An internal rift within the ruling Nepal Communist Party (NCP) has reached to its climax after Prime Minister (PM) K P Oli unilaterally on April 20 decided to introduce an ordinance that makes it easy to split the party, reports Republica. The proposed ordinance will pave way to split the party if the dissenting faction is able to garner 40 percent of the total strength either of the party's Central Committee or the Parliamentary Party Committee. This will bring amendments in the existing provisions in the Political Party Act. Existing provision makes it mandatory for the dissenting faction opting to split the party to have 40 percent strength in both the party's Central Committee and Parliamentary Party Committee.Party insiders say Prime Minister Oli's decision to hastily introduce ordinance could be a result of his troubled relations with Chairman Puspa Kamal Dahal. "Prime Minister Oli must have felt some kind of insecurity as he is left in the minority both in the Secretariat and the parliamentary party committee with a new political equation within the party," said a second-rung NCP leader, asking not to be named.

The Nepali Congress (NC) and Samajbadi Party-Nepal (SP-N) on April 21, issued a press release demanding that the Government to withdraw two ordinances amending the provisions of the Constitutional Council Act and Political Party Act, reports The Himalayan Times.The ordinance related to Constitutional Council Act allowed the Constitutional Council to take decisions on the basis of majority. Similarly, the ordinance related to Political Parties Act allows party leaders to split their party if they have 40 per cent support either in the Central Committee or the Parliamentary Party. Until now party dissidents were required to muster support of 40 members in both the Central Committee and the Parliamentary Party of their party.The NC said that both the Constitutional Council Act and the Political Party Act undermined the spirit of the constitution.SP-N said in its release that the ordinance related to Political Party Act would make it easy for those who wanted to split a party using money and power.

A meeting of the four opposition parties — the Nepali Congress (NC), Rastriya Janata Party-Nepal (RJP-N), Samajbadi Party-Nepal (SP-N) and Rastriya Prajatantra Party (RJP) — on April 22 condemned the promulgation of two ordinances that amended key provisions of the Constitutional Council Act and Political Party Act, reports The Himalayan Times.The four parties termed the two ordinances as against the spirit of the constitution and democratic norms and practices. “We take the promulgation of these ordinances as the Oli-led government’s latest attempt to take the path of tyranny. The government should immediately withdraw these ordinances,” the opposition parties stated in their joint press release.

Samajwadi Party-Nepal (SP-N) and Rastriya Janata Party-Nepal (RJP-N) sealed a unity deal on April 22 and leaders of the two parties went to the Election Commission (EC) to register their new party — Janata Samajwadi Party-Nepal (JSP-N).The two parties have decided to register their new unified partywhich will retain the SP-N’s flag and the RJP-N’s umbrella election symbol.The unity averted the risk of a split in the SP-N as Vice-chair of the party Renu Yadav was allegedly preparing to split the party with the support of six other party lawmakers – Mohammad IshtiyakRayi, Uma Shankar Argariya, Pradip Kumar Yadav, Surendra Yadav, KaludeviBishwakarma and Renuka Gurung. JSP-N leader Rajendra Mahato said they signed the unity deal to give befitting reply to Prime Minister KP Sharma Oli who relaxed the provision of the Political Party Law to engineer splits in the SP-N and RJP-N. “With this deal, we have given the message that we are not divided but united. We were to seal a unity deal after the lockdown but since the government brought the ordinances, we hastened to seal the deal of unity,” he added.The two parties’ merger means they now have a total of 33 Members in Parliament—17 from SP-N and 16 from the RJP-N. Renu Yadav’s seven lawmakers now fall short of the 40 percent threshold to split the party.

President Bidya Devi Bhandari on April 24 repealed controversial ordinances the Constitutional Council Act and the Political Party Act at the recommendation of the Council of Ministers, reports Republica. After criticism from all quarters, the Government decided to withdraw those ordinances. A meeting of the Cabinet held at the Prime Minister's official residence in Baluwatar took a decision to this effect. The first ordinance introduced by the government was an amendment on the provisions in the Political Party Act to make it easy for parties to split, while the second ordinance made it possible to convene a meeting of the Constitutional Council even without the participation of the main opposition party leader. The Constitutional Council, headed by the Prime Minister, makes constitutional appointments.

The Supreme Court (SC) on April 26 rejected the Government’s request to review its verdict on a case of transitional justice, reports Republica. A five-member bench of justices Deepak Kumar Karki, Meera Khadka, Bishwambhar Shreshta, Ishwar Prasad Khatiwada and Ananda Mohan Bhattarai refused to reopen the case. The full bench finally closed the door for reviewing the apex court verdict which was issued some two years ago following intense hearings on a case filed against the Government by Suman Adhikari. Deciding the Suman Adhikari Vs Nepal Government case, the apex court had refused to grant general amnesty to those accused of heinous crimes such as rape and murder and other serious human rights abuses.

Prime Minister KP Sharma Oli’s offer to make Madhav Kumar Nepal the third Co-chairman of the Nepal Communist Party (NCP) and Bamdev Gautam the new Prime Minister has created ripples in the party, reports The Himalayan Times on April 30. But it is not yet clear whether the Prime Minister, who made the offer in a bid to end the bonhomie between Co-chairman Pushpa Kamal Dahal and senior leader Madhav Kumar Nepal, will succeed.The Dahal and Nepal factions have been pressuring the Prime Minister to quit at least one post — party Co-chairman or the Prime Minister. Standing Committee member Raghuji Pant, who is close to Nepal, told that Nepal was not keen on Oli’s offer to make him the third chair, as its sole motive was to expose and weaken him.Pant said the Prime Minister’s offer was only a bid to weaken the Dahal and Nepal factions that had sought his resignation from either the post of party Co-chairman or the Prime Minister. Oli has fallen into minority in the party’s Secretariat, Standing Committee and Central Committee after Nepal, Gautam and JhalanathKhanal sided with Dahal.
