Foreign Minister Abul Hassan Mahmood Ali on April 1 told the International Conference on Prevention of Genocides in Brussels, the capital of Belgium that the International Crimes Tribunals (ICTs) in Bangladesh were set up to end the culture of impunity, establish rule of law, and dispense justice to the victims and their families, reports The Daily Star. The Minister said that the ICT Act, 1973 adheres to relevant international standards to ensure due process and fairness of the trials and rights of the defendants. He highlighted that during the nine-month Liberation War in 1971 “three million Bengali civilians were killed, more than 200,000 women were violated, and 10 million people were rendered refugees. A small minority of ideologically motivated local collaborators and auxiliary forces participated and abetted in committing these mass atrocity crimes.”

The International Crimes Tribunal-1 (ICT-1), after the prosecution and the defense concluded their closing arguments in the war crimes case against absconding Bangladesh Nationalist Party (BNP) leader MA Zahid Hossain Khokon on April 17 kept the case in CAV (Curia Advisari Vult, a Latin legal term meaning the court wishes to consider the matter), reports The Daily Star. During the closing arguments, prosecutor Mokhlesur Rahman Badal claimed that he had proved all the charges against Khokon “beyond any shadow of doubt”. He further said “We are seeking his [accused] capital punishment.” Khokon, believed to be living in Sweden with his son and daughter, is facing 11 charges for his alleged involvement in killings, genocide, torture, abduction and confinement of people during the Liberation War in 1971. At least 24 prosecution witnesses, including the investigation officer, testified in the case. There were no defense witnesses.

Police said that the two were arrested as they were wanted in a number of cases of violence and attack on law enforcers after the International Crimes Tribunal-1 (ICT-1) on February 28, 2013 sentenced JeI nayeb-e-ameer (deputy chief) Delwar Hossain Sayedee to death on charges of crimes against humanity during the Liberation War.

Against the backdrop of fleeing war crimes accused at the investigation stage, the investigation agency of the International Crimes Tribunal (ICT) wants amendment of the International Crimes (Tribunals) Act 1973 allowing the investigators power to arrest an accused during investigation, reports New Age. The agency made the proposal in a letter to the Law Minister on April 24 saying that the ICT act has no provision for arresting an accused by the investigation officer during investigation. Senior investigator M Sanaul Huq of the agency said ‘If this procedure of arrest is not amended incorporating the power of arrest by the Investigation Officer (IO) during investigation, we are afraid that in future no accused would be available for docking before the tribunal and all trials will be held in absentia which may tax the ends of justice’.

The International Crimes Tribunal-1 (ICT-1) on May 12 issued arrest warrant against war crimes accused Muhamad Abdul Jabbar Engineer, reports New Age. The charges he faces include planning and committing genocide, killings, arson and looting he allegedly committed at different places during the Liberation War. Born in the village Khetachira under Mothbaria sub-District of Pirojpur District on November 30, 1932, Jabbar became the chairman of Mothbaria central Peace Committee during the Liberation War. In 1986 and 1988, Jabbar was also elected Member of Parliament (MP) on Jatiya Party (JP) ticket. Later, he withdrew from politics.

Tajul Islam, a member of Qaisar Bahini, which was allegedly formed by Qaisar, also linked Qaisar to the mass killing in Brahmanbaria District. Qaisar, a state minister of the Ershad regime, faces 16 charges including genocide committed in Brahmanbaria and Habiganj Districts during the war.

The prosecution on May 19 sought the capital punishment for war crimes accused Mobarak Hossain (64) as it believes that it has successfully proved all five charges against him at the International Crimes Tribunal-1 (ICT-1), reports The Daily Star. Mobarak got involved with Jamaat-e-Islami (JeI) during the Liberation War in 1971 and joined the Awami League (AL) in the 1990s. According to the charges in the indictment order, Mobarak as a commander of Razakar force substantially “participated in,” “contributed to” and “facilitated” the commission of crimes in different parts of Brahmanbaria District in 1971. The charges against Mobarak are killing of 33 unarmed civilians at Tanmandayl in Akhaura; capture of a Hindu temple, renaming Anandamoyee Kalibari as Razakar Manzil and torturing Ashu Ranjan to death; abduction and murder of Abdul Khaleque of Satian village; abduction and torture of Khadem Hossain Khan; and abduction of Abdul Malek of Kharampur and killing of Mohammad Siraj.

Separately, a prosecution witness (PW), Abdul Matin Jamal gave deposition against War Crime accused and 'founder' of Qaisar Bahini, SM Qaisar at International Crimes Tribunal (ICT) on May 25, reports The Independent. Jamal, said he had witnessed the atrocities by Qaisar and his group in Madhabpur and Habiganj towns of Habiganj District during the war. He said,” Qaisar and the men of his Bahini along with 40-50 Pakistani Army troops went round Gutma village chanting slogan “Naraye Takbir, Allahu Akbar, Pakistan Zindabad” (Hail Pakistan, Allah is Almighty) on November 14, 1971. Qaisar divided his group into two segments, comprising Pakistani Army troops and sent one of them to Burunga village and he himself led another to Chitna village. “We went to see the condition of the village after Qaisar and his bahini left. We found that they killed 31 villagers and looted and torched the houses of the villagers. Jamal added.

Law Minster Anisul Huq on May 29 said the amended War Crimes Act was not enough to try and punish any political party for its alleged crimes during the Liberation War of 1971, reports Daily Star. “There is no provision in the International Crimes [Tribunals] Act, 1973, which was amended later, to try and punish any political party,” Anisul Huq stated. The minister came up with the observation after 15 months of the latest amendment to the International Crimes (Tribunals) Act, 1971 that aimed to try organisations for committing war crimes. The House in February, 2013 passed the amendment. Further, on the investigation into Jamaat-e-Ismali's (JeI) alleged crimes, Anisul Huq said, “It is true that there is a probe report, but at this stage, I have to move forward considering other perspectives.”

The International Crimes Tribunal-1 (ICT-1) on July 8 has decided to commence the trial of War Crimes accused engineer Abdul Jabbar, a former Jatiya Party (JP) Member of Parliament (MP), in absentia and set July 20 for a hearing on charge framing, reports Dhaka Tribune. The prosecution on May 11 brought five charges of crimes against humanity including murder, genocide and forced conversion against Jabbar, who had played a key role in forming Razakar force in Mothbaria of Pirojpur District during the Liberation War. On May 12, the tribunal issued arrest warrant against Jabbar, after taking the charges into cognizance. But he is yet to be arrested as he is still fugitive.

The tribunal fixed the date after the prosecution prayed for the former JP leader's indictment, while state-appointed defence pleads to exonerate him from the war crimes charges.Prosecutor Hrishikesh Saha said that Jabbar along with his accomplices forcefully converted 200 Hindus to Islam at Phuljhuri village in Pirojpur District in the last week of May 1971. The suspects are Mahidur Rahman (84) and Afsar Hossain alias Chutu (65). Police arrested Mahidur and Afsar in connection with the bomb blast at Shaheed Minar in the Shibganj sub-District headquarters on March 26 that killed Bangladesh Nationalist Party (BNP) activist Asaduzzaman Sujon and injured three other people. The tribunal has been keeping the cases on CAV [Curia Advisari Vult, a Latin legal term meaning the court would consider the matter], by tradition. We are keeping it on CAV.” Alleged Al-Badr 'commander' of Rangpur District, ATM Azharul Islam was indicted on November 12, 2013, on six charges of murder, genocide and crimes against humanity committed during the Liberation War in 1971. In Kishoreganj District, four children were injured, as an abandoned crude bomb exploded at Panchabati village. The victims are identified as Ridoy Mia (9), Marufa Begum (7), Surma Begum (7) and Aros Mia (2). In Dhaka city, a pedestrian was injured as a crude bomb went off on Nurjahan Road. Four JeI-ICS cadres were arrested on suspicion of plotting to carry out destructive activities. Hassan Ali, a former Razakar 'commander', is however, on the run. Mahidur Rahman and Afsar Hossain are Bangladesh Nationalist Party (BNP) supporters. The tribunal passed the order following a prosecution's petition seeking to show them arrested in a war crimes case. According to the prosecution, Mahidul and Afsar had links with the Razakar Bahini, an auxiliary force of the Pakistani Army, in Chapainawabganj District and committed crimes like murders and mass killings during the nine-month-long war. The duo were arrested in a criminal case on September 16 and the prosecution, through a petition, prayed that the tribunal show them arrested in a war crimes case, reasoning that a war crimes investigation was ongoing against them.

After the conclusion of the arguments on charges, Justice Obaidul Hassan, chairman of the three-member panel of ICT-2, adjourned the hearing till November 16. The tribunal handed down the death penalty for the killing of 33 people on the west bank of the Ganga Sagar Dighi in Brahmanbaria District on October 24, 1971.
