A Chittagong District Court on January 30 awarded death penalty to 14 people, including Motiur Rahman Nizami, Ameer (chief) of Jamaat-e-Islami (JeI) and United Liberation Front of Asom-Independent (ULFA-I) ‘vice-president’ and ‘commander-in-chief’ Paresh Baruah for smuggling 10 truckloads of arms into Chittagong District in 2004 during the last Bangladesh Nationalist Party (BNP)-led Government's tenure, reports The Daily Star. The cases were lodged with Karnaphuli Police Station a day after the arms haul at Chittagong Urea Fertiliser Ltd (CUFL) jetty in the early hours of April 2, 2004. The other convicts include ex-minister, Luftuzzaman Babar, former Director of Directorate General of Forces Intelligence (DGFI) Major General (retired) Rezzakul Haider Chowdhury, ex-director general of National Security Intelligence (NSI) Brigadier General (retired) Abdur Rahim, former NSI director Wing Commander (retired) Shahab Uddin, former NSI Deputy Director Major (retired) Liakat Hossain, ex-NSI Field Officer Akbar Hossain Khan, former Additional Secretary of Industries Ministry Nurul Amin, ex-CUFL Managing Director Mohsin Talukder and former CUFL General Manager (administration) Enamul Hoque. Three other condemned men are Hafizur Rahman Hafiz, a local arms smuggler, Din Mohammad, who supplied workers for offloading the arms and ammunition, and Haji Abdus Sobhan, owner of one of the two trawlers that carried the weapons from the deep sea to the CUFL jetty. Of the convicts, 12 were present in court, while Paresh Barua and Nurul Amin are on the run.

The International Crimes Tribunal-2 (ICT-2) on February 2 indicted Syed Mohammad Qaisar (73), a former State Minister of the Hussain Mohammad Ershad regime, on 16 charges of crimes against humanity and genocide committed in Habiganj and Brahmanbaria Districts during the Liberation War in 1971, reports The Daily Star. Qaisar, an alleged local leader of Razakar and Peace Committee was charged for “participating and abetting” an act of genocide in 22 villages under Nasirnagar sub-District in Brahmanbaria District that left 108 Hindus dead. Qaisar, the alleged founder of Qaisar Bahini, which worked with the Pakistani Army, was also charged with at least 11 incidents of killing that left 47 people dead, two incidents of rape and two incidents of inhuman acts between April 27 and November 15, 1971.

As per the full text of the verdict of the special tribunal on the Chittagong arms haul cases released on February 4, the role of the then Prime Minister Khaleda Zia in the incident was termed ‘mysterious’, reports The Hindu. Judge S.M. Mojibur Rahman of the Chittagong Metropolitan Sessions Court and Special Tribunal-1 released the full text of the 500-plus page judgment of the cases. The judge said the then Directorate General of Forces Intelligence (DGFI) chief Major General (Retired) Sadiq Hasan Rumi had informed the former Prime Minister about the situation. She did not react but said she was aware of the event.

Chittagong Police on February 10 pressed charges against Hefajat-e Islam (HeI) nayeb-e-ameer (vice president) Mufti Izharul Islam Chowdhury, his son Harun Bin Izhar and seven others in a case filed in connection with an explosion at a madrasa in the District, reports The Daily Star. The seven others who were chargesheted are Abdul Hai, Rabibur Rahman, Mohammad Ishak, Monir Hossain, Abdul Mannan, Tafsir Ahmed and Mohammad Junayed. The blast, which claimed three lives, occurred in a room of a dormitory of Al Jamiatul Ulum Al Islamia Madrasa in Chittagong city's Lalkhan Bazar on October 7, 2013.

Foreign Minister Abul Hassan Mahmood Ali on April 1 told the International Conference on Prevention of Genocides in Brussels, the capital of Belgium that the International Crimes Tribunals (ICTs) in Bangladesh were set up to end the culture of impunity, establish rule of law, and dispense justice to the victims and their families, reports The Daily Star. The Minister said that the ICT Act, 1973 adheres to relevant international standards to ensure due process and fairness of the trials and rights of the defendants. He highlighted that during the nine-month Liberation War in 1971 “three million Bengali civilians were killed, more than 200,000 women were violated, and 10 million people were rendered refugees. A small minority of ideologically motivated local collaborators and auxiliary forces participated and abetted in committing these mass atrocity crimes.”

The HC gave the verdict after hearing appeals by the four accused against the lower court judgment. The charges brought against them were not proved, as none of the witnesses saw them spray bullets at the eight people. On March 27, 2008, Second Additional Metropolitan Sessions Judge Ekramul Haq Chowdhury handed down the capital punishment to the ICS cadres.

During the closing arguments, prosecutor Mokhlesur Rahman Badal claimed that he had proved all the charges against Khokon “beyond any shadow of doubt”. He further said “We are seeking his [accused] capital punishment.” Khokon, believed to be living in Sweden with his son and daughter, is facing 11 charges for his alleged involvement in killings, genocide, torture, abduction and confinement of people during the Liberation War in 1971. Mobarak got involved with Jamaat-e-Islami (JeI) during the Liberation War in 1971 and joined the Awami League (AL) in the 1990s. According to the charges in the indictment order, Mobarak as a commander of Razakar force substantially “participated in,” “contributed to” and “facilitated” the commission of crimes in different parts of Brahmanbaria District in 1971. The charges against Mobarak are killing of 33 unarmed civilians at Tanmandayl in Akhaura; capture of a Hindu temple, renaming Anandamoyee Kalibari as Razakar Manzil and torturing Ashu Ranjan to death; abduction and murder of Abdul Khaleque of Satian village; abduction and torture of Khadem Hossain Khan; and abduction of Abdul Malek of Kharampur and killing of Mohammad Siraj.

In addition, an indigenous prosecution witness (PW), Basu Sautal on June 1 alleged at the ICT-2, that SM Qaisar made the Pakistan Army rape his aunt at a Habiganj Tea garden in Habiganj District in 1971, reports The Independent. ICT-2 headed by Justice Obaidul Hassan recorded the deposition of Basu Sautal. He is 18th prosecution witness alleged in his deposition that SM Qaisar, Gafur and Abdul Haq with two Pakistani Army men came to their house at about 10am in the morning on May 11 in 1971. The three-member ICT-1 led by its Chairman Justice M Enayetur Rahim kept Mobarak's case on CAV [Curia Advisari Vult, a Latin legal term meaning verdict could be delivered anytime] after hearing two petitions submitted by the prosecution. On November 11, 1971, Mobarak and his armed associates abducted Abdul Khaleque of Satian village at about 9:00 pm and took him to the Razakar camp of Suhilpur Union Parishad. Khaleque, a pro-liberation Ansar member, faced torture and was eventually killed, according to the charges pressed against Mobarak. While serving as a Jamaat-e-Islami (JeI) member during the Liberation War, he was involved in murder, abduction, confinement, torture and loot, according to the charges. Mobarak, as a commander of Razakar force, substantially “participated in”, “contributed to” and “facilitated” the commission of crimes in different parts of Brahmanbaria in 1971. In the closing arguments, the prosecution appealed to the tribunal to award him capital punishment for his crimes against humanity during the war. On April 23, 2013 the tribunal indicted Mobarak, for his war crimes.

The High Court (HC) on June 9 summoned Jamaat-e-Islami (JeI) acting secretary general Rafiqul Islam Khan before it on July 7, 2014 in connection with a contempt of court rule issued for making a "derogatory and contemptuous" statement about the court, reports Daily Excelsior. The bench of Justice Mohammad Asfaqul Islam and Justice Mohammad Ashraful Kamal also fixed July 7 for delivering a verdict on this issue. Earlier, on August 5, 2013 another HC bench, led by Justice M Enayetur Rahim, issued the contempt rule against Rafiqul and another JeI leader, Mohammad Ibrahim, for issuing the statement on August 1, 2013 rejecting the HC verdict that declared JeI's registration with the Election Commission illegal. Receiving a copy of the statement, the HC bench led by Justice Enayetur on August 5 also asked them to appear before it on September 16 last year to explain why contempt of court proceedings should not be brought against them for issuing such a statement. Rafiqul and Ibrahim apologised unconditionally to the court for the statement and Ibrahim appeared before the HC but Rafiqul did not, Deputy Attorney General SM Maniruzzaman said.

Police on June 11 charged five people, including Hefajat-e-Islam (HeI) Nayeb-e-Ameer (deputy chief) Mufti Izharul Islam Chowdhury and his son Harun Bin Izhar, with the killing of three people by exploding bombs at a Chittagong city madrasa (Islamic seminary)- Al Jamiatul Ulum Al Islamia Madrasa, on October 7, 2013 , reports Daily Star. The three other accused are Mohammad Zunaid, guard; Mohammad Ishaque, teacher; and Habibur Rahman, student, of the madrasa. It was primarily proved that the accused were involved in collecting bomb-making substances, making explosives by supplying these substances, and killing the people by carrying out the blast, according to the charge sheet. Police prepared the charge sheet after running an investigation by collecting evidence from the scene, analysing the autopsy reports of the deceased, and interrogating 34 witnesses including police personnel, experts, and general people. In connection with the incident, two other cases--one under the explosives act and the other under the acid control act--were also filed. The trial of the first one is underway while the charge sheet was filed in the second case.

The 22nd prosecution witness on June 12 in the case against Syed Mohammad Qaisar, told the International Crimes Tribunal-2 (ICT-2) that Qaisar was linked to a mass killing at a village in Habiganj District that left at least eight people dead during the Liberation War in 1971, reports Daily Star. Lokman Hossain, said he had seen Qaisar when the Pakistan Army shot one of his neighbours dead on May 15, 1971. Qaisar was Bangladesh's former State Minister for Agriculture and is facing 16 charges, including genocide committed in Habiganj and Brahmanbaria Districts in 1971. The International Crimes Tribunal-1 (ICT-1) on July 8 has decided to commence the trial of War Crimes accused engineer Abdul Jabbar, a former Jatiya Party (JP) Member of Parliament (MP), in absentia and set July 20 for a hearing on charge framing, reports Dhaka Tribune. The prosecution on May 11 brought five charges of crimes against humanity including murder, genocide and forced conversion against Jabbar, who had played a key role in forming Razakar force in Mothbaria of Pirojpur District during the Liberation War. On May 12, the tribunal issued arrest warrant against Jabbar, after taking the charges into cognizance. But he is yet to be arrested as he is still fugitive.

The tribunal fixed the date after the prosecution prayed for the former JP leader's indictment, while state-appointed defence pleads to exonerate him from the war crimes charges.Prosecutor Hrishikesh Saha said that Jabbar along with his accomplices forcefully converted 200 Hindus to Islam at Phuljhuri village in Pirojpur District in the last week of May 1971. Two freedom fighters of the village were also killed and Jabbar participated in the killing incident. The International Crimes Tribunal-1 (ICT-1) on September 4 warned Human Rights Watch (HRW), a New York-based global rights body, with a note to be more careful, cautious and respectful in making any statement or comment over the judicial proceedings or judges of Bangladesh courts in the future, reports The Independent. Upon a contempt of court case submitted by the prosecution, the three-member tribunal passed the order as it found contemptuous its report published on its official website over its judgment on former Jamaat-e-Islami (JeI) Ameer (Chief) Ghulam Azam, a War Crimes convict in Liberation War of 1971. Earlier, on July 15, 2013, the ICT-1 sentenced Ghulam Azam to 90 years’ imprisonment finding him guilty of all five charges of the 1971 crimes against humanity and genocide against him. After a month of pronouncement of the judgment, the HRW on August 16, 2013 released a report on its website headlined ‘Bangladesh: Azam conviction based on flawed proceedings’.

He was citing a statement made before International Crimes Tribunal-2 (ICT-2) by a prosecution witness, Monowar Hossain Khan alias Mohan Munshi, who was a guard of an Al Badr camp in Mymensingh District during the 1971 Liberation War. Mahbubey was placing arguments on the 14th day of hearing on Kamaruzzaman's appeal challenging his death sentence for crimes against humanity committed in 1971. Earlier, on May 9, 2013, ICT-2 sentenced to death Kamaruzzaman which found him guilty of five out of seven charges leveled against him. He filed the appeal with the Supreme Court on June 6, 2013.

In Kishoreganj District, four children were injured, as an abandoned crude bomb exploded at Panchabati village. The victims are identified as Ridoy Mia (9), Marufa Begum (7), Surma Begum (7) and Aros Mia (2). In Dhaka city, a pedestrian was injured as a crude bomb went off on Nurjahan Road. Four JeI-ICS cadres were arrested on suspicion of plotting to carry out destructive activities. Ahmed Miah, in his deposition told the tribunal that Pakistan Army in association with Jabbar carried out an attack at Phuljhuri village on May 17, 1971. Nizami was found guilty on eight of the 16 charges brought against him. Four charges brought him death: he was involved in the killings of intellectuals; murders of 450 civilians and rape in Bausgari and Demra; killings of 52 people in Dhulaura; killings of 10 people and rape of three women in Karamja. Mahidur Rahman and Afsar Hossain are Bangladesh Nationalist Party (BNP) supporters. The tribunal passed the order following a prosecution's petition seeking to show them arrested in a war crimes case. According to the prosecution, Mahidul and Afsar had links with the Razakar Bahini, an auxiliary force of the Pakistani Army, in Chapainawabganj District and committed crimes like murders and mass killings during the nine-month-long war. The duo were arrested in a criminal case on September 16 and the prosecution, through a petition, prayed that the tribunal show them arrested in a war crimes case, reasoning that a war crimes investigation was ongoing against them.

The International Crimes Tribunal-1 (ICT-1) on December 30 awarded death penalty to Jamaat-e-Islami (JeI) Assistant Secretary General ATM Azharul Islam (61) for crimes against humanity committed during the 1971 Liberation War, reports The Independent. The ICT-1 found him guilty in five out of six charges brought against him. The tribunal awarded the capital punishment to Azharul for the Mokshedpur Dhap Para massacre on April 16, 1971; killing of around 1,400 unarmed civilians at Jharuarbeel in Rangpur District on April 17; and abduction and murder of four Hindu teachers of the Carmichael College and others on April 30. He was also sentenced to 25 years’ rigorous imprisonment for raping women at the Rangour Town Hall between March 25 and December 16, 1971, and five years for torturing two persons—Shawkat Hossain and Rafiqul Hasan—from November to December 1.
