The International Crimes Tribunal (ICT) on January 9 accepted formal charges against former Jamaat-e-Islami (JeI) chief Ghulam Azam and its present chief Motiur Rahman Nizami for their alleged involvement in crimes against humanity during the Liberation War of 1971, reports Daily Star. ICT further directed Ghulam's chief counsel barrister Abdur Razzaq to produce the ex-JeI chief before it by 10:30am (January 10), or it will issue an arrest warrant against him. It also fixed February 12 for the hearing on charge framing against Nizami. The two JeI leaders have been charged with involvement in genocide, rape and arson during the Liberation War, the prosecutors said. The tribunal said it had examined the formal charges, probe reports and documents submitted by the prosecution, and primarily found proof that Ghulam and Nizami committed crimes against humanity in 1971.

Forty years after liberation, former Jamaat-e-Islami (JeI) chief Ghulam Azam was sent to jail by the International Crimes Tribunal (ICT) on January 11, on charges of committing crimes against humanity and peace, genocide and war crimes in 1971, reports Daily Star. ICT rejecting his petition for bail, ordered sending Azam to Dhaka Central Jail. The prosecution earlier on January 5 brought 62 specific charges against the former JeI chief. On January 9, the ICT accepted the charges and asked his counsel Abdur Razzaq, also a top JeI leader, to produce the ex-chief before the court by 10:30am on January 11. Otherwise, it warned, it would issue a warrant of arrest against Azam. Many considered the arrest to be a big challenge for the government given that JeI activists could let chaos loose over the issue.

Fifteen leader and activists of Jamaat-e-Islami Bangladesh (JeI) were taken on a seven-day remand after their arrest from the Uttara Khan area of Dhaka on January 21, reports The Daily Star. Acting on a tip-off, a team of Uttar khan Police raided the residence of one Tofazzel Hossain at Borobag of Uttar khan where the activists were holding a secret meeting at around 1:00am to foil the war crimes trial, the Officer-in- Charge said. The Police also recovered huge copies of 18 different books written against Awami League and war crimes trial. JeI leader of Tongi Golam Maula, his son Monir Hossain and Tofazzel are among the arrestees. Other arrestees are yet to be identified.

The International Crimes Tribunal (ICT) on January 26 took cognisance of the charges pressed against the detained Bangladesh Jamaat-e-Islami (JeI) Secretary General Ali Ahsan Mohammad Mojaheed, reports The New Age. The tribunal of Justice Nizamul Huq, Justice ATM Fazle Kabir and judge AKM Zahir Ahmed asked the prosecution to submit the copy of the formal charges against Mojaheed and other documents, on which the prosecution wants to rely, by January 31. The Speedy Trial Court on March 18 indicted Tarique Rahman, the fugitive son of former Prime Minister and Bangladesh Nationalist Party (BNP) leader Khaleda Zia and 29 others, in connection with the August 21, 2004 grenade attack that killed 24 people, reports Gulf Times. Aside from Tarique Rahman, prominent personalities such as former Junior Minister Lutfuzzaman Babar as well as several senior Police and Army officials will face trial that will start on March 28, 2012. The International Crimes Tribunal (ICT)-1 on March 27 took into cognizance the War Crimes (WCs) charges brought against former Bangladesh Nationalist Party (BNP) lawmaker Abdul Alim, reports Daily Star. ICT ordered the prosecution to place formal charges against Alim on April 24, 2012. It also extended bail to the BNP leader until that day. The newly-formed International Crimes Tribunal (ICT-2) has promulgated its own rules of procedure for investigation, prosecution and trial of the perpetrators committed crimes against humanity during the 1971 liberation war to keep pace with the trial process, reports The New Age. The ICT-2 framed its own rules of procedure as it is an independent tribunal which needs its own rules of procedure for functioning like that of the ICT-1. A basic change has been incorporated on application for the review of any order passed by the tribunal. One major change has been made on giving testimony of the witness before the tribunal which says that the testimony of the witness shall be recorded either in Bangla or in English through computer compose or otherwise as the tribunal directs. The cross-examination shall be strictly limited to the subject matter of the examination-in-chief of witness but the party shall be at liberty to cross-examine such witness on his credibility and to take contradiction of the evidence given by him.

Later, he was sent to Dhaka Central Jail, in compliance with the order of the International Crimes Tribunal-1 (ICT-1). Kashem was the chief of Chittagong Al-Badr unit during the Liberation War. Al-Badr was one of the forces created to help the Pakistani occupation army and oppose the pro-liberation forces during the war. Collaborating with the Pakistani army, the Al-Badr killed many and turned many places of Chittagong into killing fields. Kashem, being a member of the Central Executive Council of the Jamaat-e-Islami, also led a propaganda campaign in the UK and the Middle East to foil the ongoing trial of war criminals.

Although, the case against Mohammad Mobarak was lodged by one Khodeja Begum, widow of Abdul Khaleque, on May 3, 2009, at Brahmanbaria, the investigators started investigating the case on July 15, 2012. The tribunal Chairman Justice Mohammad Nizamul Huq granted bail to Mobarak citing the delay. The court also noted that there were 645 cases that had been transferred to the tribunal from lower courts for investigation that remain pending with the investigation agency. Earlier, in compliance with the previous order, prosecutor Advocate Sultan Mahmud Simon submitted the progress report of the investigation against Kashem Ali to the tribunal. Mir Kashem Ali is now detained in the Dhaka central jail on charge of crimes against humanity during the liberation war of Bangladesh in 1971. He was accused of committing crimes against humanity including murder, extermination, looting, repression, arson, confinement and deportation. According to the prosecution, Kashem Ali was also involved in plotting to thwart the trial of crimes against humanity at home and abroad. The prosecution sought arrest warrant against him on the plea that if he remained free, he might influence the investigation against him, prosecutor Advocate Rana Dasgupta said. He was threatening prosecution witnesses not to give depositions at the tribunal against the accused persons. Kashem Ali was arrested on June 17, 2012. The investigation agency of the International Crimes Tribunal (ICT) finished its probe on October 9, setting in motion the process of the trials of the two in connection with crimes against humanity committed during the Liberation War. Abdul Hannan Khan, coordinator of the ICT said "Operation in charge of Al-Badr” Mueen-Uddin and “chief executor” Ashrafuzzaman Khan led the force and also “directly took part” in the killing of intellectuals in Dhaka between December 10 and 15 of 1971. Making his second deposition before the tribunal in the cases, former havildar of Bandar Police outpost Golam Rasul said while on duty at the outpost on April 1, 2004, he received a phone call around 10:45pm. The caller told him that some illegal goods were being unloaded at the jetty of Chittagong Urea Fertiliser Limited (CUFL). When Rashul and sergeant Alauddin went to the jetty they met Hafiz and ULFA leader Abul Hossain. Hafiz and Abul were taken to Karnaphuli Police Station, there the duo admitted that the goods were arms brought for ULFA and the government high officials knew about it.

Rumi, a key prosecution witness in the cases, was Director General of DGFI when the August 21 grenade attack was carried out on an Awami League (AL) rally in 2004 on Bangabandhu Avenue in Dhaka. Of the 52 accused in two cases of the August 21 grenade attack, former state minister for home Lutfozzaman Babar, Jamaat-e-Islami (JeI) Secretary General Ali Ahsan Mohammad Mojaheed and 24 others were produced before the court on November 4.
