The Union Government said on December 1 that there was increase in the number of infiltration cases along the Line of Control (LoC) in Jammu and Kashmir during 2009, Daily Excelsior reported. According to the data furnished by Union Minister of State for Home Affairs Mullappally Ramachandran in reply to a written question in the Lok Sabha (Lower House of Parliament), 395 cases of apprehension of infiltration were reported in 2009 as compared to 342 in 2008. There were 573 cases of apprehension of infiltration reported in 2006 and 535 in 2007 along the LoC in Jammu and Kashmir, the data said. The Minister said that Government has increased the budget for road construction and fencing on the India-Pakistan border by nearly 300 per cent. "Along Indo-Pakistan border, the Government has approved revision of cost estimates in fencing, floodlighting, roads and Border Outposts works from the earlier sanctioned Rs 380 crore to Rs 1,201 crore," he said. The Minister said 1,915 km of fencing and 1,861 km of floodlighting works have been completed on the India-Pakistan border out of 2,043 km of fencing and 2,009 km of floodlighting sanctioned by the Government. "Out of 340 km of border roads sanctioned by the Government in Gujarat sector on the Indo-Pakistan border, the construction works of 219 km of border roads have been completed," he added.

Chidambaram noted that Jammu and Kashmir had a number of groups with a number of demands. And even though some groups had demanded the right of self-determination or self-rule, "I do not think we should shy away from talking to any group." "These will be quiet talks, quiet diplomacy... far away from the glare of media," he said, adding he could not share details of the talks at this moment. Noting that the response to the proposal was encouraging, he hoped a "solution will emerge." Asked if the Jammu and Kashmir Chief Minister Omar Abdullah too shared the Centre's perception of having "quiet talks", he said, "I think I know Omar Abdullah's position... we are on the same page." He said the right climate had been created in Jammu and Kashmir where Friday Prayers were being held smoothly and there had been no major public demonstrations against the Government. The Amarnath Yatra participated in by 3.92 lakh pilgrims had passed off peacefully without a single incident and lakhs of people were visiting the Vaishno Devi shrine without problems and Gurupurab and Eid functions were held in the Valley. Answering supplementary questions, he said there will be no talks with Pakistan unless it brings to book the perpetrators of the Mumbai terror attacks. "There are no talks with Pakistan," he said. "The Prime Minister has already stated that unless Pakistan brings to book the preparatory of 26/11 Mumbai (terror) attacks and dismantles terrorist infrastructure (in that country), there is no scope for talks with Pakistan," Chidambaram said. Replying to a debate in the Rajya Sabha on internal security, he said the Government would maintain zero tolerance towards terrorism, whether it is in the shape of jihadi violence or Hindu extremist violence. He also said India remains vulnerable to terrorism as he noted that outfits like the Lashkar-e Toiba (LeT) have forged alliances with Al Qaeda and Pakistan has not changed its attitude.

The Security Forces on December 2 arrested three militants, including the former ‘financial chief’ of the Jammu and Kashmir Liberation Front (JKLF), who had returned from Pakistan occupied Kashmir (PoK) in 2008 and evaded arrest several times since then, Daily Excelsior reported. Sirajuddin Mir, who went across the Line of Control in 1990, was arrested during a operation at the house of a slain JKLF ‘commander’ at Sunoorkalipora in the Budgam District, official sources said. "Police and Army had information that Mir might visit the residence of slain JKLF commander Haider on his anniversary today. He came trying to conceal his identity by wearing a monkey cap and wrapping himself in a blanket but was found out by the police personnel on cordon and arrested," they said. Mir, a resident of Karehama village in the Kunzer area of Baramulla District, was still active in militancy related activities and had not visited his home since returning from the other side of Kashmir in August 2008. A Range Officer in the Forest Department when he joined militancy in 1990, Mir, now believed to be around 70 years old, was the financial chief for JKLF at the peak of militancy and had stayed in PoK for more than 18 years.

The Union Government on December 2 announced the withdrawal of a "significant" number of battalions of Central forces from Jammu and Kashmir in a significant confidence-building measure following the initiative for holding a "quiet" dialogue with separatist groups, Daily Excelsior reported. The Union Home Minister P. Chidambaram informed the Rajya Sabha (Upper House of Parliament) that the decision had been taken in view of the improvement of law and order situation in the State. On the situation in Jammu and Kashmir, Chidambaram said violence in the State has been the lowest in 2009 and the Centre is willing to take "what appears to be a risky step of withdrawing a significant number of battalions of security forces" and hand over law and order to the Jammu and Kashmir Police. He also said the process has already been initiated but refused to quantify the personnel being withdrawn. The announcement would be a major confidence-building measure offered by the Union Government which has initiated a "quiet" dialogue with the separatist groups. Earlier in the day, Chidambaram told the Upper House of Parliament that Kashmiri groups have responded positively to the Centre’s initiative of "quiet talks" and hoped a solution will emerge. He said the Government would not shy away from talking to any organisation, some of which are demanding self-rule.

Bhat was a close associate of Pakistani militant Nadeem Gujjar, a resident of village Dohota in the Sialkot District in Pakistan. One Chinese pistol, one magazine and 15 rounds were recovered from his possession. Meanwhile, the Sopore Police arrested a hawala courier who had evaded arrest earlier this week. Identified as Raju, the youth was scheduled to pick up INR 300000 from Manzoor Ahmad, a bakery owner at Sopore, on November 30 but slipped from the Police net as the bakery owner was arrested. Police had raided several hideouts of Raju over the past three days and he was arrested late last night, official sources said. Eight persons have been arrested in the latest crack down on hawala operators in Kashmir valley since July 2009.

In a major set back to the dialogue process between the Centre and separatists in the State, unidentified gunmen on December 4 shot at and critically injured Fazal Haq Qureshi - a senior leader of the faction of All Parties Hurriyat Conference (APHC) led by Mirwaiz Umar Farooq - outside his house in the Soura locality of capital Srinagar, Daily Excelsior reported. Qureshi was shot at by the assailants from point blank range when he was returning home after offering the Maghrib (dusk) prayers at the local mosque at Bilal Colony, official sources said. The little known militant outfit Al-Nasireen has claimed responsibility for the attack.

He told reporters that the elements behind the attack were scared that their shops will be shut in case of resolution of Kashmir issue through a dialogue process. He asserted that talks with India and Pakistan for resolution of Kashmir issue will go ahead. Chief Minister Omar Abdullah is reported to have described the attack as a well-thought out attempt to derail the peace process. "It is the most unfortunate incident and a well thought out attempt to derail the peace process and deny people of the State a peaceful atmosphere they have a right to," Omar said. Describing Qureshi as a pro-dialogue individual and among the most reasonable separatist leaders, Omar said he was one of the separatist leaders who wanted to find a solution to the Kashmir problem at the negotiating table. The Chief Minister said Qureshi was offered security on various occasions but he turned it down. A member of the decision-making Executive Committee of the Hurriyat Conference, Qureshi had played a key role in facilitating talks between the Hizb-ul-Mujahideen (HM) and the Government in 2000 following a cease-fire in July that year. Official sources said SFs, who had been hunting four militants in upper reaches of Chilli area since the afternoon of December 13 finally trapped the militants in early hours of December 14. A heavy exchange of gun fighting between the two sides continued for more than two and a half hours in which two top militants of Hizbul Mujahideen were eliminated while two others managed to escape. Inspector General of Police (IGP), Jammu Zone, Ashok Gupta said that one of the slain militant, Tariq Hussain Khandey alias Idrees alias Mama son of Bashir Ahmed, a resident of Chilli, Gandoh was a ‘district commander’ of HM. Mama was second longest surviving militant in Doda district. He was active in the militancy since 1998, Mr Gupta said, adding he was involved in a number of militant activities including killings of civilians, attacks on SFs and abductions. Other slain militant was identified as Yasir Ahmed Kantroo alias Mubassir alias Owais. He was active since 2003 and was also wanted in a number of subversive activities. Two AK-56 rifles and four magazines were recovered from the possession of the slain militants. Senior Superintendent of Police (SSP) of Doda District, Parbhat Singh, who supervised the operation, said that SFs didn’t suffer any casualties in the operation.

Army on December 17 foiled an infiltration bid by militants at Kamalkote in Uri sector near the Line of Control (LoC), killing one militant, reports Daily Excelsior. The other cadres of the group escaped back into Pakistan-occupied Kashmir (PoK). The militants had not crossed the barbed wire fencing erected along the Line of Control (LoC) but had entered the Indian Territory when the gun battle took place. A Defence spokesman said the operation was still in progress. As per intelligence reports, more than 2000 militants are waiting at various launch pads across the LoC, awaiting orders to infiltrate into the Valley and other parts of the State. Nearly 100 militants have been killed in dozens of infiltration bids along the LoC in 2009 after the top three militant outfits - Lashkar-e-Toiba (LeT), Hizbul Mujahideen (HM) and Jaish-e-Mohammad (JeM) - lost several of their top ‘commanders’ in anti-militancy operations launched by the Security Forces.

As soon as Chopan came out of his residence premises, the militants opened indiscriminate firing on him, resulting in his on the spot death, official sources said. On the AFSPA, he reiterated the stand taken by the Army chiefs in the past that the armed forces needed special powers whenever they were deployed on counter-insurgency duties. But, he expressed the Government’s willingness to discuss changes in these powers. “Without special powers, the Army cannot operate … But at the same time we can have a detailed discussion about making some modification here and there,” he added.

A Border Security Force (BSF) trooper was killed and two others were injured as a group of militants opened firing on them after infiltrating into Indian Territory from the Line of Control (LoC) in Krishna Ghati sector of Poonch District in the morning of December 19, according to Daily Excelsior. Official sources said a group of four to six militants were pushed into this side of the LoC from Pakistan’s forward Daku Post in Krishna Ghati sector of Poonch District. However, the militants were traced by the BSF personnel, manning the forward Kranti Post in Krishna Ghati sector, as soon as they infiltrated into Indian Territory along with a consignment of arms, ammunition and explosives. Observing that their movement has been noticed by the BSF personnel from their forward posts, the militants opened heavy firing on them in a bid to intrude further into Indian Territory. Three BSF personnel were injured in the firing, one of them succumbed to his wounds while being evacuated to hospital. One of the arrested militant was working as a co-ordinator between the LeT and HM outfits and was in constant touch with several top ‘commanders’ of the two groups, official sources said. They were identified as Abdul Salam (17), son of Abdul Rashid, a resident of Dhara, Thanna Mandi and Mohammad Rafiq alias Papa Lohar (45), son of Faiz Baksh, a resident of Khanyal Kot. While Salam was affiliated to the HM, Papa Lohar was working for the LeT. Police recovered a high range wireless set, two wireless set antennas, 17 pairs of Dura cell chargers, a number of incriminating documents including letter heads of LeT and HM outfit and a medical kit from the possession of Abdul Salam. Some more recoveries were expected from the two arrested militants during their further interrogation.

Forward fencing in Mangu Chak had been cut by the militants while infiltrating into this side to plant the IED. However, main fencing at Mangu Chak, which was about a kilometer inside the Indian territory behind the forward fencing was completely intact and there was no scope of further intrusion by the militants, official sources said. This was for the third time in a little over two months when the militants sneaked into Indian side, planted IEDs and returned.

S. Pura sector of Jammu District in the morning of December 29. This is, however, not the first time when Pakistan Army or Rangers have thrown the consignments of weaponry from atop the fencing to this side of Line of Control (LoC) or International Border. Official sources said the BSF personnel noticed nine large packets lying just 20 meters inside the fencing in a field of Ghara Ram son of Pangu Ram at Pillar No. 940 falling between forward villages of Bakarpur and Gharana in R. S. Pura sector. A Bomb Disposal Squad opened the packets, which were found carrying 3.5 kilograms of RDX, three Chinese pistols, 211 rounds of 9mm, three detonators, three batteries and INR 350,000 in cash in Indian currency. The cash include 100 notes in the denomination of 1000 and rest in 500 denomination. It was being ascertained whether the currency was genuine or fake.

Indian Express reports that the year 2009 has witnessed a phenomenal drop of 25 per cent in militancy-related incidents in Jammu and Kashmir. “This year, we have achieved a milestone. It is for the first time in 20 years that less than 500 violent incidents took place in the State,” Jammu and Kashmir’s Director General of Police (DGP) Khuldeep Khoda said. The highest number of militancy-related incidents in Jammu and Kashmir took place in 1995 when the Police recorded a total of 5,946 cases across the State. Khoda said that during 2008, militancy-related violence came down by 35 per cent as compared to 2007, while in 2009, the violence dropped further by 25 per cent. “Over the past 20 years, the morale and confidence level of the Jammu and Kashmir Police has been built painstakingly and its professional skills have helped in restoration of peace and normalcy in the State. With these efforts, the graph of violence is rapidly coming down year after year,” Khoda said. For the second consecutive year in 2009, civilian casualties have been remained under-hundred mark. In 2008, 89 civilians were killed. “This year around 70 civilians were killed which is the lowest in the past 20 years,” Khoda said. The highest number of civilian casualties – 1413 - was witnessed in 1996. Khoda said that the Security Forces (SFs) causalities were also the lowest this year in the past two decades of violence. In 2008, 75 SFs were killed, while as in 2007, the causality figure was 110. This year, the lowest number of human rights violation cases was registered as compared to the previous years. “It is for the first time that no custodial death related to militancy was recorded this year,” the DGP Khoda said. The DGP said the Jammu and Kashmir Police, along with other Security Forces, succeeded in eliminating more than 50 self-styled militant commanders of different outfits during various anti-militancy operations.
