On June 1, major political parties intensified inter-party talks with a fresh commitment to prepare first draft of the new constitution by mid-July, reports myrepublica.com on June 2. Senior leaders from Nepali Congress (NC), Communist Party of Nepal-Unified Marxist Leninist (CPN-UML), Unified Communist Party of Nepal-Maoist (UCPN-M) and United Democratic Madhesi Front (UDMF) have said deliberations over forming a national unity government would be held only after resolving the unsettled issues of the new constitution. However, NC Vice-president Ram Chandra Poudel said disputes related to state restructuring could be settled in stages if all the contentious issues are not settled at one once. Poudel further claimed that major political parties are inching closer to a consensus on the number of provinces. The next meeting of the major four parties is scheduled for June 2 (today).

Further, the CPN-UML is divided over whether the Sushil Koirala-led government should be changed now or only after promulgating the new constitution, reports ekantipur.com on June 3. A section of CPN-UML leaders, including party chairman KP Sharma Oli, are strongly pressing for replacing the Koirala-led government, whereas other leaders, including the party’s Deputy General Secretary Ghanshyam Bhusal, are mounting pressure on the party leadership to change the government only after promulgating the new statute. The leaders, including Bhusal, say if the government with two-third majority fails to promulgate statute and new power equation emerges, the constitution writing will be further complicated. “It would be better to form a new government only after promulgating the new constitution. Otherwise, the government might be replaced but constitution will not be promulgated,” Bhusal said.

The meeting of the top leaders of the NC, the CPN-UML, the UCPN-M and the United Democratic Madhesi Front (UDMF) held at the Prime Minister's residence on June 2, discussed on constitution writing, disaster management and formation of a national consensus government. According to the leaders, the meeting strived to settle the past disputes and the discussions were heading towards the positive direction. The top leaders of the four parties are scheduled to next meet at 5 pm June 3 (today) in their bid to forging consensus within June 4 on topics as constitution writing, disaster management and formation of a national unity government.

"This is the most favorable time for leaders to make compromises because people at this juncture are ready to forgive leaders if they deliver a new constitution and concentrate all efforts on the task of reconstruction," Nembang told a group of journalists at his chamber in Singha Durbar on June 2. "I therefore have urged the major parties to seize this moment." Nembang said the present situation is not only favorable for compromises on key issues but also an opportune moment to heal the people's deep wounds created by recent earthquakes.

The ruling Nepali Congress (NC) and Communist Party of Nepal-Unified Marxist Leninist (CPN-UML) said that they would accept Maoist proposal of a mixed model electoral system—60 percent direct and 40 percent proportional—provided they reach consensus on federalism, reports ekantipur.com. During a four-party meeting at Prime Minister Sushil Koirala’s residence in Baluwatar on June 2, the Unified Communist Party of Nepal-Maoist (UCPN-M) proposed to elect 40 percent representatives through the proportional system and the rest under the first-past-the-post. NC and CPN-UML leaders said they would accept the proposal provided that the Maoist party reaches an understanding on federalism--the most disputed issue of the constitution. The ruling parties had previously proposed to go for the direct electoral system in their joint-proposal tabled at the Political Dialogue and Consensus Committee of the Constituent Assembly.

During a meeting held between NC and the CPN-UML at the Prime Minister's Official Residence in Baluwatar on June 7, the two parties reached agreement to limit the total number of parliamentarians from both houses to 300. Committee member Ram Narayan Bidari said it has been difficult to expedite the task of writing the preliminary draft to the desired extent as the draft of the constitution has to be written in simple language keeping the views and aspirations of all in mind. The members of the taskforce said there were no differences as such in the taskforce, in course of drafting, regarding the topics on which consensus has been built, and that intensive and wide-ranging discussions have been held on the topics to be incorporated and how this is to be done in the Preamble, Section, Articles and Sub-articles of the constitution and these topics were being finalised. The taskforce has been taking the formal and informal views and suggestions from the constitutional experts and lawyers as well in the course of giving final shape to the draft of the constitution. In the interim, Committee secretary Rabi Aryal said the taskforce would prepare the draft even late tonight (June 22) so that it could be presented in the committee’s meeting scheduled for June 24.

The CA chairman, during his meeting with the President at the President office in Shital Niwas, Kathmandu, briefed the Head of State that the work related to the constitution writing was going ahead in an expeditious manner and has reached the draft writing stage, and the committee was working day and night to take it to a conclusion at the earliest. On the occasion, President Yadav reiterated on moving ahead maintaining balance of power and cordiality among the Executive, the Legislature and the Judiciary, not to escalate dispute and to keep patience. CA chairman Nembang told media persons that during the meeting, the President pointed out the discord seen between the court and the parties, the Executive and the court and the CA and the Judiciary as of late, urging that it should not happen. Further, Nembang also expressed serious discontent over the SC's order on the 16-point deal struck between the four major political forces, adds Myrepublica.com. While President Yadav stressed on maintaining harmonious relations between the judiciary, the executive and the legislature, Nembang urged Yadav to suggest to SC to exercise judicial restraint while issuing any order on political issues. "The judiciary, the legislature and the executive have to respect each other's role," Nembang told reporters after the meeting. "The SC should have given the CA a chance to defend itself before issuing such an order."

The draft prepared by the committee has recommended 35 sections and 312 Articles. However, the taskforce which is under the committee led by Nepali Congress (NC) leader Krishna Prasad Sitaula has not been able to settle some disputed issues. The meeting of the top leaders scheduled for June 24 (today) will discuss on thorny issues. The taskforce in its draft has recommended 33 fundamental rights and nine constitutional bodies in the new constitution. However, some members of the taskforce are with an opinion to drop one constitutional body. The report prepared by the task force will be presented to the meeting of the CDC and it will be given final touch after having cursory discussion on it, informed another member of task force Ram Narayan Bidari.

This is the second time the taskforce has received deadline extension from its supervisory body. The taskforce was originally supposed to complete the work by June 22. But, after the taskforce failed to get the job done by the June 24 deadline, the CDC has instructed the taskforce to come up with the integrated draft of the new Constitution by June 26. The taskforce failed due to dispute among the parties on issues like structure of local bodies, interim election for local bodies and provisions relating to amendment to constitution and wordings on citizenships.

UCPN-M expressed its dissatisfaction saying that the Constitution Drafting Committee (CDC) Chairman Krishna Prasad Sitaula added some words which is against the 16-point understanding reached among the political parties on June 8. Seventeen months after the second Constituent Assembly (CA) election, the preliminary draft of the new constitution was tabled in the CA on June 30, paving the way for promulgation of the new national charter, reports Ekantipur.com. Even though several more steps remain before the constitution is finally out, leaders termed the move as a great achievement considering that the first CA elected in 2008 was dissolved in 2012 without producing the first draft. Constitution Drafting Committee (CDC) Chairman Krishna Prasad Sitaula presented the draft, proposing wider discussion among the CA members. During the second CA polls, major parties had pledged to bring out the first draft within six months and the final constitution within a year—by the missed January 22 deadline. Deliberations on the draft will begin on July 2, in the Assembly. The draft will then be taken to the people to solicit their opinions on the provisions. The parties, however, remain divided over the time to be allocated for public consultation.
