The Unlawful Activities (Prevention) Act (UAPA) Tribunal upheld the Centre’s ban on pro-Khalistan group — Sikhs for Justice (SFJ), ensuring that the group is declared as an unlawful association on January 9, reports The Tribune. This comes as a big relief for security agencies in Punjab, where the group has been trying to revive a separatist movement in the State. The Director General of Police (DGP) Dinkar Gupta said the ban on the SFJ was good news for the State, where it had been fishing for young and gullible youth, and radicalising them. The DGP said, “With the SFJ being declared as an unlawful association, people will not fall prey to their objective of radicalising youth and unleashing violence in the state." A notification by the Centre, declaring the SFJ as an unlawful association, was issued yesterday. Earlier, the Centre had announced its decision to declare the group as unlawful on July 10, 2019 and banned it for five years. It had then referred the matter to the UAPA Tribunal. The Tribunal, headed by Delhi High Court Chief Justice D.N. Patel, had examined all evidence produced by the Punjab Government as well as the National Investigation Agency (NIA), regarding the subversive activities of the SFJ. The tribunal held that it was clear from the evidence that activities of the group were “unlawful, disruptive and threaten the sovereignty, unity and territorial integrity of India”. It further held that the evidence proved that the SFJ was “working in collusion with anti-India entities and forces”. The tribunal took into account all “terror” incidents and unearthing of modules in Punjab since 2017; the SFJ’s social media campaign; besides letters written by the SFJ authorities to various diplomats, seeking support for their campaign.

The Border Security Force (BSF) launched a massive search operation following the sighting of drones at Tendiwala village near Shameke sector of International Border (IB) in Ferozepur District of Punjab on January 14, reports The Tribune. As per the report, drones were sighted twice around 8.48 pm and later around 11 pm in the said location. The BSF jawans belonging to the 136 Battalion opened fire at the flying objects to bring them down. Later, a joint search operation by the BSF and the Punjab Police was carried out, however, nothing substantial was found. The Senior Superintendent of Police (SSP) of the District, Vivek Sheel Soni said that the Police had received information regarding the sighting of drone-like objects following which the search was conducted to rule out any misadventure from across the border. “We have asked the villagers to report if they found something suspicious,” he said. Further, the Deputy Inspector General (DIG) of BSF, Sandeep Chanan said, though some flying objects were seen, it could not be ascertained whether they were drones or something else. He confirmed that the troops fired some rounds towards the objects and the search operation was still on.

The State Police of Punjab has banned the use of Remote Piloted Aircraft System (RPAS) or Unmanned Aerial Vehicles (UAVs) i.e. drones, in areas adjoining the India-Pakistan border across the State on January 15, reports The Tribune. The radius of 25 kilometers near the border has been declared “no drone zone” and notice boards have been installed outside all Police Stations in these areas. The Police have warned that if anyone is caught violating the order, strict legal action will be taken. The police have made it clear that no one is allowed to use drone even for shooting films and if anyone wants to shoot any occasion, prior permission has to be procured. The Station House Officer (SHO) of Gharinda, Amandeep Singh said, “The use of drones in border areas is totally banned. No one is allowed to use drones even for amusement. If wedding photographers want to shoot a ceremony, they have to seek permission. We have increased surveillance in the border villages and appealed to the public to cooperate and inform the police about the sighting of any drone activity.”

Keeping in view the misuse of drones in smuggling narcotics and arms from across the International Border (IB), the Punjab Police have put a ban on flying Unmanned Aircraft System (UAS) or Remotely Piloted Aircraft System (RPAS) i.e. drone within a distance of 25 Kilometers of the India-Pakistan border, reports The Tribune on January 22. These directions were issued to conform to the directions of the Ministry of Civil Aviation under a policy named ‘Drone Regulations 1.0’ that classify UAS or RPAS or drone, and delineate how these can be flown and set restrictions under which they can be operated. The Senior Superintendent of Police (SSP), Vikram Jeet Duggal said a special vigil would be undertaken to ensure that the directions regarding drones are followed. Ownership of a drone without a valid permit would invite action under the Indian Penal Code (IPC). The SSP further said, as per these rules, a special permit according to the potency of the drone has to be obtained from the Director General of Civil Aviation. The Ministry of Civil Aviation has issued a public notice providing a “one-time” opportunity for voluntary disclosure for all drones and drone operators till January 31.

The Sikhs for Justice (SFJ) has changed its nomenclature from “Sikh Referendum 2020” to “Punjab Referendum 2020”, reports The Tribune on January 30. As per the report, the SFJ circulated posters on social media, extending the programme to all communities and invited members of other religions, besides Dalits to join the movement. The Punjab Police and Intelligence Officials said that the SFJ had abandoned the ‘Sikh Referendum’ movement and shifted its stance after it got no response from the Sikh community over its separatist agenda. The SFJ had announced the referendum movement in 2018, and even after a publicity drive for over two years, there was no response to the movement, the Officials added.

The National Investigation Agency (NIA) on February 10, told a special NIA court that Pakistan-based terrorist outfit, Khalistan Liberation Force (KLF) ‘chief’ has been instrumental in running cross-border narco-terrorism in India, reports The Times of India. The NIA revealed this in the Court while seeking Police custody of three accused — Nirmal Singh, Satpal Singh and Hiralal, arrested in connection with the Amritsar heroine recovery case of 2019. Presenting its case for Police remand, the NIA told the Court that during the investigation, role of Harmeet Singh alias PHD, Pakistan-based chief of KLF, a proscribed terrorist organisation, has emerged in running a cross-border narco-terror network through drug smugglers, militant elements and hawala operatives based in Punjab and the other States of India. Harmeet Singh had been killed in Pakistan on January 27, 2020, the agency said.

Indian security agencies have revealed that Pakistan’s spy agency, Inter-Services Intelligence (ISI) along with Khalistan Zindabad Force (KZF) and other Khalistani terrorist groups are using drones to deliver arms and ammunition from across the International Border (IB) into the Indian territory, reports Outlook on June 20. In this context, the Border Security Force (BSF) officials said, nearly a dozen Chinese commercial drone sorties, carrying almost 100 kilograms of arms and ammunition, were sent from across the border into Punjab by the Pakistan-based Khalistani terror groups in close coordination with the ISI between September 9 and 16, 2019. Those drones with 10 kilograms payloads flew for almost seven kilometers from their launch pads at a height of 2,000 feet to deliver the payload. The latest such instance was witnessed on June 20 when BSF troops shot down a Pakistani Hexa-Copter drone carrying one M4 carbine machine (US-made), two loaded magazines (60 rounds), and seven Chinese grenades near the IB in Kathua District of Jammu and Kashmir (J&K).

The first FIR is registered based on the complaint of Dalit Suraksha Sena (DSS) against Gurpatwant Pannu and his associates, at Police Station B/Division, Police Commissionerate Amritsar for burning the Indian Constitution and Indian national flag, and instigating others to do so too, which had hurt the sentiments of the entire Scheduled Caste (SC) community in the country. The spokesperson of the Union Ministry of Home Affairs (UMHA) said the action has been taken following the banned outfit launched a campaign for registering supporters for its cause – ‘referendum 2020’. The official said, “On the recommendation of the UMHA, the Ministry of Electronics and Information Technology (MeitY) has issued the orders under section 69 A of the IT Act, 2000, for blocking 40 websites of SFJ”. According to sources in the MeitY, the SFJ’s Facebook page has already been blocked in India. They said a notice was also served to SFJ by the ministry, which said that it had been “reported to the department that the URL http://sikhsforjustice.org contained objectionable content”.

As per the report, many journalists in Delhi have lately been receiving calls originating mostly from numbers in the US, seeking their support for SFJ's Khalistan cause and ‘Referendum 2020’, under which popular vote is being solicited in support of Punjab’s secession from India. The messages that are played out every time one accepts the international call – that may show Michigan or Georgia or any other location in the US as the point of origin of the call, contain anti-India statements and invoke radical Sikh feelings to push their ‘Khalistan’ agenda. An intelligence officer said the calls on behalf of SFJ were being made as part of global propaganda run by its leader Gurpatwant Singh Pannun. The officer said, “the idea is to contact lawyers and journalists to ensure publicity for their agenda. It is possible that they have accessed their numbers from the public domain; such as PIB website or e-directory of lawyers. The numbers are mostly internet-generated and since the calls are made from different numbers, it becomes difficult to track or block them. The details emerged as two men — Bhagat Singh Brar and his business partner Parvkar Singh Dulai — challenged being blocked from travelling by air. As per supporting case documents filed by Canadian security agencies, including Public Safety Canada, the Royal Canadian Mounted Police and Canadian Security Intelligence Service, Brar was “promoting extremism, including the radicalisation of youth, with the aim of achieving Khalistan independence; and attack planning and facilitation, including weapons procurement, to conduct attacks in India.” On the other hand, Dulai was described as a “facilitator of terrorist-related activities and has shown an ongoing pattern of involvement within the Khalistani extremist milieu”. The report further said that Brar visited Pakistan in 2015 and collaborated with one Gurjeet Singh Cheema to plan an attack in India. The case documents alleged that Brar collected donations for gurdwaras and “is suspected to have been diverting major part of the funds for anti-India activities”. He was also linked to Pakistan’s Inter-Services Intelligence (ISI). Dulai has been described as a very vocal supporter of Khalistan. Also, Brar again visited Pakistan in 2018 to meet his father who happens to be Lakhbir Singh Rode, nephew of Jarnail Singh Bhindranwale and founder of the banned International Sikh Youth Federation (ISYF).

The Tarn Taran Police on September 4, arrested four smugglers and alleged accomplices of the five Pakistani intruders, who were shot dead by the Border Security Force (BSF) personnel near Dall International Border (IB) outpost in Tarn Taran District on August 22, reports The Tribune. The arrested accomplices have been identified as, Gurbir Singh and Gurbax Singh, both residents of Dall village, and Yudhvir Singh and Gurpreet Singh of Dhunda village in the District. The Senior Superintendent of Police (SSP), Dhruman Nimbale said during the forensic examination of the mobiles seized from the Pakistani intruders, it was found that the accused had interacted with the intruders before they were shot by the BSF troopers. A senior official privy to the investigations said the four used to retrieve the narcotics consignments from the IB and later handed it over to their links as per the instructions. They used to get INR 20,000 to INR 60,000 per consignment, depending on the quantity retrieved, the official said.

As per the report, the ‘chief’ of Khalistan Zindabad Force (KZF) who is in Belgium and his handlers Jagdish Bhura and Dhanna Singh had asked the two to go to Delhi and procure arms, funds for which were sent from Belgium. The announcement comes following the recent farmers’ protest against the three contentious agriculture-related Bills passed by the Parliament. SFJ’s offer has alerted security and intelligence agencies, which have shared the inputs with law-enforcement wings in both the States. SFJ’s legal adviser, Gurpatwant Singh Pannun said, “From October 1 to October 8, any farmer -- irrespective of his faith -- can register 25 votes for the Khalistan Referendum 2020 and get a grant of Rs 5,000 as assistance to repay their agricultural loans.” Calling the Indian government's new farms Bills as a “colonial agenda to ultimately turn the farmers landless”, Pannun said in his announcement that “the Modi government wants to enslave the farmers of Punjab and Haryana by turning them into destitutes. The National Investigation Agency (NIA) on December 4 filed a supplementary charge-sheet in Khalistan Liberation Force (KLF) narco-terror case in the NIA Special Court at Mohali in Sahibzada Ajit Singh Nagar District of Punjab, reports Hindustan Times. The agency filed the charge-sheet against “narco-terrorist” Dharminder Singh aka Dhana (32) under various sections of Indian Penal Code (IPC), and Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. “The accused used to receive Heroin smuggled from Pakistan from accused Jajbir Singh Samra and further distribute/sell it to local traffickers. The proceeds so generated used to be deposited with Jajbir Singh for further strengthening the activities of KLF,” NIA said in a release. Earlier, a charge-sheet was filed on May 29 against ten accused persons namely – Jajbir Singh Samra, Harpreet Singh, Varinder Singh Chahal, Nirmal Singh aka Neeldhari, Satpal Singh, Hiralal, Harjit Singh aka Bagga, Jasmeet Singh Hakimzada, Harmeet Singh and Jasbir Singh aka Shera in the Special NIA Court, Mohali, Punjab. According to the NIA release, the case pertains to the seizure of 500 grams of heroin and drug money INR 1,20,000 on May 31, 2020, from accused Jajbir Singh Samra and two others. The case was re-registered by NIA and an investigation was taken up.

Terry Milewski, one of Canada's veteran journalists, who authored the report reveals how Pakistan launched the ‘Khalistan’ insurgency using Indian Sikhs in Indian Punjab to avenge its own defeat in the Indo-Pak 1971 war. Interestingly, the report points out how Pakistan viewed the ‘Khalistan’ project as a strategic buffer and how an independent ‘Khalistan’ would end India's land access to Kashmir to the north, another key interest of the Pakistan Army since 1947. The report claims that the western democracies with large Sikh communities like Canada, the UK and the US are aware of this absurdity and therefore, skeptical of the ‘Khalistan referendum’, planned for November 2020.

Rajesh Sharma, Deputy Inspector General of Police (DIG), BSF, said the troopers on hearing the buzzing sound of a drone in the late night of December 19 near Chakri outpost, fired multiple shots towards the source. The Police authorities were alerted and a joint search operation was initiated leading to the recovery of the grenades on the following day. The 11 grenades of Arges-type HG-84 were placed in a neatly packed wooden box. The drone, however, was not recovered and it is suspected that it managed to fly back to Pakistan after dropping the payload.

Contrary to MLI’s allegations, Khalistan Referendum is a gross root initiative led by Sikh sovereigntists,” SFJ’s general counsel Gurpatwant Singh Pannun said in a statement. The MLI, on the other hand, has said that the defamation lawsuit filed by the SFJ is a “meritless attempt to silence public debate”.

According to NIA officials, Nijjar of Pandori Sukha Singh village in Ajnala Tehsil (revenue unit) of Amritsar District in Punjab, was wanted in a case registered on January 10, 2019, against Harpal Singh, another Khalistani terrorist, under various sections of the Arms Act, Maharashtra Police Act and the Unlawful Activities (Prevention) Act. The investigation later revealed that Nijjar was the main conspirator in the case. “Accused Nijjar, Harpal Singh and Moin Khan were active on social media platforms and had hatched a criminal conspiracy to revive Sikh militancy for the formation of a separate state of Khalistan,” a senior NIA official said adding that the trio used to post videos and images praising militant Jagtar Singh Hawara (a convict in Beant Singh assassination case). They also posted images and videos of Operation Bluestar and pro-Khalistani posts related to the Babbar Khalsa International (BKI) with the intention of motivating Sikh youths and others to join the ‘Khalistan movement’.
