A central government order banning the Liberation Tigers of Tamil Eelam (LTTE) has been upheld by the Madras (Tamil Nadu) High Court, which said there was every justification for the May 14, 2010 proscription and a subsequent tribunal order upholding it, The Times of India reports on July 2. A division bench comprising of Justice Elipe Dharma Rao and Justice M Venugopal, dismissing the petitions filed by Marumalarchi Dravida Munnetra Kazhagam (MDMK) leader Vaiko, Tamilar Desiya Iyakkam's Pazha Nedumaran and Prisoners Rights Forum director and advocate P Pugalenthi, said: "Though the object for which the LTTE had been floated was highly laudable, with the passage of time, it has taken ugly path, leading to many heinous crimes in our land also. Voluminous materials containing highly sensitive information have been produced before us by the Centre to show the involvement of the organization in various crimes in India, including the assassination of Rajiv Gandhi, wherein the top brass of the LTTE were the accused. All these materials were available with the government while issuing the notification."

A year after the chargesheet was filed against four suspected Lashkar-e-Toiba (LeT) militants for planning bomb blasts in major shopping centres in Delhi, a city court on November 1 formally framed charges against them, reports Indian Express. Delhi Police had submitted the chargesheet in September last year against suspected LeT militants Ahtisham Farooq and Shafaqat Ali Tuggu and their associates, Tawseef Ahmed Peer and Saijee Tanwar, for planning to execute a mission, code-named "Shahi Programme", in the capital. Ahtisham, Shafaqat and Tawseef are in judicial custody while Saijee is out on bail. The trial is scheduled to commence on December 17, 2013.Additional Sessions Judge Daya Prakash ordered that they face trial for cheating, impersonation, forgery and criminal conspiracy. Ahtisham, Shafaqat and Tawseef will also stand trial under provisions of Unlawful Activities Prevention Act (UAPA), Explosive Substances Act and for offences against the State under relevant sections of the Indian Penal Code (IPC).

National Investigation Agency (NIA) officials on November 1 conducted investigations at the factory at Halol in Panchmahal District (Gujarat) that had manufactured a polythene bag, which was used to pack explosives for bomb blasts of October 27, 2013 at the venue in Patna, reports The Times of India. Panchmahal Police had also visited the unit on October 31 evening after they were tipped off about the development. It was a preliminary probe by them before the NIA officials arrived.

Sharma, pertaining to issuance of a passport to Sameer Khan Pathan an alleged Lashkar-e-Toiba (LeT) militant who was killed by Gujarat Police on October 22, 2002, reports The Times of India reports November 2. He had allegedly obtained passport in the name of Nawab Khan Haiyyatkhan Pathan from here to visit Pakistan on January 13 in 1998, said sources.CID started investigations into issuance of the passport in 2010 following an official communication from the Gujarat Police and an FIR was registered against five persons including the passport officer and three employees of the passport department for issuing a passport to Pathan.

Three weeks before Patna blasts of October 27, four Indian Mujahideen (IM) operatives, Haider Taufiq, Tariq and Nauman involved in the incident had come on the radar of intelligence agencies, The Times of India reports on November 2. They were being tracked through human and technical intelligence constantly. Based on the inputs, the National Investigation Agency (NIA) also got a non-bailable warrant issued against key suspect Haidar Ali, a week before the blasts while one of his associates was called to NIA's Patna office four days before the blasts to help officials track Haidar. Still, intelligence agencies did not get a hint of the Patna attacks. IM operative Manzar Imam, who was arrested from Ranchi (Jharkhand) in March, 2013 had revealed their names as early as October 1, 2013.

The duo are ‘clean’ in the sense they do not have any charges against them, and are therefore ideal to take control of his real-estate business in Mumbai, Bangalore and the National Capital Region, in which Dawood has been steadily investing for the past few years,” a senior Anti-Terrorism Squad (ATS) official said.“It is also a smart way to get back former D-Company loyalists who have over the years given up on hardcore crime but still swear by Dawood and Shakeel. Mustakeen and Humayun will need these trusted men to run the over-ground businesses,” said Himangshu Roy, Joint Commissioner of Police (crime), Mumbai.

A news agency has quoted the sources as saying that the National Investigation Agency (NIA) has recovered a document from Ranchi with details of the entire planning, including the placement of each of the 13 bombs. The document shows that the blasts were planned by IM operatives Tehsin Akhtar and Haidar Ali and included the same planters as in the Patna blasts.It also includes the name of Imtiaz Ansari, arrested after one of the Patna bombs exploded at the city railway station. The chart's matrix reveals Imtiaz had planted bombs near the Thai Monastery in Bodh Gaya. His accomplice Ainul alias Tarique, who was injured while planting bombs at Patna station and later died, had planted bombs at the Targhar Monastery. The NIA's explosive conclusion was recently revealed to Parliament's Standing Committee on Finance by the Research and Analysis Wing (R&AW), the Intelligence Bureau (IB), and the Department of Revenue Intelligence (DRI). The security features imitated to print fake notes can be duplicated by highly sophisticated machines that only the Pakistan government owns, the committee was told. Most of the pivotal parameters of the paper like GSM (paper density measured in grammes per square metre), Wax Pick Quotient, and Poly Vinyl Alcohol and PH Values were found matching with the legal tender of Pakistan.The parliamentary panel was informed that the volume of FICN smuggled into India in 2010 was between INR 1,500 and INR 17 billion, which went up to INR 25 billion in 2012 - a rise of 55 per cent. This year, FICN worth INR 12 billion has already infected the Indian economy till July.

After the 2010 German Bakery blasts of Pune (Maharashtra), Indian Mujahideen (IM) has not used RDX in any of the blasts, indicating the group has been procuring explosives locally and from easily available sources as RDX is hard to get and is generally smuggled across the border from Pakistan by terror groups.The Hindu reported on November 8, Uzair Ahmed who was arrested by the National Investigation Agency (NIA) for alleged links with the IM is purportedly emerging as a key member of the terror outfit’s module that is suspected to have carried out serial blasts in both Patna and Bodh Gaya. At the instance of his handlers, Uzair had allegedly been funding the module’s operations. The module members were also in touch with their handlers in Pakistan.“Whether he was directly involved in the conspiracies is yet to be established. The accused had, on several occasions, supplied funds to the module members. We suspect this was used to procure raw materials for the improvised explosive devices used in the recent terror strikes,” a senior NIA official said. IM planned to follow up their terror attack in Patna with explosions at Nalanda University and strikes in Chhattisgarh, which votes this month for its next government, say investigators, NDTV reported on November 7. NIA says that it has pieced together the plans of the Mujahideen based on documents that it recovered from a small hotel it raided earlier this week in the hope of finding one of the main planners of the Patna attack.Further, The Hindu reported that few details are available on the past of Hyder Ali, the prime suspect in both the Bodh Gaya and Patna blasts cases. But intelligence sources say he was involved in the Students Islamic Movement of India (SIMI) prior to its proscription in 2001.

"In the raid, the NIA detained six people and recovered 300 passbooks, 30 ATM cards and other documents related to money transaction," the official said. NIA suspects that those detained have links with terrorists in and outside the country. Moreover, Police are ascertaining whether these four persons are part of Pakistan’s Inter-Services Intelligence (ISI) sponsored funding in India or part of some hawala (illegal money transfer) transactions. Lakhisarai Superintendant of Police (SP) Rajiv Mishra said these persons frequently talked to one Ibrahim Khan based in Pakistan and transferred the received money to different persons in India after getting instructions from him. The arrested suspects have reportedly confessed their links with Khan and said that they used to receive money from him in the fake bank accounts they had opened with fake documents of other persons in several local banks and transferred the cash to other persons. Additional Sessions Judge Daya Prakash ordered framing of charges against suspected LeT militant Ahtisham Farooq, Tawseef Ahmed Peer, who is allegedly associated with LeT, their accomplices Shafaqat Ali Tuggu and Saijee Anwar.The court directed that charges against all the four accused be framed under various provisions of Indian Penal Code (IPC), including sections 420 (cheating), 468 (forgery for the purpose of cheating) and 120B (criminal conspiracy).Except Anwar, the other three accused were also ordered to be put on trial for offences under the Explosive Substances Act and Unlawful Activities Prevention Act (UAPA) and under section 121-A (conspiring to commit certain offences against state) of IPC. Farooq, Tuggu and Peer are presently in judicial custody while Anwar is out on bail. This decision was taken at a coastal security review meeting at South Block, chaired by Defence Minister A.K. Antony. He directed the government agencies, particularly the Home and Shipping Ministries, to take up the issue of private armed guards on board commercial ships. “The effort would lead to better regulation on the issue of floating armouries carrying private armed guards and weapons in our maritime zones,” he said.The Union minister also reviewed the progress of several schemes initiated for enhancing coastal security such as mandatory registration of fishing boats, issue of biometric ID cards to fishermen, formation of state maritime boards, designation of shipping lanes in ports, survey and monitoring of landing points along the coast. He was apprised of the work carried out in setting up of 46 coastal radar stations and the phase-II of additional 38 radar stations envisaged as part of the Coastal Surveillance Network.

In a statement by Kolkata Police it has been said that terrorist /antisocial elements may seek hideouts in the residential areas and it might breach the peace and create disturbance of public tranquillity. These fresh arrests have been made to facilitate ongoing investigations, which have established that the five SIMI operatives provided logistics, financial and ideological support to run the banned organisation. They were identified as Sheikh Azijullah, Moinuddin Mashiuddin Qureshi, Sheikh Habibullah, Hayat Noor Khan alias Raju Mistry and Roshan Ghulam Sheikh. All of them were booked under provisions of the Prevention of Unlawful Activities Act, 1968. Indian Express reports on November 18 that four alleged IM operatives suspected to be involved in the Patna blasts stayed in Raipur for over a fortnight immediately after the incident, according to the Chhattisgarh Police. Additional Director General (ADG, Intelligence) Mukesh Gupta told that the Patna blasts suspects, Haider Ali alias Abdullah, Numan Ansari, Taufeeq Ansari and Mojibullah, were provided shelter in Raipur. The Chhattisgarh Police have confirmed the identities of the four with the NIA and the Bihar Police. Gupta said the seven who have been arrested were under surveillance for over three years. While they were found to be involved in some organisational activities for SIMI, an alert was raised following a reported phone conversation between Siddiqui and another person in Arabic on October 17, when some words like "qurbani (sacrifice)", "Gujarat", and "Narendra Modi" came up. The recording of the conversation has been sent to the Intelligence Bureau (IB) for translation. Meanwhile, NIA has announced a cash reward of INR one million on the head of Hider Ali and INR 500,000 each on the three other suspects who figured as accused in both Bodh Gaya and Patna blasts, The Times of India reports on November 18.

Jaleel, a resident of Sanjay Nagar area, and Qureshi of Rajatalab locality were nabbed for their alleged links with the banned terror outfit," Raipur Superintendent of Police O.P. Pal said. As per initial inputs, Jaleel and Qureshi were involved in arranging funds for the banned outfit and also attended camps organised by the terror module being run by Umer Siddhiqui, another SIMI cadre, arrested from Chhattisgarh on November 14, 2013, for allegedly masterminding Bodh Gaya blasts (July 7, 2013). With the latest arrest, the number of activists linked to the SIMI held from Chhattisgarh so far, has reached 13, he added. Police had arrested Sidhhiqui, who runs a coaching centre in Raja Talab, and auto driver Abdul Wahid Khan (54) of Pandri area on November 14, 2013, for their alleged links with SIMI. He stated, “They (Pakistan) should book the culprits and unless they are given maximum punishment, I don’t think our nation will be satisfied.” He also said, “Before 26/11, coastal security apparatus was very weak but now we have been able to establish a vibrant and strong coastal security.” He said coordination with other stakeholders involved in coastal security has also improved.

Lawyers for seven Pakistanis accused of involvement in the Mumbai 2008 attacks (also known as 26/11) on November 25 said the case against them “lacks evidence”, reports Daily Times. Pakistan charged seven men in 2009 over the attacks, but has insisted it needs to gather more evidence in India before proceeding further, infuriating New Delhi. Rizwan Abbasi, a lawyer for the accused said the Indians only had themselves to blame for the slow progress. “This case has many legal flaws and lacks evidence. It is being delayed in Pakistan because India has failed to provide required evidence against the accused,” he said in a news conference. The only gunman to survive the siege, Ajmal Kasab, was tried in Mumbai and hanged on November 21, 2012 for waging war against India, murder and terrorist attacks. “By hanging Kasab, India destroyed the only living evidence of these attacks and created problems for investigations in Pakistan,” Abbasi said. New Delhi has branded Pakistan’s attempts at prosecuting the men a “facade” and has insisted it has already handed over enough evidence to convict the accused. Abbasi claimed the dossiers handed over by India contained only “information and no solid evidence”. “There was also no proof that the attackers had any link with my clients because the phone numbers Indian authorities said were used for the contacts were not of Pakistani companies,” he added.

Meanwhile, Daily Excelsior on November 27 reports that Pakistan’s efforts to unite the two factions of All Parties Hurriyat Conference (APHC) in Kashmir - separately led by led by Syed Ali Shah Geelani and Mirwaiz Omar Farooq - have failed. The efforts to unite the two factions have failed as sources say neither of the factions wants unification. Earlier, Geelani was offered to be the spiritual leader of the joint APHC and Mirwaiz its chairman but Geelani has reportedly turned it down as it would have made Mirwaiz more powerful. Pakistan in a bid to unite the two factions closed down one of the offices of the Hurriyat Conference in Islamabad three months ago. Since then, the two factions are operating from same office with Yusuf Naseem, representative of Mirwaiz faction of APHC and Ghulam Mohammad Safi, representing Geelani faction of APHC, issuing statements jointly signed by them. Sources said that since the formation of Government by Nawaz Sharif, Pakistan Government has thrown its weight behind Syed Ali Shah Geelani. Earlier when Pervez Musharaf was in power in Pakistan, he had thrown his weight behind Mirwaiz and the Pakistan People’s Party lead Government followed the suit.

Reacting sharply to the statement of the counsel for seven accused that the evidence provided by India was a “sham”, Ministry of External Affairs (MEA) Spokesperson, Syed Akbaruddin said India had discussion with Pakistan leaders, including Mr Sartaj Aziz who came here only recently, and they acknowledged that India had provided the evidence it had. Otherwise all evidence was there in Pakistan itself, as it was there that the conspiracy was hatched, the training of the culprits took place and financing was arranged, Mr Akbaruddin said. His remarks came when asked about the claim of Raja Rizwan Abbasi, counsel for Lashkar-e-Toiba (LeT) ‘commander’ Zakiur Rehman Lakhvi and six other accused, that the dossiers provided by India was information and not evidence as required by the court, and what was provided was a “sham”not evidence. The MEA Spokesperson said the onus to provided evidence to the court lay on the Government of Pakistan.

The accused, Dr Imran Ahmed, is alleged to be part of the first group of the module that held meetings in Saudi Arabia to further LeT's cause of targeting Hindu radicals and journalists sympathetic to the Hindutva cause. Border Security Force (BSF) on November 29 said illegal migration from Bangladesh has come down significantly as close to 75 per cent of border area has been fenced, reports Times of India. The Director General of BSF, Subhash Joshi, also said the force will be extra vigilant to meet any challenge that may emerge along this border when the neighbouring country goes to polls in January next year. "Illegal migration has come down (from Bangladesh). I think one reason is that we have fenced about 75 per cent of the border area...there cannot be a fool-proof border but surely instances of illegal crossings have come down," Joshi told reporters during his annual press conference on the occasion of the forces' 48th Raising Day on December 1. “There are polls in Bangladesh next year...we are prepared in terms of any security-related challenges that may occur along the frontier," he said when asked about the preparations of the border guarding force in this context.
