As many as 829 villages in Gadchiroli District of Maharashtra have no Internet connectivity was revealed by the Department of Telecommunications (DoT) in an affidavit filed before the Nagpur bench of the Bombay High Court (HC) on January 19 when hearing on a suo motu Public Interest Litigation (PIL) (No7/2020) took place, reports telecom.economictimes.indiatimes.com. The PIL was based on letters by 10 school students, hailing from remote villages in the Naxalite [Left Wing Extremist, LWE]-infested District, to the HC Chief Justice and senior administrative judge at the Nagpur bench, where Firdos Mirza was appointed as amicus curiae. Upset over the information by the DoT, a division bench comprising justices Sunil Shukre and Anil Pansare expressed concern over the future of schoolchildren from the tribal-dominated district.

In a setback to the National Investigation Agency (NIA), the Chhattisgarh High Court on March 2 dismissed the probe agency’s appeal to quash or transfer the second First Information Report (FIR) registered in connection with the 2013 Maoist attack in Jheeram valley that had killed 29 persons, including several senior Congress leaders, reports The Indian Express. The FIR in question was filed by slain Congress leader Uday Mudliar’s son Jitendra Mudliar in 2020. A division bench of justices RCS Samant and Arvind Chandel passed the order, clearing way for the State Police to carry on with the investigation into the alleged conspiracy behind the attack. The central probe agency had moved the High Court after a special NIA court in Jagdalpur had rejected its plea. Reportedly, on May 25, 2013, Maoists ambushed and killed 29 persons, including senior leaders Nand Kumar Patel, Vidya Charan Shukla and Mahendra Karma, during a poll campaigning tour in Bastar. The Congress had alleged “a bigger political conspiracy” behind the attack, demanding an independent inquiry. The case was transferred to the NIA the same year and the Congress party termed the agency’s 2016 probe report “more of a cover-up than an investigation”.

A special National Investigation Agency (NIA) court in Dantewada District of Chhattisgarh on March 14 acquitted tribal activist Soni Sori and three others in a case filed against them by the Chhattisgarh Police in 2011 for alleged channelizing of ‘protection money’ to Naxalites [Left Wing Extremists, LWEs], reports The Pioneer. Special Judge (NIA Act) Vinod Kumar Dewangan passed the order on March 14. Besides Sori, the court also acquitted her activist nephew Lingaram Kodopi, construction contractor B.K. Lala and then Essar company official D.V.C.S. Verma, citing that the prosecution has failed to prove the charges against the accused. Therefore, in the absence of corroborative evidence, the accused are acquitted, the court said in a 76-page order. Sori and Kodopi were arrested on charges of acting as Communist Party of India-Maoist (CPI-Maoist) conduits and allegedly receiving "protection money" for the rebels from the Essar company. They were booked under the Indian Penal Code (IPC) sections 124 (A) (sedition), 121 (waging or attempting to wage war against government) and 120-B (criminal conspiracy) and the Unlawful Activities Prevention Act (UAPA) and the Chhattisgarh Special Public Security Act.

The Kerala High Court on March 17 quashed the charges slapped under the Unlawful Activities Prevention Act (UAPA) and under section 124A (sedition) of the Indian Penal Code (IPC) against Communist Party of India-Maoist (CPI-Maoist) leader Roopesh in three cases registered in Kuttiadi and Valayam Police Stations in Kozhikode District of Kerala, reports The New Indian Express. A Division Bench comprising Justice K Vinod Chandran and Justice C Jayachandran issued the order while allowing the petition filed by Roopesh seeking to quash the cases. The authority headed by a retired high court judge had recommended charging the section against the petition based on the letter of the home department on February 7, 2018. The sanction of the State Government in the first two crimes was on June 6, 2018, and in the other crime on April 7, 2018; both delayed. In the UAPA and the Rules framed thereunder, a specific time of seven days is provided. The Authority has to make a recommendation, after which the appropriate Government also has to issue a sanction within another seven days from the receipt of the recommendation, argued the petitioner. "Amidst the raging controversy as to the retention of offence of sedition in the IPC; which the naysayers categorise as a relic of the colonial past; a symbol of British hegemony and the votaries support in the wake of rising anti-national feelings under the cloak of liberal thought, the Government sat over a sanction for six months, violating the time frame prescribed in the rules," observed the Bench. The Bench held that the sanction under the UAPA granted after six months from the date of receipt of the recommendation of the authority is not a valid sanction. "We find the sanction order of the UAPA to be not brought out in time, as statutorily mandated and bereft of any application of mind; both vitiating the cognizance was taken by the Special Court," observed the court.

Communist Party of India-Maoist (CPI-Maoist) leaders BG Krishnamurthy and Savithri, who were in judicial custody, were brought before a court in Karkala on May 4, in connection with pending investigation into cases filed against them at Karkala rural, Hebri and Ajekar Police Stations, and they were sent to Police custody for 12 days for questioning, reports The New Indian Express. A senior officer said that the accused were sent to Police custody in connection with 13 cases against them in three Police Stations under Karkala sub-division in Udupi District. In November last year, the Maoist duo Krishnamurthy and Savithri were arrested and were later moved to Viyyur central prison in Thrissur, sources said. They are charged with spreading Maoist ideology, possession of weapons, weapon training and unlawful assembly to launch an armed agitation.

Bankura Police arrested Sanjeev Majumder (35) on charges of being involved in Communist Party of India-Maoist (CPI-Maoist) activities, from Ghola under Barahanagar Police Station limits in North 24 Parganas District of West Bengal on May 9, reports anandabazar.com. Several Maoist posters were also recovered from him. Majumder, a resident of Barahanagar Police Station limits in North 24 Parganas, was arrested from his home on May 9 and was taken to Bankura Khatra Court on May 10, the judge ordered seven days Police custody. Assistant Public Prosecutor of Khatra Sub-Divisional Court Sandeep Chakraborty said, “A case has been filed against Sanjeev Majumdar under various sections of treason. The Chhattisgarh High Court on May 11 stayed the enquiry proceedings of a judicial commission newly reconstituted by the State Government, which added new terms of reference to an existing enquiry into the 2013 Jheeram Ghati Communist Party of India-Maoist (CPI-Maoist) attack that left 28 Congress leaders dead, reports Hindustan Times. A petition was filed by senior Bharatiya Janata Party (BJP) member of Legislative Assembly (MLA) and leader of opposition Dharamlal Kaushik questioning ‘constitutionality’ of the commission on April 13. Kaushik pointed out that the report of the Jheeram Ghati Inquiry Commission headed by Justice Prashant Kumar Mishra should have been tabled in legislative assembly within six months of its submission but without submitting the report, the state government reconstituted the judicial commission. The division bench of chief justice Arup Kumar Goswami and justice RCS Samant has also issued notices to the state government and the judicial commission and sought a reply. “The court after hearing the petition stayed the enquiry proceedings of the reconstituted judicial commission. Senior Communist Party of India-Maoist (CPI-Maoist) leaders, B G Krishnamurthy and Savithri alias Rejitha, natives of Bhuvanahadlu village under Sringeri Taluk (administrative division) in Chikkamagaluru District of Karnataka, and other Maoists who were arrested in Kerala in November 2021, were produced in Kundapur Court in Udupi District on August 17, reports Daijiworld. The inquiry of cases on both Maoists is transferred to District Court, and chargesheets on six cases under the limits of Shankaranarayana Police Station limits and one under Kollur Police Stations limits are already submitted to court. However, the criminal sections in these cases need to be inquired in District Court, hence, all the seven cases were ordered to be transferred to the District Court. B G Krishnamurthy submitted a written appeal to the court and requested to keep him in prison of Karnataka. In his appeal, Krishnamurthy stated that out of the four cases in Kerala, he has secured bail in one and he can go for inquiry from Karnataka for the remaining three cases. However, the court did not accept his appeal as of now. Earlier, South Asia Terrorism Portal (SATP) has reported the arrest incident on November 9, 2021.

The Kerala Government is likely to withdraw the plea submitted before the Supreme Court to restore Unlawful Activities Prevention Act (UAPA) charges against alleged Communist Party of India-Maoist (CPI-Maoist) leader Roopesh, reports Mathrubhumi on August 23. It is learnt that the standing counsel for Kerala Government will intimate the decision to the Supreme Court bench chaired by justice MR Shah, when the court takes up the matter. Earlier, the Government had approached the apex court to restore UAPA charges against Roopesh in the cases registered in Valayam and Kuttiady Police Stations. The court had sent notice to Roopesh on this. The court is slated to take up the matter on September 19.

The Supreme Court, on November 9, said it was considering allowing the house arrest request of activist Gautam Navlakha incarcerated in connection with the Elgar Parishad-Communist Party of India-Maoist (CPI-Maoist) link case, reports The New Indian Express. The top court asked Additional Solicitor General (ASG), S V Raju, appearing for the National Investigation Agency (NIA), to seek instructions and inform it about restrictions that can be placed on Navlakha while keeping him under house arrest for a few days. A bench of justices K M Joseph and Hrishikesh Roy said it will pass the order Thursday after hearing the ASG. "He is a 70-year-old man. We don't know how long he will live. Certainly, he is going towards the inevitable. It's not that we are going to release him on bail. He is not going to enjoy the default bail that comrade Sudha (Bharadwaj) got. We are conscious that we have to tread carefully. We agree that house arrest as an alternative has to be used carefully." "We are concerned about what restriction would you like to place. Place whatever restrictions. It's not that he is going to destroy the country. At least let him remain under house arrest for a few days. Let's try to work it out," the bench said.

S R Navandar, Special Judge, under Unlawful Activities Prevention Act (UAPA), Pune, on December 14, convicted Arun Bhelke on various counts with sentences to run concurrently, who was arrested on charges of being an active member of banned organisation Communist Party of India-Maoist (CPI-Maoist), reports The Hitavada. The Anti-Terrorism Squad (ATS) had arrested Bhelke and his wife Kanchan Nannaware, both hailing from Chandrapur in Vidarbha region, in September 2014. Bhelke and Nannaware were arrested from Kanhe Phata area in Pune Rural. Both were booked under various provisions of the Indian Penal Code (IPC) and UAPA. They were lodged in Central Jail, Yerwada. On January 24, 2021, Nannaware died after a prolonged illness. On December 14, Arun Bhelke was convicted under Section 420, 467, 468, 471, and 474 of the IPC and Sections 20 and 38 of the UAPA. Under the provisions of the IPC, he was sentenced to five years, seven years, five years, five years, and five years separately, with a fine of Rs 5,000/- in each provision. In default to pay the fine, his sentence included, simple imprisonment of one month under each of the cited sections of the IPC. Under the UAPA, he was sentenced to eight years with a fine of Rs 10,000-, in default of which simple imprisonment of two months. Under Section 38 of the UAPA, the court awarded sentence of seven years with fine of Rs 7,000/-, in default of which two months of simple imprisonment.

A court in Dumka District, on December 23, released Communist Party of India-Maoist (CPI-Maoist) cadre Sukhlal Murmu alias Praveer Da, who was jailed for blowing up a polling party's bus returning after holding elections and then firing indiscriminately and killing eight polling personnel including five Policemen near Asna village in Sarsajol in Shikaripada Block in Dumka District during Lok Sabha (Lower House of the Indian Parliament) elections 2014 (April 24, 2014), reports zeenews.india.com. This decision has been given by the court of Dumka Additional Sessions Judge I Ramesh Chandra. Praveer Da is currently lodged in Hotwar Jail of Ranchi while three others accused Budhnath Murmu, Tala Kudi Murmu and Baburam Baski are lodged in Dumka Central Jail, and one accused Som Murmu is currently out on bail. The jailed accused were presented through video conferencing and after the hearing, the court ruled to release them.
