The Pakistan-based Lashkar-e-Toiba (LeT) and Jaish-e-Mohammed (JeM) are using territory and elements in Bangladesh and Nepal for movement of terrorists and finances in India, according to a paper prepared by the Union Home Ministry on internal security situation. The modus operandi is recruitment of Indian youths by the LeT and Bangladesh-based Harkat-ul-Jihad-al-Islami (HUJI-BD) for training in Pakistan and Pakistan occupied Kashmir (PoK) and then sending them back to India for sabotage and subversive activities, Times of India reported. "These outfits are well organised, interlinked and have the latest hardware and communication equipment," according to the paper. Investigations into recent terrorist attacks, including the 7/11 Mumbai blasts, Varanasi serial blasts in March 2006 and the attack on the Indian Institute of Science in Bangalore in December 2005 have indicated increased use of Bangladeshi territory by Inter-Services Intelligence (ISI)-backed terrorist groups and the growing terror networking of Bangladeshi fundamentalist groups with the LeT and JeM. According to intelligence sources, in all these attacks, suspected terrorists had infiltrated from across the India-Bangladesh border. The current strategy of these groups, according to the paper, is to maintain continuous flow of finances to sustain terrorist networks, target vital installations and economic infrastructure, recruit and train local modules and attack soft targets like market places, public transport system, places of worship and congregations. Their strategy also includes provoking communal tensions to create a wedge between communities and supplying hardware through land and sea routes. The Home Ministry indicated that the terrorist infrastructure in Pakistan and PoK is yet to be dismantled and it is being used by Pakistan-based and ISI-sponsored outfits like the JeM, LeT, Al-Badr and Hizb-ul-Mujahideen (HM).

The designated Terrorist and Disruptive Activities (Prevention) Act (TADA) court on December 4 held guilty six aides of prime conspirator Tiger Memon (who is still at large) for hurling hand grenades at a fishermen's colony, killing three persons and injuring six on March 12, 1993, reports Times of India. The guilty were identified as Bashir Ahmed Usman Ghani Khairullah, Zakir Hussain Noor Mohammed Shaikh, Abdul Khan, Feroze Amani Malik, Moin Querishi and Salim Rahim Shaikh. They were also found guilty under Section 3 (3) of TADA for aiding and abetting terrorist act, going to Pakistan for arms training and attending conspiracy meeting. With the conviction of these six accused, the total number of those held guilty so far has risen to 100. Twenty-three persons were acquitted by the court. With this, the first phase of verdict, involving conviction or acquittal of the accused concluded. The second phase of verdict which involves arguments by the Central Bureau of Investigation and defence lawyers on the quantum of sentence would begin on December 11 and is expected to last a few days. In the third phase, designated judge P. D. Kode would award the quantum of sentence to each of the convicted.

The Uttar Pradesh Government on December 4 said that it had not received any direction from the Union Government to proscribe the Students Islamic Movement of India (SIMI). According to Times of India, in a written reply to a question in the State legislative assembly, Chief Minister Mulayam Singh Yadav said that no instructions had been received from the Centre to ban SIMI. The State Government had recently successfully moved an application in a district court in Baharaich seeking withdrawal of cases against SIMI chief Shahid Badar Falah.

The designated Terrorist and Disruptive Activities (Prevention) Act (TADA) court on December 6 issued non-bailable warrants against Abdul Qayyum and Aziz Bilakhiya, both absconding accused in the 1993 Mumbai serial blasts case, according to Daily News & Analysis. Both are also alleged to be close associates of gangster Abu Salem, who is currently under detention in a Mumbai jail. The warrants will enable the Central Bureau of Investigation (CBI) to declare the duo as ‘proclaimed offenders’, attach their properties and seek their arrest in foreign countries. After his deportation from Portugal in November 2005, Salem had described the role of Qayyum and Bilakhiya along with Riyaz Siddiqui in arms distribution in furtherance to the 1993 blasts conspiracy. Siddiqui was arrested but the other two managed to escape.

A Delhi Court has sentenced two Hizb-ul-Mujahideen (HM) militants, arrested three years ago with a huge cache of arms and explosives, to seven years rigorous imprisonment, according to Press Trust of India. On December 8, Judge Ravinder Kaur, convicting Ahmed Tarif Hussain and Tazeem Ahmed alias Kaka under various provisions of POTA (Prevention of Terrorism Act) and Explosives Act, also imposed a fine of INR 80,000 each on them. The court reportedly took note of the fact that their arrest led the police to a place near the Lotus Temple in Delhi where two Pakistani militants, Hafiz Rashid and Ali Bahadur, were killed in a shootout. The two men had been arrested with two AK-56 rifles, 120 cartridges, six hand grenades, two detonators, 4.3 kilograms of RDX and INR 15 lakh cash on December 7, 2003, from the Khanpur area of South Delhi.

Keeping with the security establishment’s assessment of the country facing high-level threats from a slew of terrorist outfits, the Union Government is finalizing a counter-terrorism doctrine, reports Times of India. The policy framework of the counter-terror doctrine (CTD) has been prepared by the Intelligence Bureau (IB) after detailed consultations with police chiefs of various States. The CTD reportedly argues that terrorist groups must be ready to provide credible proof of halting violence for meaningful negotiations. The doctrine pitches for a clear-cut policy, ruling out negotiating release of terrorists in situations like a hijack, apart from being aimed at persuading hostage-takers to surrender or creating a time cushion for action by anti-terror squads. The CTD says that in the event of a hijack, negotiations are only to be used as a strategy to gain time and not to concede terrorists’ demands. It further says, "Sufficient number of trained persons should be available in each state and Central paramilitary forces (CPMFs) to deal with situations of hostage-taking/hijacking.” The CTD will go to the Cabinet Committee on Security for approval this week. Chiefs of all security agencies have reportedly been asked to submit their final views by then.

On December 10, the Nellore district police arrested four suspected agents of the Pakistani Inter-Services Intelligence (ISI) near L. R. Pally village. Superintendent of Police, Laxmi Reddy, said the suspects were detained following information that bombs and explosives were being produced and transported from a house. Three of the arrested persons reportedly belonged to Delhi and had come to the village posing as unani (oriental medicine) and aurvedic (traditional Indian medicine) practitioners. One of India’s most wanted fugitives, Dawood Ibrahim Kaskar, is under pressure to leave Pakistan and may have suffered a heart attack, reports Daily News & Analysis. Quoting intelligence sources in New Delhi, the report said that Dawood, who is the prime accused in the 1993 Mumbai blasts, suffered the attack a couple of weeks ago and was taken to an Islamabad hospital. No further details of the incident were available. Sources added that Dawood, who went though a cosmetic surgery last year to change his looks, is under constant pressure from Government agencies in Pakistan to leave. He is thus expected to seek refuge in some African countries. Dawood is reported to have mining interests in northern Africa and investments in Australia.

The three Lashkar-e-Toiba (LeT) militants, who were arrested by the Delhi Police on December 19 near the Red Fort in the national capital, came from Manipur, reports The Hindu. The police claimed to have recovered two kilograms of RDX, a hand grenade and two detonators from the arrested persons, who were allegedly planning to carry out bomb blasts at crowded market places in Delhi. The Joint Commissioner of Delhi Police (Special Cell), Karnal Singh, informed that this is the first time that the LeT has been found to have links in Manipur. He also said that a lead into the activities of the module was provided by two Bangladeshi nationals, who were arrested in the Capital in October 2004 with plastic explosives. During interrogation, one of the three arrested militants, Salman Khurshid Kori, said that he was sent to Pakistan occupied Kashmir for training in 2001 and had recruited few persons for the purpose. He also claimed to have mediated between the Manipur-based Islamist outfit, the People’s United Liberation Front (PULF), and LeT militants based in Bangladesh.
