, while mobilisation of the army will be done as per the decision of the council of ministers. However, that will have to be approved by the stipulated parliamentary committee. The proclamation has also made the income and assets of the King taxable. The proclamation has also declared Nepal as a secular state and added that the government will make provision for resolving the citizenship problem.

The agreement on topics such as ending the workers’ contract system, issuing appointment letters to employees and providing a minimum of Rs 100 as daily-wage, was reached between the two sides after a three-day-long dialogue at the BCCI office. Over a dozen industries were shut down in the past week after the ANTUF began organising workers’ meetings on the industrial premises and other programmes putting forward a number of demands for the workers’ benefit.

They made public the 25-point Cease-fire Code of Conduct to pave the way for elections to the Constituent Assembly, modalities of which would be discussed during the next round of talks. The coordinator of the Government team, Home Minister Krishna Prasad Sitaula, and the coordinator from the Maoists’ side, Krishna Bahadur Mahara, signed the Cease-fire Code of Conduct. “We will soon hold election to Constituent Assembly and will create an environment in which people will be able to exercise their democratic rights without fear and threats,” said Sitaula after signing the code and added that the “next round of the talks will focus on the process and modalities of election to the Constituent Assembly and whatever differences we may have will be settled amicably.” Meanwhile, Mahara reportedly said, “election to Constituent Assembly is our one-point agenda.” Some of the points agreed upon at the meeting included: both sides to refrain from activities that may provoke the other side; Mobilisation of arms to stop; both sides shall not attack security bases of the other side or use landmine or ambush against each other; fresh recruitment to stop and bandh (shutdown) or strike will not be called during the truce.

The coordinator of the Maoist talks team, Krishna Bahadur Mahara, has reportedly demanded a national convention with participation of people from all sections of society, to draft a new constitution and annul the present one. Speaking at a mass meeting organized by the Maoists in Janakpur on May 27, Mahara said that an interim regime should be formed after dissolving the present Government and Parliament should hold elections to the constituent assembly. Mahara also alleged that a section of the seven-party alliance was for the status quo. “A force out of the SPA is heading in the opposite direction,” Mahara said. Himalayan Times reports that despite the code of conduct being signed by the Government and Maoists on May 26, and in clear violation of it, a significant number of Maoist cadres in combat dresses carrying khukuris (swords) were present in the meeting.
