The rehearing of the arguments against Jamaat-e-Islami (JeI) leader Delwar Hossain Sayedee started at the International Crimes Tribunal-1 (ICT-1) with the prosecution placing its summing-up on January 13, reports The Independent. Prosecutor Advocate Syed Haider Ali presented submission on the opening day of the fresh arguments. He mainly repeated the same argument in a concise form. The three-member tribunal, led by Justice ATM Fazle Kabir, stipulated January 13 and 14 to hear the prosecution's arguments. The tribunal also disallowed a defence's plea for an adjournment in the rehearing of arguments till the disposal of a review petition of Sayedee against the tribunal's order that rejected his appeal for a fresh trial on January 3.

ICT-2 said JeI contributed significantly to the creation of auxiliary forces during the Liberation War for combating unarmed Bengali civilians in the name of protecting Pakistan. The then Pakistani Government and the military setup a number of auxiliary forces such as Razakars, Al-Badr, Al-Shams and Peace Committee. These forces were formed to collaborate with the Pakistani military in identifying and eliminating all those who sympathized with the liberation of Bangladesh, individuals belonging to minority religious groups, especially the Hindus, political groups belonging to the Awami League (AL) and other pro-liberation political parties, Bengali intellectuals and innocent civilians. People of the then East Pakistan wholeheartedly supported the war and participated in the call to free Bangladesh. But a small number of Bengalis, Biharis, other pro-Pakistanis, as well as members of a number of different religion-based political parties, particularly JeI and its student wing Islami Chhatra Sangha (ICS) joined and collaborated with the Pakistan military to actively oppose the creation of independent Bangladesh. And most of them committed and facilitated the commission of atrocities in violation of customary international law in the territory of Bangladesh.

International Crimes Tribunal–2 (ICT-2) registrar AKM Nasiruddin Mahmud said on January 20 that ICT-2 is to deliver its verdict in the case against expelled Jamaat-e-Islami (JeI) leader Maulana Abul Kalam Azad, a war crime accused, also known as Bachchu Razakar, on January 21 (today). This is the first instance in the country's history that a war crime accused is going to receive punishment, for his alleged involvement in crimes against humanity during the country's Liberation War in 1971. Azad, former leader of Islami Chhatra Sangha (ICS), student wing of JeI, is facing eight charges of crimes against humanity, based on eight incidents that left at least 12 people dead and two women raped in Faridpur District, in 1971.

The International Crimes Tribunal-2 (ICT-2) made history on January 21 by sentencing Jamaat-e-Islami (JeI) leader Maulana Abul Kalam Azad to death, in its maiden judgment, for genocide and crimes against humanity during the Liberation War, reports The Daily Star. The 65-year-old fugitive, also known as Bachchu Razakar, was found guilty of killing 14 Hindus, raping two women, torturing two other persons and setting homes ablaze in Faridpur District, his birthplace. The judges said in the verdict “In dealing with the charges we have found that the accused Abul Kalam Azad alias Bachchu Razakar himself had physically participated being accompanied by his armed accomplices to the commission of crimes and as such he held criminally responsible for the direct commission of crimes proved.” Azad was sentenced to death for four of the charges, although found "guilty beyond doubt" in seven.

International Crimes Tribunal-2 (ICT-2) on February 5 sentenced JeI leader Abdul Quader Mollah to life term imprisonment on war crimes charge, reports UNBConnect. The three-member tribunal, led by Justice Obaidul Hasan, pronounced the sentence after reading out a 132-page verdict. A total of 18 witnesses, 12 from the prosecution and 6 from the defence, testified in the case. In May 28, 2012, the tribunal indicted Quader Mollah for six offences of crimes against humanity, including killing, mass murder, conspiracy and instigation during the 1971 Liberation War. This is the second verdict of the ICT in connection with the crimes against humanity cases. On January 21, 2013, the same tribunal delivered its maiden verdict sentencing JeI leader Abul Kalam Azad alias Bachchu Razakar to death, in absentia.

The legislative and parliamentary affairs division placed the draft Bill at the weekly meeting of the cabinet with Prime Minister Sheikh Hasina in the chair seeking equal rights for both the prosecution and the defence to appeal against conviction and sentence. The ICT law allows the Government to appeal only against an order of acquittal while a person convicted and sentenced by a tribunal can appeal against such conviction and sentence.

Selim, along with two other JeI leaders, including a Member of Parliament, had been summoned by the court to explain their comments about the war crimes trials. The tribunal decided to release Selim Uddin on bail and fixed March 21 for his hearing. Selim Uddin’s physical appearance was also dispensed with. The court ordered that Selim be set free if there are no other charges against him. The JeI leader, however, is currently in a 10-day remand, implicated in two other criminal cases.

The arrested ‘secretary general’ of HeI, Junaid Babunagari (62), revealed this in his confessional statement to Metropolitan Magistrate Harun-ur Rashid of Dhaka. “I came to know from our volunteers assigned at the rally that apart from some of our activists, Jamaat-Shibir men as well as some members of the Chhatra Dal and Jubo Dal, having no beards, were on the rampage and were looting in Motijheel, Paltan and Baitul Mukarram areas,” a source, who had access to the statement, quoted Babunagari as saying. “At one point, information came that those unruly people were torching book shops and the Quran Shareef. The ICT-1 took the 14 charges the prosecution had submitted on May 16 into cognisance. “Upon perusing the documents [charges, witness's testimony etc], it appears the prosecution brought strong prima-facie charges against the accused,” said Justice ATM Fazle Kabir, chairman of the three-member Tribunal-1, before accepting the charges. Additional District and session’s judge Ali Akbar passed the order when the accused surrendered before his court seeking bail in the cases filed with Siddhirganj Police Station. The BNP men surrendered before the lower court in compliance with a High Court order. The High Court on May 19 granted the accused one month’s interim bail asking them to surrender before the trial court within the period. He said banned militant outfit Harkat-ul-Jihad-al Islami Bangladesh (HuJI-B) leaders Moulana Tajuddin, Mufti Hannan and Maulana Abu Taher were present at the meeting. Former state minister for home affairs Lutfozzaman Babar also attended the meeting and he had been there in a black jeep, he said. The naval official also told the court that Mufti Hannan was the mastermind of the grenade attack and supplied the grenades. International Crimes Tribunal-2 (ICT-2) on June 24 indicted Chowdhury Mueen-Uddin and Ashrafuzzaman Khan in absentia for their alleged involvement in crimes against humanity during the Liberation War in 1971, reports The Independent. ICT-2 led by its chairman Justice Obaidul Hassan also fixed July 15 for starting opening statement in the case. The tribunal also asked the prosecution to submit list of witnesses on the same day. Some 16 formal charges were brought against them and ICT-2 accepted 11 charges including abduction and murder of the intellectuals. On May 2, ICT-2 issued arrest warrant against them after taking charges against them into cognizance. According to formal charges, Mueen-Uddin was the ‘operation in charge of Al-Badr" and Ashrafuzzaman Khan was the "chief executor’ of the force and they "directly took part" in the killing of intellectuals in Dhaka. The investigators submitted a total of 584-page investigation report to the tribunal on allegation of wartime crimes.

Prosecutor Tureen Afroz on July 19 said: “We are working on the issue after the verdict in the Quader Molla case. We all know about the role of this political party during the Liberation War. So they have no right to work as political party in Bangladesh.” Hannan Khan, chief coordinator of the tribunal’s investigation agency, said: “Our officers are working with the prosecution team. We have got many documents as proof of anti-liberation activities of Jamaat. They have no right to conduct political activity in an independent Bangladesh.” On February 17, the Government amended the ICT Act 1973, incorporating the provision to try political parties and organisations, alongside individuals, for the war crimes committed in 1971. It will allow organisations such as JeI to be brought before the special tribunals and charged for committing “crimes against humanity.”

Quasem Ali allegedly was a key leader of Chittagong District’s Al Badr unit and also featured prominently in the national Al Badr structure. Quasem Ali became the general secretary of Islami Chhatra Sangha, the then student wing of JeI, on November 7, 1971. Later, he was shown arrested for his alleged involvement with crimes against humanity during the Liberation War, following an arrest warrant issued by a tribunal on December 19, 2010. On April 4, 2012, he was indicted for 23 charges of crimes against humanity including genocide, murder, abduction, torture in confinement, arson attack, looting and complicity in atrocities committed in Chittagong District. Nine out of the 23 charges were proved against the BNP leader. The verdict without containing the court observation and judgment got posted on different websites much ahead of its pronouncement. Showing copies of the verdict collected from the websites, Salauddin’s wife claimed that the judgment against her husband was dictated and he was denied justice. She also said that the verdict circulated on the websites was originated from the Law Ministry. Turning down the allegation, State Minister for Law Quamrul Islam on Tuesday said, “It’s clear that a section is hatching conspiracies to make the verdict questionable both at home and abroad.” Later on October 2, International Crimes Tribunal Registrar Nasir Uddin Mahmud filed a General Diary (GD) with Shahbagh Police Station over the alleged leak of the verdict. A tribunal is set to deliver on October 9 (today) its verdict in the war crimes case against former Bangladesh Nationalist Party (BNP) minister Abdul Alim, who was allegedly involved in killing Bengalese, especially Hindus and freedom fighters, during the 1971 Liberation War, reports The Daily Star. Alim faces 17 charges of crimes against humanity and genocide. According to the charges, he participated in the killing of as many as 600 people and was also involved in looting, arson, deportation and detention of unarmed civilians. He was the chairman of Joypurhat Peace Committee and a leader of Razakar Bahini. Alim was arrested on March 27, 2011 from his residence in Joypurhat District and indicted on June 11, 2012.

The prosecution was able to prove nine of the 17 charges brought against Alim, who was a member of BNP founder Ziaur Rahman’s cabinet. He was sentenced to imprisonment until death on four charges. He was also awarded 20 years’ jail on four more charges and 10 years’ on another charge. All the 11 charges leveled against Ashraf and Mueen by the prosecution were proved beyond doubt. The convicts received death penalty for abduction and killing of nine Dhaka University teachers, six eminent journalists and three physicians in December 1971. Mueen was the ‘operation in charge’ and Ashraf was the ‘chief executor’ of the force and they directly took part in the killing of intellectuals in Dhaka. On June 24, Ashraf and Mueen were jointly indicted on 11 counts of crimes against humanity for abducting and killing 18 intellectuals. The trial began on July 15. The two accused were tried in absentia. Mueen lives in London and Ashraf in New York.

A Dhaka court on December 18 sentenced eight activists of Bangladesh Chhatra League (BCL), the student wing of Awami Laegue (AL) to death and 13 others to life imprisonment for killing tailor Bishwajit Das (24) in Old Dhaka a year ago, reports The Daily Star. Sentencing the activists of BCL, the judge observed that the Bishwajit murder case was quite sensitive and different from other lawsuits. The crime was committed in broad daylight, not in the dead of night. It was a heinous and deplorable killing, said the court about the incident that happened during the opposition’s blockade on December 9 last year. Of the eight condemned killers, two are absconding, while 11 of the 13 convicts, who got life term, are also on the run. The BCL men who got death penalty are: Rafiqul Islam Shakil, Mahfuzur Rahman Nahid, Emdadul Haque Emdad, GM Rasheduzzaman Shaon, Md Saiful Islam, Qayum Mia Tipu, Rajon Talukdar and Noor-e-Alam Limon. Of them, Rajon and Limon are on the run. The ones given life imprisonment are: AHM Kibria, Saiful Islam Saiful, Golam Mustafa, Alauddin, Obaidul Quader Tahsin, Imran Hossain, Khandaker Md Yunus Ali, Tarique Bin Zohur, Azizur Rahman, Al Amin Sheikh, Monirul Haque Pavel, Mosharraf Hossain and Kamrul Hasan. Of them, only Kibria and Mustafa are behind bars while the others have been absconding. The incident took place on December 9, 2012, when Bishwajit was going to his Amantron tailoring shop at Shankharibazar from his house at Hrishikesh Das Lane in Dhaka city. As he was walking through the road in front of Bahadur Shah Park, a crude bomb went off nearby during the Bangladesh Nationalist Party (BNP)-led opposition’s blockade. Immediately, a group of activists of Jagannath University BCL unit swung into action. They mistook Bishwajit for a blockader and chased him. Bishwajit ran for his life and hurried to the second floor of a nearby building. The BCL men hunted him down as he tried to take shelter in a dental clinic on that floor. They dragged him down to the street. For about five minutes, the BCL men hacked him with sharp weapons and beat him with iron rods and hockey sticks. Bishwajit made a desperate attempt to escape and finally managed to free himself from the attackers. As he crossed the road, he collapsed. Some pedestrians then took him to the Mitford Hospital where he died.

Jamaat-e-Islami (JeI) Nayeb-e-Ameer (Deputy Chief) Abdus Subhan (77) has been indicted on December 31 for involvement in genocide and murders of unarmed people along with looting, setting houses on fire and complicity to commit crimes against humanity during the Liberation War, reports The Daily Star. Subhan was arrested on September 30 for his alleged involvement in the crimes against humanity. After framing nine charges against Subhan, the International Crimes Tribunal-1 (ICT-1) set January 28 for beginning his trial with opening statement from the prosecution. The most notable of the nine charges brought against Subhan is killing of 300-400 people including Hindus by the Pakistani army and its local collaborators under his leadership at several villages in Satbaria union of Sujanagar sub-District of Pabna District on May 12, 1971. Other charges brought against Subhan include killing of five and injuring three others in his presence and under his leadership at Juktitala village in Ishwardi sub-District of Pabna District on April 13, 1971. Accompanied by local Jamaat leaders and Biharis, Subhan abducted three persons, who had taken shelter in a local mosque, on April 17-18 in 1971. Later, they were killed before him. Led by Subhan, the Pakistani army raided Sahapur village in Ishwardi sub-District on May 2, 1971 and killed five people and looted several houses before setting those on fire. Subhan allegedly abducted two persons from Arankhola cattle market in Ishwardi sub-District on May 16, 1971. The hostages were tortured at District Dak Bungalow in Ishwardi. The JeI leader also led the Pakistani army in alleged attacks on Kulniya and Dogachi villages in Pabna District on May 11, 1971. Five people were killed and several houses were torched at that time. On May 20, 1971, under the leadership of Subhan, the Pakistani army allegedly picked up 18 people from Varara village in Pabna District and killed one of them instantly. Others had been tortured at Nurpur Power Plant. Later, some of them were killed near Debottar Bazar. At least 18 people were killed in the incident. In the first week of September, Subhan, accompanied by local Razakars, abducted two pro-liberation persons from Dublia Bazar under Pabna District and killed them inside a temple at Kuchiamara village. On October 30, 1971, Subhan and local Razakars attacked Betbaria village in Ishwardi and looted several houses before setting those on fire. Four people were also abducted from the village and later killed.
