Co-chairpersons of the ruling Nepal Communist Party (NCP) Pushpa Kamal Dahal and KP Sharma Oli resumed dialogue on August 2, after almost a week in an attempt to end the stalemate between rival factions in the party, reports The Himalayan Times. Dahal went to hold talks with Oli along with senior party leader Jhalanath Khanal. Deputy Parliamentary Party leader of the NCP, Subas Chandra Nembang, who is close to Oli, was also present in the meeting. The NCP faction led by Dahal and senior leader Madhav Kumar Nepal has asked the Prime Minister to quit either as Prime Minister or party co-chair. However, Oli has refused to quit any of the two posts.

Four leaders of Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand) were arrested from a hotel in Radi Bazaar of Western Rukum District in Province No. 6 while they were holding talks, reports Khabarhub on August 6. The arrested are identified as District Secretary Hiramani Rawal (39), District Committee member Ghamand Mahar (28), District Committee chief of party’s student wing Prem Prashan Bohara (19), and cadre Tul Bahadur Gharti (20).

Vice-chair of the ruling Nepal Communist Party (NCP) Bamdev Gautam, who till a few weeks ago was siding with the party’s faction led by Co-Chair Pushpa Kamal Dahal and senior leader Madhav Kumar Nepal, on August 5, said he was in no camp, reports The Himalayan Times. Gautam issued a press statement through his Personal Aide Bishwamani Subedi, saying he was not with any camp within the party. His statement gives some respite to Prime Minister KP Sharma Oli, who has fallen in minority in the NCP’s Standing Committee and Central Committee. According to the statement, Gautam told Dahal when the latter went to meet him at his residence that he was in favour of party unity and he was not with any faction or leader. Dahal had gone to Gautam’s residence to ascertain his support in the fight against Oli. Earlier, on July 28, Gautam mooted a six-point proposal suggesting that Oli be allowed to stay as PM until the term of the House of Representatives ended and chairman of the party until the next General Convention. The proposal adds that Dahal should assume the executive chairperson of the party.

Revoking the verdicts of lower courts, the Supreme Court has given a clean chit to Govinda Bahadur Batala, a ‘brigade commander’ of then Maoist People’s Liberation Army who allegedly masterminded the murder of Ram Hari Shrestha, a restaurateur in Koteshwor in 2008, reports Kathmandu Post. Shrestha was abducted from Kathmandu on April 27, 2008 and his body was found on the bank of Trishuli River in Chitwan district a month later on May 25. In his Police statement, Batala confessed to have taken Shrestha, along with Keshav Adhikari and Gangaram Thapa to Chitwan, for an investigation into their alleged involvement in the robbery of Rs 1.7 million and a pistol. On May 31, 2011, a single bench of Chitwan District Court judge Bhojraj Pokharel ordered three months of imprisonment to Batala arguing even though he wasn’t directly involved in the killing, he was present at the scene. The Hetauda Appellate Court upheld the decision on January 19, 2014. Batala challenged the decision in the Supreme Court. The division bench of Justices Tej Bahadur KC and Tanka Bahadur Moktan on March 1 issued a verdict, giving clean chit to Batala arguing that he had no involvement in the entire crime. KC and Moktan, in their verdict, say the decisions of Chitwan District and Hetauda Appellate courts were wrong.

The International Commission of Jurists has recommended that Nepal give full shape to all its inclusion commissions established by the Constitution and provide adequate financial and human resources to allow them to function in an independent manner, reports Kathmandu Post on August 7. In its report “Human Rights and the Rule of Law in a Federal Nepal”, the international non-governmental organisation of judges and lawyers around the world said appointments to the commission should be done with due urgency so that the commissions function as per the spirit of the statute. “The needed amendments are well-known, and if implemented, would create a consensus that would allow the transitional justice process to finally move forward—the stated goal of the current government,” reads the report. It also has recommended the government initiate a new process for the appointment of commissioners to transitional justice bodies that is transparent and consultative.

63 lawmakers from the ruling Nepal Communist Party (NCP) on August 9, started a signature campaign to pressure party leaders not to do anything against the unity of the party, reports The Himalayan Times. The lawmakers’ move comes at a time when the factional feud in the NCP has reached a climax, with the faction led by Co-chair Pushpa Kamal Dahal and senior leader Madhav Kumar Nepal asking Prime Minister KP Sharma Oli to quit either as the PM or party co-chair. Oli has, however, refused to quit any of the two posts. Organizing a press conference, the lawmakers representing the federal Parliament also urged the party leadership to focus on containing the spread of the COVID-19. The lawmakers involved in the signature campaign are deemed close to both Prime Minister KP Oli and Chairman Pushpa Kamal Dahal. The lawmakers have also announced that they will not support any of the top leaders if they decide to split the party.

The six-member task force has two loyalists of each of the three top leaders, Oli, Dahal and Madhav Kumar Nepal. The Oli faction is represented by Province 5 Chief Minister Shankar Pokharel and party General Secretary Bishnu Prasad Paudel, who will coordinate the task force; Janardan Sharma and Pampha Bhusal are from Dahal faction, while Bhim Rawal and Surendra Pandey represent Nepal.

The Secretariat meeting endorsed a six-member task force formed earlier by Prime Minister Oli and Chairman Pushpa Kamal Dahal to draft an agreement to settle the intraparty differences seen in the NCP, according to NCP Spokesperson Narayan Kaji Shrestha. The Election Commission (EC) on August 19, registered new Communist Party of Nepal-Unified Marxist–Leninist (CPN-UML) party, chaired by Sandhya Tiwari, a permanent resident of Morang District, reports The Himalayan Times. The General Secretary of the party is Manish Kumar Upadhyay, a permanent resident of Dhanusha District. According to an official of the EC, the new CPN-UML was granted the election symbol of rising sun in the Himalayas. The EC source said since the KP Sharma Oli and Pushpa Kamal Dahal led Nepal Communist Party (NCP) had the Sun as its election symbol, the new CPN-UML office bearers chose rising Sun in the Himalayas as their election symbol. EC Spokesperson Raj Kumar Shrestha said the polls panel decided to register the new party after it met all the requirements. With this, total number of registered parties at the EC has reached 132.

Co-chair of the ruling Nepal Communist Party (NCP) Pushpa Kamal Dahal on August 20, told Prime Minister KP Sharma Oli to withdraw recent political appointments as that could adversely affect the environment within the party at a time when a task force had already been formed to solve the intra-party feud, reports The Himalayan Times. Dahal told Oli that he should make political appointments only after getting them approved by the party Secretariat. The Government recently appointed Durga Bhandari as the acting chairperson of Press Council Nepal. The appointment was stayed by the Supreme Court on August 19. The Government also appointed Kalyan Rokka as the chair of Youth and Small Enterprises Self-Employment Fund. A few days ago, Dahal and senior NCP leader Jhalanath Khanal had met Oli and opposed the appointment of Sushil Bhatta as the chief of Investment Board Nepal.

The six-member Task Force formed by the ruling Nepal Communist Party (NCP) to resolve the bitter intra-party rift on August 22 suggested that Prime Minister K P Oli should complete his five-year tenure, while Executive Chairman Pushpa Kamal Dahal be allowed to exercise full executive power over party affairs, reports Hindustan Times. According to Oli’s Press Adviser Surya Thapa, the two chairpersons held talks in Kathmandu and fixed the date for the next Secretariat meeting on August 29 to discuss the Task Force report. The Task Force has stated that Oli will remain the Prime Minister till the General Election and will focus on governance, while Dahal will hold party meetings, implement party decisions and focus mainly on party affairs. The Task Force also suggested that the party prepare for the first unity convention scheduled for April 7-12, 2021 on the basis of consensus.

The organisations also regretted for not bringing truth to the public regarding cases of disappeared, even 14 years after the signing of the Comprehensive Peace Accord in 2006. "Although the Comprehensive Peace Agreement of 21 November 2006 between the government and the Communist Party of Nepal (CPN-Maoist), which formally ended the armed conflict, promised to make the fate or the whereabouts of the disappeared public within 60 days, thousands of families have been being denied the right to the truth about these cases for the last 14 years. The Commission of Investigation on Enforced Disappeared Persons (CIEDP) issuing a press release on the occasion of the International Day of the Victims of Enforced Disappearances on August 30 asked the Government to facilitate its activities by amending the existing transitional justice law in line with the Supreme Court order to make it victim-friendly, reports Republica. The commission also stated that there are some provisions in the Commission of Investigation on Enforced Disappeared Persons and Truth and Reconciliation Act, 2014 which need to be amended as per the order of the Supreme Court. According to the commission, of the total 3,223 complaints registered at the commission, preliminary investigations have been completed on 23 complaints, and comprehensive investigations are being carried out on the other 2,507 complaints.
