On August 4, the police reportedly arrested an Inter-Services Intelligences (ISI) agent in Jaipur, the capital city of Rajasthan, while he was trying to get an Indian passport at the passport office in the city. A diary with information on sensitive military installations in Rajasthan along with a debit card and a mobile phone were seized from his possession. He was identified as Shahnawaz Khan who lived in Kolkata, capital of West Bengal, for several years before migrating to Pakistan in 1969.

The Supreme Court on August 4 confirmed the death sentence of Jaish-e-Mohammed (JeM) activist, Mohammed Afzal, in the Parliament attack case, but condoned the death sentence of Shaukat Hussain Guru and passed the order of 10 years rigourous imprisonment and Rupees 25,000 fine. The apex court also upheld the Delhi High Court judgment of acquitting S. A. R. Geelani and Afsan Guru, wife of Shaukat Guru. On December 13, 2001, five Pakistani terrorists, identified as Mohammed, Haider, Hamza, Rana and Raja, had attacked the Indian Parliament and were subsequently killed by the security force (SF) personnel. Nine SF personnel were killed and 16 others sustained injuries in the attack.

According to Press Trust of India, the Special Task Force (STF) of Uttar Pradesh Police arrested two suspected agents of the Inter-Services Intelligence, Pakistan’s external intelligence agency, from the capital Lucknow on August 7. Fake currency notes with face value of Rupees 68,500 were seized from them, said STF sources. Identified as Mobin Ansari, a native of Nepal, and Ashfaq Ahmed of Gorakhpur, the duo reportedly confessed that they used to smuggle fake Indian currency via Nepal through their own agents and circulate them in the bordering districts of Uttar Pradesh and Delhi.

On August 14, the Government announced a new hijack policy, under which for the first time, it can shoot down a commercial aircraft if it is turned into a ‘missile’ by the hijackers. The policy, approved by the Cabinet Committee on Security (CCS), also reportedly states that there will be no negotiations with hijackers on their demands. Hijackers will be engaged in negotiations only to bring an end to the incident, comfort passengers and prevent loss of life but without conceding to any demand. Consequent to the CCS approval, sources said, the policy is now operational and mock exercises can be expected in the near future to test how it works. The Bureau of Civil Aviation Security is also preparing an Aviation Security manual that will list out procedures and identify strategic targets, according to Indian Express. Defence Minister Pranab Mukherjee told the media that if a hijacking incident occurred on Indian soil, the aircraft would be immobilised and not allowed to take off. On shooting down the aircraft, the Minister said these would be undertaken in extreme circumstances. According to the policy, if a ‘rogue aircraft’ paid no heed to Air Traffic Controller warnings and deviated from its specified path or headed towards any strategic spot such as the Rashtrapati Bhavan, India Gate or Parliament House, a decision on shooting it down would come into play. In case of an emergency situation, the shoot down orders could be given by the Prime Minister, Defence Minister or Union Home Minister, whoever could be contacted first. The policy also provides for death penalty to hijackers and lays down procedures to ensure that the National Security Guard commandos, accompanied by a central negotiating team, are airborne within two hours of the hijack.

Addressing the nation on Independence Day on August 15, Prime Minister Manmohan Singh asserted that the entire infrastructure of terrorism in Pakistan should be "totally dismantled" as "half-hearted" efforts at curbing terrorists cannot succeed. "I am aware that the Government of Pakistan has put some checks on the activities of terrorists from its soil. However, it is not possible to achieve success through half-hearted efforts. It is necessary that the entire infrastructure of terrorism is totally dismantled," he said. Referring to Jammu and Kashmir, the Prime Minister said terrorists have never been friends of the people. As long as they continue their terrorist attacks, the armed forces would be alert and would give them a fitting response in which common citizens might also be affected at times, he said, adding "if violence continues then our response too will be hard." Dr. Singh also reiterated, "I have said before and I am repeating once again that there is no issue that cannot be resolved through the process of discussion and dialogue. Our doors are open and will continue to be open for anyone interested in dialogue."

According to The Hindustan Times, Sheikh Mohammed Muzamil, acquitted by a special Prevention of Terrorism Act, 2002 (POTA) Court in the Ghatkopar bomb blast case, surrendered before the trial court, which took him into custody on August 16. The accused had surrendered after the POTA court issued warrants against him in view of the Bombay High Court admitting an appeal filed by the Maharashtra Government challenging acquittal of five accused in the Ghatkopar bomb blast of December 2, 2002. Three other accused in the case - Abdul Mateen, Imran Rehman Khan and Mohammed Altaf - had surrendered earlier while co-accused Toufiq Ahmed is still at large.

A court in the national capital New Delhi on August 23 convicted a Kashmiri terrorist who planted a bomb in a building in the busy Connaught Place area on May 2, 2001. Additional Sessions Judge, S. C. Rajan, convicted Arzad Ahmed Qureshi, an activist of the Muslim Front, under various provisions of the Explosives Act after he pleaded guilty to the offence. However, the court acquitted him of charges under Section 121 and 121A (waging war against Government of India) of the Indian Penal Code as the prosecution could not prove the specific accusations. Qureshi was arrested on May 4, 2001 from a lodge in the Jama Masjid area of Old Delhi and recovered one kilogram of RDX, two hand grenades, a timer pencil from his possession.

"We have written to the Home Ministry and will move the apex court for a review of its judgment in the Parliament attack case as soon as we get the permission," Deputy Commissioner of Police (Special Cell), Ashok Kumar, told UNI on August 23. Geelani was on August 4, 2005, acquitted in the case, when the Supreme Court upheld the High Court decision in this regard. The court also reduced the sentence of another death-row-convict Shaukat Hussain Guru to rigorous imprisonment of ten years. However, it had confirmed the death sentence on another accused Mohammad Afzal, an activist of the Jaish-e-Mohammed (JeM).

On August 29, India is reported to have handed over to Pakistan a list of nearly 30 wanted people, including mafia don Dawood Ibrahim, Jaish-e-Mohammed (JeM) chief Maulana Masood Azhar and United Liberation Front of Asom (ULFA) chief Paresh Baruah, seeking their deportation to face trial. The list, which also includes names of Dawood associate Chhota Shakeel and Rawalpindi-based Hizb-ul-Mujahideen (HM) chief Syed Salahuddin, was handed over by the Union Home Secretary V. K. Duggal to his Pakistani counterpart Syed Kamal Shah on the opening day of the two-day Home Secretary-level talks in New Delhi, according to Daily Excelsior. Among other names in the Indian list are Khalistan Commando Force (KCF) chief Paramjit Singh Panjwar, Babbar Khalsa International (BKI) leader Wadhawa Singh and two men - Ishaq Atta Hussain and Sagir Sabir Ali Shaikh - who allegedly wanted to target the Union Home Minister Shivraj Patil. India also sought extradition of five hijackers of the IC-814 in 1999 and some of the Khalistan leaders, including Ranjit Singh Neeta, who have been holed up in Pakistan since late 1980s. Pakistan also gave India a list of 37 "wanted" persons alleging they were in India and mostly involved in alleged drug trafficking offences. Farooq, who will lead the delegation, accepted the invitation for the talks that will take place nine days ahead of Dr. Singh’s meeting with the Pakistani President Pervez Musharraf in New York. "The Prime Minister has invited Hurriyat chairman and other leaders for talks," the Prime Minister’s Media Adviser Sanjaya Baru said in Delhi. "It was our demand that the talks should be held at the highest level. So we have agreed to meet the Prime Minister on the scheduled date," Farooq said in Srinagar. He also said a joint meeting of the Hurriyat Executive Committee, General Council and Working Committee will be held today, September 1, to work out a strategy for the talks, the first with the Congress-led coalition Government since it came to power in May 2004.
