Baburam Bhattarai-led Naya Shakti (New Force) has made its financial guidelines public on March 1, reports Republica. As per the guidelines, the would-be party will not accept more than NR 50,000 per year from an individual donor and more than NR 2 million per year from an institution, firm or company. The Naya Shakti has also made it clear that it will not accept donations from foreigners, incumbent civil servants and staffers of the institutions which are dependent on Government grants or have 51 percent of shares of the Government. Likewise, the Naya Shakti has announced to reject donations from the firms, institutions or companies, which are registered in foreign lands, black-listed as borrowers or contractors as well as which have 51 percent of share of foreign Governments or have religious and communal goals.

Office of the United Nations High Commissioner for Human Rights (OHCHR) has said that it can’t support Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP) due to lack of authority given to these instruments to ensure justice to the conflict victims and book perpetrators of serious human rights violations, reports The Himalayan Times on March 2. OHCHR in a statement said “In the absence of steps by the Government of Nepal to ensure that the enabling law and procedures of the CIEDP and TRC are in compliance with its international legal obligations, the United Nations is unable to provide support to these institutions.” The TRC and the CIEDP were set up in February 2015.

The agitating United Democratic Madhesi Front (UDMF) on March 2 announced new protest programmes against what it calls discriminatory provisions of the Constitution, reports The Himalayan Times. According to a press release issued by the UDMF Secretariat, the front said that it would carry out an awareness programme in the Tarai from March 8 to March 14 which includes interaction and corner meetings across Madhes. The front also announced it would organize rallies in Kailali, Mahottari, Dhanusha, Siraha and Rupandehi Districts on March 18 to protest the Government crackdown against UDMF cadres in those Districts. On March 20, the front will burn a collective effigy of the erstwhile Constituent Assembly (CA) members who promulgated the Constitution.

Truth and Reconciliation Commission (TRC) Chairman Surya Kiran Gurung said that TRC and the Commission of Investigation on Enforced Disappeared Person (CIEDP) are not astonished by the statement of position by the Office of the High Commissioner for Human Rights (OHCHR) regarding the two transitional justice mechanisms in Nepal, reports Republica on March 5 (today). He said that the United Democratic Madhesi Front (UDMF) had given a chance for the Government to settle the issues by changing the forms of agitation in Madhes. UDMF submitted a seven-point memorandum to the PM urging the Government to address their 11-point demands before mid-April. In the four-page memorandum, the UDMF demanded to carve out two provinces in the Tarai/Madhes, with full autonomy to both. It also sought inclusive representation of all the communities in all organs of the state. The front demanded to delineate constituencies on the basis of population and to retain the proportion of mixed election system ensured in the Interim Constitution.

According to CIEDP Spokesperson Dr Bishnu Pathak, the Commission has set up an investigation division within it and the division will at first investigate on the complaints received at its central office and through local peace committees in Districts. After verifying the complaints, the Commission will send trained officials to the victims' houses to fill an ante-mortem data form for each disappeared person. The Commission will start recording statements of the family and witnesses about the possible perpetrators behind each case of disappearance. After this, the commission will record statements of the alleged perpetrators. If the statements of the victim's family, witnesses and alleged perpetrators lead the commission to a conclusion that the disappeared person is already dead, the Commission will exhume the grave. The Commission will ultimately write to the attorney general for legal action against the perpetrators and to impart judicial remedy to the family. The commission will also write to the Government for providing reparation to the family.

Quashing a writ petition questioning the constitutionality of the provision on the grounds that it was against human rights, the SC said: "The provision is in tune with the Constitution as per the Public Security Act promulgated by parliament that entertains preventive detention by the authorities." It also upheld the terrorist tag on leaders of the Communist Party of Nepal (Maoist), approving the two-and-a-half-year-old Government decision to ban the insurgents. TRC has decided to collect complaints of the victims of decade-long Maoist insurgency beginning April 17 and has asked the District Peace Committees (DPCs) across the country to coordinate the task. TRC has set up a nine-member Monitoring and Vigilance Committee (MVC) under TRC member Manchala Jha to check impartiality and fairness of DPC work. Chitwan District’s Nisha Neupane, who was a Maoist fighter during insurgency, has also been made one of its members. TRC member Mahhabi Bhatta put a ‘note of dissent’ on the decision and demanded to scrap the MVC, as TRC itself is capable of overseeing DPC work.

Sadbhawana Party (SP) Chairman Rajendra Mahato during a press conference after the conclusion of three-day extended meeting of the party in Biratngar town of Morang District on March 31 warned that a stern protest would be launched from mid-April if the Government did not address demands of Madhes by that time, reports The Himalayan Times. He said “The government has time till mid-April to address the demands of the Madhes. We are not in a mood for another protest. It will be better if the government utilise the opportunity.” He went on to say the new protest would be aimed at pressurising the Government instead of giving trouble to people.
