A Delhi court on April 1 declared three Jaish-e-Mohammed (JeM) terrorists Masood Azhar, Ghazi Baba and Tariq Ahmed, all Pakistanis, as ‘proclaimed offenders’ in the December 13, 2001 terrorist attack on Parliament. The court also directed the Delhi Police to seek assistance of the Interpol after the prosecution submitted that all steps were taken to trace the three accused in the case. The prosecution had moved an application in the court requesting it to declare the three as proclaimed offenders. The prosecution also informed the court that all efforts were made to trace the immovable and movable properties of the three persons but without any success. The police have charged the three accused with having masterminded the December 13 terrorist attack in which five Pakistani terrorists attempted to attack the Parliament House. All the five were killed in an encounter and four of their associates arrested and booked under the Prevention of Terrorism Ordinance (POTO).

According to police sources, more than 100 left wing extremists, Naxalites of the People’s War Group (PWG) had been arrested over the week from the border areas of Bankura and Midnapore districts. The Bankura district police chief said the arrests were made during raids conducted by Bankura and Midnapore police in Sarenga and Gwaltor areas bordering the two districts. He said the PWG is active in Pakirbasha, Baka colony, Bhalubhasa, Bhalu-chiri and Khaiarpur forest areas of the two districts. Arms including guns, improvised pipe guns, rifles and cartridges were seized during the raids, he added.

Maharashtra government on April 1 asked the Union government to hand over the case involving Mohammed Afroz, a suspected Al Qaeda terrorist, to the Central Bureau of Investigation (CBI) in view of its ‘worldwide ramifications’. Speaking to the media in New Delhi, the State Home Minister Chhagan Bhujbal said, "We have requested the Centre that CBI should take over this case for further inquiry in this case for its worldwide ramifications." He said that the Maharashtra police and Central agencies have gone to Australia to pursue the investigation and added that even the Mumbai police have to go through the Centre to pursue this case abroad. The Prevention of Terrorism Act (POTA) deals with heinous crimes like subversion, insurgency and terrorism. It replaces the Prevention of Terrorism Ordinance (POTO) first promulgated in October 2001 and re-promulgated in December 2001.

The Supreme Court on April 2 upheld the death penalty awarded to a Khalistani terrorist Devender Pal Singh under the erstwhile Terrorist and Disruptive Activities (Prevention) Act (TADA) on the basis of a confessional statement to the police which he had later retracted. Singh was an accused in the 1993 car bomb attack, which targeted the then Youth Congress President M S Bitta. Nine persons were killed in that incident. The Court held that death penalty was “the most appropriate sentence” for Singh. He confessed “voluntarily” and his retraction was an “afterthought”, added the court.

Uttar Pradesh director general of police, Mahesh Chandra Dwivedi said the entire police system was being modernised to put an effective check on the activities of Pakistan's Inter Services Intelligence (ISI) on the Indo-Nepal border in the State. Speaking to newsmen in Lucknow on April 2, he said that the number os security outposts on the border have been increased and adequate police force and Provincial Armed Constabulary (PAC) have been deployed there. Besides, Homeguard jawans of the local blocks have been especially deployed on the Bahraich-Nepal border. On the activities of organisations like Students Islamic Movement of India (SIMI), he said strict instructions had been given to immediately register a case and arrest the members of any such organisation if they indulged in anti-social activities. A Special Task Force (STF) of Uttar Pradesh police, meanwhile, on April 3, said it busted an international gang dealing in counterfeit currency. One person, believed to be involved in smuggling such currency from Dubai, was arrested in Kaushambi district in this connection and currency worth Rs. 2.16 lakh was recovered from him.

A Mumbai court on April 3 granted bail to the suspected Al Qaeda terrorist Mohammed Afroze in a robbery case after police failed to submit a charge sheet within the mandatory 90-day period. The police have already discharged Afroze from three of the four robbery cases under which they had earlier booked him, stating that they found no evidence against him. Afroze, however, continues to be in judicial custody on charges of sedition after being charged under the Indian Penal Code.

Media reports on April 3 have indicated that approximately 30 terrorists from Nepal and Bangladesh, linked to Osama bin Laden’s Al Qaeda, may attempt to sneak into different States of India, including those in the Northeast, Bihar, West Bengal, Orissa and Jharkhand. Reports cited that the Union Ministry of Home Affairs in its communiqué has cautioned these States regarding the possible infiltration by such terrorists who reportedly also have links with the Jamait-e-Islami, a Islamist party in Bangladesh. The terrorists have reportedly decided to follow the said route due to heavy troop deployment in the western sector.

Condemning acts of trans-border terrorism against India, Russia on April 5 asked Pakistan to put an end to the activities of terrorist organizations operating from the last and de-escalate tension with India by implementing measures announced by it to combat terrorism. A joint statement issued in New Delhi on April 5, at the conclusion of the four-day visit of Vladimir B Roushailo, Secretary of the Russian Security Council, said that Russia "expressed its understanding and support regarding India’s justified demands that these activities from Pakistan and territories controlled by it cease complemently". The statement also said that the only way of lessening tension in relations between India and Pakistan is to bring to logical conclusion the measures announced by Pakistan to put an end the activities of terrorist organisations. "The result of such actions will be judged by action it takes on the ground in this direction", the statement added.

A senior police official said the bombs went off while prayers were being offered in the mosques. The blasts triggered tension in the area and the administration deployed the Rapid Action Force (RAF) and the Eastern Frontier Rifles to maintain peace in the area.

The district police chief said that the terrorists had taken shelter inside the forest after they were chased by the forces in Suripara village near Jaldapara. Security forces had stepped up combing operation specially in the adjoining villages of Jogindranagar, Mechbill, Kunjanagar, Moiradanga, Shalkumar, Kalabari, Pradhanpara and Bhangharhat, he said. A Delhi court on April 8 closed a 11-year old case filed under the Terrorist and Disruptive Activities (Prevention) Act, TADA, against the Akali Dal (Mann) leader and Member of Parliament Simranjit Singh Mann, saying the prosecution was not interested in his trial. The court observed, "The case is closed against Mann because this court feels that the prosecution is not interested in arresting him and sending him to face trial in the court". The court said despite warrants issued against Mann and another Akali leader Talib Singh Sandhu 11 years ago, the same had not been executed and these persons were ‘roaming freely’. A TADA case against Mann was filed in 1991 for alleged activities of sedition and delivering inflammatory speech at a Gurudwara in the capital where he had spoken about formation of Khalistan.

Suspected Al Qaeda terrorist Mohammed Afroz Abdul Razak was released on April 9 from Byculla prison in Mumbai following bail granted by a special court even as the police filed a chargesheet against him, four months after his arrest in a case of sedition. Afroz has been charged with section 120 b (conspiracy), section 121 A (waging war against nation), section 126 (acts of depredation against countries friendly with India), section 420 (cheating) and section 467 (forgery) of the Indian Penal Code (IPC). Soon after his release, Afroze appeared before the designated Judge, who accepted the chargesheet and adjourned the case upto April 24. Afroze was released from the jail on the orders of the court, which granted him bail on April 5 as the police failed to file chargesheet within the stipulated 90 days after the arrest. The court allowed the police to investigate further but did not fix any time frame.

She said, "Since the State government are also empowered to implement POTA, Tamil Nadu government will take appropriate action against such parties (supporting the cause of the LTTE)". Pointing out that the LTTE was a banned organisation in the country under the Unlawful Activties (Prevention) Act, 1967, Jayalalithaa said she had already written to the Prime Minister on April 10 requesting that the ban be extended for two more years. The Chief Minister added that the State Assembly would pass a resolution on April 16 demanding extradition of V Prabhakaran to India facing trial in the Rajiv Gandhi assassination case in which the LTTE chief is the prime accused. The resolution also demanded the Union government to send Army to Sri Lanka with the consent of the government there to arrest Prabhakaran, if the Sri Lanka government was unable to capture him and opposed permission to LTTE activists to enter India. The court acquitted the four for want of sanction from the Union government to prosecute them for waging war against the government of India as also for lack of evidence. However, the court framed charges against two other JKIF terrorists Feroze Ahmad Mir and Mohammad Sayed Tantrik alias Yusuf under section 121 (Waging or attempting to wage war or abetting waging of war against government of India), section 121-A (conspiracy to commit offences punishable by section 121) and section 120-B (criminal conspiracy) of the Indian Penal Code (IPC). The police had arrested Feroze Ahmad Mir and Tantrik on June 20, 2001 from a guest house in Delhi and seized Rs 15 lakh from them. Later rests of the accused were arrested on the basis of their statements.

Both the leaders reviewed the main elements of the peace process, measures that would be put in place before the commencement of talks in Thailand with the Liberation Tigers of Tamil Eelam (LTTE) and government's response to issues relating to the content of the agenda for the talks. The proposed constitutional reforms, Peiris explained are designed to achieve a broad consensus in the South as a means of imparting greater stability to the political situation and enabling unrestricted participation by all groups in the emerging solutions. The report of the team said, "The objective behind the Godhra carnage was to weaken Indian positions on the border and to make the area more porous for jihadi infiltrators and smugglers of drugs and arms by forcing India to divert its Army from border to civil deployment". To substantiate its allegation of the ‘Pakistani hand’ in the Godhra episode, the team claimed there was a very high traffic of telephone calls from Godhra to Karachi before February 27. Faily and four others have been arrested under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985 and are being interrogated. Speaking to the media in Chennai , NCB zonal director Shankar Jiwal said this was the largest case of heroin smuggling in southern India so far. He said investigations are on to discover the source of the high-grade heroin, suspected to be in Madhya Pradesh, and headed for Sri Lanka. But, he added, a link with the Liberation Tigers of Tamil Eelam (LTTE) has not been established as yet.

Delhi police on April 29 told a New Delhi court that chargesheet would be filed within 10 days in the December 13 attack on Parliament in which the Jaish-e-Mohammed (JeM) chief Maulana Masood Azhar and two of his close Pakistani aides have been declared as proclaimed offenders. The four arrested accused in the case-- JeM's pointman in Delhi Mohd Afzal, Shaukat Hussain, his wife Afsan Guru and A R Geelani-- a suspended lecturer of a Delhi University College have been booked under the Prevention of Terrorism Act (POTA). Earlier, the court had directed the police to seek the help of the Interpol after the prosecution had submitted that all steps were taken to trace the three men wanted in the case.

Afroze, charged with sedition, had confessed on December 18, 2001 before the Additional Chief Metropolitan Magistrate in Mumbai about his alleged links with the Al Qaeda, undergoing pilot's training in a foreign country and the secret plans of this organisation to blow up prime targets in the U.K, the US and India.
