In a bid to restart the long-stalled transitional justice process, at a meeting on January 6, Foreign Minister Pradeep Gyawali said that Government will hold consultations with conflict victims and other stakeholders in all seven Provinces from January 13, reports Republica. According to Government officials, consultations will be held in two sessions – one session exclusively for conflict victims and another round of consultations together with all the stakeholders. The consultations will primarily focus on how to address the concerns raised by conflict victims and other stakeholders while drafting the laws and on ways to resolve the insurgency era-cases.

Presenting a memorandum to Minister of Foreign Affairs Pradeep Gyawali, the Conflict Victims’ Common Platform (CVCP) on January 6 demanded that the transitional justice act be amended on the basis of the Supreme Court’s verdict of January 2, 2013, which states any amendment or new act should be drafted by a drafting task force including victims, experts and human rights activists. The CVCP said the process of appointment of members to two transitional justice commissions should start only after the amendment of the act. The commissions — Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP) — have remained vacant since the office-bearers retired in mid-April. A recommendation committee led by former chief justice Om Prakash Mishra has published a list of 61 candidates aspiring for TRC and CIEDP posts. However, former CVCP Chairperson Suman Adhikari said “None of the 61 candidates are competent enough to lead the commissions as no competent person wants to lead such toothless commissions. We suggested amendment to the act in line with SC verdicts to empower the commissions and search for competent office-bearers.”

Bhagiram Chaudhari, Chairperson of the Conflict Victims’ Common Platform (CVCP), said that cobnflict victims have lost all hope that the incumbent Government and the political parties will ensure that the transitional justice process is victim-friendly, reports Kathmandu Post on January 9. In an interaction with Law Minister Pradeep Gyawali on January 5 and 6, victims’ representatives had asked that thorough discussions be held with victims across the country before taking the legal amendment process forward. The Law Ministry, however, has scheduled interactions in all provincial headquarters for a single day, on January 13, with inputs from all the concerned parties, including victims, human rights activists, civil society members and local leaders. “It is clear the consultation is nothing but a formality to show the world that the government talked to concerned parties before the amendment,” said Bhagiram Chaudhari. Chaudhari further expressed concern that the transitional justice process was becoming increasingly opaque.

Conflict victims have urged the Government to suspend the process initiated to appoint commissioners for key Transitional Justice (TJ) bodies at least until the new law is promulgated, reports My Republica on January 11. On January 10, Primary victim groups--Conflict Victims' Common Platform (CVCP) and National Network of Disabled Conflict Victims –(NNDCV) threatened to stay away from the TJ process. Both the groups warned of boycotting the TJ process if their demands were ignored, while conflict victims have announced to reject their participation in national consultations scheduled for January 13, 2020. “Since the consultation scheduled for January 13 is just for the sake of consultation and not meaningful as demanded by the victims, it’s not acceptable to us,” reads the statement issued by CVCP. After spending 10 months without doing anything substantive to complete the given assignment, a committee formed to suggest commissioners for the two commissions - Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP) - has reportedly finalized the probable candidates. The recommendation process is now said to be delayed until the consultations are organized.

Conflict victims decried Government’s consultations held on January 13 as a sham, reports Kathmandu Post. As victims and human rights defenders had feared, the consultations held simultaneously in all seven provincial headquarters — Biratnagar, Janakpur, Hetauda, Pokhara, Butwal, Surkhet and Dhangadi were more formality than genuine efforts to listen to their grievances and concerns. The consultations were held in two sessions—three hours with victims and another three hours with human rights defenders, civil society members, security forces and the media. Conflict victims and human rights defenders described the entire process as a farce. “Some of our friends couldn’t even put forth their concerns due to time constraints. Rather than listening to our voices, the discussion was aimed at showing that the government has taken our feedback to amend the Act,” Badri KC, a conflict victim from Baglung who was present at the consultation in Pokhara, told. “The discussion was just a formality. I am not at all hopeful about our concerns being incorporated in the Act,” Shree Kumari Budha, whose father was killed by the Maoists in Thawang, Rolpa and who was present at the consultation in Butwal, told. Former Conflict Victims Common Platform (CVCP) chairperson Suman Adhikari said “The victims were only given three hours. This means, the government is holding the consultations in a ritualistic manner.”

The recommendation committee formed under former chief justice Om Prakash Mishra to nominate office bearers of the two Transitional Justice (TJ) mechanisms had recommended the office bearers on January 18. The CVCP said the recommendation committee endorsed the names recommended by the political parties that were indifferent to the pain and suffering of conflict victims. Stating that their lack of imitative to amend the TRC Act, was one of the major causes behind the failure of the two transitional justice bodies, CVCP said, and the recommendation committee ignored the concerns of the conflict victims. The CVCP further said it recommended party’s loyalists in the two TJ bodies without reviewing causes of their failure, and the rights of the victims could not be ensured by the two TJ bodies as they would be unable to investigate the cases of human rights violations in impartial and independent manner. According to CVCP recommendation of the ‘loyalist and inefficient persons’ in the TRC and the CIEDP was made with the intention of to prolong the TJ process. “We will not support the TRC and the CIEDP unless they are formed after consulting us and amending the TRC Act,” CVCP said in the release. The CVCP urged national and international stakeholders to exert pressure on the Government to address concerns of the conflict victims.

The commissions —Truth and Reconciliation Commission (TRC) and Commission of Investigation on Enforced Disappeared Persons (CIEDP) — got full shape after their new chairpersons and members took oath of office and secrecy on January 23. However, conflict victims say they will continue their non-cooperation unless the act is amended. They have so far not entertained the commissions’ invite for discussion on the issues. The victims also said that they had not institutionally taken part in any of the interactions organized by the TRC and CIEDP so far. Conflict Victims Common Platform Chair Bhagiram Chaudhary said “The commissions are inviting individuals. We’ve not taken part institutionally. We are firm on our opinion that the commissions cannot deliver results unless the act is amended. Since the commissions have been formed through political intervention, they cannot deliver.”

Four international human rights organisations and the Office of the United Nations High Commissioner for Human Rights (OHCHR) on May 1 welcomed the Supreme Court (SC)’s decision to reject a Government petition to review its landmark verdict on transitional justice, reports Kathmandu Post.Following the decision, the Government now needs to revise the existing transitional justice law as per the court’s order ensuring justice to the victims of conflict-era abuses, said Amnesty International, TRIAL International, International Commission of Jurists and Human Rights Watch, in a statement.In a separate statement Rupert Colville, spokesperson for OHCHR, said the court’s decision reconfirms that the only way for the Government to credibly proceed with the transitional justice process is to abide by key human rights and transitional justice principles reflected in the 2015 court ruling, including the centrality of victims and the importance of accountability for serious violations. “Victims' advocacy groups and civil society members have welcomed the court's decision, and so do we,” he said.The SC on April 26 rejected the Government’s plea, registered in April 2015 that sought a revision of a verdict issued by a five-member special bench led by then chief justice Kalyan Shrestha in February that year. Five Special Rapporteurs under the United Nations Human Rights Council (UNHRC) in a letter asked the Nepal government if the provincial-level consultations held with conflict victims in January to amend the Transitional Justice Act were participatory, reports Kathmandu Post on May 16. They also asked the Nepal Government also to explain how the seven provincial-level consultations ensured a broad and effective participation of all interested victims, including all categories of victims and victims residing in remote locations, to ensure that their views are accurately and comprehensively represented. They have also asked to inform if the Nepal Government plans any further consultations to engage who were left out earlier and update on how the inputs received from victims and civil society were or will be given due consideration and inclusion in the amended Act. The Government on January 13 held interactions with the victims and other concerned stakeholders at the headquarters of seven provinces. The participants had told that consultations were held in two sessions—three hours with victims and another three hours with human rights defenders, civil society members, security forces and the media. They said the entire process was a ‘farce’. Earlier, UN has written two letters on March 16, 2020, and April 12, 2019 asking the Government to expedite the process to amend the Act in line with Nepal Supreme Court’s ruling and international obligations.

The National Human Rights Commission (NHRC) issuing a press statement on May 30 expressed serious concern about arbitrary and frequent arrests of Chakra Bahadur Khatri of Khotang District, a leader of the Netra Bikram Chand-led Communist Party of Nepal-Maoist (CPN-Maoist-Chand), reports The Himalayan Times. The rights body said the Government was responsible for making the condition of Khatri unknown even to his family, meting out inhumane treatment to him and refusing to abide by frequent orders of the Supreme Court. A report by consortium of Non-Governmental Organisations (NGOs) said that five years since the United Nations Human Rights Council (UNHRC)’s Universal Periodic Review, Nepal is yet to fully implement a single recommendation on transitional justice, reports Kathmandu Post on July 9. The report, submitted to the UNHRC on behalf of 440 NGOs advocating for human rights, says not a single commitment expressed by the Nepal Government during the review in November 2015 has been fully implemented. The Nepal Government had accepted 18 recommendations and ‘noted’ one recommendation made by different countries during the review in November 2015. However, it has wasted five years without taking any concrete measures to implement its own commitments, says the report.

In their joint report submitted to the UNHRC for the Universal Periodic Review (UPR) slated for January 2021, as many as 39 organisations of the victims said they are still desperately waiting for truth, justice and reparations even though the armed conflict ended in 2006. In its report “Human Rights and the Rule of Law in a Federal Nepal”, the international non-governmental organisation of judges and lawyers around the world said appointments to the commission should be done with due urgency so that the commissions function as per the spirit of the statute. “The needed amendments are well-known, and if implemented, would create a consensus that would allow the transitional justice process to finally move forward—the stated goal of the current government,” reads the report. It also has recommended the government initiate a new process for the appointment of commissioners to transitional justice bodies that is transparent and consultative.

The commission also stated that there are some provisions in the Commission of Investigation on Enforced Disappeared Persons and Truth and Reconciliation Act, 2014 which need to be amended as per the order of the Supreme Court. In its written request to the Ministry of Law and Justice, the commission said “Most of the victims’ families relied on daily wages or on foreign employment for their earnings. However, the pandemic left most of them unemployed. The loss of jobs has pushed them into difficulties even to meet their daily needs. It is the responsibility of the state to support its citizens in the time of crisis.” The recommendation, according to the commission, was made after an interaction with the families of the victims who have filed complaints at the commission. NCP leaders are divided about what should be the party’s ideology after the party’s General Convention, with the Oli camp time and again vouching for people’s multi-party democracy. Erstwhile CPN-Maoist Centre, which was led by Dahal before its merger with the CPN-UML, had championed the cause of people’s democracy of the 21st century. Some leaders of the ruling party are saying that a new ideology could be developed by synthesising people’s multi-party democracy and people’s democracy of the 21st century. Conflict victims, who have been awaiting justice for the last 14 years, say political parties have repeatedly employed transitional justice to play the game of one-upmanship, reports Kathmandu Post on December 3. On November 13, Nepal Communist Party (NCP) Co-chair Pushpa Kamal Dahal accused Prime Minister KP Sharma Oli of taking unilaterally with complete disregard to the party’s instructions. On November 25, the Oli Cabinet decided to provide free treatment for the injured from the decade-long armed conflict at Government hospitals. Suman Adhikari, founding chairperson of the Conflict Victims Common Platform said “What had stopped the Oli government from announcing free treatment all these years? It’s just a messaging by Oli to the former Maoists in his party.” On November 29, a day after Oli’s political document, Minister for Law and Justice Shiva Maya Tumbahanghe invited the representatives of conflict victims and said that the Government wants to see the transitional justice process concluded without delay. Gopal Shah, chairperson of the Conflict Victim’s National Platform said “All these claims that the government is committed to concluding the transitional justice process are nothing but an eyewash. The government is reaching out to the victims now not because it is worried about them. It is trying to placate the victims to remind Dahal that the transitional justice could invite trouble for him.” Since its formation in 2015, the transitional justice bodies have not completed a single investigation of thousands of cases. According to Shyam Shrestha, a political commentator who follows the left politics closely, Oli is using every means to retain his superiority in the party and transitional justice is one of them. “Whenever Oli lands in trouble in the party, he uses transitional justice as a bargaining tool against the Maoists. He is playing the same trick now, albeit in a more visible manner,” said Shrestha.

The Office of the President said in a notice that President Bidya Devi Bhandari has approved the recommendation, pursuant to Article 76 (1) and (7) and Article 85 of the constitution, of the Council of Ministers to dissolve the House of Representatives. The President has also approved the Cabinet’s recommendation for holding general elections on April 30 and May 10, 2021. Advocates Lokendra Oli, Keshar Jung KC and Dinesh Lamichhane have jointly registered the writ petition as the Article 77(1) of the Constitution states that a person who is not a member of Parliament cannot be a Prime Minister and a Minister. “Our writ petition was just registered. Discussions on it will be held on Wednesday. We have demanded that the caretaker government cannot reshuffle the Cabinet and therefore the move should be scrapped,” said advocate Oli. In the writ, the petitioners have also demanded that the Supreme Court issue an interim order not to implement the decision of December 25 of Cabinet reshuffle. The Office of the President and the Office of the Prime Minister and Council of Ministers have been made defendants.
