Prime Minister KP Sharma Oli was forced to agree to discuss the 19-page proposal of party Co-chair Pushpa Kamal Dahal on December 1 in the Secretariat meeting of the ruling Nepal Communist Party (NCP) held at the Prime Minister’s official residence in Baluwatar, Kathmandu, reports The Himalayan Times. Oli found himself in minority in the nine-member Secretariat when he said Dahal should withdraw his 19-page proposal, with only party General Secretary Bishnu Prasad Paudel backing the Prime Minister.

Conflict victims, who have been awaiting justice for the last 14 years, say political parties have repeatedly employed transitional justice to play the game of one-upmanship, reports Kathmandu Post on December 3. On November 13, Nepal Communist Party (NCP) Co-chair Pushpa Kamal Dahal accused Prime Minister KP Sharma Oli of taking unilaterally with complete disregard to the party’s instructions. On November 25, the Oli Cabinet decided to provide free treatment for the injured from the decade-long armed conflict at Government hospitals. Suman Adhikari, founding chairperson of the Conflict Victims Common Platform said “What had stopped the Oli government from announcing free treatment all these years? It’s just a messaging by Oli to the former Maoists in his party.” On November 29, a day after Oli’s political document, Minister for Law and Justice Shiva Maya Tumbahanghe invited the representatives of conflict victims and said that the Government wants to see the transitional justice process concluded without delay. Gopal Shah, chairperson of the Conflict Victim’s National Platform said “All these claims that the government is committed to concluding the transitional justice process are nothing but an eyewash. The government is reaching out to the victims now not because it is worried about them. It is trying to placate the victims to remind Dahal that the transitional justice could invite trouble for him.” Since its formation in 2015, the transitional justice bodies have not completed a single investigation of thousands of cases. According to Shyam Shrestha, a political commentator who follows the left politics closely, Oli is using every means to retain his superiority in the party and transitional justice is one of them. “Whenever Oli lands in trouble in the party, he uses transitional justice as a bargaining tool against the Maoists. He is playing the same trick now, albeit in a more visible manner,” said Shrestha.

Secretariat members Jhalanath Khanal, Madhav Kumar Nepal, Bamdev Gautam, Narayankaji Shrestha, and Bishnu Poudel attended the meeting which was chaired by Executive Chairperson of the party Pushpa Kamal Dahal. The meeting was scheduled to hold deliberation on the proposals tabled earlier by the chairmen duo KP Sharma Oli and Pushpa Kamal Dahal at the party Secretariat. On November 28, Oli presented a 38-page-long rebuttal in response to a 19-page-long political paper presented earlier by Dahal. Chairman Dahal, in his political document, raised questions on the incumbent government's performance, asking indirectly Oli to step down from the post. Arguing that the political paper presented by Dahal was against the principles and values of the communist party, Oli demanded withdrawing the political paper presented by Dahal at the party’s Secretariat meeting. Oli termed the report tabled by Dahal as mere allegations.

Minister for Foreign Affairs Pradeep Gyawali at an interaction in the Capital on December 13 said the Government is giving final touches to the bill to amend the Enforced Disappearances, Truth and Reconciliation Act-2014 to be presented in the winter session of Parliament, reports Kathmandu Post. The amendment is being drafted by complying with the provisions of the Comprehensive Peace Accord, the Supreme Court’s ruling, Nepal’s international commitments, concerns of the conflict victims and the ground reality of the country, Gyawali said. “The transitional justice process prioritises reconciliation, but with consent from the victims. Also, there will be no amnesty in cases involving human rights violations,” he said.

Addressing a virtual programme, jointly organised by Accountability Monitoring Committee and Conflict Victims Common Platform, Minister Gyawali said the Government was carrying out activities to ensure justice to the victims. “There would be no pardon in cases of serious human rights violation. During his field trip to various brigades and barracks across the country, Thapa directed army personnel to be more vigilant saying that the Chand-led group have declared people’s Government in Kalikot, bombed various places and killed innocent people including school teachers. “Let us not be surprised by some unwanted activities of the group led by Netra Bikram Chand, so be prepared,” said the chief of Army.

Prime Minister (PM) KP Sharma Oli on December 15 introduced an ordinance to amend the Constitutional Council Act (Functions, Duties, and Procedures) 2010, according to which a meeting of the council can be convened even if it falls short of the quorum required to convene the meeting, reports Kathmandu Post. Three lawyers filed a writ petition at the Supreme Court on December 28 demanding that the reshuffle of KP Sharma Oli Cabinet be scrapped because Oli has been reduced to a caretaker prime minister after he dissolved the House of Representatives on December 20, reports Kathmandu Post. Advocates Lokendra Oli, Keshar Jung KC and Dinesh Lamichhane have jointly registered the writ petition as the Article 77(1) of the Constitution states that a person who is not a member of Parliament cannot be a Prime Minister and a Minister. “Our writ petition was just registered. Discussions on it will be held on Wednesday. We have demanded that the caretaker government cannot reshuffle the Cabinet and therefore the move should be scrapped,” said advocate Oli. In the writ, the petitioners have also demanded that the Supreme Court issue an interim order not to implement the decision of December 25 of Cabinet reshuffle. Speaker of the dissolved House of Representatives (HoR), Agni Prasad Sapkota on December 31 said that the Constitution of Nepal does not allow Prime Minister K.P. Sharma Oli to dissolve Parliament, reports Republica. Sapkota maintained “The current constitution does not give the authority to the Prime Minister to dissolve parliament in circumstances like this one. I am going to give this opinion to the supreme court as well.” Speaker Sapkota also said that he is holding wider consultation with all stakeholders concerned to see how he as the speaker of the now dissolved parliament can play his role to safeguard the constitution and work in the interests of the country and its people.
