Media reports said the Supreme Court, on April 1, declined to accept an amended affidavit that the Union government sought to file in the case relating to the detention under the Prevention of Terrorism Act, 2002 (POTA) of Marumalarchi Dravida Munnettra Kazhagam (MDMK) leader Vaiko. As reported earlier, the Union government, on March 31, informed that it would file a fresh affidavit deleting paragraphs-12 and 13 of the original affidavit in the case.

Attorney General (AG) Soli J Sorabjee stated in the Supreme Court, on April 2, that mere expression of support to a terrorist organisation without actual aid to it would not amount to an offence under the Prevention of Terrorism Act (POTA) 2002. He was speaking while filing an affidavit in the Supreme Court in case relating to the detention of Marumalarchi Dravida Munnettra Kazhagam (MDMK) leader Vaiko under POTA. He reportedly expressed a similar opinion in January 2003, when the Union Government referred to him the case of MDMK leader and Union Minister M Kannappan, who had made pro-Liberation Tigers of Tamil Eelam (LTTE) statements in July and August 2002. As reported earlier, the Apex Court, on April 1, declined to accept an amended counter-affidavit in which the Union government sought to delete paragraphs 12 and 13 of the original affidavit in Viko’s case. Separately, arguments in the three POTA cases challenging the constitutional validity of POTA, including that filed by Vaiko, started on April 2 in the Supreme Court.

According to media reports, five agents of the Inter Services Intelligence (ISI), Pakistan’s external intelligence agency, were arrested in Ahmedabad, Gujarat, on April 3. A foreign-made revolver and five cartridges of .32 calibre were seized from their possession. They reportedly confessed that they were trained in the use of arms explosives at an ISI training camp near Karachi, Pakistan. The accused also confessed that they were sent to Gujarat to carry out a series of bomb blasts and kill important personalities. Meanwhile police in the State capital Ahmedabad are investigating their possible role in the murder of former Gujarat Minister Haren Pandya.

The chargesheet would be filed on April 9. As reported earlier, Police in Mumbai arrested five activists of the Student Islamic Movement of India (SIMI) and a Lashkar-e-Toiba (LeT) terrorist, on different dates, in connection with the blast. Three persons were killed and 32 more injured when a powerful bomb blast occurred inside a bus at Ghatokpar, in Mumbai.

Dossa was arrested in Mumbai, on March 19, 2003, after he was deported from Dubai. He is accused of supplying arms and ammunition for the blasts and sending men to Pakistan for arms training.

The 1,100-page charge sheet was filed against Mohammed Abdul Mateen, Shaikh Mohammed Muzamil, Zahir Ahmed Bashir Ahmed, Imran Rehman Khan and Mohammed Altaf, for conspiring to execute the blast. A supplementary charge sheet would be filed later against co- accused Taufiq Ahmed, who was arrested in Chennai, Tamil Nadu, in October 2002, police said. In separate letters to both the leaders, Karunanidhi said the abuse of the Act "has crossed all limits." It is unfortunate that a journalist was arrested under POTA, while the Act was meant to curtail the activities of armed terrorists, he added, referring to the arrest of Nakkeeran editor R R Gopal, charged with sedition and under the Arms Act. He was arrested on April 12 for his links with sandal wood smuggler Verappan and his role in murders. POTA charges were filed against him on April 16. Gopal and has been remanded to judicial custody till April 25. Karunanidhi also said that, out of the 41 persons arrested so far under POTA, more than 20 were politicians. Reports said, on April 22, Attorney General of India Soli Sorabjee, arguing in the Supreme Court, justified the validity of the Prevention of Terrorism Act (POTA), 2002 on grounds of ensuring the security, sovereignty and integrity of the country. He was placing his arguments on a petition that challenged the constitutional validity of the Act. An act of terrorism cannot be equated with breach of general law and order, as contended by the petitioners, he added. He also said that the mere possibility of the abuse of powers under POTA would not render the Act unconstitutional. Media reports of April 24 said, following the interrogation of a suspected perpetrator of the March 13-Mulund-blast, Mumbai Police raided the house of a Students Islamic Movement of India (SIMI) activist, in Padgha-Borivli village, Thane district, Maharashtra and recovered an AK-56 rifle. The rifle allegedly belongs to Saquib Nachan, another accused in the blast, who had surrendered to the Mumbai High Court on April 10. Besides, police said Nachan secured the rifle from Lashkar-e-Toiba (LeT) terrorist Abu Sultan, who was shot dead in an encounter on March 29, in Mumabi.

The report also pointed out that terrorism in Jammu and Kashmir (J&K) and in the northeast as well as violence by left-wing extremists in the States of Andhra Pradesh, Bihar, Chhattisgarh, Jharkhand, Madhya Pradesh and Orissa as the area of concern. It also further stated that approximately 60 to 70 per cent of terrorists operating in J&K are from outside, "under the direct control of Inter Service Intelligence (ISI), Pakistan’s external intelligence agency'' with local people "playing the role of porters and guides.'' A report said, a detainee in Mulund bomb blast case, Saquib Nachan was also charged by the police in Mumbai, Maharashtra on April 29 for his alleged involvement in another case of bomb explosion that occurred on December 2, 2002 at Ghatkopar. Later, he was further remanded to police custody till May 12. On March 13, 2003, 12 persons, including four women, were killed and 72 more injured in a powerful bomb explosion inside a local train at Mulund Railway station, in Mumbai. Police in Kolkata, West Bengal arrested two top-level terrorists of the proscribed National Democratic Front of Bodoland (NDFB) from a hotel in the city’s Park Street area, on April 30 and also recovered Rupees one million from their possession. They are group’s ‘speaker’, Sunil Brahma alias B. Simong alias B. Benga and a "captain" in the outfit’s hierarchy B. Buthang. The outfit is active in Assam. Police believe that the NDFB terrorists had come to collect ‘fund’ from Kolkata-based businessmen operating in Assam. A local court subsequently remanded them to police custody till May 6. Assam would send a police team to Kolkata on May 1, today to interrogate the detained NDFB leaders.
