Cabinet Minister and Sri Lanka Muslim Congress (SLMC) chief Rauff Hakim said, on January 1, 2003, it was for Prime Minister Ranil Wickremasinghe to decide whether he would be present at the peace talks with the Liberation Tigers of Tamil Eelam (LTTE) as a representative of the Muslim community. His remarks were made in the light of the Alliance of Muslim Parliamentarians writing a letter to Wickremasinghe that Hakim has lost the confidence of Muslims and of his own party, and should, hence, be not permitted to represent the Muslims. Another serving Minister M. H. Mohamed and Minister and SLMC dissidents’ leader A. L. M. Athaullah, too, reportedly signed the letter. Hakim has been attending the peace talks as a member of the government delegation. The government has not clearly stated that he was representing the Muslim community, though.

Defence Secretary Austin Fernando said, on January 1, 2003, a major issue in resettling internally displaced persons (IDPs) in high security zones (HSZ) was the absence of proper records on original inhabitants. While the Government Agent’s office in Jaffna says there were 14,000 houses in the Palaly HSZ, the Army maintains that there were less than 10,000, even as the Liberation Tigers of Tamil Eelam (LTTE) contends there were 29,000. On the number of IDPs, the government’s figure is 36,000 the LTTE puts it at 145,000. "This will be a bigger issue and shows how loosely integrated the plan of resettling of people in HSZs is. We are getting a chance to talk about the issue" at the forthcoming peace talks in Thailand, Fernando said. He added that before resettling the IDPs in HSZs, de-mining, identification of original inhabitants and the provision of infrastructure facilities should be completed.

Hakeem has hitherto been one of the government delegates at the peace talks. The fourth round of peace talks is due to begin on January 6, in Thailand. Hakeem will lead a four-member Muslim delegation including South Eastern University Vice Chancellor Prof. M. L. M. Cadeer, Peradeniya University senior lecturer Dr. H. S. Hazbulla and M. I. M. Mohideen. The delegation will discuss issues such as resettlement of displaced Muslim families in the North and East and problems of Eastern Muslims. Other reports said SLMC dissidents led by Athaullah have been demanding that their representative be also included in the Muslim delegation at the peace talks.

A thorough check found there was no VSAT equipment in the consignment, the Premier said. He added that the LTTE was already running a clandestine radio––Voice of Tigers. But, the LLTE asking for government permission to import equipment and to operate a radio station, the LTTE Premier said, "… indicated a welcome change in [its] attitude. It signaled the LTTE's acceptance and willingness to come within the ambit of Sri Lankan law and regulation." Declaring that the ongoing peace process had found international support, which he said was a positive direction, he said, "Making available community radio broadcasting facilities, under regulation by the government was seen as one of encouraging forward movement in this positive direction." He asked the President to place entire episode "in the context of the positive developments towards a permanent peace in Sri Lanka."

Norwegian Foreign Ministry spokesman Oystein Boe was quoted by the state-run Daily News on January 4 as saying that Norway had merely responded to a government request to help the Liberation Tigers of Tamil Eelam (LTTE) import communication equipment for setting up FM transmission to give a further fillip to the peace process. Norway refuted the allegation made by President Chandrika Kumaratunga that it was illegally helping the LTTE to import radio equipment, in violation of Sri Lankan laws, under the guise of brokering peace. Kumaratunga has, on December 30, written to the Norwegian Prime Minister in this regard. Norway said it would soon send a reply. Besides, the President had also reportedly raised questions over Norway's objectivity in facilitating the peace process. On the other hand, Norway reaffirmed its commitment to help reach a final peace settlement "We are going to continue to be available for the parties in Sri Lanka," Boe said.

Cabinet Minister and government chief negotiator at the peace talks with the Liberation Tigers of Tamil Eelam (LTTE) G L Peiris said on January 8, in Thailand, that the Sub-Committee on De-escalation and Normalisation (SDN) has not been disbanded, but agreed there were differences between the government and the LTTE. Peiris said, "It is natural for differences to come up during such a process. If there weren't any such differences there would be no need for negotiations". LTTE's Chief Negotiator Anton Balasingham said, meanwhile, on January 8 that their representatives would not attend a scheduled SDN meeting on January 14, and added, "There is no crisis, the talks (successive rounds of delegation-level peace talks) will go on".

President Chandrika Kumaratunga, on January 8, asked the government to call upon the Liberation Tigers of Tamil Eelam (LTTE) to disband its suicide killers’ wing, the Black Tigers, reports said. President’s spokesman Harim Peiris said she asked for reciprocity from the LTTE because the Sri Lankan Army's Deep Penetration unit has been demobilised. He also declined to make known the opinion of the President on High Security Zones (HSZs). He said, "Firstly, the President's position was never made public… The Commanders discussed the matter with the President as the Commander In Chief but that was an essentially confidential discussion and we hope it remained confidential on the part of the Commanders as well".

Stating that "disarming would be suicidal", he added, "The strength of this (LTTE) army is the protection of our people, the bargaining power of our people and we will not disarm until the aspirations of our people are met." He said the government and the LTTE have demonstrated a high level of commitment to surmount difficult situations. "At the last [fourth] session of peace talks we demonstrated that the Government will not hesitate to assert itself and take a strong stand when required", Peiris said. As evidence, he said there were differences of opinion on resettling internally displaced persons (IDPs) in High Security Zones (HSZs) and "at the end of the talks both parties agreed to complete resettlement outside the HSZ in the first phase and then go into the HSZs later." He also added that resettlement in HSZs will commence based on the report of General Satish Nambiar of India who gas been asked to prepare a technical report on the situation in the HSZs. He also said the fifth round of peace talks would be held in Thailand between February 7 and 10. The core political, economic and humanitarian issues will be taken up at these talks. He disclosed that Amnesty International former chief Ian Martin would attend the talks and help in drawing up a comprehensive programme to safeguard human rights, for the final solution as well as during the negotiations period as well.

He was speaking to Tamil Guardian following reports that a former Indian General, Satish Nambiar, has submitted an interim report on resettling people in High Security Zones. Balasingham said the LTTE "will fiercely oppose and reject any proposal that makes resettlement of refugees conditional upon de-commissioning of LTTE weapons". He clarified what de-escalation and normalisation meant to the LTTE and said these did not mean de-militarisation and de-mobilisation. Stating that the LTTE did not ask for demilitarisation or dismantling of camps or reduction of troops, he added. "What we are asking the Government of Sri Lanka is to allow our people to return to their homes. It is the unconditional right of our people. The denial by the state of the right of refugees and IDPs to return to their homes under conditions of peace constitutes a gross violation of human rights." He also reminded Nambiar that the LTTE fought against the Indian Army when it was asked to disarm its cadres. To recollect, as per the Indian Peace Keeping Force (IPKF) agreement, the LTTE had to lay down all arms, but refused, and launched a war against the IPKF. He asked Nambiar to approach the issue carefully and cautiously and take into consideration the sensibilities of the LTTE. Balasingham added, "The Tigers (LTTE) will not accept any recommendations from anybody that would be prejudicial to the strategic equilibrium enjoyed by LTTE forces."

The Government and the Liberation Tigers of Tamil Eelam (LTTE) are expected to discuss fiscal aspects of power sharing at the sixth round of peace talks scheduled to be held from March 18 to 21 in Hakone, Japan. Cabinet spokesperson G.L.Peiris said on February 13 that both sides have laid a solid foundation for political issues concerning the proposed federal system and it was time to take up the economic aspects. "Extensive powers can be given to the periphery but those powers cannot be executed without resources," said Peiris. He said the LTTE is currently analyzing Swiss and German modalities of fiscal policy. LTTE representatives have already traveled to Berlin and Berne to examine how policies are being implemented there. Peiris also said that despite the short session of the last round of talks in Berlin both the parties were able to achieve a significant progress with regard to human rights. "It is meaningless to ask the people for an opinion at this stage when sufficient progress has not been made on core political issues," Balasingham said. He was responding Government chief negotiator G. L. Peiris’ statement on April 3 that the Government was seriously considering holding a non-binding referendum. Balasingham further said a significant number of Tamils were rendered refugees or internally displace persons. Hence a referendum was unworkable and impracticable in Tamil areas. The TNA will now hold further discussions with Premier Ranil Wickremasinghe on the issue, TNA parliamentary group leader R.Sampanthan said, on April 9. The TNA, the Liberation Tigers of Tamil Eelam (LTTE) and Jaffna residents have already strongly objected to a proposal to locate the garrison at the municipal grounds. The Army rejected proposals to shift the brigade headquarters to Kaakaithivu or Kallundai Veli. While the Army said it could not locate the headquarters at a place where there are no basic facilities the TNA contended that it would not permit shifting the headquarters from one populated area to another. During the discussions, the Army said it could shift the garrison to Old Park in Jaffna town instead of the municipal lands, and clearly stated that it would otherwise remain at the present site, the Jaffna Fort.

Delivering the keynote address, United States Assistant Secretary of State Richard Armitage said the LTTE has been designated as a foreign terrorist organization in the US since 1997, and hence its representatives were not given visas to attend the meeting. He, however, said the US feels "encouraged by the recent behaviour of the LTTE", and "can see a future for the LTTE as a legitimate political organization". Nevertheless, for the US to withdraw the foreign terrorist organization designation accorded to the LTTE, it "must unequivocally renounce terrorism, in word and in deed".

The state-run Daily News said on April 21 that the Government has disagreed with some proposals made by SLMM chief Tryggve Telefssen, while agreeing with some others that would not affect the role of the Sri Lanka Navy. The SLMM’s proposals (Initial Working Paper) were sent to the Government and the Liberation Tigers of Tamil Elam (LTTE) on April 3. The Government is understood to have said in its response that there was no need to change the existing system. The LTTE was supposed to have submitted its responses by April 20-evening. It is not yet known if it has met the deadline.

Norwegian head of the Sri Lanka Monitoring Mission (SLMM) Tryggve Teleffsen had proposed in an April 3 ‘discussion paper’ that Government (should) "recognise the LTTE Sea Tigers as a de facto naval unit." The SLMM also said that second draft of proposals regarding amendments in the IDP had been sent to both, the Sri Lankan Government and the LTTE for their comments and they should return the same before April 30. It further said, "The balance of power is one of the basic elements for the present ceasefire. Hence, to maintain their Force's capabilities both parties must have the right to carry out training and exercise in designated areas. Such exercises and training should cause minimum disturbance to the normal life". The statement also said, "In this context it should also be noted that there are no requirements in the ceasefire agreement to de-mobilise any of the LTTE military units including the Sea Tigers. The final composition of the Sri Lanka Armed Forces should be reached at the peace talks". It added that the LTTE Sea Tigers had neither legal rights nor any legitimate task of safeguarding the sovereignty and territorial integrity of Sri Lanka and these obligations belong to the forces of the Government of Sri Lanka only.

The message was conveyed in a letter by the outfit’s chief negotiator, Anton Balasingham, to the Prime Minister Ranil Wickremesinghe. It said, "you have conveniently ignored the stark reality that the LTTE runs a de facto administration of its own in vast tracts of territories under its control in the northeast". As reported earlier, on May 21, the LTTE had sought an autonomous and Interim Administration with a dominant role for itself in both policy-making and implementation of development and rehabilitation projects in the NEP. The group also rejected the Prime Minister's offer for a provincial administrative structure. "We are disappointed to note that the Prime Minister's statement does not offer anything new. The so-called provincial administrative structure' is the new name given to the Apex Council proposed by him for development and rejected by us as extremely limited and inadequate," the LTTE said. "While our leadership has proposed an Interim Administrative framework, a politico-administrative structure for the NEP with wider participation of the LTTE, the Government has offered a council with a structure and mechanism for the development of the region," it added. Sri Lanka Monitoring Mission (SLMM) spokeswoman Agnes Bragadottir, on July 27, said that the Head of the SLMM General Tryggve Tellefsen, who is on a private visit to Norway, will raise the issue of Liberation Tigers of Tamil Eelam’s (LTTE’s) refusal to abide by the SLMM ruling for dismantling the Wan Ela camp with some of the Norwegian facilitators. She said, "We are very disappointed with the LTTE's refusal to abide by our ruling but expecting a response to the letter sent by the SLMM Chief strongly advising the LTTE to reconsider their stance." This was enumerated in the outfit’s Interim Administrative proposals which were handed over to the Sri Lankan Government through the Norwegian facilitators. While setting a five-year deadline for "a final settlement," of the ethnic conflict, the LTTE said that "if no settlement is reached and implemented'' by then, the interim body's "independent election commission'' would "conduct free and fair elections in accordance with international democratic principles under international observation'' to choose the members of the ISGA. The LTTE's demands reportedly include "all powers and functions in relation to regional administration exercised by the Government in and for the northeast'' including revenue, law and order, land and marine resources. Further, it has sought control over finances with powers over domestic and international borrowings and to "engage in or regulate internal and external trade." LTTE political wing leader, S.P. "We have received very clear assurances that the Ceasefire Agreement will be respected including freedom of movement for Liberation Tigers of Tamil Eelam (LTTE) cadres and the Sri Lankan Armed Forces have been instructed to continue extending their fullest co-operation to the Sri Lanka Monitoring Mission," Helgesen said at a media briefing in Colombo. He said Norway would continue as a facilitator, provided that there is clarity about who is holding responsibility on the Government side. Until such clarity is re-established, there is no space for further efforts by the Norwegian Government to assist the two parties in making further progress in the peace process, he added. According to him, "The allegations leveled against our draft proposals that they aim to create an independent Tamil State or that they contain stepping stones for separation are not true. Our proposals do not constitute a framework for a permanent, final solution. Our draft proposals deal with an interim arrangement." He also refuted charges that the outfit has been rewarded too much during the cease-fire period and said instead that they have suffered heavy loses during the last two years, pointing to the sinking of what he called two LTTE merchant ships. However, the LTTE chief admitted that they are recruiting in a "small-scale" for maintaining an ‘administrative structure’.
