On June 1, the designated Terrorist and Disruptive Activities (Prevention) Act (TADA) court sentenced thee convicts in the 1993 Mumbai serial blasts case, reports Indian Express. Special Judge P D Kode sentenced Niyaz Shaikh to life imprisonment for being part of the conspiracy behind the blasts. “He was part of the conspiracy till the end. But having regard to the fact that he did not commit the terrorist act (bombings), he has been sentenced for life,” said Judge Kode. Separately, Farooq Motorwala, convicted for initiating one of the approvers of the case into training of arms and ammunition and sent him to Pakistan, was sentenced for 13 years rigorous imprisonment (RI) and fined INR 25,000. Shaikh Mohammed Ehtesham, who was charged with being part of the landing of arms and ammunition in Raigad, was sentenced to 10 years RI and fined INR 50,000. Ghulam Hafiz Shaikh, who was convicted for participating in the landing and transportation of arms and ammunition from Raigad to Mumbai, was sentenced to eight years RI and fined INR 25,000.

Noor Mohammed Khan who stored RDX in his premises at Kashimira on the outskirts of Mumbai was given five years RI and INR 150,000 fine. Travel agent Altaf Ali Sayyed was handed a ten-years RI with a fine of INR 250,000 for possessing two suitcases containing 85 and 100 hand grenades with detonators. With this, 68 of the 100 people convicted have been awarded sentences by the TADA court.

The designated Terrorist and Disruptive Activities (Prevention) Act (TADA) court on June 5 sentenced two conspirators in the 1993 Mumbai serial blasts case to life sentences and three others to jail terms ranging from five years to 14 years, reports Hindustan Times. Special Judge P D Kode awarded life sentence and a fine of INR 50,000 to Pervez Qureshi, who he said was involved "in the conspiracy till early hours of March 12, 1993 but backed out at the last moment". Qureshi was also involved in landing RDX and arms on the Shekhadi coast and he went to Pakistan for arms training. The other convict given a life term was Salim Mirza Shaikh alias Salim Kutta, who was also ordered to pay a fine of INR 200,000. He was mainly involved in landing arms and ammunition at Dighi. Though Salim was not involved in the actual bombings that claimed 257 lives, he was aware of what was being smuggled into Dighi and was given a life sentence for being party to the conspiracy.

"We have reports to suggest some elements of the Pakistan Army, including the Inter-Services Intelligence, are helping to push the militants across," said Indian Army Chief General J. J. Singh. "There is always some support available to militants to infiltrate across the border," Singh told reporters at a Defence Ministry function in New Delhi.

Times of India reports that the designated Terrorist and Disruptive Activities (Prevention) Act (TADA) court on June 6 sentenced Ibrahim alias Baba Moosa Chauhan to 10 years' rigorous imprisonment (RI) and a fine of INR 277000 in the 1993 Mumbai serial blasts case. Ibrahim had visited cinema actor Sanjay Dutt’s residence at Bandra to deliver AK-56 rifles. Judge P. D. Kode had held Chauhan guilty of six charges, including charges under the TADA for delivering, at the instance of gangster Anees Ibrahim Kaskar, AK-56 rifles to Sanjay Dutt and another accused Sameer Kurla, who was later shot dead. Chauhan was also held guilty for possession of an AK-56, 10 magazines and 25 hand grenades, under TADA as well as under the Arms Act, Explosive Substances Act and Explosives Act.

A suspected Lashkar-e-Toiba (LeT) operative held near the Bangladesh border in April was shown as arrested by police in Hyderabad in connection with the May 18 bomb blast in the city’s Mecca Masjid, reports Deccan Herald. Nayeem alias Sameer was earlier in the custody of Mumbai police and was brought here on a transit warrant. He was remanded to judicial custody for 14 days. Sameer was one of four suspected LeT cadres held by the Border Security Force (BSF) near the Bangladesh border in April while they were trying to sneak into West Bengal. Later, he was handed over to Mumbai Police for his alleged involvement in bomb attacks on local trains. During a narco-analysis test, Sameer reportedly told Mumbai Police that he had transported RDX to Hyderabad, officials sources said. This was the second arrest by the Special Investigation Cell of city police which is probing the bomb blast. Earlier on May 25, police arrested Shoaib Jagirdar, a close associate of Sameer, from Jalna in Maharashtra. He is now in judicial remand.

The designated Terrorist & Disruptive Activities (Prevention) Act (TADA) court on June 7 sentenced two more accused in the 1993 Mumbai serial blasts case, reports The Hindu. Sheikh Ali Sheikh Umar, involved in the conspiracy at all stages, was sentenced to life imprisonment, while Ejaz Pathan, who recruited people for execution of the conspiracy, was sentenced to 10 years rigorous imprisonment (RI) and a fine of Rs.225,000. Umar was one of the occupants of the van which contained arms and was abandoned at Worli on March 12, 1993, the day of the blasts. The van had proved crucial for investigators, who then began unearthing the entire conspiracy. On the other hand, Ejaz Pathan’s health condition prompted TADA judge, P D Kode, to go easy on his sentence, though Pathan had been absconding for about 10 years and was an undertrial only after he was deported from Dubai in February 2003. Pathan has already spent four years in jail. Special public prosecutor Ujjwal Nikam later said the sentence was way too little and the Central Bureau of Investigation would appeal to the Supreme Court for an enhancement of the sentence.

Deccan Herald reports that agents of Pakistan’s external intelligence agency, the Inter-Services Intelligence (ISI), and smugglers are increasingly exploiting the India-Pakistan border area in Gujarat for illegal activities taking advantage of the non-deployment of the Border Security Force (BSF) in certain difficult stretches of the border. Security forces reportedly face a lot of problems while manning the border in Gujarat and Rann of Kutch as harsh climate makes the terrain non-negotiable during monsoon and post-monsoon months. The Union Home Ministry (MHA) has approved an INR 3800 crore proposal for fencing and floodlighting of 310 kilometers of the Gujarat border. Official sources said that 217 kilometers of fencing and 178 kilometers of the remaining floodlighting have been completed till March 2007 and work on the remaining portion was under progress. The entire work, which was targeted to be completed by March 31, 2007, got delayed due to unprecedented rains in Gujarat in 2006.

Intelligence agencies, particularly Intelligence Bureau and `Q' branch of the Criminal Investigations Department, have stepped up vigil at the Mandapam refugee camp and other camps in the State following reports of alleged recruitment for the Liberation Tigers of Tamil Eelam (LTTE) there through its agents, reports The Hindu. According to a report posted in the www.defence.lk, the LTTE had asked its operatives to approach Tamil refugees, particularly youth, who recently fled the country and took asylum in Tamil Nadu, to return to the Island nation in order to join LTTE in their fight against Sri Lankan forces. Following the report, the intelligence agencies in Ramanathapuram and other parts of the State have increased surveillance on Sri Lankan refugees living in various camps. Reacting to the reports, the intelligence officials summarily rejected the chances of recruitment. "No body can approach refugees with the so-called motive, as all their activities and movements are being closely monitored. We have posted a strong network to track down illegal activities, if any. They cannot escape from our surveillance," an officer of `Q' branch told The Hindu.

Identified as Mukhtar Ahmed Khan from Kupwara in Jammu and Kashmir, the militant was carrying about 1.5 kilograms of RDX, a timer and two detonators. Delhi Police sources said that Khan was scheduled to go to Pakistan by the Delhi-Lahore bus on June 13 to meet LeT commanders based in Pakistan occupied Kashmir (PoK). Police further said that the explosives seized from him were meant to cause bomb blasts in Delhi at the behest of LeT commander Abu Alqama. Khan was supposed to hand over the explosives to another LeT operative in Delhi before taking the bus to Lahore. Khan revealed to the police that he initially worked for LeT for money but later gained the confidence of Abu Musab alias Tahir and Abu Hamza, the district commanders of LeT in Srinagar. Khan had visited Pakistan in January 2006 and attended the LeT camp at Muzaffarabad in PoK and received three month-training in the use of weapons and explosives.

Kode, said Mubina, adopted sister of the absconding mastermind Tiger Memon, had allowed a crucial meeting of conspirators in her house for which she was paid. Zebunnisa, who concealed weapons in her homes that were sent by Hindi cinema actor Sanjay Dutt, was sentenced under section 3(3) of the TADA. The judge observed that although she looked after the AK 56 rifles, ammunition and some hand grenades, the real possessors of the weapons were Manzoor Ali Sayyed and Abu Salem who had been handling the distribution of the firearms on behalf of Anees Ibrahim Kaskar, another absconding accused.

An agent of Pakistan's external intelligence agency, the Inter-Services Intelligence (ISI) was arrested in Hyderabad by the Special Investigation Cell (SIC) which is assisting the Central Bureau of Investigation (CBI) in its probe into the May 18 Mecca Masjid bomb blast in the city, reports Times of India. Mohammed Abdul Sattar, a 27-year-old airconditioner mechanic, was picked up on June 15 from near Secunderabad railway station while moving under suspicious circumstances with a travelling bag. He reportedly confessed that he had received arms training in Pakistan in 2004 along with other ISI activists under the leadership of Shaheed, a key suspect in the Hyderabad blast. However, it was not clear if Sattar had any role in the blast. The police seized provocative literature and VCDs on jehadi activities from his possession. He was produced in a court which sent him to judicial remand for 15 days.

The note verbale provides an assurance that Davy would be repatriated to Denmark to serve any prison term after his trail in India. Following a request from the Central Bureau of Investigation (CBI), the Union Cabinet had cleared a proposal in April 2007 to give an undertaking to the Danish authorities that Davy would not be awarded capital punishment. The executive assurance was necessary as India does not have an extradition treaty with Denmark. The CBI, which had put up an Interpol Red Corner notice against Davy, located him in Denmark and sent in an extradition request. Davy is accused of dropping arms by an AN-26 aircraft over Purulia in West Bengal in December 1995. The aircraft was intercepted and forced to land at Mumbai. However, Davy escaped even as the other members of the aircraft crew were arrested.

Kashmir-based militant groups have earmarked certain soft routes in the western coastal areas to intrude into India. “At least half a dozen such incidents have recently been reported, where terrorists entered into India either by bribing those guarding the coastal areas or by dodging their eyes,” revealed an unidentified officer of a central intelligence agency. The officer also said that “Most of the arms and ammunition smuggled into India either for terrorists, Naxalites or other organised criminals, are coming through the coastal regions.” Interrogation of militants who were arrested by security agencies in Kashmir and wireless intercepts of terrorist conversations have also revealed the intrusion plans of the terrorists into the country. The Union Ministry of Defence has reportedly submitted a $700 million plan to buy military equipment for the coast guard to replace the obsolete technology of coastal patrolling.

Hindustan Times reports that on June 19, sixteen persons convicted in the 1993 Mumbai serial blasts case challenged the validity of the designated Terrorist & Disruptive Activities (Prevention) Act (TADA) court that tried them. Seven kilograms of RDX, six detonators, five watches including three improvised watches equipped with timer wire, two batteries and a switch remote was recovered from them. The duo was identified as Mohammed Yaqub, a resident of Tarapur under Badhapur police station of Bijnore district and Nasir, a resident of Naumi village under Badhapur police station of Bijnore district. Both were reportedly trained in Pakistan. Addressing a press conference in capital Lucknow, the Uttar Pradesh Director General of Police (DGP) G. L. Sharma said the duo wanted to carry out blasts at railway stations, bus stands and religious structures in various parts of the country, including Mumbai and Delhi. The DGP said the two had supplied more than 100 kilograms of RDX to various parts of the country.

The Hindu reports that on June 21, the designated Terrorist and Disruptive Activities (Prevention) Act (TADA) court trying the case regarding the bomb blast in the Rashtriya Swayamsevak Sangh (RSS) office at Chennai on August 8, 1993, which had resulted in the deaths of 11 persons and injuries to nine others, acquitted S.A. Basha, founder of the banned Al Umma, and four others, while holding 11 persons guilty. In his 505-page judgment, Additional Sessions Judge T. Ramasamy said lack of religious tolerance was the root cause for many things, including the bomb blast. Besides Basha, the others acquitted were Mukthar Ahmed, Aminudeen Sheriff and Mohamed Abdul Aslam. Abu Backer Siddique, Hyder Ali and Khaja Nizamuddin were sentenced to life imprisonment under various provisions of the Indian Penal Code (IPC), including conspiracy, promoting enmity between different groups and murder, and under the Explosives Act, Explosive Substances Act and TADA. They were also sentenced to 10-year imprisonment under various counts. Rafiq Ahmed was sentenced to three years of rigorous imprisonment (RI). Shahabuddin, Abdul Rahim, Ahmed Gnaniyar, Syed Mohammed Buhari, S.K Mohamed Ali, Mohamed Zubair and Mohamed Moosa Mohideen were sentenced to five years of RI.

The Hindu reported that Special Task Force (STF) of the Uttar Pradesh police arrested an ‘area commander’ of the Harkat-ul-Jihad-al-Islami (HUJI) operations in India Jalaluddin alias Amanullah Mandal alias Babu, a resident of Bhilparha in 24 Pargana South district in West Bengal and his associate Naushad alias Haafiz near Residency in Lucknow on June 23-morning. STF personnel also recovered cache of arms, including nine-kg of high explosives, an AK-47 rifle, two magazines and 60 cartridges of AK-47, 20 hand-grenades and 10 detonators from their possession. As reported earlier, on June 21, the Uttar Pradesh police arrested two terrorists belonging to the HuJI outfit. Meanwhile, Director-General of Police G.L. Sharma said that with the arrest of the four militants the STF had busted the HUJI module, which had masterminded terror acts in different parts of the country. He claimed that Jalaluddin was the main accused in the Shramjeevi Express blast in Jaunpur district in June 2005 and one of his associate was also involved in the Sankat Mochan temple blast in Varanasi in March 2006. He Jalaluddin has been active in India since 2001 and had recruited around 150 youths who were sent for training in terror acts to Pakistan, he added.

According to The Hindu, on June 25, the designated Prevention of Terrorism Act (POTA) court sentenced nine persons, including the prime accused Asghar Ali, to life imprisonment in the Haren Pandya murder case. Pandya, the former Gujarat Home Minister, was shot dead at a park in Ahmedabad city on March 26, 2003. POTA court judge Sonia Gokani also sentenced two other accused to seven years imprisonment while one more accused was sentenced to five years imprisonment. A total of 19 persons were named as accused in the case out of which 15 have been arrested while four others are still absconding. The prosecution has submitted that Asghar Ali had selected youths from Ahmedabad and Hyderabad, capital of Andhra Pradesh, and sent them to Pakistan for terrorist training in camps runs by the Jaish-e-Mohammed (JeM) and Lashkar-e-Toiba (LeT). After returning from Pakistan, some of these youths first executed the tiffin bomb blasts and then targeted Jagdish Tiwari a local Vishwa Hindu Parishad leader who was shot at and injured. Later they killed Pandya at Law Garden when he had gone for a morning walk.

The Administrative Reforms Commission (ARC) on June 25 favoured sweeping powers to the Centre to deploy armed forces in case any State faced "major public order problems" and the repeal of the Armed Forces Special Power Act (AFSPA), according to Tribune. The Commission also recommended bringing investigation of certain crimes with inter-state and national ramifications directly under the jurisdiction of central investigating agency like the Central Bureau of Investigation. These offences include terrorism, organised crimes, acts threatening national security, sedition, arms and human trafficking, assassination of major public figures and serious economic offences. On the issue of the AFSPA of 1958, the Commission while recommending its repeal suggested to bring an enabling legislation in its place for deployment of Central forces in the North Eastern States. "The Unlawful Activities (Prevention) Act, 1967, should be amended by inserting by a new chapter VI A as recommended by the Committee to Review the AFSPA. The Chapter VI A would only apply to North Eastern states," it said. "We want the government, both Centre and states, to implement the report ARC on Public Order in its fully as it tries to address the vacuum created over the years," Veerappa Moily, the commission Chairman told the media after submitting the report to Prime Minister Dr. Manmohan Singh in New Delhi on June 25.

Special Cell officials of the Delhi Police said that the three young men, identified as Nayeem, Mohammad Muslim and Wasim, all residents of Ghaziabad in Uttar Pradesh, were carrying counterfeit currency notes worth INR 3.3 million. The acting Foreign Secretary of Bangladesh, Touhid Hossain, and Indian Foreign Secretary Shivshankar Menon issued a joint statement at a press conference. Menon described Bangladesh as a "priority" for India and said although it is in India's interest for Bangladesh to be "peaceful, democratic and stable", "ultimately, it's the people of Bangladesh who will decide their future." Speaking on security issues, Menon said, "I think our securities are linked. We have a common security interest.
